ABOUT THIS DIVORCE KIT Enclosed with this kit are the following forms: (1) Instructions, (2) Requirements For Filing, (3) Frequently Asked Question and Answers; (4) Marital Settlement Agreement; (5) Divorce Complaint (also called Petition); (6) Waiver of Acceptance of Service; (7) Answer to Complaint/Petition; (8) Financial Statement Form; (9) Child Custody Jurisdiction Form; (10) Petition for Name Change; (11) Certificate of Corroborating Witness; (12) Notice of Hearing; (13) Final Decree of Divorce Judgment. NOTICE: The forms included in this package are samples of divorce forms commonly used by courts throughout the nation. State-specific forms may be required but are not supplied by this kit nor are they available from this company. The purchaser of this product is responsible for obtaining any additional or modified documents necessary to pursue his/her own divorce as is required by local courts. Please check with the clerk of the Divorce court concerning specific forms required in your area. General Requirements (These requirements may vary depending on where you live. Check with the Clerk of Court in the county where you intend to file to confirm all requirements for filing). Residence Requirements: Either spouse must have been a resident for 6 months, and a resident of the county for 90 days before filing. Where to File: In the county of the filing spouse. Approved Grounds for Divorce: No-Fault: The marriage has become insupportable because of discord or conflict of personalities that has destroyed the legitimate ends of the marital relationship and prevents any reasonable expectation of reconciliation; or Living separate and apart without cohabitation for 1-3 years. Fault-Based: Adultery; Abandonment; Cruel and inhuman treatment; drunkenness; neglect; imprisonment of one spouse; General Divorce Procedure: Either spouse may file separately, or both may file jointly. Legal Separation Provision: Either spouse may seek a legal separation prior to filing for a formal divorce. Alimony: Either spouse may be required to pay support to the other spouse. Child Custody, Visitation and Support: The court may award sole or joint custody; If one parent receives sole custody, the other parent will likely be given visitation rights; The court will usually require the parent who doesn't have custody to pay child support. Rights to Maiden Name: Either spouse may resume his or her former name.
