MINUTES OF MEETING
BOARD OF COUNTY COMMISSIONERS OF SARPY COUNTY, NEBRASKA

A meeting of the Board of County Commissioners of Sarpy County, Nebraska was convened in open and public session at
5:00 P.M. on April 14, 1998 at the Papio-Missouri River Natural Resources District for a Coordination Meeting. The NRD
made a presentation and discussion followed. The Board recessed and reconvened at 7:00 P.M. at the Courthouse in
Papillion, Nebraska. Present: Thomas O’Hara, Tim Gay, Bart Bonn, Don Knott Sr., Tim Schram, Board Administrator Mark
Wayne and Debra J. Houghtaling, County Clerk.

Notice of the meeting was given in advance thereto by publication in the Bellevue Leader on April 8, 1998, a copy of the
Proof of Publication is on file in the County Clerk's office. Notice of the meeting was simultaneously given to all members
of the Board of County Commissioners of Sarpy County, Nebraska. Availability of the agenda was communicated in the
published notice and in the notice to members of the Board of County Commissioners of this meeting. All proceedings
were taken while the convened meeting was open to the attendance of the public.


Commissioners' comments were recorded.


O’Hara moved, seconded by Knott, to approve the Consent Agenda. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays:
None.

CONSENT AGENDA:

O’Hara moved, seconded by Knott, to approve the minutes of the April 7, 1998 meeting as submitted. Ayes: O’Hara, Gay,
Knott, Bonn & Schram. Nays: None.



O’Hara moved, seconded by Knott, to approve the claims as submitted by Debra J. Houghtaling, Sarpy County Clerk, and
authorize the County Clerk to issue warrants for said claims. A complete listing of claims is on file in the office of the
County Clerk. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.



Resolved by O’Hara, seconded by Knott, to approve and authorize the Chairman to sign the Interlocal Cooperation
Agreement with the City of Gretna stating that Sarpy County will provide permit issuance and building inspections within
the jurisdictional limits of the City. Agreement begins April 15, 1998 and ends April 15, 2001. Ayes: O’Hara, Gay, Knott,
Bonn & Schram. Nays: None.



O’Hara moved, seconded by Knott, to approve the following Gretna-Springfield Maintenance Facility Project (Sarpy County
Highway Dept. Storage Facility) disbursement requisition:

Resolved by O’Hara, seconded by Knott, to authorize the Chairman to sign the Annual Return/Report of Employee Benefit
Plan, IRS Form 5500 for the calendar plan year 1997, effective date of plan January 1, 1991. Ayes: O’Hara, Gay, Knott,
Bonn & Schram. Nays: None.



O’Hara moved, seconded by Knott, to approve the request of the City of Bellevue for free use of the Sarpy County Landfill
for their annual Spring clean-up (date of event: May 16 & 17). They will be required to pay the surtax fee levied by the
Nebraska Department of Environmental Control. Free access to the Landfill shall be limited to the week following the
event as recommended by the Landfill Manager. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.



Resolved by O’Hara, seconded by Knott, that the bid of Barone Security Systems for the Card/Key Access System in the
amount of $33,983.00 is accepted, per written and oral recommendation of the Purchasing Department, and this Board's
Chairman, Clerk and Attorney are authorized to execute necessary documents. Ayes: O'Hara, Gay, Knott, Bonn &
Schram. Nays: None.
REGULAR AGENDA:

Knott moved, seconded by Schram, to approve the liquor license application of Albertson’s, Inc. d.b.a. Albertson’s #2251
for a Class K-Wine Off Sale Only and Class E-Beer, Off Sale Only at 3641 Twin Creek, Bellevue, Sarpy County, Nebraska
and notify the Nebraska Liquor Control Commission of Board approval. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays:
None.



As advertised sealed bids were opened for striping of County roads and various City streets for the Sarpy County Highway
Department. Two (2) bids were received:

Knott moved, seconded by O’Hara, to refer the bids for striping of County roads and various City streets to the Purchasing
Department for review and recommendation. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.



Fran Grothe, County Purchaser, reported that bids for an Inmate Telephone System for the Sarpy County Jail have been
solicited, made, opened and reviewed pursuant to Board authorization.

After a public hearing, Schram resolved, seconded by Knott, that the bid of AmeriTel Pay Phones, Inc. for inmate pay
phone service for the County jail in the amount of 41% of the gross revenues generated from the system is accepted, per
written and oral recommendation of the Purchasing Department, and this Board's Chairman, Clerk and Attorney are
authorized to execute necessary documents. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.



Resolved by Knott, seconded by Schram, that pursuant to Neb. Rev. Stat. §39-1722, et seq. (Reissue 1993), that a
certain right-of-way located near the intersection of 109th and Giles Road (further described on Exhibit "A" as attached to
resolution) located in Sarpy County, NE is hereby vacated and that the Surveyor is hereby authorized to negotiate a
purchase agreement for said property and present the same to this Board for approval. Ayes: O'Hara, Gay, Knott, Bonn &
Schram. Nays: None.

Resolved by Knott, seconded by Bonn, to extend the County’s agreement with Sarpy’s Big Red Keno, Ltd. through
October 17, 1999 and the Chairman is authorized to sign such documents as may be necessary for the purposes of this
resolution. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.



Resolved by Bonn, seconded by Knott, that the Surveyor has proposed a contract with Hill-Farrell Associates, Inc. for
surveying and engineering services in conjunction with improvements for Schneekloth Road between 25th Street and 36th
Street, 27th Street between Schneekloth Road and Platteview Road in Sarpy County, NE. The Surveyor is hereby
authorized to execute on behalf of Sarpy County, NE the contract with Hill-Farrell Associates, Inc. (contract attached to
said resolution) in the amount of $103,197.06 and the same being approved by the Board. Ayes: O’Hara, Gay, Knott,
Bonn & Schram. Nays: None.


Knott moved, seconded by Schram, to sit as a Board of Equalization. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays:
None.


Schram moved, seconded by Bonn, to approve the following Tax Corrections as approved by the County Assessor:
#10774 - #10775. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.



Knott moved, seconded by Schram, to approve the following exemption applications for 1998 tax exemption on motor
vehicles owned by qualifying non-profit organizations, as approved by the County Treasurer:

                Sertoma Club of Omaha                             1966 Ford School Bus

Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.
Schram moved, seconded by Knott, to return to regular session. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.


ZONING ACTIONS:

Resolved by Schram, seconded by O’Hara, to approve the following applications for Special Use Trailer Permits to park
single wide mobile homes to be used for recreational purposes for a period of three (3) years with renewal by publication
as recommended by the Sarpy County Planning Commission.

Prime Realty Inc., a Nebraska Corporation, General Partner, James V McCart, Pres., for a Change of Zone from RE to IL
on the following described property: being a platting of Tax Lot 3, located in part of the SW 1/4 of Sec 24, T14N, R11E of
the 6th P.M. Sarpy County, Nebraska. (138th and Cornhusker Road, north side of street) be approved as it complies with
the Comprehensive Plan. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None.

Resolved by Knott, seconded by Bonn, that the application of Brook Valley III, LTD, a Nebraska Limited Partnership by
Prime Realty Inc., a Nebraska Corporation, General Partner, James V McCart, Pres., for a preliminary plat of a subdivision
to be known as Brook Valley III Business Park being a platting of Tax Lot 3, located in part of the SW 1/4 of Sec 24, T14N,
R11E of the 6th P.M. Sarpy County, Nebraska (138th and Cornhusker Road, north side of street) be approved as it
complies with the Comprehensive Plan. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None



Knott moved, seconded by O’Hara, that the application of Papio Valley Land Company by Don Graham, for approval of a
final plat of a subdivision to be known as Harrison Estates on the following described property: being a platting of the
NE1/4 of Sec. 16, T14N, R11E of the 6th P.M., Sarpy County, Nebraska (southwest corner of 168th and Harrison Street)
be sent back to the Planning Commission for further review. Ayes: O’Hara, Gay, Knott, Bonn & Schram. Nays: None


There was no Legislative Update.


The March, 1998 fee report of the Register of Deeds ($113,766.33) was presented and placed on file.


At 8:16 P.M. Knott moved, seconded by O’Hara, to adjourn until April 21, 1998 at 3:00 P.M. Ayes: O’Hara, Gay, Knott,
Bonn & Schram. Nays: None.
