                                     JUNE 21, 2011

The Mayor called the meeting to order at 6:30 P.M.

5. Oral Communications
Charles Polm a resident of Gustine advised Council that the City is in need of
additional services related to Police protection, weed abatement and public
space maintenance in Borrelli Ranch. The City Manager advised that a meeting
with Mr. Polm and the Police Chief has been scheduled for June 23, 2011.

Dominic Biles a resident of Gustine described his experiences with criminal
activity near his home and advised Council of the need for more Police patrols in
the evening.

Sonia Williams a resident of Gustine urged the Council to decline the application
and proposal for a 57 unit affordable housing project on Sullivan Road in Gustine.
Ms. Williams stated that affordable housing currently exists in Gustine and
additional affordable housing would be a drain on City services. She further
expressed that the Council not rezone the property as proposed as well. In
closing she advised that the noticing requirement for the project of 300 feet was
inadequate and that the City should go above and beyond the requirement to
notify citizens. The City Manager encouraged Ms. Williams to attend the
scheduled Public Hearings related to the project in July and August.
Patricia Bear a resident of Gustine advised the Council that the Fourth of July
Celebration attracts numerous visitors to the City of Gustine and as such she
requested that the City perform weed abatement on the HWY 140 approach to
Gustine near the intersection of HWY 33.

Felix Barrera a resident of Gustine advised Council of his personal experiences
with crime and urged the Council to increase Police protection / patrol and
inquired about a Neighborhood Watch Program.

Mr. Polm a resident of Gustine advised Council that he opposed additional
affordable housing in Gustine as the “Self Help” (affordable homes) homes have
not sold.

Dominic Biles a resident of Gustine asked the Council if it was common for
property values to drop as drastically as his has as a result of affordable housing
going in. Staff advised Mr. Biles that the economic downturn would account for
depreciation of property but from a planning perspective, placement of
affordable housing is a land use decision to meet the community values.

Mr. Polm further addressed Council advising them of the need for stop signs to
curtail speeding traffic in his neighborhood. The Mayor advised Mr. Polm to bring
specific information related to his concern to his meeting with the Police Chief.

Alex Guerrero a resident of Gustine advised of the need for better Police
response time and more action to curtail illegal motor vehicle traffic on and near
the canal near Borrelli Ranch.

Rick Nagel a resident of Gustine advised the Council that he was concerned
about the changes in Gustine’s crime rate over the years.

Vin Perry a resident of Gustine advised the Council that he supports his
neighbors’ concerns (Borrelli Ranch).

Arlene Payne a resident of Gustine asked the Council what its policy was with
regard to Neighborhood Watch. The City Manager advised that at the current
time there is no established Neighborhood Watch. Mr. Polm indicated that he
would be the contact person from the Borrelli Ranch neighborhood to explore
initiating a Neighborhood Watch Program.

8. City of Gustine Consent Calendar

      a. Warrants
         Recommendation: Approve warrants as submitted
      b. Treasurers Report for the Month of May 2011
         Recommendation: Review and approve
      c. Minutes of the Regular Meeting of June 7, 2011
         Recommendation: Review and approve
      d. Resolution Confirming the 2.5% Utility Tax to be Collected from Users of
         Cable TV, Gas, Electric, Telephone, and Water within the City Limits
         of Gustine for Fiscal Year 2011-2012
         Recommendation: Approve Resolution as submitted.

The Mayor introduced the consent calendar. There was no public comment.
Mayor Pro Tem Oliveira moved to approve the consent calendar. Council
member Schultz seconded the motion and it carried 5-0.

9. City of Gustine Administrative Agenda
The Mayor advised the Council and those in attendance that the regular City
Council meeting of June 21, 2011 would take a recess. The Mayor then called to
order the Special Meeting of June 21, 2011 at 7:21 P.M.

Council resumed the regular meeting of June 21, 2011 at 7:24 P.M.

      a. Consider Approving Road Closures, Restricted Parking for the Parade
         and Fireworks Display and Waiver of Police Staff /Overtime for the
         Fourth of July Celebration.

         3. Motion to approve requested road closures, restricted parking and
            waiver of Police staff overtime related to the annual Fourth of July
            Celebration.

Police Chief Dunford presented the staff report. There were no public or Council
comments. Council member Garcia moved to approve the requested road
closures, restricted parking for the parade and waiver of Police staff/ overtime
for the annual Fourth of July Celebration. The motion was seconded by Council
Member Schultz and carried 5-0.

      b. Consider a Resolution Establishing an Appropriations Limit and
         Certifying the Population Estimate for the Fiscal Year 2011/2012
         1. Receive staff report

         3. Motion to approve the resolution establishing an appropriations
            limit and certifying the population estimate for the fiscal year
            2011/2012.
City Manager Greg Greeson presented the staff report. There were no public or
Council comments. Council Member Garcia moved to approve the resolution
establishing an appropriations limit and certifying the population estimate for the
fiscal year 2011/2012. The motion was seconded by Council member Nagy and
carried 5-0.

      c. Consider Adoption of the Preliminary City Budget for Fiscal Year 2011-
         2012
         1. Receive staff report
         2. Receive public comment
         3. Motion to approve the Preliminary City Budget for Fiscal Year 2011-
            2012

City Manager Greg Greeson presented the staff report. The City Manager
advised that the preliminary budget was balanced and that a final budget
would come before Council in August. He further advised the final budget may
be affected by labor negotiations that are ongoing and the creation of a
depreciation fund for Police and Fire. There was no public comment. Mayor Pro
Tem Oliveira moved to approve the Preliminary City Budget for fiscal year 2011-
2012. The motion was seconded by Council member Nagy and carried 5-0.

10. City Department Reports
Police Chief Dunford reported on the recent department sponsored Safety Fair /
Bike Rodeo and thanked participating staff. He then invited Council to City Hall
next Wednesday to meet five new Gustine Reserve Police Officers to be sworn in.

Fire Chief Borrelli reported to Council on the recent Y-Lead tour of the Fire
Station, fire fighting activities related to coverage on Father’s Day and recent
meetings with other local agencies.

Administrative Services Director Scully advised the Council that the City Pool
opened with 91 guests, the status of the Merced County “Bail Out” effort, and
the status of the State Budget and the effect on Redevelopment. He further
advised of a Fire Grant proposal that California Consulting was working on that
had a low 5% City match requirement.

Public Works Director Garza advised the Council that of his meeting with an
Arborist to evaluate and provide the City with a recommendation concerning
the condition and future care of the trees in Henry Miller Park.

City Engineer Gouveia advised the Council that the City has USDA’s approval to
proceed with the City Hall Project and it should go to bid somethime in July.

11. City Manager Reports
The City Manager commended the Police Department for the success of the
recent Safety Fair and Bike Rodeo.

12. City Council Reports
Council member Schultz advised staff that he would be attending the City
County Dinner on June 28, 2011 and supported staff pursuing the establishment
of Neighborhood Watch Program in Gustine.

Council member Nagy advised he had nothing to report.

Council member Garcia expressed his appreciation with regard to the swift and
consistent removal of graffiti by staff, supports the development of a
Neighborhood Watch Program in Gustine and that Family Night is June 27, 2011.

Mayor Pro Tem Oliveira advised that he is in support of establishing a
Neighborhood Watch Program in Gustine, commended staff on the success of
the Safety Fair / Bike Rodeo, encouraged participation in the Walk for Health
Program at the High School on Wednesday evenings and asked that the Walk
for Health banner downtown be relocated perhaps at City Hall.

Mayor Brazil commended staff on the success of the Safety Fair / Bike Rodeo,
and the application of new infield dirt at one baseball field. The Mayor
encouraged public participation in reporting criminal activity in Gustine and
expressed his appreciation regarding the season opening of the City Swimming
Pool.

13. Closed Session

Council member Garcia was called away from the meeting and was absent for
Closed Session.

Council returned from closed session at 8:40 P.M. and the Mayor advised that
there was no reportable action on agenda items 13a, 13b and 13c.

d. PUBLIC EMPLOYMENT – Pursuant to Government Code Section 54957:

             Director of Administrative Services
             Administrative Analyst
Mayor Pro Tem Oliveira moved to approve the Administrative Analyst
employment agreement. The Motion was seconded by Council member Schultz
and carried 4-1 with Council member Garcia absent.

employment agreement. The Motion was seconded by Council member Schultz
and carried 4-1 with Council member Garcia absent.

Mayor Pro Tem Oliveira moved to approve the Chief of Police employment
agreement. The Motion was seconded by Council member Schultz and carried
4-1 with Council member Garcia absent.

Mayor Pro Tem Oliveira moved to approve the City Manger employment
agreement. The Motion was seconded by Council member Schultz and carried
4-1 with Council member Garcia absent.

14. Adjournment
Mayor Pro Tem Oliveira moved to adjourn the meeting. The Motion was
seconded by Council member Nagy and carried 4-1. The meeting adjourned at
8:48 P.M.
