1. Introduction
1.1 Community Dental Services CIC (CDS) acknowledges its responsibility to
display no-smoking notices and take reasonable steps to ensure that staff,
customers, members and visitors do not smoke in buildings in line with the
following legislation:
The Smoke-free (Premises and Enforcement) Regulations 2006
The Smoke-free (Signs) Regulations 2012
1.2 This means that no one is permitted to smoke in CDS buildings or premises
(including substantially enclosed areas such as car parks). The policy extends
to all vehicles, plant and machinery. Private vehicles are only included when
they are used to transport colleagues and /or service users, however for
health and safety reasons the CDS recommends employees do not smoke
whilst driving.
2. Purpose of policy
2.1 The aim of this policy is to:
Protect and improve the health of staff.
Protect and improve the health of patients, visitors and contractors
Protect both smokers and non-smokers from the danger to their health of
exposure to second-hand smoke
Set an example to other employers and workforces, particularly in health-
related locations.
Comply with health and safety legislation and employment law
Raise awareness of the dangers associated with exposure to tobacco
smoke
Take account of the needs of those who choose to smoke and to support
those who wish to stop smoking
3. Roles and responsibilities
3.1 Responsibility for implementing this policy rests with the Chief Executive. Day-
to-day responsibility for implementation lies with Line Managers.
4. Scope of Policy
4.1 This policy will apply to all staff, patients, visitors, contractors and other
persons, who enter any CDS owned or rented buildings and grounds for any
purpose.
Visitors
4.2 Staff members should inform visitors of the smoke free policy. However they
are not expected to enter into any confrontation which may put their personal
safety at risk.

Vehicles
4.3 Smoking is not permitted in CDS vehicles. Smoking is not permitted in lease
vehicles during working hours.
Staff
4.4 Staff are required not to smoke whilst on duty and smoking is not permitted by
CDS staff working in other premises. Identification Badges should not be worn
if a member of staff is smoking at the perimeter of the exclusion area during a
break.
Care in Patients’ Own Homes
4.5 CDS recognises that it is an individual patient’s right to smoke in their own
home but that this is an environment in which employees are potentially at risk
from the harmful effects of second hand smoke. To be completed…
5. Non-compliance with this policy
5.1 Staff who do not comply with the policy will be interviewed by their line
manager and referred to the local Stop Smoking Service or Occupational
Health, for support and advice as appropriate.
5.2 At all times line managers will be encouraged to ascertain any potential health
or other cause for breach of policy and provide support as a means of
encouraging adherence to the policy.
5.3 Persistent failure to comply with this policy by staff will be addressed using the
CDS Disciplinary Policy.
5.4 Patients, and visitors accompanying them, who fail comply with this policy will
be asked not to smoke by any staff member who becomes aware of this.
5.5 If patients or their friends/family/carers refuse to stop smoking on CDS
premises, CDS reserves the right to cease treatment of the patient.
6. Signage
6.1 To ensure that everyone entering CDS sites understands that smoking is not
allowed in the buildings and grounds, at least one legible no-smoking sign will
be displayed in each premises owned or occupied by CDS.
6.2 At least one legible no-smoking sign is displayed will be displayed in any CDS
vehicles.
7. Support for smokers
7.1 Details of local Stop Smoking services which can provide advice and support
will be made available to staff on the CDS Intranet.
