Make sure that you are eligible for the insurance cover. you should make sure that you know what this insurance does and does not cover. Please note the conditions of cover if you change the basis of your employment or are employed on a fixedterm contract or if you intend to work outside the Republic of Ireland, the United Kingdom, the Channel Islands or the Isle of Man for more than 30 consecutive days. your right to Cancel (i) Within the “cooling off period” - if you decide you do not want the cover under this policy and wish to cancel your insurance, you can do so within 30 days of the commencement date or the date you receive this policy document (the “cooling off period”). Any premium paid to be refunded to your account, provided no claim has been made under the terms of this policy. If you have made a claim, no refund of premium will be payable. (ii) Outside the “cooling off period” - if you cancel outside the initial 30 day “cooling off period”, no refund of premium will be payable. (iii) All cancellation requests should be made to: Ulster Bank Cards P.O. Box 4015 Dublin 2 Telephone: 01 702 5244 How much does it cost? The cover costs €1.01 for every €100, or part thereof shown on your statement balance. No charge will be made if your balance is nil. Premiums are applied automatically and charged to your Credit Card Account each month. The premiums quoted are correct at time of issue (other taxes/costs may exist that are neither paid nor imposed by the supplier). Who can have cover? you are eligible if on the commencement date you are: • at least 18 years of age and under 65 years of age (cover ceases at age 65); • permanently living in the Republic of Ireland; • in active employment or self-employment and have been so continuously for the six months immediately prior to the commencement date. If however, on the commencement date: • you are not in employment, or have not been continuously employed for six months, then accident and sickness and involuntary unemployment cover will not commence until you have been in active employment for a continuous period of at least six months; • you are absent from work due to an accident or sickness, cover will not commence until you return to active employment for a continuous period of at least one month. The benefits under this insurance cannot be assigned or transferred by you. What is covered? The insurance scheme provides the benefits shown below: Accident and Sickness Cover If you are disabled for 14 consecutive days or more, a monthly benefit will become payable to your account on the 15th day. After that, the monthly benefit will be payable for each further continuous 30 day period of disability. This will continue until the period of disability ends, or a total maximum of 12 monthly benefits have been paid to your account for any one period of disability. When deciding your maximum entitlement to benefit, periods of disability arising from the same cause which are not separated by at least three consecutive months of active employment will be treated as one continuous period of disability. 1 Should you receive the maximum of 12 monthly benefit payments for any one period of disability you will not be able to claim any further disability benefit until you have returned to active employment for at least six consecutive months. Pregnancy and childbirth – We will pay benefit for any disability resulting from any symptom(s) of, or complication(s) of pregnancy and childbirth which a doctor certifies prevents you from working, and which is not excluded under any other exclusions listed in this policy. However, no benefit will be payable for normal pregnancy and childbirth related conditions. involuntary Unemployment Cover If you are unemployed for 30 consecutive days or more, a monthly benefit will become payable to your account on the 31st day. After that, the monthly benefit will be payable for each further continuous 30 day period of unemployment. This will continue until the period of unemployment ends, or a total maximum of 12 monthly benefits have been paid to your account for any one period of unemployment. When deciding your maximum entitlement to benefit, periods of unemployment which are not separated by at least three consecutive months of active employment will be treated as one continuous period of unemployment. Should you receive the maximum of 12 monthly benefit payments for any one period of unemployment you will not be able to claim any further unemployment benefit until you have returned to active employment for at least six consecutive months. A claim for unemployment benefit will be suspended for up to six months if you take temporary work during your claim. If further unemployment occurs during this period it shall be treated as part of the same claim. If you take temporary work for longer than six months you will have to re-qualify for unemployment benefit. The 30 day waiting period for unemployment benefit will not begin until the end of any period for which you receive, or are entitled to receive, payment instead of working your notice. If you are self-employed you can only claim unemployment benefit if you have involuntarily ceased trading due to the financial insolvency of your business. Temporary cessation of trading or periods of unemployment due to shortage of work are not covered. For contract workers, unemployment due to the non-renewal of a fixedterm contract will only be covered if the contract had been renewed on two consecutive occasions prior to the loss of employment. life Cover If you die, we will pay to your account an amount equal to the principal sum. If you suffer accidental bodily injury and, as a result die within 12 months then your account will be credited with an amount equal to double the principal sum. if your reason for claiming changes you may not claim for accident and sickness and unemployment benefit for the same period. If however, your reason for claiming changes from disability to unemployment (or vice versa) without a break, payment will continue without the waiting period, up to a maximum of 12 monthly benefit payments in total for any one claim. What is not covered? Accident and sickness claims will not be paid for: • any period of disability lasting less than 14 consecutive days. 2 Accident, sickness or unemployment claims will not be paid if they are wholly or partly the result of: • any medical condition for which treatment had been given or diagnosis had been made or investigations commenced during the 12 months immediately before your commencement date; • your wilful deliberate actions, drug addiction or drug dependence or taking alcohol or drugs, except under a doctor’s direction (unless that direction relates to the treatment of drug addiction or dependence); • war, invasion, riot, revolution or any similar event. Unemployment claims will not be paid: • if you are advised within the first 30 days immediately after your commencement date, that you are to lose your employment or we reasonably believe you knew it to be impending on that date, whether or not you had received official notice; • for any period of unemployment lasting less than 30 consecutive days; • for any period for which you have received, or are entitled to receive, payment instead of working your notice; • if it results from resignation, voluntary redundancy, early retirement or dismissal which is caused by your own misconduct, or industrial action in which you are directly involved; • if it results from the non-renewal of a fixed-term contract unless the contract has been renewed on two consecutive occasions prior to the loss of employment; • if it arises from the loss of temporary work or if periods of unemployment are a regular feature of your normal occupation; • resulting from the loss of employment occurring whilst you are employed outside the territorial limits of the Republic of Ireland, the United Kingdom, the Channel Islands or the Isle of Man for a period intended to be for more than 30 days. definitions In this Certificate, the following words and phrases have the meaning given next to them. These words and phrases will appear in bold letters wherever they appear. “account” – The Ulster Bank credit card account to which the premium is charged. “accident” and “sickness/disability” or “disabled” – incapacity caused by accidental bodily injury, sickness or disease which leaves you totally unable to do the duties of your normal occupation and unable to do any other paid work. you must be under the regular care and attention of your doctor. “accidental bodily injury” – Bodily injury resulting solely and directly from accidental outward violent and visible means and does not include sickness or disease or any naturally occurring condition or degenerative process. “active employment” – employment from which you are not absent due to accident or sickness. “commencement date” – The date your account was opened or the date of acceptance of your application for Credit Card Repayment Protector, if later. “doctor” – A qualified medical practitioner registered with the Medical Council and working in the Republic of Ireland or registered with the General Medical Council and working in the United Kingdom, the Channel Islands or the Isle of Man. The doctor who confirms your disability when you are making a claim, cannot be you, a relative or close friend. “employment/employed” – Working for at least 18 hours a week if you are working in the Republic of Ireland (or at least 16 hours per week if you are working in the United Kingdom, the Channel Islands or the Isle of Man), under a contract of employment that does not have a fixed or implied date for ending. you must be receiving a salary or wages and be paying the appropriate class of Pay Related Social Contributions (or National Insurance contributions). “monthly benefit” – 10% of the principal sum subject to a minimum payment of O8 unless the principal sum was ‘nil’ in which case the benefit is also nil. There is a maximum limit of 01,200 per month. “normal occupation” – your paid occupation immediately before your disability or unemployment, and any similar paid occupation which we reasonably think you are, or may reasonably become qualified for in view of your training, education and ability. 3 “normal pregnancy” – Means symptoms which normally accompany pregnancy which are of a minor and/or temporary nature (such as morning sickness and dizzy spells) and which do not represent a significant medical hazard to mother or baby. “principal sum” – The outstanding debit balance on your account (up to a maximum sum of €12,000) on the last monthly statement date immediately prior to: • the date on which disability commences or the date on which you first become aware of impending unemployment; or • the date of death in respect of life cover. “self-employment/self-employed” – Working for at least 18 hours a week in Republic of Ireland for profit in a profession or business, either alone or with others. you must be paying the Class S Pay Related Social Contributions or liable to pay tax under Schedule D case (i), (ii), (iv) or (v) as defined by the Income and Corporation Taxes Act 1988 (“ICTA”). “temporary work” – Means employment for an indefinite period which is not intended to be permanent. employment of this nature via an Employment Agency is considered temporary work. “unemployment/unemployed” – A period of involuntary unemployment when you have no temporary work and: • you are entirely without gainful employment (which includes the assisting, managing and/or the carrying on of any part of the day to day running of a business); • you are available for and actively seeking work and are able to provide evidence of this; and • you are credited with the correct Social Insurance Contributions in the Republic of Ireland or you have a current Job Seekers Agreement and are claiming Job Seeker’s Allowance, National Insurance Credits or Income Support from the Employment Service (or relevant agency), in the United Kingdom, the Channel Islands or the Isle of Man. “we/us/our” – Pinnacle Insurance plc. “you/your” – The principal cardholder named on the credit card application form to whom this Certificate of Insurance is issued. premiums, termination and Variation your insurance cover and entitlement to benefit under the insurance scheme ends as soon as any of the following occur: 1. the date when your obligations under your credit card agreement stop or are assigned or transferred to someone else; 2. when you retire from work or you reach 65 (you will need to advise us in writing if you retire earlier); 3. the date on which we cancel this Certificate by giving you 30 days’ notice in writing to you at your last known address. Any premium payment due during such period of notice shall be waived; 4. the date the monthly premium due is not paid; 5. the date on which you cancel the Certificate by giving us seven days’ notice in writing; 6. the date on which you die. If your Certificate is cancelled for reasons (3), (4) or (5) above, your entitlement to benefit will not be affected in respect of any existing claim, or any incident occurring before the cancellation date which results in a valid claim. The premium rate or policy terms may be amended at any time by us giving you at least 60 days written notice. This policy has reviewable premiums, which means that your premium may change to reflect any changes in the assumptions we use to calculate how much it will cost us to provide your cover. The assumptions we use are based on a number of factors including: (a) the expected cost of meeting claims in the future; (b) changes to the number of claims we receive, the average duration of our claims and the average amount we pay per claim; 4 (c) new information arising from external sources such as general industry or Republic of Ireland population experience including industry or population unemployment experience; (d) our expenses; (e) policy lapse rates; (f) interest rates; (g) tax rates; (h) the cost of any legal or regulatory changes. When reviewing premium rates we will take a fair and reasonable view on any likely changes in our costs and any changes will not be based on whether you have made a claim or any changes in your health or employment. As a result, your premium may go up, stay the same or go down, and there is no limit on the size of any change. We reserve the right to conduct such a review on a monthly basis and you will normally be given at least 60 days’ written notice of any alteration to the premium rates or the terms of cover under this policy. If your premium or cover is changed due to legislative, tax or regulatory changes which are outside our control, then we may not be able to give you 30 days’ notice. Except where your premium or cover is changed due to legislative, tax or regulatory changes, the minimum period between consecutive changes will be 180 days. If a review results in an increase to your premium and you do not wish to pay the increase you can contact us to discuss your options. you may be able to reduce your benefit, change your type of cover, or cancel without notice and without penalty. How to Claim you (or your personal representatives in the event of a Life claim) should call our Helpline on 1800 509 538. If you die we require an original or certified copy Death Certificate or a copy of Grant of Probate/Letter of Administration. Once you have been unable to follow your employment due to accident or sickness for 14 consecutive days or more, we require a certificate from your employer saying that you are not working and certification from your doctor. To claim unemployment benefit, you must be credited with the correct Social Insurance Contributions in the Republic of Ireland or you must have a current Jobseekers Agreement and/or be claiming Jobseekers Allowance, National Insurance Credits or Income Support from the Employment Service (or relevant agency) in the United Kingdom, the Channel Islands or the Isle of Man. you must be registered with the Employment Service for 30 consecutive days. However you should register with the Employment Service (or relevant agency) as soon as you become unemployed. If you are self-employed, we will require satisfactory proof of your involuntary insolvency and ceasing to trade. Claims payments will be credited to your account. Once we have made these payments we will not make any further payments for the same claim. In order to maintain the highest level of service, we may record and monitor telephone communications. When claiming benefit any proof required must be provided at your expense. Failure to provide the required supporting evidence will mean we will be unable to pay your claim. 5 We may make enquiries in connection with your claim, contact your employer or ask you to attend a medical examination but we will pay the examiner’s fee. If you or your partner are receiving any State benefit, you should advise the Benefits Agency if you are also claiming under this policy. In some circumstances the amount of monthly benefit you receive under this policy may affect your entitlement to State benefit. your local Benefits Agency will be able to provide you with further information. you must pay the monthly premium even if you are making a claim or receiving monthly benefit under Certificate, if you wish cover to continue after your claim. In the event of an Insurance claim, any information which you provide to the Insurer whether on the claim form or otherwise will be put in to a Register of Claims through which Insurers share such information to prevent fraudulent claims. A list of participants and the name and address of the operator is available from us on request. you have a legal right to choose which law will apply to this contract. Unless we agree otherwise, the law which applies to this contract is the law of the Republic of Ireland. Should a situation arise where there is a conflict between your interests and ours, we will tell you, and we will explain how we intend to proceed. Should you feel that a conflict of interest has occurred and we have not treated you fairly you are able to make a complaint through our Complaints Procedure – see next section. We are covered by the Financial Services Compensation Scheme (the FSCS). you may be entitled to compensation from the FSCS if we cannot meet our obligations. The amount of compensation depends on the type of business. Most types of insurance business are covered for 100% of the first £2,000 of a valid claim and 90% of the remaining amount of the loss.
