					This is an agreement between a divorced couple to be used when child support is due
from past months, and must be repaid in arrears. This document can be customized to
fit the needs of the drafting parties. This document is useful for divorced individuals who
seek an agreement under which the individual who owes the past-due child support will
agree to the pay the past-due amount pursuant to the terms of a written agreement.
          AGREEMENT TO REPAY CHILD SUPPORT
                     ARREARS
THIS AGREEMENT (“Agreement”), made effective as of _______________________,
20__ [Instruction: Insert Date] (the “Effective Date”), by and between
__________________________ [Instruction: Insert Husband Name]), (“Husband”),
located at ___________________________________________ [Instruction: Insert
Address] and _______________ [Instruction: Insert Wife Name] (“Wife”), located at
_______________________________________        [Instruction:    Insert  Address].
Husband and Wife are hereinafter cumulatively referred to in this Agreement as the
“Parties.”

WHEREAS, as of the Effective Date, Husband is obligated to pay child support to Wife
for the care of their _______ (___) [Instruction: Insert Number of Children] children,
in the aggregate amount of ___________Dollars ($___________) [Instruction: Insert
Child Support Amount] per month (the “Monthly Child Support Amount”);

WHEREAS, as of the Effective Date, Husband is presently in arrears in child support
payments in an amount totaling ________________________ Dollars ($__________)
[Instruction: Insert Amount in Arrears] (the “Amount In Arrears”);

WHEREAS, the Parties desire for the Amount In Arrears to be repaid by Husband to
Wife as indicated herein;

NOW, THEREFORE, in consideration of the mutual covenants and agreements
contained in this Agreement, the parties hereby agree as follows::\

1. From the Effective Date through such time when the Amount In Arrears has been
repaid in full, on a monthly basis, due on the _______th [Instruction: Insert Day
Number] day of each month, Husband shall pay:

   A. The Monthly Child Support Amount; and

    B. Husband shall pay an additional _______________ Dollars ($___________)
[Instruction: Insert Monthly Arrears Repayment Amount] (the “Monthly Arrears
Repayment Amount”, which sum shall be applied against the Amount In Arrears.

2. In addition, Husband shall also pay Wife’s reasonable and actual attorney fees, which
are acknowledged to be ________________ Dollars ($______________)[Instruction:
Insert Attorney Fee Amount]. Such payment shall be made by Husband no later than
____________________ [Instruction: Insert Date].

3. Provided that payments are made as provided for herein, no interest shall be charged
against the Amount in Arrears and Wife shall take no further action in regards to the
Amount In Arrears. In the event that Husband fails to pay as agreed, the repayment of

the entire Amount In Arrears shall become immediately due, together with interest at the
legal rate.

4. Following Husband’s full and complete repayment of the Amount In Arrears,
Husband shall solely be obligated to pay the Monthly Child Support Amount each month.

5. This is the entire agreement between the Parties and may only be modified by a
writing executed by each of the Parties hereto.

IN WITNESS WHEREOF, the Parties have executed this Agreement effective as of the
date first written above.
