                                             ‫) ( ﻗﺩﻡ ﺍﻝﺼﺤﺎﺒﺔ ﻤﺒﺎﻴﻌﺔ ﺃﺒﻲ ﺒﻜﺭ ﻋﻠﻰ ﺩﻓﻥ ﺭﺴﻭل ﺍﷲ ﻭﺘﺠﻬﻴﺯﻩ.‬
                                              ‫) ( ﺍﻝﺤﺎﻜﻡ ﻏﻴﺭ ﻤﻠﺯﻡ ﺒﺎﻷﺨﺫ ﺒﻤﺒﺩﺃ ﺍﻝﺸﻭﺭﻯ ﻋﻠﻰ ﻤﻁﻠﻕ ﺍﻷﻤﻭﺭ.‬
                     ‫) ( ﻤﻥ ﻋﻴﻭﺏ ﺍﻝﺸﻭﺭﻯ ﺃﻨﻬﺎ ﺘﺩﻋﻭ ﺇﻝﻰ ﻋﺩﻡ ﺘﻨﻔﻴﺫ ﺍﻝﻘﺭﺍﺭﺍﺕ ﻭﺘﻁﺒﻴﻘﻬﺎ؛ ﻷﻨﻬﺎ ﻏﻴﺭ ﻤﻠﺯﻤﺔ.‬

                                                              ‫) ( ﻋﻘﻭﺒﺔ ﺍﻝﻘﺫﻑ ﻓﻲ ﺍﻹﺴﻼﻡ ﺜﻤﺎﻨﻴﻥ ﺠﻠﺩﺓ ﻻ ﻏﻴﺭ.‬
                                              ‫) ( ﺘﺜﺒﺕ ﺠﺭﻴﻤﺔ ﺍﻝﺴﺭﻗﺔ ﺒﺈﻗﺭﺍﺭ ﺍﻝﺴﺎﺭﻕ ﺃﻭ ﺒﺸﻬﺎﺩﺓ ﺍﺜﻨﻴﻥ ﻋﺩﻭل.‬

    ‫ﺩ. ﻻ ﺸﻲﺀ ﻤﻤﺎ ﺴﺒﻕ.‬          ‫ﺝ. )ﺃ+ﺏ(.‬                    ‫ﺏ. ﺘﺤﺩﻴﺩ ﺍﻝﻨﺴل.‬                  ‫ﺃ. ﺘﻨﻅﻴﻡ ﺍﻝﻨﺴل.‬

                                                           ‫٤. ﻤﻨﻌﻬﻡ ﺍﻹﺴﻼﻡ ﻤﻥ ﺤﻕ ﺍﻹﻗﺎﻤﺔ ﻓﻲ ﺩﺍﺭ ﺍﻹﺴﻼﻡ:‬
   ‫ﺩ. ﺍﻝﻤﺤﺎﺭﺒﻭﻥ.‬            ‫ﺝ. ﺍﻝﻤﻌﺎﻫﺩﻭﻥ.‬                    ‫ﺏ. ﺍﻝﻤﺴﺘﺄﻤﻨﻭﻥ.‬                      ‫ﺃ. ﺃﻫل ﺍﻝﺫﻤﺔ.‬

                                                                                  ‫٣١. ﻴﻭﺼﻑ ﺍﻝﺘﺭﺍﺙ ﺒﺄﻨﻪ:‬

                  ‫ﺝ. ﻤﻌﺼﻭﻡ ﺩﺍﺌﻤﺎ.‬             ‫ﺏ. ﻴﺤﺘﻤل ﺍﻝﺨﻁﺄ ﻭﺍﻝﺼﻭﺍﺏ.‬              ‫ﺃ. ﻓﻴﻪ ﻤﺎ ﻴﻨﻔﻊ ﻭﻤﺎ ﻴﻀﺭ.‬

                                                                        ‫٤١. ﻴﺸﺘﺭﻁ ﻓﻲ ﻭﺠﻭﺏ ﺤﺩ ﺍﻝﺴﺭﻗﺔ:‬

                         ‫ﺏ. ﺃﻥ ﻴﻜﻭﻥ ﺒﺎﻝﻐﺎ ﻋﺎﻗﻼ .‬                        ‫ﹰ ﹰ‬        ‫ﹰ‬
                                                                       ‫ﺃ. ﺃﻥ ﻴﻜﻭﻥ ﺍﻝﻘﺎﺫﻑ ﻤﺴﻠﻤﺎ ﻋﺎﻗﻼ ﺒﺎﻝﻐﺎ.‬
                                  ‫ﺩ. ﻜل ﻤﺎ ﺴﺒﻕ.‬                                 ‫ﹰ‬      ‫ﹰ‬    ‫ﹰ‬
                                                                               ‫ﺝ. ﺃﻥ ﻴﻜﻭﻥ ﺒﺎﻝﻐﺎ ﻋﺎﻗﻼ ﻤﺨﺘﺎﺭﺍ.‬

                              ‫٥١. ﺍﻝﻤﻠﻜﻴﺔ ﺍﻝﺸﺎﻤﻠﺔ ﻝﻸﻤﻭﺭ ﺍﻝﺘﻲ ﻻ ﻴﺠﻭﺯ ﻝﻸﻓﺭﺍﺩ ﻭﻻ ﺍﻝﻬﻴﺌﺎﺕ ﺤﻴﺎﺯﺘﻬﺎ ﻫﻲ :‬

  ‫ﺩ. ﻤﻠﻜﻴﺔ ﺍﻝﺩﻭﻝﺔ.‬       ‫ﺝ. ﻤﻠﻜﻴﺔ ﺍﻷﻓﺭﺍﺩ.‬               ‫ﺏ. ﺍﻝﻤﻠﻜﻴﺔ ﺍﻝﺠﻤﺎﻋﻴﺔ.‬             ‫ﺃ. ﺍﻝﻤﻠﻜﻴﺔ ﺍﻝﻤﺸﺘﺭﻜﺔ.‬
