1.0 Introduction
The Environmental Projects Grants Scheme (the Scheme) is an agreed mechanism to
assess and fund proposals from local community-based clubs and voluntary organisations
in the development of environmental community projects and works in the greater
Carranstown area (as defined in Appendix A).


The Indaver Community Liaison Committee (ICLC) is a joint Community, Developer,
Local Authority Forum created in compliance with Planning Decision PL17.219721.
The ICLC’s remit in the administration of this scheme is to assess and recommend the
disbursement of funds to qualifying projects. Its recommendations shall be submitted to
the Slane Electoral area Committee and subsequently to the Full Membership of Meath
County Council for statutory approval in accordance with established protocols.
The scheme is being funded through the proceeds of the Community levy for the Indaver
Thermal Treatment facility.


1.1      Background to the Current Scheme
The Minister for Environment and Local Government’s Policy Statement in October
1998 contained in the “Changing Our Ways” document advocated that,
“Local authorities working closely with local communities should utilise a proportion of
income from waste charges and gate fees to mitigate the impact of waste management
facilities on communities through appropriate environmental community projects”.
An Bord Pleanala incorporated this waste policy direction in its decision under PL
17.219721 (Appendix D). The relevant conditions are reproduced below.


Condition No. 5
 A community Liaison Committee shall be established consisting of a minimum of 8
representatives ( 2 officials from the Planning Authority, 2 representatives from the
developer, 2 local residents and 2 elected members of Meath County Council. The
composition of the committee shall be subject to the agreement of the Planning
Authority.


Condition No. 29
“The developer shall pay to the Planning Authority a financial contribution as a special
contribution… in respect of the provision of environment improvements and recreational/
community facility projects in the vicinity of the proposed waste management facility and
also in respect of the provision of an artistic feature in Duleek Village”.

1.2 Indaver Community Liaison Committee membership

The inaugural meeting of the Indaver Community Liaison Committee was held on 20th
November 2008. The ICLC comprises of two representatives from the local community,
two representatives from Indaver Ireland, two elected representatives from Meath County
Council, Slane Electoral Area and two officials from Meath County Council (Planning &
Environment Sections). The Community have nominated three representatives, two of
which may attend and exercise their voting rights at any one time.
Committee voting rights are agreed as follows:
   Two from the local community representatives
   Two from elected representatives and
   Two from Indaver Ireland.


Local Area to Benefit (within Co Meath only)
The local area to benefit generally from environmental community projects and works is
determined by the committee as comprising of the town lands or part of the town lands
hereunder as delineated within a 2.5km radius of the Indaver facility.

All as delineated in red on Map No. 1 Appendix A and herein afterwards called
‘Carranstown District’. The hatched area highlighted in map 1 attached to appendix A
further delineates locations proximate to haul routes serving the facility .Projects outside
the area delineated may be considered by the ICLC and the Council at their absolute
discretion taking into account the significance of such projects to local communities and
the overall level of funding available in the relevant year together with the number and
nature of other applications on hand. A projects proximity and direct benefit to
populations living within the hatched area highlighted in map 1 appendix A, shall always
be a material consideration in the disbursement of funding under the scheme


2.0      Scheme
The scheme is closely based on the template for Community Grants Schemes adopted by
Meath County Council in compliance with planning approval for major waste
infrastructure developments within its administrative area.




2.1      Terms and Conditions
     The scheme includes directions and templates as follows;
        Instructions to Applicants in completing the form
        Grant Acceptance Form
         Legal Agreement between the council and beneficiaries
        Payment Stage Requirements- to include for Insurance, tax certificates etc.
        Policy/Protocol for Grants not availed of and extensions of grant drawdown date.
        The scheme provides Capital Assistance for qualifying projects
        Each applicant shall be required to state how their proposal when complete will
         benefit communities in their area.

3.0  Carranstown Environmental Improvement / Community Projects
Grant Scheme.
The Carranstown Environmental Community Grant Scheme 2009 established by
Meath County Council (the Council) provides financial assistance to community-based
clubs/groups and voluntary organisations for the development of environmental
community projects and works in the locality as defined in section 1.1 “Local Area to
Benefit”.
Funding for qualifying projects will be recommended by the ICLC for the approval of the
Council. The funding will be at least on an annual basis or other appropriate period as
may be decided by the committee..
The Developer has agreed to pay Meath County Council €1.27 for each tonne of waste
accepted at the facility in each year of its operational life.



The overall fund available shall not exceed the equivalent to 200,000 tonnes x €1.27 in
any one year, unless varied by subsequent permission.
The developer has agreed to make €100,000 available in each of 2009, 2010 and 2011 in
advance of the operational phase of the development.
The net amount payable in subsequent years shall recognise the advancement of funding
during the construction period.
The Environmental Community Grant Scheme is available to new projects and for the
refurbishment of existing facilities.
Priority will be given to projects that enhance their local area and in so doing provide
the maximum opportunity to advance community , social and environmental initiatives .


Funding will be allocated to eligible projects in co-ordination with other funding streams
to create added value .

The provision of multi-user facilities shall be recognised and the scheme shall endeavour
to disburse funding in an equitable and transparent manner.

The aim of the scheme is to assist community-based projects that are:

-   Well founded
-   Well supported by their community, financially and otherwise
-   Preferably based on a co-operative proposal from several groups so as to create a
    better and more sustainable use of resources by sharing facilities
-   Based on an acknowledgement of and/or provision for, social inclusion
-   Are recognised by the Council and the ICLC as being the main provider of a
    particular service to all members of the public in the local community area

-   Formulated within the context of existing plans and strategies of Meath County
    Council and other agencies and which
-   Ensure that those facilities or parts of the project directly assisted by the scheme are
    available without discrimination to all members of the community that the project
    serves
.




3.1      Eligibility

In general applications will be considered from, not for profit organisations and or
associations which:

-   Are registered and in good standing with their national representative bodies (if any)
-   Have a constitution or rules acceptable to the Council and the ICLC
-   Hold annual general meetings
-   Are open to new members, without discrimination, from the area which the club or
    association serves
-   Have audited financial and other records available to the Council and the ICLC, if
    required
-   May not be part of a formal structure as described above but who can demonstrate
    that they are representative of their local community.




3.2 Examples of Projects Eligible for Funding

-   Parks
-   Amenity areas
-   Walking areas
-   Community halls and resource centres
-   Community arts projects
-   Playgrounds
-   Recreational facilities
-   Local heritage projects

3.3 The ICLC recommends that the construction of a footpath from the “Sports Field to
the White House” be delivered from the 1st phase of funding advanced by the developer.

A provision of €150,000 shall be made from the €100,000 funding being made available
in each of the years 2009 & 2010 by the developer *

The balance of funds being made available for 2010 shall be applied to the general grants
scheme and applications invited for qualifying projects during the latter half of 2010.

The ICLC consider that the application of funds to this project is warranted, being a
visible and tangible benefit to local communities particularly those residing within the
hatched area. (See map attached to Appendix A)

The ICLC also recognises the need for the provision of public lighting linking Duleek
village with the public lighting at the Indaver facility.
The allocation of funding for such a public lighting scheme shall be considered at a later
date in the context of available funding and subsequent to the receipt of statutory
planning approval for that infrastructure.


* Funding applied to the provision of such infrastructure shall reduce the amount of
funding available to other community projects in the early years of the scheme.

Funding shall be made available by the developer to the Council by 31st March each year
in respect of the preceding years contribution in accordance with planning condition (29)
and or any agreement re the availability of funding in advance of the operational phase
of the proposed development.
Projects which show a combination of guaranteed funding mechanisms such as ..

         Meath County Council Funding
         Sports Capital Funding
         Leader (Meath Partnership) Funding
         Enterprise Funding
         Other Agencies/Government Departments
         Local Sponsorship
         National Organisation
         Own Resources both fund raising and voluntary labour, etc.

..will be particularly encouraged

Assistance will not be available to fund maintenance or day to day running expenses
Maintenance or operational costs shall not qualify for assistance under the scheme.
Mobile assets will not be considered for financial assistance. In this context mobile
assets includes sports equipment.

3.4      General Conditions

3.4.1    Any beneficiary receiving assistance under this scheme will be required to sign an
         acceptance form and to enter into a legal agreement and/or Deed of Charge
         conferring the right on the Council to seek a refund of the grant paid, in whole or
         in part, where the facility is disposed of at any time or if the beneficiary ceases its
         activities within 5/10 years in the case of the payment of the grant. Details of the
         acceptance form , legal agreement and Deed of Charge are contained in Appendix
         E. A signed form of acceptance is required for cumulative grant amounts less than
         €20,000, a legal agreement is required for cumulative amounts of more than
         €20,000 and less than €100,000 and a deed of charge is required for cumulative
         amounts of €100,000 and above.

3.4.2 The Council and the ICLC reserves the right to seek the submission of the
      minutes of any Annual or Extraordinary General Meeting or the audited Financial
      Accounts of any beneficiary funded under this Scheme.

3.4.3 Receipt of assistance under this Scheme must be recognised in a manner to be
      agreed with the Council and the ICLC. (This will include the erection of signage
      provided by the Council in appropriate cases).

3.4.4 Applications for funding must be submitted on the appropriate application form-
      Appendix F and all relevant and necessary information and supporting
      documentation must be included in accordance with the “Instructions to
      Applicants” and “Additional Information for Applicants” contained in
      Appendix G. Incomplete applications not supported by the required
      documentation will not be considered and will be returned in full to the
      applicants.

3.4.5 Appropriate evidence of financial need and proposals for matching resources must
      be produced and efforts to source alternative funding must be outlined. The level
      of grant payable may be determined having regard to the amount of other funds
      generated/raised by the applicant organisation.

3.4.6 Beneficiaries are responsible for ensuring compliance with all requirements
      relating to the income tax and other relevant statutory codes. The payment of a
      grant will be subject to the beneficiary providing up to date details of a current
      C2/Tax Clearance Certificate from the Revenue Commissioners where
      appropriate.


3.4.7 Facilities aided under this Scheme must comply fully with all statutory and/or
      licensing requirements. In particular they shall comply with the provisions of the
      Local Government (Planning and Development) Acts, the Building Regulations
      and any other relevant legislation.

3.4.8 Payments will be made, in full or in part, on the basis of original invoices of
      expenditure vouched as paid in such a manner as is required by the Council and
      the ICLC as outlined in the “Payment Stage Requirements” document contained
      in Appendix H.

3.4.9 The beneficiary shall agree to be responsible for any loss, damage or injury to
      persons or property arising out of the provision or use of the facility and shall
      indemnify Meath County Council against all claims howsoever arising.

3.4.10 The beneficiary shall effect and produce evidence of appropriate Employers
       Liability Insurance and Public Liability Insurance to limits as specified in the
       “Payment Stage Requirements” document Appendix H. The Council shall be fully
       indemnified.

3.4.11 All grant-aided assets shall, where appropriate, be kept insured at all times against
       loss or damage by fire, storm or flooding. All compensation paid under such
       insurance shall be used to restore the property so damaged or lost and any
       shortfall shall be made good by the beneficiary. The interest of the Council shall
       be noted on all policies and the Council shall be notified of any claims made.

3.412 The beneficiary must produce appropriate satisfactory evidence of clear and valid
      title to the lands or buildings to be funded under the Scheme. Where title is
      leasehold the interest must be generally for a minimum of 10 years and such
      matters will be taken into consideration by the Council and the ICLC in deciding
      the amount of grant (if any) to be paid. However, the council and the ICLC
      recognises that it may not always be feasible for a group to obtain a ten year lease
      agreement. In such cases a degree of flexibility will be allowed for a reduced
      lease period, which shall be for an absolute minimum of 5 years and at the
      absolute discretion of the council and the ICLC to be determined on a case by
      case basis having regard to the benefits of a project to an area and the level of
      grant aid being approved Where the proposal is to provide facilities on lands
      owned by the Council, (e.g. a playground or park) a letter from the relevant
      section of the Council will suffice.

3.4.13 All or any portion of a grant which has been unpaid may be withheld by Council
       and the ICLC where specified conditions are not being complied with or where
       there is an unapproved material change in the proposals for which the application
       was made.

3.4.14 Grant-aided facilities shall not be alienated, assigned, sold or otherwise disposed
       of without the consent of the Council and the ICLC.
3.4.15 The benefiting organisation or club shall be responsible for compliance with the
       Health & Safety obligations imposed under the Safety Health and Welfare at
       Work Act 2005 and all regulations made there-under

3.4.15 Grant allocations may be reviewed or revoked at any time by the Council and the
       ICLC if progress on the development or refurbishment of the facility is not
       satisfactory. In any event grant allocations will be revoked if not taken up within
       the periods specified in this scheme unless otherwise agreed by the Council and
       the ICLC at its absolute discretion. In deciding on compliance for grant
       drawdown the council will apply the criteria contained in the “Policy/Protocol for
       Grant Drawdown and Grants not availed of” as contained in Appendix I

3.4.16 The Council and the ICLC may, from time to time, amend the conditions of this
       Scheme, as it deems appropriate and in any event shall review the operation and
       conditions of the scheme not more than every 2 years.


3.5      Types & Levels of Assistance

3.5.1 The overall amount of funding available in any year will be dependent on the
      tonnage of waste disposed of at the Indaver Facility and will be announced
      annually in the first quarter of the year or as soon as practicable thereafter.
      Applications will be invited between the date of the announcement of the
      available fund and a period not greater than 6 weeks thereafter (or the next
      working day if the 1st falls on a weekend or public holiday) or such other date as
      the council and the ICLC may deem practicable.

3.5.2 Funding not availed of in any year will be carried forward to the following year’s
      fund at the discretion of the Council and the ICLC.

3.5.3 Assistance under this fund is available to new projects or refurbishment of
      existing facilities.

3.5.4 Generally up to 60% of the cost of capital expenditure subject to a maximum
      grant of €100,000 per project, in any one year, is available. In any event, the
      amount to be contributed towards any proposed project by a successful applicant
      organisation/group will be at the absolute discretion of the Council and the ICLC.
      In determining this amount the council and the ICLC will take into consideration,
      inter alia, the proximity of the proposed project to the facility and the overall
      merit and worthiness of the project in terms of benefits that will accrue in
      mitigating the impact of the facility on the local community.

         NB: Groups or organisations, from outside the delineated area, making
         application, will be required to provide matching funding i.e. 50%. The level of
         matching funding required, within a) the Carranstown District and b) the hatched
         area to be determined by the Council and the ICLC taking into consideration local
         knowledge and proximity to the facility

3.5.5 Consideration may be given to allocating funding in excess of this maximum
      amount where the applicant body can demonstrate that the project concerned is of
      countywide/wider area importance. In considering whether funding in excess of
      the maximum amount will be approved consideration will be given to the overall
      level of funding available in the relevant year and the number and nature of other
      applications on hands. It will always be the aim of the scheme to grant aid the
      maximum possible number of eligible projects in any year.

3.6      Criteria for Assistance

3.6.1 Assistance will be provided for substantial new projects (generally having a
      minimum cost of €10,000) or refurbishment of existing facilities. Projects with a
      lesser cost may be considered if they demonstrate that they will have a positive
      effect on the available amenity/recreation facilities or physical appearance of an
      area.

3.6.2 Where new projects are to replace an existing facility the application must include
      a detailed explanation as to why the existing facility is not suitable or why it
      cannot be refurbished and/or extended.

3.6.3 Financial assistance will not be provided retrospectively and expenditure incurred
      before an offer of support is made will be ineligible. However, where a group can
      demonstrate to the satisfaction of the council and the ICLC that expenditure was
      necessarily incurred in a significant project due to requirements to avail of other
      grants, the council and the ICLC at its absolute discretion may decide to grant aid
      such a project that has commenced. In any event this discretion shall only apply to
      the calendar year in which application for the grant assistance has been made and
      duly approved.

3.6.4 Funds will be allocated on the basis of need where there is a genuine lack of
      facilities of the type proposed, where the project is considered to be viable and
      sustainable in the long-term and where there is adequate public access and
      community support.

3.6.5 Capital assistance must be claimed and drawn down within 12 months from the
      date of approval unless an extension of the drawdown date has been applied for
      and approved in accordance with the “Policy/Protocol for Grants not availed of”
      as contained in Appendix I. The maximum time for an extension of the original
      drawdown date shall be one year only, unless a group or organisation can
      demonstrate exceptional circumstances that prevent from drawing down the grant
      within the 1 year extended period. The granting of an extension is excess of 1 year
      shall be at the absolute discretion of the council and the ÌCLC and shall be
      determined on a case by case basis where the exceptional circumstance preventing
      drawdown shall be submitted in writing to the council and the ICLC.

3.6.6 Applications for multi-year funding for projects that will deliver major significant
      sporting/leisure/recreation/community facilities to the local area are not excluded,
      as the Council and the ICLC will encourage the realistic phasing of projects to
      match available income. However the granting of funding to a phased project in
      any year does not commit the Council and the ICLC to provide funding in the
      following or later years.

3.6.7 Funding will not be paid for any project which requires Planning Permission and
      for which Planning Permission has not been obtained although projects may be
      approved in principle pending receipt of permission.

3.6.8 Beneficiaries in some instances may be required to provide the Council and the
      ICLC with a realistic business plan dealing with the future running and
      maintenance costs of the project and the sources of the ongoing funding to meet
      such costs.


3.6.9    Checklist

         (4) In the case of all applicants:

                   -    Map of all lands being used by the Club/Organisation.
                   -    Copies of any relevant Planning Permission, Fire Safety Certificates or
                        other relevant permits.
                   -    Copies of most recent financial records including details of matching
                        funding available.
                   -    Copies of Co-operation agreements with other Clubs/Organisations.
                   -    Copy of relevant Insurance Policy.
                   -    Copy of Tax Certificate/Charitable Status Certificate as appropriate

THIS AGREEMENT made the                                    day of

20____ between Meath County Council of County Hall, Navan in the

County of Meath (hereinafter called the Council which expression shall

include its successors) of the one part and the persons or body details of

which are set out in the First Schedule hereto (hereinafter called the

Beneficiary which expression shall include their Successors, Executors

Administrators and Assigns) of the other part.

         (A) WHEREAS:-

                  1. The Council has or may hereafter approve the Beneficiary for

                       a grant or grants from monies allocated out of the Councils

                       community levy on Indaver Thermal Treatment facility fund

                       towards the acquisition of property/carrying out of

                       development works as set out in the Second Schedule hereto

                       (hereinafter called the Scheme) being carried out by the

                       Beneficiary in respect of the property described in the Third

                       Schedule hereto (hereinafter called the premises)

                  2. In consideration of the grant or grants, the Beneficiary has

                       agreed to covenant with the Council in the manner

                       hereinafter appearing.

         (B) NOW THIS INDENTURE WITNESSETH that in pursuant to

                the said agreement and in consideration of the grant or grants now

                paid or to be paid by the Council to the Beneficiary, the

                Beneficiary hereby, where it is a corporate body for itself and its

                successors and where it is individuals jointly and severally on

                their own behalf and on behalf of each and every individual of the

                group for which they are Trustees, covenant and agree with the

                Council as follows:-

                  1. To observe and comply with the general terms and conditions

                       relating to grants by the Council under the Carranstown

                       Environmental Projects Grant Scheme that may be

                       applicable at the time the grant or grants are paid.

                  2. To comply with and observe in full the conditions or

                       stipulations as set out in the Fourth Schedule hereto.

         (C) PROVIDED ALWAYS AS HEREBY AGREED AND

                DECLARED BY AND BETWEEN THE PARTIES

                HERETO:-

                  1. That nothing herein contained shall be construed as

                       compelling the Council to make any grant payment other

                       than such if any as may have been made or agreed prior to

                       the date hereof.

                  2. Payment of grant will be made by and at the discretion of the

                       Council in one payment or by several payments on

                       production of such evidence as the Council may require as to

                       the progress or completion of the works.

                  3. If the Beneficiary-

                                (a) Requires at any time within 5 years from the date of

                                     the last payment of the grant or any instalment of the

                                     grant to use the premises or part thereof for purposes

                                     other than those provided for in the scheme or

                                     desires to be relieved from the trust and provisions

                                     hereof they should so inform the Council in writing

                                     or

                                (b) In default of strict compliance by the Beneficiary

                                     with the terms of a notice of writing served by

                                     prepaid post addressed to the Beneficiary at its

                                     address as set out in the First Schedule hereto setting

                                     out reasons and particulars of any breach or non-

                                     performance or no observance by the Beneficiary of

                                     the Covenants and conditions or agreements herein

                                     contained and requiring the beneficiary to rectify

                                     same in such period as may be specified in such

                                     notice not being less than a period of one month

                                     from the date when in the ordinary course of post

                                     the said notice would be delivered to the said

                                     address/

                                     then in any such event upon written demand by the

                                     Council to the Beneficiary, the Beneficiary will

                                     repay to the Council the full amount of the grant

                                     paid to the Beneficiary or so much thereof as the

                                     Council shall demand and to this end the

                                     Beneficiary shall for a period of 5 years from the

                                     date of this agreement henceforth hold the premises

                                     and all buildings and structures and fittings thereon

                                     and therein upon trust for sale or mortgage to raise

                                     an amount sufficient to repay the said grant or so

                                     much thereof as may be specified in the notice from

                                     the Council and a receipt from the Council for the

                                     amount so paid shall be a sufficient discharge to

                                     any purchaser or mortgagee and on payment of the

                                     amount aforesaid the Beneficiary shall be relieved

                                     from the trusts and covenants hereby imposed.

                                  The provisions of this clause shall lapse and cease to

                                  have effect 5 years from the date of the last payment

                                  of the grant or instalment of the grant.

                                        FOURTH SCHEDULE

    1. To hold and use the premises (including all additions and

         improvements thereto or thereon and all new buildings and new works

         to be erected thereon) for the purposes of the scheme for a term of 5

         years from the date of the last payment by the Council of the Grant (or

         any instalment of any grant payment) subject to the terms and

         conditions hereinafter contained

    2. To apply the money representing the grant for the purpose for which it

         was approved by the Council and to furnish full information as to the

         expenditure of the said money comprising the grant when so required

         by the Council.

    3. To provide all necessary additional finance for the acquisition of the

         premises/the completion of the works from its own funds or by local

         or private contributions and to ensure the Beneficiary maintains at all

         times satisfactory working capital requirements for the operation of

         the facilities on the premises.

    4. To complete as soon as possible the development works to the

         satisfaction of the Council in a proper manner in accordance with the

         plans and specifications first approved of by the Council.

    5. To ensure that all buildings and constructions erected on the premises

         are in compliance with the Planning Laws and Regulations and such

         other statutory laws and regulations which may relate thereto and on

         completion of the premises to furnish an Architects Certificate of

         Compliance with Planning Permission and Building Control

         Regulations in accordance with Law Society Guidelines.

    6. To keep and maintain the facilities on the premises open to the public

         at all reasonable times and at all reasonable hours and to encourage

         members of the public to enjoy the facilities provided or to be

         provided on the premises at either no charge or reasonable charge.

    7. To promote or market actively the amenities provided on the premises

         and to cooperate with and ensure the cooperation of all persons

         engaged on the premises with the Council and its servants or agents.

    8. To ensure that all facilities on the premises are fully accessible to

         people with disabilities.

    9. To ensure that all contractors, consultants, subcontractors and

         suppliers engaged in relation to the development works on the

         premises be registered for VAT and have the appropriate Tax

         Clearance Certificate and to ensure that all such contractors,

         consultants, subcontractors and suppliers comply with all statutory

         requirements, tax registration and local or other requirements with

         regard to the conduct of their affairs including Health and Safety

         Requirements and payment of minimum wages to all employees.

    10.To submit to the Council on request the yearly operating and yearly

         audited and certified accounts in relation to the facilities on the

         premises with any relevant statistics which the Beneficiary may be

         able to provide in relation to the operation of the facilities to the

         include the number of persons availing of the facilities and such like

         matters and to submit to the Council upon request copies of the

         minutes of meetings relating to the operation of the premises

         including the minutes of every annual general meeting.

    11.To effect policies of insurance against Employers Liability, Public

         Liability and Third Party Risks in respect of occupation and uses of

         the facilities on the premises and to produce to the Council its servants

         or agents on request the policies herein before referred to together

         with receipts for all current premiums.

    12.To keep the premises and fixtures and fittings thereon and all

         buildings to be erected thereon fully insured against loss or damage by

         fire and against such other insurable risks as are normally insured

         against in the case of property similar to the premises and user thereof

         in the full replacement value thereof and when ever required by the

         Council so to do to produce the policy or policies of insurance on

         receipt for the current premium due thereon and to apply any money

         received on foot of any such policy or policies for restoring and

         reinstating to the satisfaction of the Council any property which may

         be destroyed or damage by fire or other insured risk insured under this

         clause.

    13.To keep the premises and fixtures and fittings thereon and all

         buildings erected or to be erected thereon and all improvements made

         or to be made thereon or thereto in good order repair and condition

         and to such standards as may from time to time be required by the

         Council and by statue law and to permit the Council its servants or

         agents to inspect the premises at all reasonable times and to forward to

         the Council all information which may be reasonably be required in

         relation to same.

    14.To indemnify the Council from and against all actions, proceedings,

         costs, claimants, demands and liabilities howsoever arising from all

         and every activity carried out or promoted by the Council in

         connection with the facilities on the premises.

    15.To pay to the Council any charges and expenses (on a full and

         unqualified indemnity basis) incurred by it, whether before or after the

         date of demand to the Beneficiary for payment, in enforcing or

         endeavouring to enforce payment of any money or the compliance

         with any obligations arising hereunder or otherwise in relation to this

         agreement or in resisting or endeavouring to resist any claims made

         against the Council by the Beneficiary in connection with any

         liabilities or alleged liabilities to the Council together with interest

         thereon at a rate set under the Courts Act 1981 or amending

         legislation from the date that liability was incurred or fell due to the

         date of payment.

    16.To ensure for a period of 5 years from the date of the last payment of

         the grant or instalment of the grant that the premises or any part

         thereof including fixtures and fittings shall not be assigned, sublet or

         hired out or the possession thereof parted with by the Beneficiary

         save with the consent in writing of the Council provided always that

         such consent shall not be required in respect of occasional licenses to

         persons or bodies for the use of the premises for purposes associated

         for the achievement of the objectives of the scheme.

    17.To permit the Council to send an observer to any meetings of the

         Beneficiary and to nominate two members to the Board of

         Management (if any) of the Beneficiary.

    18.Provide on the premises such signage as may reasonably be requested

         by the Council advertising the fact that the carrying out of the scheme

         is part funded by a grant or grants from the Council.

    19.Pay promptly on demand to the Council such sum or sums as may

         become due and owing to it as a result of the provisions of paragraph

         C.3 of this indenture together with interest thereon at a rate set under

         the Courts Act 1981 or amending legislation from the date that

         liability was incurred or fell due to the date of payment.

                        Council for the amount of the said grant or grants (not

                        exceeding a sum of €                       ) for a term of 10 years

    30.To effect policies of insurance against Employers Liability, Public

         Liability and Third Party Risks in respect of occupation and uses of

         the facilities on the premises and to produce to the Council its servants

         or agents on request the policies herein before referred to together

         with receipts for all current premiums.

    31.To keep the premises and fixtures and fittings thereon and all

         buildings to be erected thereon fully insured against loss or damage by

         fire and against such other insurable risks as are normally insured

         against in the case of property similar to the premises and user thereof

         in the full replacement value thereof and when ever required by the

         Council so to do to produce the policy or policies of insurance on

         receipt for the current premium due thereon and to apply any money

         received on foot of any such policy or policies for restoring and

         reinstating to the satisfaction of the Council any property which may

         be destroyed or damage by fire or other insured risk insured under this

         clause.

    32.To keep the premises and fixtures and fittings thereon and all

         buildings erected or to be erected thereon and all improvements made

         or to be made thereon or thereto in good order repair and condition

         and to such standards as may from time to time be required by the

         Council and by statue law and to permit the Council its servants or

         agents to inspect the premises at all reasonable times and to forward to

         the Council all information which may be reasonably be required in

         relation to same.

    33.To indemnify the Council from and against all actions, proceedings,

         costs, claimants, demands and liabilities howsoever arising from all

         and every activity carried out or promoted by the Council in

         connection with the facilities on the premises.

    34.To pay to the Council any charges and expenses (on a full and

         unqualified indemnity basis) incurred by it, whether before or after the

         date of demand to the Beneficiary for payment, in enforcing or

         endeavouring to enforce payment of any money or the compliance

         with any obligations arising hereunder or otherwise in relation to this

         agreement or in resisting or endeavouring to resist any claims made

         against the Council by the Beneficiary in connection with any

         liabilities or alleged liabilities to the Council together with interest

         thereon at a rate set under the Courts Act 1981 or amending

         legislation from the date that liability was incurred or fell due to the

         date of payment.

    35.To ensure for a period of 10 years from the date of the last payment of

         the grant or instalment of the grant that the premises or any part

         thereof including fixtures and fittings shall not be assigned, sublet or

         hired out or the possession thereof parted with by the Beneficiary

         save with the consent in writing of the Council provided always that

         such consent shall not be required in respect of occasional licenses to

         persons or bodies for the use of the premises for purposes associated

         for the achievement of the objectives of the scheme.

    36.To permit the Council to send an observer to any meetings of the

         Beneficiary and to nominate two members to the Board of

         Management (if any) of the Beneficiary.

    37.Provide on the premises such signage as may reasonably be requested

         by the Council advertising the fact that the carrying out of the scheme

         is part funded by a grant or grants from the Council.

    38.Pay promptly on demand to the Council such sum or sums as may

         become due and owing to it as a result of the provisions of paragraph

         D of this indenture together with interest thereon at a rate set under

         the Courts Act 1981 or amending legislation from the date that

         liability was incurred or fell due to the date of payment.

All questions on the application form must be fully answered / completed in a clear and
concise manner. If using an answer ‘Not Applicable’ or N/A you must clearly state the

         Additional Information for Applicants
      Please read carefully before completing the
                      application


If you are considering applying for Meath County Council/Indaver Community Liaison
Committee Carranstown Environmental Projects Grant Scheme 2010 for a heritage
project the following information may be relevant to your application.

The Heritage Act, 1995, defines national heritage as including monuments,
archaeological objects, heritage objects, architectural heritage, flora, fauna, wildlife
habitats, landscapes, seascapes, wrecks, geology, heritage gardens and parks, inland
waterways.

Hedgerow Management:
Under section 40 of the 1976 Wildlife Act, as amended by Section 46 of the Wildlife
(Amendment) Act, 2000, it is prohibited to cut, grub, burn or otherwise destroy, during
the period March 1st to August 31st, in any year, any vegetation growing in any hedge or
ditch, except in certain, legally defined circumstances.

Protected Structures:
A protected structure is a structure that a planning authority considers to be of special
interest from an architectural, historical, archaeological, artistic, cultural and scientific,
social or technical point of view. The Record of Protected Structures (RPS) forms part of
the County Meath Development Plan, 2001 (www.meath.ie/devplan). Any community
group considering applying for funding for protected structures should seek advice from
Meath County Council.

Graveyards or other archaeological sites:
Groups should check carefully the ownership and legal status of a graveyard. A licence
is required from the National Monuments Service of the Department of the Environment,
Heritage and Local Government prior to undertaking any work on any graveyard that is a
Recorded Monument. All works in graveyards funded under the community grant
scheme shall be in accordance with the guidelines as set out in the ‘Care and
Conservation of Graveyards’ (OPW 1995).

Archaeological sites:
All known sites and monuments are identified and listed for protection by the National
Monuments and Historic Properties Service, in the Record of Monuments and Places, a
statutory inventory of sites protected under the National Monuments Acts (1930-1994).
The Record of Monuments and Places is a set of 6" maps of County Meath with an
accompanying index which shows all the sites, monuments and zones of archaeological

potential, recorded to date in the county. The inventory concentrates on pre 1700 AD
sites. The Record of Monuments and Places is available to the public at the Planning
Office of Meath County Council and Town Councils.

Under Section 12 (3) of the National Monuments (Amendment) Act 1994 monuments
and places included in the record are protected as follows:

"Where the owner or occupier (not being the commissioners) of a monuments or place
which have been recorded under subsection (1) of this section or any person proposes to
carry out, or to cause or permit the carrying out of, any work at or in relation to such
monument or place, he shall give notice in writing of his proposal to necessity and with
the consent of the Commissioners and shall not, except in the case of urgent necessity and
with the consent of the Commissioners, commence the work for a period of two months
after having given the notice"

This notice shall be sent to the National Monuments and Historic Properties Service, Dún
Sceine, Harcourt Lane, Dublin 2. Telephone 01-4117100.

Sites designated for nature conservation:
If a community group plan to undertake a project on sites they should check if any nature
conservation designation exists i.e. many rivers are designation in County Meath.
Designated sites in County Meath are detailed in the Meath County Development Plan,
2001 (www.meath.ie/devplan) or alternatively at www.heritagedata.ie.
Nature conservation designations include proposed candidate Special Areas of
Conservation (SACs) designated under the EU Habitats Directive (92/43/EEC) e.g. River
Boyne and Blackwater, Special Protection Areas (SPAs) designated under the EU Birds
Directive (79/409/EEC) or Natural Heritage Areas (NHAs) protected by the Wildlife
(Amendment) Act, 2000.
Consultation and permission will be required from the National Parks and Wildlife
Service of the Department of Environment, Heritage and Local Government.
Consultation with the Fisheries Board may also be necessary.
Planting
Where possible, planting of native species appropriate to the area is encouraged.

Protected flora, fauna and habitats:
Meath County Council may request that a flora/fauna survey be undertaken as part of the
conditions of a community grant e.g. all Irish bat species are protected under the Wildlife
Act (1976) and Wildlife [Amendment] Act (2000) and are listed under Annex IV of the
Habitats Directive (92/43/EEC).
Consent:
Where consent is necessary it is the responsibility of the applicant to obtain all
necessary consents on approval of grant and prior to commencement of project.

                     Payment Stage Requirements


Once an application for grant aid has been approved and a letter of offer issued, the
following information must be provided before grant payment can be processed.

Note: A ceiling of €300 applies for payments in cash for vouched services and
purchases for applicants who provide invoices and receipts in support of such
payments. All payments in excess of €300 must be paid by cheque.

1) Original invoices in respect of eligible expenditure as outlined in your Letter of
   Offer.

2) (i)             Original receipts in respect of 1) above.
   (ii)            Copies of cleared cheques written in payment for these invoices or copies
                   of the actual cheques written in payment as well as bank statements
                   clearing the cheques in question.

3) (i)             Original current tax Clearance Certificate from you, the Applicant.
   (ii)            In the case of groups who have attained charitable status, their CHY No.
                   will suffice in respect of Corporation Tax; but PAYE tax clearance will be
                   required if the group has any employees.
   (iii)
4) Tax Clearance Certificate/C2 details will be required in respect of all sub-
   contractors, consultants and all suppliers of goods/services.

5) Evidence of proper insurance cover
                (i) Public Liability Insurance cover- €2.6m cover
                (ii) Employer’s Liability cover- €2.6m cover.
                (iii)Insurance against fire damage to buildings, or facilities being grant
                     aided.

Policies (i) and (ii) must indemnify Meath County Council against any claims
howsoever arising.
6) Copy of Certificate of Incorporation and Memorandum and Articles of Association
   (where the Applicants being grant aided is a Company) and where the applicant is an
   unincorporated body or group a copy of its constitution or rules.
7) Certificates confirming compliance with Planning Permission and confirmation that
   new structures and refurbishment/extension to existing structures comply with
   Building Regulations 1991 and Fire Safety Regulations are also required.

8) For Groups who have been approved for voluntary labour as part matching funding,
    an authentication of hours being claimed needs to be submitted and certified by an
    independent official such as an accountant, solicitor, member of An Garda Siochana,
    Peace Commissioner or priest.
9) Compliance with the General Conditions of the Scheme.
10) Completion of forms of Acceptance and Legal Agreements/Deed of Charge to the
    satisfaction of the council and its Law Agent.
11) In general, compliance with all statutory regulations. In particular, copy of planning
    permission if not presented at time of application or if grant approved in principle
    subject to planning permission being obtained.
12) A Meath Co. Co. plaque must be erected at the location of the project on successful
    completion and prior to drawdown of funds.
13) Any publications/publicity (i.e. newspaper, radio, TV) should acknowledge the grant
    aid of      the Meath County Council/Indaver Community Liaison Committee
    Carranstown Environmental Projects Grant Scheme 2010. 200_

        Drawdown Policy / Protocol for Grants not availed of.

Upon receipt by the council of a “written claim” for grant drawdown by the due
drawdown date this will represent compliance in principle with the criteria for drawdown
as laid down in the Meath County Council/Indaver Community Liaison Committee
Carranstown Environmental Projects Grant Scheme 2010. Once a claim is received
additional supporting documentation may be required in order to properly and fully
assess compliance with the general conditions and payment stage requirements. The
Council/Indaver Community Liaison Committee in exercising its right to seek this
additional information will allow a degree of flexibility in terms requesting, submitting
and assessing additional supporting documentation. In any event the drawdown shall be
complete within 6months of the initial submission.

If a grant is not availed of in the calendar year of allocation, the applicant will be given
        the opportunity to avail of an extension of the drawdown date. A claim seeking
        extension should be submitted to the Council/Indaver Community Liaison
        Committee at the earliest possible date when it becomes apparent to applicant that
        the notified drawdown date will not be complied with. The claim for extension of
        the drawdown date shall be submitted in writing on or before the notified
        drawdown date. Otherwise the grant drawdown period will be deemed to have
        expired and will be revoked. Each claim for extension of the drawdown date shall
        clearly and concisely outline the circumstances or otherwise outside the control of
        the applicant preventing drawdown by the notified date. Each claim for an
        extension shall be judged on individual merits and the length of the extension
        shall be at the Council/Indaver Community Liaison Committee’s absolute
        discretion. The maximum time for an extension of the original drawdown date
        shall be one year only unless a group or organisation can demonstrate exceptional
        circumstances that prevent from drawing down the grant within the 1 year
        extended period. The granting of an extension is excess of 1 year shall be at the
        absolute discretion of the Council/Indaver Community Liaison Committee and
        shall be determined on a case by case basis where the exceptional circumstance
        preventing drawdown shall be submitted in writing to the council.

The procedure for payment of a grant is by way of a Manager’s Order.                          Similar
procedures shall apply to claims for extension of the notified drawdown date.

If a claim for a drawdown or extension of the drawdown date is not submitted to the
Council//Indaver Community Liaison Committee by qualifying clubs / organisations on
or before the notified date, the approved grant shall be revoked.
