               Novo membro da Comissão ENVI

           O presidente anuncia que, no seguimento da partida de Bairbre De Brún, Martina
           Anderson passou a integrar a Comissão ENVI na qualidade de membro titular a partir
           de 12 de junho de 2012. O presidente dá as boas-vindas a Martina Anderson.

               Anúncio de uma audição conjunta das Comissão ENVI e DROI

           O presidente anuncia que será organizada uma audição conjunta sobre as
           consequências das alterações climáticas para os direitos humanos, com apresentação

          As regards the proposal by Mr Rossi on "Health innovation for better and more
           efficient care - the way forward"1 the coordinators recalled that on 24 October
           2011 "[t]he secretariat [had been] instructed to draw up a note clarifying which
           aspects were already covered by existing legislation and by Commission
           communications, and where there was a need for additional political action at EU
           level." That note was circulated ahead of the last coordinators' meeting [ER]

     The first coordiators' meeting after summer recess shall be held on 12 September, 10.00
     - 11.00, in Strasburg.



     C.1. Release of ENVI meeting from the reserve: 5 November 2012, 15.00 - 18.30 hrs
     [JK & VPH]

     Decision

     Due to the committee's increasing workload it was decided to make use of this 'reserve'
     half-day. Accordingly, the ENVI meeting shall held also on Monday, 5 November 2012
     from 15.00 - 18.30 hrs, in addition to the half-day of Tuesday 6 November a.m.



     C.2. Delegation to Hyderabad - change in size
     [YG and EI]

     Decision

     The coordinators

           held an extensive exchange of views
           instructed the chairman to write to the President and to the Chairman of the
            Conference of Committee Chairs in order to
                o reiterate the committee's whish that the European Parliament should
                   receive the best possible assistance from the Commission in the context of
                   international conferences the outcome of which was subject to the consent
                   procedure
                o seek clarifications as to the uniform policy on committee missions to
                   international conferences which the governing bodies would apply to all
                   the standing committees
           decided that the size and composition of the official ENVI delegation to
            Hyderabad should be maintained (3 members, viz. EPP, S&D, Greens/EFA)
           agreed that up to four additional Members (viz. ECR, GUE/NGL, ALDE, S&D)
            could accompany the official delegation on the understanding that the rules rule
            out any reimbursement of travel expenses
           instructed the secretariat to inform the coordinators, delegation members and
            group staff to clarify the applicable arrangements in writing (in particular:
            deadline for accreditation = 13 July 2012; deadline for advance payments for
            hotel = 1 August 2012).

        entitled 'Independence policy and implementing rules on Declarations of Interest'
        and that that paper was due for adoption by the end of 2012
       noted that some coordinators considered that certain statements of financial
        interests might give rise to potential conflicts of interest
       instructed the chairman to seek a Legal Opinion from the Legal Service so as to
        clarify
            o the rules governing the economic and financial interests of members of the
                Management Board of the ECDC in general and of EP representatives in
                particular
            o whether the declarations of interest as submitted would be compatible
                with those rules
            o whether, in the event of potential present incompatibilities, the
                termination of certain activities would resolve potential conflicts of
                interests.
       agreed to take a final decision on 12 September in the light of the conclusons of
        the Legal Opinion.

               took note of the following decision of the Conference of Presidents and instructed
                the secretariat to systematically draw the attention of rapporteurs to this
                decision:

     At its meeting of 27 June 2012, the Conference of Presidents

                  recalled that following an exchange of views on the question of the use of
                   delegated acts on 19 April 2012, the Conference of Presidents invited the
                   competent services to carry out a screening procedure of pending proposals as
                   well as legislative acts already adopted, in order both to establish whether errors
                   had already been made in relation to the application of Article 290 TFEU and to
                   avoid future decisions which would be legally questionable;

                  took note of the abovementioned letter of 13 June 2012 from Mr LEHNE, Chair of
                   the Conference of Committee Chairs, in which he transmits the results of the
                   screening procedure on legislative proposals that are currently being negotiated,
                   while noting that the situation in this regard is subject to ongoing change;

                  took note of the specific files on which negotiations are underway, listed in the
                   annex to the above-mentioned letter, which, inter alia, include a significant
                   number of AGRI dossiers specifically concerning the alignment of agricultural
                   legislation to the new categories of delegated and implementing acts established
                   by the Lisbon Treaty which will be voted in 1st reading during the July plenary;

                  heard Mr Lehne presenting the latest state of play regarding some specific files
                   included in the draft agenda for the July part-session ;

                  invited the committees concerned to strongly defend Parliament's position on the
                   use of delegated acts and underlined that in the absence of an appropriate
                   agreement on the issue(s) concerned in clear legal cases, no plenary vote(s)
                   leading to a first-reading agreement on the dossiers in question would be
                   scheduled, either by including the provisions on the delegated acts at plenary
                   stage or by not submitting the file to the plenary;

                  expressed its wish that a satisfactory outcome to this issue can be found as a
                   matter of priority, not least with the assistance of the Commission;

                  expressed its intention, in the meantime, to return to the item on a standing basis
                   when adopting the plenary agenda.

At it's meeting of 5 July 2012, the Conference of Presidents

       "-    heard President SCHULZ

            o insist that Parliament's work on the MFF related legislative proposals should
              be duly coordinated;

            o underline that, therefore, committees can establish contacts with the CY
              Presidency and start negotiations on their future programmes with their
              corresponding Council formations without however concluding any first
              reading agreement or any sectoral deal.

            o recall that, as stated in Parliament's resolution "nothing is agreed until
              everything is agreed"

       -    endorsed this approach."

        - Look at a possible revision of EU legislation on sources of noise

     The detailed specifications shall be finalised in a follow-up written procedure.



     C.6.2. Workshop on Active and Healthy Ageing - A challenge for the EU to create age-

     Decision

     The coordinators decided that the above workshop shall be organised.


     C.6.3. Study on "disease mongering", request by Mr Rossi
     [ER]

     The papers for the meeting included several background papers submitted by Mr Rossi.

           heared Mr Rossi for further explanations
           agreed, owing to the lack of time, to return to the matter at their next meeting.


     C.7. Comitology - transmission of RPS measures during recess period

     The coordinators took note of a letter from the Chairman to Commissioner Dalli
     deploring the non respect of the comitology summer recess.



     C.8. ETS - implementation of the Commission declaration on the implementation of the
     Energy Efficiency Directive

C.9. Diesel exhaust - request from the Greens/EFA for an oral question on recent
classification of diesel exhaust as carcinogen category 1 by the WHO's International
Agency for the Research of Cancer

The coordinators decided to invite the Commission to the Committee in order to answer
the above question (Oral Question in Committee, Rule 197).



C.10. Shiprecycling - Request from the Greens/EFA for an opinion by the Legal Service in
relation to the Commission proposal on shiprecycling

Decision

The coordinators decided to seek a Legal Opinion on the following question:
              What legal or economic instruments could be adopted to oblige all EU
              shipowners irrespective of the flag of the ship to comply with the proposed
              regulation, or to contribute to compliance in case they owned a ship only for
              part of its life, and how can this be enforced?

The political groups shall be given to add more detailed specifications in a follow-up
written procedure.



C.11. Request by S&D for an exchange of views on: "Funding crisis at the Global Fund to
Fight Aids, TB and Malaria and its impact on EU countries most affected by multi-drug
resistant TB, in particular Romania"
