It contains a description of the Act that governs the activities of the Development Bank of Southern Africa (DBSA), the mandate of the DBSA, products and services, and the availability of its records as a public body. This manual also includes information from the Development Fund, which is a subsidiary of the DBSA. The manual is available in English and will in future be translated in two other official languages. Copies of the manual can be obtained from the Information Officer or the DBSA website The Promotion of Access to Information Act No. 2 of 2000 (the Act) The objects of this Act are  to give effect to the constitutional right of access to – o any information held by the State; and o  any information that is held by another person and that is required for the exercise of protection f any rights; to give effect to that right – o subject to justifiable limitations, including, but not limited to, limitations aimed at the reasonable protection of privacy, commercial confidentiality and effective, efficient and good governance; and o in a manner which balances that rights with any other rights, including the rights in the Bill of Rights in Chapter 2 of the Constitution; to give effect to the constitutional obligations of the State of promoting a human rights culture and social justice, by including public bodies in the definition of “requester”, allowing them, amongst others, to access information from private bodies upon compliance with the four requirements in this Act, including an additional obligation for certain public bodies in certain instances to act in the public interest; to establish voluntary and mandatory mechanisms or procedures to give effect to that right in a manner which enables persons to obtain access to records of public and private bodies as swiftly, inexpensively and effortlessly as reasonably possible; and generally, to promote transparency, accountability and effective governance of all public and private bodies by, including, but not limited to, empowering and educating everyoneto understand their rights in terms of this Act in order to exercise their rights in relation to public and private bodies; to understand the functions and operation of public bodies; and to effectively scrutinize, and participate in, decision-making by public bodies that affects their rights. Section 14 of this Act requires that all public bodies compile a manual giving information to the public regarding the procedure to be followed in requesting information from the public body for the purpose of exercising or protecting rights       Development Bank of Southern Africa: Information Manual 3 Section 1 STRUCTURE, FUNCTIONS AND SERVICES OF THE DEVELOPMENT BANK OF SOUTHERN AFRICA (DBSA) Legislative framework The Development Bank of Southern Africa exist as a juristic person by the name the „Development Bank of Southern Africa Limited‟ and its role, powers, functions and duties are defined by the Development Bank of Southern Africa Act, 1997. Published in Government Gazette No17962 –Vol. 382 on 25 April 1997 – No 641. The DBSA is registered as a company in terms of the Companies Act, 1973, but is exempt from the provisions of the Companies Act, 1973 (Act 61 of 1973). The Minister may however by notice in the Gazette apply any provision of the Companies Act, 1973, the Banks Act, 1990, or such other law to the Bank, in so far as such provision is not inconsistent with the provisions of the Development Bank of Southern Africa Act, 1997 (Act 13 of 1997) with such modifications as the Minister may deem fit and may specify in that notice, and may withdraw or amend any such notice. Objects of the Development Bank of Southern Africa The main objects of the Bank are the promotion of economic development and growth, human resources development, institutional capacity building, and the support of development projects and programmes in the region by:  mobilising financial and other resources from the private and public sectors, national or international, on a wholesale basis, as determined in the regulations;  appraising, planning and monitoring the implementation of development projects and programmes;  facilitating the participation of the private sector and community organisations in development projects and programmes;  providing technical assistance, particularly in respect of human resource development and training with regard to the identification, preparation, evaluation, financing, implementation and management of development projects and programmes;  funding or mobilising wholesale funding, as determined in the regulations, for initiatives to minimise or mitigate the environmental impact of development projects or programmes. The ancillary objects of the Bank are to:   to assist other international, national, regional and provincial initiatives in order to achieve an integrated finance system for development; and to assist other institutions in the national or international public and private sectors with the management of specific funds in order that the developmental requirements of the region may be met Development Bank of Southern Africa: Information Manual 4 Mandate of the Development Bank of Southern Africa The core business of the Development Bank of Southern Africa is the support, both financially and in a facilitative role, of the creation of infrastructure to serve South Africa‟s needs. The proposed definition of the DBSA development support with the emphasis on infrastructure, is the physical assets and institutional capacity for which funding is not fully available from the Government, other DFI's in terms of their mandates (where existing capacity exists), or the private sector, and which are required to implement a development project or programme and which can sustain loan or equity financial support. The infrastructure supported by the DBSA can be defined in three broad categories, namely economic infrastructure, institutional and human infrastructure, and socially orientated infrastructure. The economic infrastructure supported includes regional, municipal, rural, ecotourism, and enterprise infrastructure. The degree to which the DBSA would assist with institutional and human infrastructure is dependent on the outcome of a decision on where Government wishes to place the emphasis between development and banking. The DBSA also include as infrastructure the institutional infrastructure for borrowers specifically if it is project and programme related and builds capacity in a DBSA target area. Although socially orientated infrastructure is excluded from the normal understanding of infrastructure the DBSA incorporated it into its broad definition of infrastructure. Annexure "A" gives a list of what is commonly understood by economic, institutional, human, and social orientated infrastructure. The instruments the DBSA use to support infrastructure development is:  Making direct loans available at its prevailing interest rates for infrastructure;  Taking up an equity stake in infrastructure development, where appropriate;  Providing guarantees, where appropriate, to leverage private sector support by reducing the perceived risk of investment;  Acting as a merchant bank to package risk appropriately, as well as the consequential investment and returns, in close collaboration with the private sector, government and other agencies;  Providing technical assistance (both financial and expertise) to clients and potential clients in order to build capacity, thus maximising the development impact of infrastructure investments (for example, economic programming and policy development support, financial modelling such as the CSM and DCSM, integrated environmental management capacity, establishments of billing and collection systems). The Fund will only operate within the boundaries of South Africa. Objects of the Development Fund The Fund‟s specific objective will be to address development failure through building capacity to manage development initiatives at various levels particularly at third-tier government and community levels. The Fund‟s development assistance is aimed at creating the necessary conditions to promote development by enhancing local government, other public entities and communities‟ abilities, opportunities and access to resources to generally minimum threshold levels. This includes supporting local government, other public entities and communities to effectively articulate their requirements, needs and related activities and, where necessary to launch developmental initiatives to serve as a foundation to mobilise other development partners and resources for further development. Development Bank of Southern Africa: Information Manual 6 The core business of the Development Fund will be to maximise the impact of development finance through addressing human, institutional and financial capacity constraints to rural and urban development, by providing development assistance and mobilising resources for this purpose. Section 10 of the Act requires the SAHRC to publish a Guide containing information reasonably required by a person wishing to exercise or protect any right in terms of this Act. In other words you do not need to request this information in terms of the Promotion of Access to Information Act. Although the Act provides for only two groups of information categories, those that are access controlled and those that are automatically available, it is important for the Bank to create a third group of information categories by dividing the automatically available group into two sub-groups – the automatically available group and the semi-automatically available group. Group 1: Automatically available information categories The following information / records can be obtained automatically without a formal request:  Annual reports  DBSA printed publications  Newsletters  Booklets  Pamphlets  Other literature intended for public viewing Group 2: Semi-automatically available information categories This group of information categories includes all the structured, non-structured data, information and knowledge generated by the individual staff members of the Bank and published by the Bank in the form of reports or publications. The requests for access to these information categories represent the bulk of all the information requests received by the Bank. to any of the above categories of information, you are required to complete a request form as set out in annexure B hereto. These forms are available from:  The DBSA Information Officer (whose contact details are in section 2 of this manual);  The SAHRC website (www.sahrc.org.za)  The Department of Justice and Constitutional Development website (www.doj.gov.za). There is a prescribed fee (payable in advance) for requesting and accessing information in terms of the Act. Details of these fees are contained in the request form. You may also be called upon to pay the additional fees prescribed by regulation for searching for and compiling the information, which you have requested, including copying charges. It is important to note that access is not automatic – you must identify the right you are seeking to exercise or protect and explain why the record you request is required for the exercise or protection of that right. You will be notified in the manner indicated by you on the request form whether you request has been approved. Section 8 REMEDIES FOR NON-COMPLIANCE WITH THE ACT Any requester dissatisfied with any decision of the DBSA in respect of a request for access to a record of the DBSA can either lodge an internal appeal to the relevant authority or approach the High Court or another court of similar status to seek redress. If the requester wants to lodge an internal appeal it must be done within 60 days after receiving the notice that his request was not approved or within 30 days if notice to a third party is required. An internal appeal must be lodge in the prescribed Form B in annexure B. Development Bank of Southern Africa: Information Manual 18 Section 9 FEES PAYABLE AS PRESCRIBED BY THE ACT The fee for a copy of the manual as contemplated in regulation 5 (c) of the Act is R0,60 for every photocopy of an A4 size of page or part thereof. The actual postage is payable when a copy of a record must be posted to a requester.
