5. No works can begin until a survey has been conducted by a person, the identity of
   whom has been previously agreed in writing by the English Nature Species
   Protection Officer and the Local Planning Authority, to investigate whether the barn
   is utilised by bats or any other protected species, and the survey results passed to
   English Nature and the Local Planning Authority.

    If such use is established, a scheme for the protection of the species/habitat shall be
    submitted to and agreed in writing by English Nature and the Local Planning
    Authority before any work commences on site.

6. All the external works of the development hereby permitted shall be completed
   before the expiration of three years from the date of this permission.

7. This permission shall relate to the proposed conversion in accordance with the

      PROPOSED CONVERSION OF A REDUNDANT AGRICULTURAL BUILDING TO
      A DWELLING WITH INTEGRAL OFFICE ACCESSED OFF CARR LANE AT
      SMALLEY FOLD BARN, SMALLEY FOLD FARM, COMMONS LANE,
      BALDERSTONE

      REFUSED for the following reason(s):

      1. The proposal is considered to be contrary to the Council’s adopted Interim
         Supplementary Guidance Note –“Housing”. Section 3.4 of the Guidance states that
         applications for the conversion of barns and other agricultural buildings will be
         refused unless specified circumstances apply. In this case the applicants have
         provided insufficient evidence that appropriate justification for the development
         exists. On this basis the development, if allowed, would add to the existing over
         supply of housing within the Borough, contrary to the objectives of Planning Policy
         Guidance Note 3 – “Housing”, which would cause harm to the urban concentration
         strategy as set out in the adopted Lancashire Structure Plan. For these reasons the
         scheme is also considered contrary to Alteration 10 of the Ribble Valley Districtwide
         Local Plan Alterations Review 1st Deposit Edition and Policy 12 of the Emerging
         Lancashire Structure Plan.

      2. The proposal by virtue of its isolated position and the harmful effect from the
         creation of a large garden area with the likely impact of domestic paraphernalia such
         as sheds, washing lines, children's play equipment and fence lines on this part of the
         open countryside would represent an urban encroachment to the detriment of the
         surrounding countryside. It is therefore considered contrary to Policies G1, H15, H7
         and ENV3 of the Districtwide Local Plan and Policy 1 of the Lancashire Structure
         Plan 1991-2006 'Greening the Red Rose County'.

      3. If allowed the development would set a dangerous precedent for the acceptance of
         other similar proposals without sufficient justification which would render more
         difficult the implementation of the established planning policies of the Council.

      4. The proposal is considered contrary to policy H16 of the Districtwide Local Plan in
         that the building to be converted is considered structurally unsound and would
         require extensive rebuilding/alterations above the permitted allowance of 30% as
         specified in the Council's detailed guidance note on structural issues associated with
         such schemes. Approval of such a scheme would be tantamount to the creation of a
         new dwelling in the open countryside without sufficient justification to the visual
         detriment of the area.

      5. The proposal is considered contrary to the provisions of Policy H17 of the
         Districtwide Local Plan by virtue of a design which is unsympathetic to the original
         form and character of the building in terms of its excessive window openings which
         provide a domestic appearance. Approval would thus be detrimental to the visual
         amenities of the area.

            Mr Harvey spoke on this agenda item.

            The Chief Planning Officer submitted a report providing Committee with the historic
            facts relevant to the Pendle View Fisheries site and giving a response to the petition
            received by Committee on 15 July 2004. The Council's ambition to protect and enhance
            environmental quality underlies the decision of this Council which had been upheld on
            appeal. The report outlined the history of the site with regard to the various planning
            applications that had been approved over the years dating back to 1983. The case put to
            Members by one of the owners of the fisheries concluded that in their view, the company
            could not continue to run the business without a second person resident on site for the
            next 2-3 years. They believed that at that stage the business would be able to justify
            overnight staff and the need for a second couple would no longer be valid. Therefore,
            their request was that the static building not be removed from the site for the interim
            period. The decision to refuse permission for the existing mobile home to remain on the
            site had been recently upheld by a Planning Inspector as an appeal decision and thus
            Pendle Fisheries had been advised that the temporary building should be removed by mid
            July 2004 and that if it was not, the Council would pursue formal enforcement action via
            a breach of condition notice.

            The Committee considered their options with regard to the request from Pendle Fisheries.

RESOLVED:   That Committee having regard to the history of the site and clear advice given by both
            officers and the Planning Inspectorate agree to pursue formal enforcement action on this
            site on a timescale that would allow for the necessary works to be complete by the
            beginning of September 2004.

280         TRAINING FOR COUNCILLORS – THE ROLE OF COUNCILLORS IN PLANNING:
            PROBITY AND PROPRIETY ISSUES
            The Chief Planning Officer reminded Committee that a training day for Councillors had
            been arranged on 17 September 2004. He reported that six places had been offered to
            Craven District Council which left 19 places for Ribble Valley Borough Councillors and
            officers. He encouraged as many Councillors to attend as possible.

RESOLVED:   That Committee note the course and advise all individual Members to strive to attend and
            should there be any remaining places available on the course, these be opened out to non
            Planning and Development Committee Members.

281         BUILT CONSERVATION AND HERITAGE SERVICE IMPROVEMENT OPTIONS
            The Chief Planning Officer submitted a report detailing the options open to Committee to
            enhance the current built conservation and heritage service offered by the Council. He
            reminded Committee of the background to the post of Design and Conservation Officer
            that had been created in the late 1980’s and over time had developed into a job dominated
            by development control duties with particular responsibility for design and conservation

            matters. This authority had now been recently notified that there would be a new Best
            Value Performance Indicator for 2005/06 with specific regard to the percentage of
            conservation areas which have been subject to a character assessment or its review within
            the last five years as a proportion of the total number of conservation areas in the local
            authority area. The Chief Planning Officer informed Committee that we would need
            extra resources to enable this work to be carried out. He reminded Committee that the
            Ribble Valley Local Plan actually includes a priority list for conservation area appraisals
            and that the Corporate Plan states that a programme would be prepared. The Local Plan
            states that appraisals have been prepared for Clitheroe, Ribchester and Whalley.
            However, these were now all over five years old. The Local Plan also suggests carrying
            out appraisals at Hurst Green, Sabden and Worston with a view to possible conservation
            area designation.

RESOLVED:   That Committee authorise the Director of Development to carry out a tendering exercise
            to secure external assistance in carrying out a series of conservation area assessment and
            enhancement schemes and a general set of guidelines for listed building owners in the
            area.

            withdrawn.
