The Division of Banking has requested 65 ftes for FY2005 which is current with FY2004.
Although the division currently has four vacancies, the notes by the vacancies indicate when
these positions are planned to be filled. In an attempt to cut back on expenses due to budget
reductions, the division has left these positions vacant. Although the Division of Banking would
like to retain the funding of these vacant positions for a longer period of time to be used in other
areas of the division’s budget, the division is no longer able to meet terms of agreements with
federal regulators and statutory requirements with the number of filled positions that currently
exist. In 2002, 166 bank examinations were conducted. This number was reduced to 139 in
2003. It cannot be reduced further and still fulfill our mission.

I would like to point out that the Division of Banking was authorized 78 ftes in FY 2002. In FY
2003, the division reduced its authorized ftes by 6 positions to 72 ftes. In FY 2004 the division
again reduced its authorized ftes by 7 positions to 65 ftes. The division has requested 65 ftes for
FY 2005 and plans on filling all of these in the near future.

Re:    Professional Licensing FTEs



The Division organization chart is attached. We currently have eleven (11) FTEs in the Division. Two
positions are vacant, the Division Administrator and a clerk-specialist position. The Division
Administrator ‘s position has been staffed by an “Acting Administrator” since July 1, 2003. The position
is to be filled in accordance with Iowa Code section 546.10 (2). The salary for the position has been
funded at $74,441. The clerk-specialist position has been vacant since January 2, 2004. We are
currently in the process of conducting interviews to fill the position and it is anticipated it will be offered
to a qualified candidate by February 11, 2004. The position has been funded at $ 34,776. The clerk-
specialist position became vacant due to the death of an employee (Administrative Assistant 1) and
promotion of another into the vacant AA position.

In order to operate the Division, it is essential that the staffing remain at the current level of11 FTEs. We
provide staff to the six Boards and Commission (Accountancy, Architects, Engineers & Land
Surveyors, Landscape Architects, Real Estate Commission and Real Estate Appraisers) as well as
serving as superintendent of the Savings and Loan Associations. The Division is responsible for the
regulation of approximately 33,000 licensees in order to ensure citizens of the state receive
professional, competent, and safe services. The boards and commission examines, licenses, certifies,
or issues permits or licenses to practitioners, sets standards for license renewal and continuing
education, investigates all complaints filed and considers alleged violations of their practice act and
Iowa regulations, conducts disciplinary hearings, and actively monitors the compliance of licensees with
orders issued by the boards and commission. The Division is dedicated to the protection of the public
through its regulatory activities.

The Division annually deposits more funds into the General Fund than are appropriated back to the
Division.

The Iowa Utilities Board is willing to reduce its authorized FTE’s from 79 to 74,
with the understanding that our FUNDING will not be reduced. Since the
IUB bills the utilities for the actual costs we incur, reducing our
appropriation has no ultimate impact on the state’s general fund. Any
reduction to the IUB budget reduces our revenues by an equal amount.

By utilizing vacancy factors in our budget, we are spending part of our salary
funding on general operating costs. We cannot carry out our statutory
responsibilities if our spending cap is reduced. If necessary, we will request
adequate funding from the Department of Management as provided in Iowa Code
§ 476.10, which provides in pertinent part:

         Whenever the board shall deem it necessary in order to carry out
         the duties imposed upon it in connection with rate regulation under
         section 476.6, investigations under section 476.3, or review
         proceedings under section 476.31, the board may employ
         additional temporary or permanent staff … Before the board
         expends or encumbers an amount in excess of the funds budgeted
         for rate regulation and before the board increases quarterly
         assessments pursuant to this paragraph, the director of the
         department of management shall determine that the expenses
         exceed the funds budgeted by the general assembly to the board
         for rate regulation and that the board does not have other funds
         from which the expenses can be paid.


There are three positions that have been vacant for 26 or more pay periods that
we would like to maintain, including:

1) Utility Regulatory Engineer 2 - Safety & Engineering: To ensure that safety
standards are addressed and enforced, particularly in conjunction with
generation plant and gas pipeline siting.

2) Utility Regulatory Engineer 2 - Energy: To work on the numerous
transmission and distribution issues currently under debate in the electric
industry at the regional and national level.

3) Utility Analyst 1 – Telecommunication: To review tariffs, company applications
for certification, and assist senior analysts on numerous and complicated issues
in the telecommunications industry.
