S e c t i o n 400. Powers of Cftv. The C i t y shall have t h e power t o maka and
enforce a l l r u l e s and r e g u r a t i o n s i n r e s p e c t t o municipal a f f a i r s , s u b j e c t
o n l y t o such r e s t r i c t i o n s and l i m i t a t i o n s as may be proviaed in this CSarter,
and in t h e C o n s t i t u t i o n of t h e S t a t e of C a l i f o r n i a . It shall a l s o have t h e
power t o e x e r c i s e any and a l l r i g h t s , powers and p r i v i l e g e s h e r e t o f o r e o r
h e r e a f t e r e s t a b l i s h e d , granted o r p r e s c r i b e d by any law of t h e S t a t e , by t h i s
Charter, o r by o t h e r lawful a u t h o r i t y , o r which a municipal c o r p o r a t i o n might

S e c t i o n 401. Procedures. The C i t y shall have t h e power t o act pursuant -
t o procedure e s t a b l i s h e d by any l a w of t h e S t a t e , u n l e s s a d e f e r e n t proce-
d u r e i s established by ordinance,

S e c t i o n 500. Enumeration of and Term. T e e l e c t i v e o f f i c e r s of t h e C i t y
shall c o n s i s t of:
X C i t y Council composed of f i v e (5) members d o a r e r e g i s t e r e d v o t e r s
of t h e C i t y , f o u r ( A ) t o be r e s i d e n t s of t h e i r r e s p e c t i v e d i s t r i c t s and
nominated and e l e c t e d from t h e C i t y a t l a r g e . The f i f t h t o be both aomi-
n a t e d and e l e c t e d from t h e C i t y a t l a r g e and t o be known a s :
The Hayor;
A C i t y Clerk;
A Cfty T r e a s u r e r ; and
d C i t y Attorney.
A l l of t h e e l e c t e d o f f i c e r s shall serve f o r a term of f o u r ( 4 ) y e a r s .
The tenns or' o f f i c e of t h e members or' t h e C i t y Council r e s i d i n g i n d i s t r i c t s
Two and Three, and t h e terms of o f f i c e of t h e Hayor, C i t y Clerk, C i t y Treas-
u r e r and C i t y Attorney e l e c t e d i n 1969 s h a l l e x p i r e i n t h e y e a r 1973. The
terns OF o f f i c e OF t h e p r e s e n t members of t h e C i t y Council r e s i d i n g i n d i s -
t r i c t s One and Four shall e x p i r e i n t h e y e a r 1971.
The terms of a l l e l e c t i v e o f f i c e r s s h a l l commence on J u l y F i r s t follow-
ing t h e i r e l e c t i o n and e a c h s h a l l seme u n t i l his s u c c e s s o r is e l e c t e d and
qualified. Any ties i n v o t i n g shall be s e t t l e d by t h e c a s t i n g of l o t s .
Provided, however, t h e C i t y Council, on and a f t e r t h e o p e r a t i v e d a t e
( a s t h e t e n n " o p e r a t i v e d a t e " is h e r e a f t e r d e f i n e d ) s h a l l be composed of
seven (7) members, six (6) t o be r e s i d e n t s of t h e i r r e s p e c t i v e d i s t r i c t s
and nominated and e l e c t e d from t h e C i t y a t Large, and t h e s e v e n t h t o b e b o t h
nominated and e l e c t e d from t h e C i t y a t Large, and t o be known a s t h e Xayor.
A t any time when t h e C i t y Council f i n d s by ordinance adopted by n o t
ess t h a n four (4) a f f i r m a t i v e v o t e s t h a t t h e p o p u l a t i o n of t h e C i t y ex-
ceeds 100,000 p e r s o n s , t h e C i t y Council shall thereupon, and w i t h i n s i x t y
( 6 0 ) d a y s a i t e r t h e e f f e c t i v e d a t e of such o r d i n a n c e , adopt a n o r d i n a n c e by
a t l e a s t t h r e e (3) a i f i r m a t i v e v o t e s d i v i d i n g t h e C i t y i n t o s i x (6) Districts
f o r t h e purpose of e l e c t i n g members of t h e Council,
Said d i s t r i c t s s o r e v i s e d and f i x e d s h a l l comprise a s n e a r l y as p r a c t i -
c a b l e e q u a l numbers of v o t e r s a s determined by r e c o r d s of t h e r e g i s t r a t i o n o i

County and be composed of c o n t i g i u o u s and compact t e r r i t o r y and bounded by
n a t u r a l boundaries of street l i n e s .
The o r d i n a n c e s h a l l p r o v i d e t h e d i s t r i c t s s o t h a t each Councilman t h e n
i n o f f i c e w i l l reside $thin t h e d i s t r i c t b e a r i n g t h e number of t h e d i s t r i c t
from which he w a s e l e c t e d and D i s t r i c t 5 and D i s t r i c t 6 s&all.not i n c l u d e
t h e r e s i d e n c e of any of t h e members of t h e Councff except t h a t e i t h e r s u c h
districts may i n c l u d e t h e r e s i d e n c e of t h e Mayor.
Within t h i r t y (30) d a y s a f t e r t h e e f f e c t i v e d a t e of t h e ordinance es-
t a b l i s h i n g six ( 6 ) c o u n c i l d i s t r i c t , t h e Council shall in t h e manner provid-
ed by law, call-a s p e c i a l e l e c t i o n f o r t h e purpose of holding an e l e c t i o n f o r
a councilman from District 5 and a councilman from D i s t r i c t 6. If any can-
d i d a t e r e c e i v e s a m a j o r i t y f o r e i t h e r of such o f f i c e s , t h e C i t y Council s h a l l
d e c l a r e sucfi c a n d i d a t e o r c a n d i d a t e s (as t h e c a s e may be) e l e c t e d . I f no -
c a n d i d a t e f o r e i t h e r o r b o t h of such o f f i c e s r e c e i v e s a m a j o r i t y , a f i n a l
e l e c t i o n s h a l l be held on t h e Fourth Tuesday f o l l o w i n g s a i d e l e c t i o n between
t h e two c a n d i d a t e s r e c e i v i n g t h e h i g h e s t v o t e i n t h e f i r s t e l e c t i o n f o r e a c h
o r e i t h e r of s a i d o f f i c e s . Followiag s a i d second e l e c t i o n , t h e C i t y Council
s h a l l d e c l a r e t h e c a n d i d a t e r e c e i v i n g t h e h i g h e s t v o t e f o r e a c h o r e i t h e r of
s a i d o f f i c e s elec:ed.
Such e l e c t i o n , i n c l u d i n g t h e nominations, n o t i c e , canvass and o t h e r
proceedings, shall follow as h e a r as may be p r a c t i c a b l e t h e procedures f o r
e l e c t i o n s . The Council may proviae procedures f o r such e l e c t i o n s by ordin-
ance.

a t d i f f e r e n t tknes, a t U : 0 1 a.m. on t h e seventh day a f t e r t h e last such
d e c l a r a t i o n . Such seventh day is h e r e i n defined as t h e o p e r a t i v e d a t e .
The Councilman e l e c t e d in t h e f i r s t i n s t a n c e from D i s t r i c t 5 s h a l l
serre a term t5at s h a l l commence on t h e o p e r a t i v e d a t e and s h a l l 2nd a t
t h e same t i m e t h a t t h e term of t h e councilman from D i s t r i c t 1 ends. The
Councilman e l e c t e d i n t h e f i r s t i n s t a n c e from D i s t r i c t 6 s h a l l serve a term
that s h a l l commence on t h e o p e r a t i v e d a t e and end a t t h e same time as t h e
term of t h e councilman from D i s t r i c t 2 ends.
Councilmen t h e r e a f t e r e l e c t e d from D i s t r i c t s 5 and 6 s h a l l serve f o r
a term of f o u r (4) years,
On and a f t e r t h e o p e r a t i v e d a t e , t h e City shall be divided i n t o six (6)
d i s t r i c r s notwithstanding t h e p r o v i s i o n s of S e c t i o n 501 of t h i s Charter.
X o M t h s t a n d i n g t h e p r o v i s i o n s of S e c t i o n 502 of t h e C h a r t e r , and a f t e r
t h e o p e r a t i v e d a t e , t h e C i t y Council may change t h e boundaries of t h e S i x
D i s t r i c t s i n t o which t h e C i t y has been d i v i d e d by ordinance adopted by a t
least f i v e (5) a f f i r s a t i v e v o t e s whenever i n t h e opinion of t h e C i t y Council
such is n e c e s s a r y t o b e t t e r e q u a l i z e t h e p o p u l a t i o n among t h e r e s p e c t i v e d i s -
tricts.
On a r d a r ' t c r t h e o p e r a t i v e d a t e whenever t h e p r o v i s i o n s of t h e Charter
c a l l f o r t h r e e ( 3 ) a f f i r m a t i v e v o t e s , o r t h e concurrence of t h e t h r e e (3)
members of t h e C i t y Council; o r otherwise provide f o r an a c t i o n t o be taken
5y t h r e e (3) members of t h e C i t y Council, such p r o v i s i o n s shall b e conszrued
t o r e q u i r e f o u r (4) a f f i r m a t i v e v o t e s , o r t h e concurrence of f o u r (4) mem-
b e r s of t h e C i t y Couxicl3 o r otherwise provide f o r a n a c t i o n t o be taken by
f o u r (4) members of t h e Cfty Council.

f o r n e c e s s a r y t r a v e l i n g ana o t h e r expenses when on o f f i c i a l d u t y o u t of t h e
C i t y on o r d e r of t n e C l t y L o u n c i l . I n a d d i t i o n , members of t h e C i t y Council,
ana t h e Yayor, s h a l l r e c e i v e a salary o i S i a Hundred D o l l a r s ($600.00) p e r
month.
Other E l e c t i v e O f f i c e r s . The o t h e r e i e c t i v e o f r i c e r s , e x c e p t i n g t h e
members o r t h e Board of E d u c a t ~ o n ,s h a l l s e v e r a l l y r e c e i v e a t s t a t e d times

The C i t y Council s h a l l judge t h e q u a l i f i c a t i o n g of i t s members as set f o r t h

S e c t i o n 608. Ordinances. Enactment. In a d d i t i o u t o such acts of t h e
C i t y Cormcil a s a r e r e q u i r e d by t h i s Cbarter t o be by ordinance, every act
of t h e C i t y Council e s t a b l i s h i n g a f i n e o r o t h e r penalty, o r g r a n t i n g fran-
c h i s e , shall be by ordinance.

S e c t i o n 609. Ordinances. P u b l i c a t i o n . The C i t y Clerk shall cause each

S e c t i o n 610. C o d i f i c a t i o n of Ordinances. Any o r a l l ordinances of the
City which have been enacted and published in t h e k e r required a t t h e

consolidated, r e v i s e d , indexed and arranged as a comprehensive ordinance

of b u u d i n g s , plumbing, wiring, o r o t h e r s u b j e c t s whfch r e q u i r e e x t e n s i v e
r e g u l a t i o n s , a f t e r having been arranged a s a comprehensive code, may l i k e -
wise b e adopted by r e f e r e n c e i n t h e manner hereinabove provided.
Section 611. Ordinance. When E f f e c t i v e . N ordinance s h a l l become ef-

f e c t i v e u n t i l t h i r t y days from and a f t e r t h e d a t e of its adoption, e x c q t
t h e following, which s h a l l t a k e e f f e c t upon a d o ~ t i o n :
(a) A ordinance c a l l i n g o r otherwise r e l a t i n g t o an e l e c t i o n ;

(b) BP improvement proceeding ordinance adopted under some law
o r procedural ordinance;
(c) An ordinance d e c l a r i n g t h e amount o i money necessary t o 5e

(d) An emergency ordinance adopted i n t h e manner h e r e i n provided.
S e c t i o n 612. Ordinances, V i o l a t i o n , Penalty. A v i o l a t i o n of any ordi-
nance of t h e C f t y shall c o n s t i t u t e a misdemeanor and may be prosecuted i n
t h e name of t h e People of t h e S t a t e of C a l i f o r n i a o r may be redressed by
c i v i l a c t i o n . The maximum f i n e o r p e n a l t y f o r any v i o l a t i o n or' a c i t y ordi-
nance s h a l l be t h e sum of One Thousand ($1,000.00) D o l l a r s , o r a term of
imprisonment f o r a period n o t exceeding one year, o r both such f i n e and fm-
prisohment. The C i t y Council may provide by ordinance t h a t persons imprison-
ed i n t h e C i t y Jail f o r v i o l a t i o n of law o r ordinance may b e compelled t o
l a b o r on p u b l i c works.
S e c t i o n 613. Ordinances. Amendment. The amendment of any s e c t i o n o r
s e c t i o n s of an ordinance may be accomplished s o l e l y by t h e re-enacunent of
such s e c t i o n o r s e c t i o n s a t length, as amended.
S e c t i o n 614. Publishing of Legal Xotices. In t h e event =hat t h e r e i s
more than one neTwspaper of general c i r c u l a t i o n published in t h e C i t y , t h e
C i t y Council a n n u a l l y , p r i o r t o t h e beginning of each f i s c a l year, shall
p u b l i s h a n o t i c e i n v i t h g b i d s and c o n t r a c t f o r t h e p u b l i c a t i o n of a l l
l e g a l n o t i c e s o r o t h e r matte5 required t o be published i n a newspaper of
g e n e r a l c i r c d a t i o n published and c i r c u l a t e d i n s a i d C i t y during t h e ensu-
i n g f i s c a l year. I n t h e event t h e r e is only one newspaper of general cir-
c u l a t i o n published in t h e C i t y , then t h e Cfty Council shall have t h e p a r e r
t o c o n t r a c t w i t h such newspaper f o r t h e p r i n t i n g and p u b l i c a t i o n of such
l e g a l n o t i c e s without being required t o a d v e r t i s e f o r b i d s t h e r e f o r . The
newspaper with which any such c o n t r a c t is made shall be designated as t h e
o f f i c i a l newspaper f o r t h e p u b l i c a t i o n of such n o t i c e s o r o t h e r marter f o r
t h e period of such c o n t r a c t . I n na c a s e s h a l l t h e c o n t r a c t p r i c e charged
f o r such publication exceed t h e customary rates charged by such newspaper
f o r t h e p u b l i c a t i o n of l e g a l n o t i c e s of a p r i v a t e c h a r a c t e r .
When i t may appear t o t h e C i t y Councfl that t h e rates offered are un-
f a i r , t h e C i t y Council may employ o t h e r means of p u b l i c a t i o n in' l i e u of
newspaper a d v e r t i s i n g . . I n t h e event t h e r e is no o f f i c i a l newspaper desig-
nated by t h e C i t y Council, then a l l l e g a l n o t i c e s o r o t h e r m a t t e r may be
published by p o s t i n g copies thereof in a t least t h r e e p u b u c p l a c e s i n t h e
City.

Section 700. City Clerk, The C i t y Clerk shall have power and be required
( a ) Attend all meetings of t h e City Council and b e responsible
f o r t h e recording and maintaining of a f u l l and t r u e record of a l l of
t h e proceedings of t h e C i t y Councfl i n books t h a t shall bear appro-
p r i a t e titles and be devoted t o such purpose. Such books sball have a
g e n e r a l index s u f f i c i e n t l y comprehexisive t o enable a person r e a d i l y t o
a s c e r t a i n matters contained t h e r e i n ;
(b) Xaintain ordinance and r e s o l u t i o n books i n t o which shall be
recorded a l l City ordinances and r e s o l u t i o n s with t h e c e r t i f i c a t e of
t h e c l e r k annexed t o each thereof s t a t i n g t h e same t o be t h e o r i g i n a l
o r a c o r r e c t copy, givFng t h e number of s a i d ordinance o r r e s o l u t i o n
and, a s t o a n ordinance r e q u i r i n g publication, s t a t i n g t h a t the same

has been published o r posted i n accordance with this Charter;
(c) B e t h e custodian of t h e seal of t h e City;
(d) Administer oaths er a f f i m a t i o n s , t a k e a f f i d a v i t s and deposi-
t i o n s p e r t a i n i n g to t h e a f f a i r s and business of t h e C i t y and c e r t i f y
copies of o f r ' i c i a l records;
(e) Have charge of a l l c i t y e l e c t i o n s ; and
( 2 ) Devote his full t i m e during business hours t o t h e d u t i e s of
h i s o f f ice.
S e c t i o n 701. City Treasurer. The City Treasurer shall be t h e custodian
of a l l p u b l l c funds belonging t o o r under t h e c o n t r o l of t h e City, o r of any
ofr'i ce, departnent or agency t h e r e o f , and t o that end s h a l l have power and be
required to:
( a ) Receive and have custody of a l l m o n i e s r e c e i v a b l e by t h e City
from any suurce;
(b) Deposit a l l m o n i e s received i n such d e p o s i t o r i e s as map be
designated by r e s o l u t i o n of t h e C i t y Council and i n compliance with
all of t h e provisions of t h e S t a t e Constitution and laws df the S t a t e ,
gwerzzing t h e handl.ing, d e p o s i t i n g and sectafng of p u b l i c funds;
( c ) Disburse monies on demands properly audited i n t h e manner pro-
vided f o r fn this Charter;

(d) Prepare and submit t o t h e City C o n t r o l l e r monthly w r i t t e n re-
p o r t s of a U r e c e i p t s , ~ i s b u r s e a e n t s and fund balances, copies of which
shall be f i l e d with t h e C i t y Manager; and
(e) Devote his f u l l time dur4ag business hours t o t h e d u t i e s of
his o f f i c e .
S e c t i o n 702. Ciw Attorney. To become e l i g i b l e f o r Ciry Attorney t h e
person elected o r appoiuted s h a l l have been admitted t o p r a c t i c e before the
Supreme C o u r t of t h e S t a t e of California and s h a l l have been engaged i n t h e
p r a c t i c e of l a w f o r a t l e a s t t h r e e years p r i o r t o h i s e l e c t i o u o r appoint-
aent. The City Attorney s h a l l have power and be required to:
(a) Represent and advise t h e City Council and a l l City o f f i c e r s i n
a l l matters of law pertaining t o t h e i r o f f i c e s ;
(b) Represent and appear f o r t h e City and any City o f f i c e r o r
employee, o r former City o f f i c e r o r mployee, i n any o r all a c t i o n s
and proceedings i n which t h e City o r any such o f f i c e r o r employee,
i n o r by reason of h i s o f f i c i a l capacity, is concerned o r is a party,
but t h e C i t y Council s h a l l have c o n t r o l of a l l l e g a l business and pro-
ceedings and may employ other a t t o r n e y s t o take charge of any U t i g a -
t i o n o r matter o r t o a s s i s t the C i t y Attorney therein;
(c) Attend all regular meetings of t h e City Council and give h i s
advice o r opinion i n writing whenever requested t o do s o by the City
Council o r by any of the boards o r o f f i c e r s of t h e C i t y ;
(d) Apprwe t h e form of aU. bonds given t o and a l l c o n t r a c t s made
by t h e City, endorsing his approval thereon i n writing;
(e) Prepare any and a l l proposed ordinances o r resolutions f o r t h e
City, and amendments thereto;
(f) Prosecute on the behalf of t h e people such crfmfnal cases f o r
v i o l a t i o n 3 of t h i s Charter, of C i t y ordinances o r of misdemeanor of-
fenses a r i s i n g u@onv i o l a t i o n of t h e l a w s of t h e S t a t e a s i n his opin-
i o n o r that of t h e Chief of P o l i c e warrant h i s a t t e n t i o n ;
(g) Devote such time t o t h e d u t i e s of his o f f i c e as map be speci-
f i e d i n the ordinance fixing t h e compezisation f o r such off i c e ; and
(h) On vacating t h e o f f i c e surrender t o his successor a l l books,
papers, fil- and docwnents p e r t a i n i n g t o the C i t y ' s a f f a i r s .
Section 703, O f f i c e r s t o be Appointed bu t h e City Council. The City
Council shall appoint t h e City Manager, which p o s i t i o n shall not be in the
Czassified S e n i c e , and who may be removed by motion of the City Council
adopted by a t l e a s t t h r e e a f f i r m a t i v e votes.
It shall a l s o appoint and may remove, under the C i v i l ~ e r k c e

ions of this Charter, t h e City Controller, which position s h a l l be in t h e
C l a s s i f i e d Service.
Section 704. Other Appointfve Officers. In a d d i t i o n t o the o f f i c e r s
enumerated in the preceding section, t h e r e shall be the ocher appointive
o f f i c e r s enumerated in this Charter, who s h a l l be appointed by the City Man-
ager and who shall be t h e heads of t h e i r r e s p e c t i v e deparrsents,
The City Council may provide by ordinance f o r t h e c r e a t i o n o r abolish-
ment of o t h e r appointive o f f i c e r s or deparonents.
Section 705. Ciw Xanager. Xp~oinanent. Ths City ?lapager sball be choa-
en on t h e b a s i s of his executive and a d m i n i s t r a t i v e q u a l i f i c a t i o n s . H e s h % h
b e paid a s a l a r y commensurate with h i s r e s p o n s i b i l i t i e s a s c h i e f administra-
t i v e o f f i c e r of t h e C i t y . N City Councilman shall r e c e i v e such appointment

during t h e t e r n f o r which he shall have been e l e c t e d , nor within one y e a r
a f t e r t h e e x p i r a t i o n of his term.
Section 706. C i t y k n a g e t . Powers and Duties. The C i t y Manager shall b e
t h e chief = e c u t i v e o f f i c e r and t h e head of t h e a d m i n i s t r a t i v e branch of t h e
City government. He s h a l l be r e s p o n s i b l e t o t h e C i t y Council f o r t h e proper
a d m i n i s t r a t i o n of a l l a f f a i r s of t h e C i t y excepting such m a t t e r s f o r which
e l e c t i v e o f f i c e r s a r e made r e s p o n s i b l e by t h i s C h a r t e r , and he shall have
power and be required to:
(a) Appoint and remove, s u b j e c t t o t h e C i v i l S e r v i c e provisions of
t h i s C h a r t e r , a l l department heads of t h e C i t y , except e l e c t i v e o f f i c e r s
and t h o s e t h e power of appointment of whom iis vested i n t h e C i t y Council,
and pass upon and approve a l l proposed appointnents and removals of sub-
o r d i n a t e employees by department heads;
(b) Prepare t h e budget annually and submit i t t o t h e C i t y Council
and be r e s p o n s i b l e f o r its a d m i n i s t r a t i o n a f t e r adoption;
( c ) Prepare and submit t o t h e C i t y Council as of t h e end of t h e
f i s c a l year a complete r e p o r t on t h e f i n a n c e s and a d m i n i s t r a t i v e ac-
tivies of t h e C i t y f o r t h e preceding year;
( 6 ) Keep t h e City Council advised of t h e f i n a n c i a l c o n d i t i o n and
f u t u r e needs of t h e C i t y and make such recommendations a s may seem t o
him d e s i r a b l e ; and
( e ) Perform such o t h e r d u t i e s as aay be prescribed by t h i s Charter
o r r e q u i r e d of him by t h e C i t y Council, not i n c o n s i s t e n t wfth this C a -

S e c t i o n 707. C i t y ?iahaaer. Council Table. The C i t y ~Yanagers h a l l be
accorded a seat a t t h e C i t y Council t a b l e and shall be e n t i t l e d t o p a r t i c i -
pace i n t h e d e l i b e r a t i o n s of t h w i t y Council, but shall not have a vote.
S e c t i o n 708. C i t y C o n t r o l l e r . Powers and Duties. The City C o n t r o l l e r
shali have power and be required to:
( a ) Compile t h e budget expense and c a p i t a l estfmates f o r t h e C i t y
Xanager;
(b) SuperPise and be r e s p o n s i b l e f o r t h e disbursement of a l l monies
and have c o n t r o l wer a l l expenditures t o i n s u r e t h a t budget appropria-
t i o n s a r e n o t =ceeded;
(c) Maintain a g e n e r a l accounting system f o r t h e City government

Section 709. C i t y Engineer. Powers and Duties. To be e l i g i b l e f o r ap-
pointment as C i t y Engineer t h e appointee s h a l l be a Registered C i v i l Engi-
neer i n t h e S t a t e of California. The City Engineer shall have power and be
required t o :
(a) Supervise and be r e s p o n s i b l e f o r a l l City engineerins work;
(b) S u p e n b e and be r e s p o n s i b l e f o r t h e maintenance, properly

S e c t i o n 710. S t r e e t Superintendent. Powers and Duties. The S t r e e t Super-

S e c t i o n 1001. Appropriations. The.City Council shall i n c l u d e i n i t s
annual budget & f i c i e n t a p p r o p r i a t i o n s of funds f o r t h e e f f i c i e n t and
proper f u n c t i o n i a g of such boards and commissions.
S e c t i o n 1002. Apoointments. Terms. The members of each of such boards
o r commissious s h a l l be appointed, and s h a l l be s u b j e c t t o removal, by mo-
t i o n of t h e C i t y Council adopted by a t least f o u r a f f i r m a t i v e v o t e s . The
members thereof shall serve f o r a t e r n of f o u r y e a r s and u n t i l t h e i r respec-
t i v e s u c c e s s o r s a r e appointed and q u a l i f i e d .
The members f i r s t appointed t o such boards and commissions shall s o

t h e same are not i n c o n f l i c t with t h i s Charter.
Section 1305. I n i t i a t i v e , Referendum and Recall. There is hereby
resetved t o t h e e l e c t o r s of t h e City t h e powers of t h e i n i t i a t i v e , re-
ferendum and r e c a l l of municipal e l e c t i v e o f f i c e r s . The p r o v i s i o n s of

ARTICLE XIV
FLSCAL dDMINISTRATION
S e c t i o n 1400. F i s c a l Year. The f i s c a l year of t h e C i t y government
s h a l l begin on t h e f i r s t day of J u l y of each year and end on t h e t h i r -
t i e t h day of June of t h e following year.
Section 1401. Tax System. Unless o t h e r v i s e provided by ordinance,
t h e C i t y shall continue t o use, f o r t h e purpose of ad valorem municipal
t a z a t i o n , t h e c o m t y system of assessment and t a x c o l l e c t i o n , a s such
system is nov in e f f e c t o r m y h e r e a f t e r be amended and i n s o f a r as such
p r o v i s i o n s a r e not in c o n f l i c t with this Charter.
I f t h e City Council shall f a i l t o f i x t h e r a t e s and levy taxes on o r
b e f o r e August 31, in any year, t h e r a t e s f o r t h e n e s t preceding fiscal
y e a r shall thereupon be a u t o m a t i c a l l y adopted and a tax a t such rates
s U be deemed t o have been l e v f e d on all t a x a b l e property in t h e City
f o r t h e c u r r e n t f i s c a l year.
Section 1402. Tax Limits. Exclusive of s p e c i a l levies permitted by
t h i s Charter, t h e C i t y Council shall not levy a p r o p e r t y tax Fn excess
of One ($1.00) D o l l a r on each One Hundred ($100.00) D o l l a r s of t h e ass-
e s s e d v a l u e of a x a b l e property in t h e City f o r municipal purposes, un-
less authorized by t h e a f f i r m a t i v e v o t e s of two-thirds of t h e e l e c t o r s
v o t k g on such proposition a t any e l e c t i o n a t which t h e question of such --
a d d i t i o n a l levy f o r municipal purposes is submitted t o t h e e l e c t o r s .
There shall be levfed and c o l l e c t e d a t t h e time and i n t h e same
manner as o t h e r property t a x e s f o r municipal purposes a r e l e v i e d and eel-
l e c t e d , as a d d i t i o n a l taxes, i f no o t h e r provision f o r payment thereof
is made:
(a) A t a x s u f f i c i e n t t o meet a l l l i a b i l i t i e s of t h e C i t y f o r prin-
c i p a l and i n t e r e s t of a l l bonds o r judgments due and unpaid, o r t o
become due d u r i n g t h e ensuing f i s c a l year; and
(b) A t a x s u f f i c i e n t t o a e e t a l l o b l i g a t i o n s of t h e C i t y t o t h e
S t a t e Employees' Retirement System, f o r t h e r e t i r e m e n t of City Em-
ployees, due and unpaid o r t o become due dur-%ng t h e ensuing f i s c a l
year.
A s p e c i a l l e v y , in a d d i t i o n t o t h e above, may be made a n n u a l l y f o r
park, playground and r e c r e a t i o n purposes in an amount nor t o exceed twenty
(20c) c a t s on each One Hundred ($100.00) D o l l a r s or' t h e assessea v a l u e
on t a x a b l e property i n t h e City.
S p e c i a l l e v i e s , i n a d d i t i o n t o t h e above, may be made a n n u a l l y , f o r

h a s been o r may h e r e a f t e r be irrcurred f o r t h e purpose of a c q u i r i n g , es-
t a b l i s h i n g o r extending a system of water-works f o r t h e supplying of
w a t e r , o r f o r t h e purpose of c o n s t r u c t i n g severs o r d r a i n s in t h e City,
f o r which purposes a f u r t h e r indebtedness may be i n c u r r e d by t h e i s s u -
ance of bonds, s u b j e c t o n l y t o t h e p r o v i s i o n s of t h e S t a t e C o n s t i t u t i o n
and of this Charter.
S e c t i o n 1404. Annual Budget. P r e p a r a t i o n by t h e C i t y Manager. A t such-
d a t e a s h e s h a l l determine, t h e C i t y ' W a g e r , o r an o f f i c e r d e s i g n a t e d
by U, shall o b t a i n from each department head estimates of r e v s u e and
e x p e n d i t u r e f o r his department, d e t a i l e d in such manner as may be p r e -
s c r i b e d by t h e C i t y Nanager. I n p r e p a r i n g t h e proposed budget, t h e C i t y
Xanager shall review t h e estimates, shall hold c o n f e r e n c e s t h e r e o n with
t h e depa-nt heads, r e s p e c t i v e l y , and may r e v i s e t h e estimates as h e
may deem advisable.
S e c t i o n 1405. Budget. Submission t o C i t y Council. A t least t h i r t y -
f i v e (35) days p r i o r t o t h e beginning of each f i s c a l y e a r , t h e City M n a-
a g e r s h a l l submit t o t h e C i t y Council t h e proposed budget as prepared by
him. A f t e r reviewing same and making such r e d s i o n s a s it may deem ad-
v i s a b l e , t h e C i t y Council s h a l l d e t e r d n e t h e t i m e f o r t h e holding of
a p u b l i c h e a r i n g t h e r e o n and shall c a u s e t o be p u b l i s h e d a n o t i c e there-
of n o t less t h a n t e n (10) days p r i o r t o s a i d h e a r i x g by a t least one
i n s e r t i o n i n t h e o f f i c i a l newspaper.
Copies of t h e proposed budget s n a l l be a v a i l a b l e f o r i n s p e c t i o n by t h e
p u b l i c in t h e o f f i c e of t h e C i t y C l e r k a t least t e n days p r i o r t o s a i d
hearing.
S e c t i o n 1406. Budget. P u b l i c Bearing. A t t h e time s o a d v e r t i s e d , o r
a t any t i m e t o which such p u b l i c h e a r i n g s h a l l from time t o time be ad-
journed, t h e C i t y Council s h a l l hold a p u b l i c h e a r i n g on t h e proposed
budget a t which i n t e r e s t e d persons d e s i r i n g t o be heard s h a l l be given an
o p p o r t u n i t y t o do so.
S e c t i o n 1407. Budget. F u r t h e r C o a s i d e r a t i o n and Adoption. A f t e r t h e
c o n c l u s i o n of t h e p u b l i c h e a r i n g t h e C i t y Council s h a l l f u r t h e r c o n s i d e r
t h e proposed budget and make any r e v i s i o n s t h e r e o f t h a t i t may deem adv-
i s a b l e and on o r b e f o r e June 30, i t shall adopt t h e budget w f t h revis-
i o n s i f any, by t h e a f f i r m a t i v e v o t e s of a t least t h r e e members. Upon
f i n a l a d o p t i o n , t h e budget s h a l l b e i n e f f e c t f o r t h e ensuing f i s c a l
year. A copy t h e r e o f , c e r t i f i e d t o by t h e C i t y C l e r k , s h a l l be f i l e d
w i t h t h e C i t y C o n t r o l l e r and a f u r t h e r copy s h a l l be placed, and s h a l i
remain on f i l e , in t h e o f f i c e of t h e C i t y C l e r k where i t s h a l l b e a v a i l -
able f o r i n s p e c t i o n . The budget so c e r t i f i e d shall be reproduced and
' c o p i e s made a v a i l a b l e f o r t h e use of o f f i c e r s , departments and agencies
of t h e C i t y .
S e c t i o n 1408. Budget X ~ n r o p r i a t i o n s . From t h e e f f e c t i v e d a t e of t h e
budget, t h e s e v e r a l amounts s t a t e d t h e r e i n as proposed e x p e n d i t u r e s
s h a l l b e and become a p p r o p r i a t e d t o t h e s e v e r a l departments, o f f i c e s and
a g e n c i e s f o r t h e r e s p e c t i v e o b j e c t s and purposes t h e r e i n named. A l l ap-
p r o p r i a t i o n s s h a l l l a p s e a t t h e end of t h e f i s c a l y e a r t o t h e e x t e n t
t h + t t h e y s h a l l n o t have been expended o r l a w f u l l y encumbered.
A t any meeting a f t e r t h e adopt?on of t h e budget, t h e C i t y Council
map amend o r supplement t h e budget by motion adopted by t h e a f f i r m a t i v e
votes of a t least f o u r members s o as t o a u t h o r i z e t h e t r a n s f e r of un-
used b a l a n c e s a p p r o p r i a t e d f o r one purpose t o a n o t h e r purpose, o r t o
a p p r o p r i a t e a v a i l a b l e revenue n o t i n c l u d e d in t h e budget.
S e c t i o n 1409. C o n t r a c t s on P u b l i c IJorks. Every c o n t r a c t h v o l a g
an e x p e n d i t u r e of more t h a n Seven Thousand F i v e Hundred ($7,50,0.00) Dol-
lars f o r t h e c o n s t r u c t i o n o r improvement (excluding maintenance and re-
p a i r ) of p u b l i c b u i l d i n g s , works, streets, d r a i n s , sewers, u t i l i t i e s ,
p a r k s and playgrounds s h a l l b e l e t t o t h e lowest r e s p o n s i b l e b i d d e r

c h a s i n g system f o r a l i C i t y departments and agencies. The Ci:p ?fanager
s h a l l recommend and t h e C i t y Council s h a l l c o n s i d e r and adopt by ordinance
r u l e s and r e g u l a t i o n s governing t h e c o n t r a c t i n g f o r , purchasing, s t o r -
i n g , d i s t r i b u t i o n o r d i s p o s a l of all s u p p l i e s , m a t e r i a l s and equipment
r e q u i r e d by any o f f i c e , department o r agency of t h e C i t y government.
S e c t i o n 1411. Coumeritive Biddinq. Before making purchases o f , o r
c o n t r a c t s f o r , s u p p l i e s , materials o r equipment, ample o p p o r t u n i t y s h a l l
b e given f o r competitive bidding, under such rules and r e g u l a t i o n s and
w i t h such e x c e p t i o n s as t h e C i t y Council may p r e s c r i b e i n t h e ordinance
s e t t i n g up such r u l e s and r e g u l a t i o n s . When making purchases f o r t h e
C L t 7 , l o c a l merchants shall be given t h e p r e f e r e n c e , q u a l i t y and p r i c e s
being equal.
S e c t i o n 1412. Cash Basis Fund. Deleted from C i t y Charter June 30, 1969.
S e c t i o n 1413. P u b l i c S e n i c e Departments' Deoreciation Fands. The
C i t y Couucil s h a l l a n n u a l l y set a s i d e from t h e income derived from its
revenue producing p u b l i c u t i l i t i e s , as a s e p a r a t e d e p r e c i a t i o n fund f o r
each of s a i d p u b l i c u t i l i t i e s , a sum which, according t o t h e e s t i m a t e of
t h e C i t y Manager, and approved by t h e C i t y Council, s h a l l be s u f f i c i e n t t o
aeet t h e normal d e p r e c i a t i o n in s a i d p u b l i c u t i l i t y . Such d e p r e c i a t i o n
funds s h a l l be used only f o r t h e replacement, b e t t e r s e n t , and e x t s n s i o n of
t h e p l a n t s and equipment of s a i d p u b l i c u t i l i t i e s , r e s p e c t i v e l y .
S e c t i o n 1414. C a p i t a l Outlays Funds. A fund f o r c a p i t a l o u t l a y s , gen-
e r a l l y . is herebv c r e a t e d , t o be known a s t h e "Capital Outlays Fund."
The city c o u n c i l - by ordinance may c r e a t e a s p e c i a l fund o r funds f o r a
s p e c i a l c a p i t a l o u t l a y purpose. The C i t y Council may l e v y and c o l l e c t
t a x e s f o r c a p i t a l o u t l a y s and may i n c l u d e i n t h e annual t a x l e v y a l e v y
f o r such purposes in which event i t must a p p o r t i o n and a p p r o p r i a t e t o

S e c t i o n 1415. Departmental T r u s t Fund. The C i t y Council may pre-
s c r i b e by ordinance f o r t h e s e t t i n g up of a " T r e a s u r e r ' s Departmental
T r u s t Fund" i n t o which t h e c o l l e c t z o n of t h e p o l i c e department, s t r e e t
department, b u i l d i n g o f f i c i a l , e t c . , may be deposited d a i l y by t h e r e s -
p e c t i v e o f f i c e r s w i t h t h e C i t y Treasurer. Withdrawls from such fund may
be made by t h e T r e a s u r e r only on o r d e r signed by t h e proper department
head and f o r t h e f o l l a r f n g purposes only:
( a ) The making of refund of b a i l which has been exonerated o r of
o t h e r refundable d e p o s i t s ;
(b) The making of s e t t l e m e n t s w i t h C i t y funds a t t h e end of each
c a l e n d a r month f o r c o l l e c t i o n s acctnuulated d u r i n g t h e month.
P e t t v Cash Funds, The C i t y Council may provide f o r revolving p e t r p
cash funds, t o be p a i d t o t h e City Manager o r department heads and used
f o r payment i n cash of e x p e n d i t u r e s provided f o r i n t h e budgets t h a t can-
n o t c o n v e n i e n t l y be p a i d otherwise. The Cfty Manager of such o t h e r de-
partment heads shall account t o t h e C f t y Council f o r a l l disbursements
made therefrom when making demand f o r replenishment of t h e same and a t
such o t h e r t i m e s a s t h e Council may r e q u i r e and t h e amounts of such d i s -
bursemencs s h a l l thereupon be charged a g a i n s t t h e proper a p p r o p r i a t i o n s .
S e c t i o n 1416. P r e s e n t a t i o n of Demands. Each demand a g a i n s t t h e C i t y
s h a l l be presented t o t h e C i t y C o a c r o l l e r , who shall examine t h e same.
If t h e amount thereof is l e g a l l y due aud t h e r e remains on his books an
unexhausted balance o r an a p p r o p r i a t i o n a g a i n s t which t h e same may be
charged, he shall approve such demand and draw his warrant on t h e C i t y
T r e a s u r e r t h e r q f o r , payable o u t of t h e proper fund. Objections of t h e
C o n t r o l l e r may be o v e d e d by t h e C i t y Council and t h e warrant ordered
drawn, - - - --
The C i t y C o n t r o l l e r shall t r a n s m i t such demand w i t h his approval o r
r e j e c t i o n t h e r e o f endorsed t h e r e o n and warrant, i f any, t o t h e Cfty
Manager. I f a demand is one f o r v h i c h an a p p r o p r i a t i o n has been made, i t
s h a l l r e q u i r e t h e approval of t h e C i t y Manager. A demand f o r which no
a p p r o p r i a t i o n has been made, s h a l l r e q u i r e t h e approval of t h e C i t y Council.

Any person d i s s a t i s f i e d w i t h t h e r e f u s a l of t h e C i t y Xanager t o ap-
prove any demand, in whole o r i n p a r t , may p r e s e n t t h e same t o t h e C i t y
Council, which, a f t e r examining i n t o t h e m a t t e r may approve o r disapprove
t h e demand i n whole o r in p a r t .
A t e v e r y r e g u l a r meeting of t h e C i t y Council, t h e C i t y tlanager shall
f u r n i s h t h e C i t y Council w i t h a list of a l l demands approved by him since
t h e d a t e of t h e preceding r e g u l a r meeting.
S e c t i o n 1417. g a r r a n t s on Treasury. A f t e r a ~ p r o v a lby t h e C i t y Mana-
g e r , o r C i t y Council, as t h e c a s e may be, t h e warrant i n payment thereof
as prepared, by t h e C i t y C o n t r o l l e r , s h a l l be presented t o t h e C i t y Treas-
u r e r and s h a l l be paid by him o u t of t h e funds d e s i g n a t e d , i f t h e r e be
s u f f i c i e n t money i n t h e f i n d f o r t h a t purpose. A warrant n o t paid f o r
l a c k of funds s h a l l be r e g i s t e r e d , and a l l r a g i s t e r e d w a r r a n t s s h a l l be
p a i d i n t h e o r d e r of t h e i r r e g i s t r a t i o n when funds t h e r e f o r a r e a v a i l a b l e .
I n t h e payment of municipal o r o t h e r bonds upon p r e s e n t a t i o n and

S e c t i o n 1418. Actions Against City. N suit s h a l l be brought on any

t k e beginning of each f i s c a l y e a r , a q u a l i f i e d accountant who, a t such
tine o r times as may be s p e c i f i e d by t h e C i t y Council, shall examine t h e
books, r e c o r d s , i n v e n t o r i e s and r e p o r t s of dl o f f i c e r s and employees vno
r e c e i v e . handle o r d i s b u r s e p u b l i c funds and of such o t h e r o f f i c e r s , em-
ployees o r deparrments a s t h e C i t y Council may d i r e c t . A t t h e end of t h e
y e a r , a f i n a l a u d i t and r e p o r t shall be submitted by such accountant t o
t h e C i t y Council, one copy t h e r e o f t o be d i s t r i b u t e d t o each member, one
t o t h e C i t y Manager, C i t y C o n t r o l l e r , C i t y T r e a s u r e r , and C i t y Attorney,
r e s p e c t i v e l y , and t h r e e a d d i t i o n a l c o p i e s t o be placed on f i l e in t h e
o f f i c e of t h e C i t y Clerk where t h e y shall be a v a i l a b l e f o r i n s p e c t i o n by

o r p l a c e s f o r t h e o p e r a t i o n of p l a n t s , works, o r equipment f o r t h e f u r n i s h i n g

v a l i d and e x i s t i n g franchise. The City Council is enpowered t o g r a n t such
f r a n c h i s e t o any such person, firm o r corporation, whether operating under
an e t ~ i s t i n gf r a n c h i s e o r not. The C i t y Council may p r e s c r i b e t h e terms and
c o n d i t i o n s af any such g r a n t . It may a l s o provide, by procedural ordinance,
t h e method of procedure and a d d i t i o n a l terms and c o n d i t i o a s f o r making such
g r a n t s , s u b j e c t t o t h e p r o v i s i o n s of t h i s Charter.
Section 1502. Resolution of I n t e n t i o n . Notice and Public Hearinq. Before
g r a n t i n g any f r a n c h i s e , t h e C i t y Council s h a l l pass a r e s o l u t i o n d e c l a r i n g
its i n t e n t i o n t o g r a n t t h e same, s t a t i n g t h e name of t h e proposed grantee,
t h e c h a r a c t e r of t h e f r a n c h i s e and t h e terms and c o n d i t i o n s u?on which i t is
proposed t o be granted. Such r e s o l u t i o n s h a l l f f x and set f o r t h t h e day,
hour and p l a c e when and where any persons having any i n t e r e s t t h e r e i n o r any
o b j e c t i o n t o t h e g r a n t i n g thereof may appear b e f o r e t h e City Council and be
heard thereon. It shall d i r e c t t h e City C l e r k t o p u b l i s h s a i d r e s o l u t i o n
a t Least once, within f i f t e e n (15) days of t h e passage t h e r e o f , i n t h e
off icial newspaper. Said n o t i c e shall be published a t least t e n (10) days
p r i o r t o t h e date of hearing.
A t t h e time set f o r the hearing t h e C i t y Council shall proceed t o near
and pass upon a l l p r o t e s t s and its d e c i s i o n thereon s h a l l be f i n a l and con-
c l u s i v e . Thereafter, i t may grant, o r deny, t h e f r a n c h i s e , s u b j e c t t o t h e
r i g h t of referendum of t h e people.
S e c t i o n 1503. Tenn of Franchise. Every f r a n c h i s e s h a l l s t a t e t h e term
f o r which i t is granted, which, u n l e s s i t be indeterminate as provided f o r
herein, shall not exceed twenty-f i v e (25) y e a r s .
A f r a n c h i s e g r a n t may be indeterminate, t h a t is t o say, it may provide
t h a t i t shall endure i f u l l f o r c e and e f f e c t u n t i l t h e same, w i t h t h e con-

sent of t h e P u b l i c U t i l i t i e s Commission of t h e S t a t e of C a l i f o r n i a , shall be
v o l u n t a r i l y surrendered o r abandoned by i t s possessor, o r u n t i l t h e S t a t e of
C a l i f o r n i a , o r s&e municipal o r p u b l i c c o r p o r a t i o n , thereunto duly author-
ized by l a w , s h a l l purchase by v o l u n t a r y agreement o r s h a l l condemn and take,
under t h e power of eminent domain, all property a c t u a l l y used and u s e f u l i n
t h e e x e r c i s e of such f r a n c h i s e and s i t u a t e w i t h i n t h e t e r r i t o r i a l limits of
t h e S t a t e , municipal o r p u b l i c c o r p o r a t i o n purchasing o r condemning such pro-
p e r t y , o r u n t i l t h e f r a n c h i s e s h a l l be f o r f e i t e d f o r noncontplfance with its
terms by t h e possessor thereof.
Section 1504. Grant t o be in Lieu of A l l Other Franchises. Any fran-
c h i s e granted by t h e C i t y with r e s p e c t t o any given u t i l i t y s e r P i c e s h a l l be
i n l i e u of a l l o t h e r f r a n c h i s e s , r i g h t s o r p r i v i l e g e s owned by t h e g r a n t e e ,
or by an? successor of the granree t o any r i g h t under such f r a n c h i s e , f o r
t h e rendering of such u t i l i t y s e m i c e w i t h i n t h e limits of t h e C i t y as they
now o r may h e r e a f t e r exist, except any f r a n c h i s e derived under Section 19 of
A r t i c l e X I of t h e Consti:ution of C a l i f o r n i a as s a i d s e c t i o n e x i s t e d p r i o r
t o t h e amendment thereof adopted October 10, 1911. The acceptance of any
f r a n c h i s e hereunder, s h a l l o p e r a t e a s an abandonment of a l l such f r a n c h i s e s ,
t i g h t s and pr5vileges wirhin t h e limits of t h e City a s such l h i t s shall a t
any time exist, in l i e u of which such f r a n c h i s e s h a l l be granted.
Any f r a n c h i s e granted hereunder s h a l l not become e f f e c t i v e u n t i l w r i t -
t e n acceptance thereof s ' d l have been f i l e d by t h e g r a n t e e thereof with t h e
C i t y Clerk. Such acceptance shall be f i l e d w i t - t e n days a f t e r t h e adop-
t i o n of t h e ordinance g r a n t i n g t h e f r a n c h i s e o r any excension thereof granted
by t h e City Council and when s o f i l e d , such acceptance shall c o n s t i t u t e a
continuing agreement of such g r a n t e e t h a t if and when t h e City s h a l l there-
after annex, o r c o n s o l i d a t e with, a d d i t i o n a l t e r r i t o r y , any and a l l f r a n c h i s e s ,
r i g h t s and p r i v i l e g e s owned by t h e g r a n t e e t h e r e i n , except a f r a n c h i s e d e r i v e d
under s a i d c o n s t i t u t i o n a l provision, s h a l l likewise be deemed t o be abandoned
w i t h i n t h e limits of such t e r r i t o r y .
S e c t i o n 1505. Eminent Domain. N f r a n c h i s e g r a n t s h a l l in any way o r t o
o
any e x t e n t impair o r a f f e c t t h e r i g h t of t h e C i t y t o a c q u i r e t h e p r o p e r t y or'
t h e grantee thereof e i t h e r by purchase o r through t h e e x e r c i s e of t h e r i g h t
of antnent domain, and nothing h e r e i n contained shall b e construed t o con-
tract away o r t o modify o r t o abridge e i t h e r f o r a term or i n p e r p e t u i t y t h e
C i t y ' s r i g h t of emfnent domain w i t h r e s p e c t t o any p u b l i c u t i l i t y . Every
f r a n c h i s e g r a n t s h a l l r e s e n r e t o t h e C i t y t h e r i g h t t o purchase t h e property
of such u t i l i t y e i t h e r a t an agreed p r i c e or a p r i c e t o be determined in a
manner t o be prescrf5ed in t h e g r a n t , o r i n t h e procedural ordinance herein-
above mentioned. In f i x i n g t h e p r i c e t o be paid by t h e City f o r any u t i l i t y ,
no allowance s h a l l be s a d e f o r f r a n c h i s e v a l u e ( o t h e r than t h e a c t u a l amount
paid t o t h e C i t y a t t h e time of t h e f r a n c h i s e a c q u i s i t i o n ) , good w i l l , going
c m c e r n , earning power, increased c o s t of re?roducrion, severance damage, o r
increased v a l u e of r i g h t of way.
S e c t i o n 1506. Duties of Grantees. By its acceptance of any f r a n c h i s e
hereunder, t h e g r a n t e e shall covenant and a g r e e t o perform and be bound by
each and a l l of t h e terms and c o n d i t i o n s imposed i n t h e g r a n t , o r by proce-
dural ordfnance and s h a l l f u r t h e r a g r e e t o :
(a) Comply v i t h a l l l a w f u l ordinances, Rlles and r e g u l a t i o n s there-
t o f o r e o r t h e r e a f t e r adopted by t h e C i t y Council i n the e x e r c i s e of its
p o l i c e power governing t h e c o n s t r u c t i o n , maintenance and o p e r a t i o n of
its p l a n t s , works o r equipment;
(b) pa$ t o t h e C i t y on demand t h e c o s t of a l l r e p a i r s t o p u b l i c
- property made necessary by any of t h e o p e r a t i o n s of t h e g r a n t e e under
such f r a n c h i s e ;
(c) Indemnify and hold harmless t h e C i t y and its o f f i c e r s from any
and a l l l i a b i l i t y f o r damages proximately r e s u l t i n g f r w any o p e r a t i o n s
under such f r a n c h i s e ;
(d) Remove and r e l o c a t e without expense t o the City any f a c i l i -
ties i n s t a l l e d , used and maintained under t h e f r a n c h i s e if and when
made necessary by any l a w f u l change of grade, alignment o r width of
any p u b l i c s t r e e t , way, a l l e y o r place, including t h e construction of
any subway o r viaduct; and
( e l Pay t o t h e C i t y during t h e l f f e of t h e f r a n c h i s e a percent-
age, t o be s p e c i f i e d in t h e g r a n t , of t h e g r o s s annual r e c e i p t s of
t h e g r a n t e e w i t h i n t h e limits of t h e Cfty, o r such o t h e r compensation
as t h e City Council may p r e s c r i b e in t h e grant.
Section 1507. Exzrcisfng Rights Without Franchise. The e x e r c i s e by
any person, f i r m o r corporation of any p r i v i l e g e f o r which a f r a n c h i s e is
r e q u i r e d , without possessing a v a l i d and e x i s t i n g f r a n c h i s e t h e r e f o r ,
shall be a sisdemeanor and shall be punished i n t h e same manner as v i o l a -
t i o n s of this Charter a r e punishable and each day t h a t such condition
continues t o exist shall c o n s t i t u t e a s e p a r a t e v i o l a t i o n .
mLOYEES ' RETIREMENT SYSTEK
S e c t i o n 1600. Employees' Retirement Spstem. The S t a t e Employees'
Retfrement Law as now e x i s t i n g and as h e r e a f t e r amended, is hereby adopted
f o r tAe C i t y of Compton t o t h e end t h a t t h e retirement system f o r t h e
employees of s a i d C i t y h e r e t o f o r e c r e a t e d , pursuant t o v o t e of t h e people
is hereby continued i n f u l l f o r c e and e f f e c t and plenary a u t h o r i t y and
power i s hereby v e s t e d in s a i d C f t y , its Council and its s e v e r a l o f f i c e r s ,
a g e n t s and employees t o do and perform every a c t and e x e r c i s e every power
g r a n t e d , pexmitted o r required in accordance w i t h t h e provisions of s a i d
S t a t e Employees' Retirement Law t o continue t h e p a r t i c i p a t i o n by t h e C i t y
of Compton in t h e S t a t e Employeest Retirement System as a c o n t r a c t member
thereof.
S e c t i o n 1601. Retirement Contract. The c o n t r a c t h e r e t o f o r e entered
i n t o w i t h t h e Board of A d m i d s t r a t i o n of t h e S t a t e Employees' Retirement
System may be terminated by t h e C i r y only under a u t h o r i t y granted by
ordinance adopted by a m a j o r i t y v o t e of t h e e l e c t o r s of t h e City of Compton.
S e c t i o n 1700. D e f i n i t i o n s . Unless t h e p r o v i s i o n o r the context other-
wise r e q u i r e s , a s used i n this Charter:

S e c t i o n 1701. S t a t e of Extreme Emerzency. During t h e e x i s t e n c e of any
n a t i o n a l o r l o c a l emergency c r e a t e d by military a t t a c k o r sabotage, o r i n
t h e providing f o r adequate n a t i o n a l o r l o c a l defense, o r uDon t h e occasion
of a g r e a t p u b l i c calamity, such a s an e x t r a o r d i n a r y f i r e , flood, storm,
epidemic, earthquake, o r o t h e r d i s a s t e r , t h e C i t y Hanager is hereby author-
i z e d t o t a k e such a c t i o n a s is deemed by him necessary to safeguard l e e ,
h e a l t h o r property notwithstanding any o t h e r p r o v i s i o n of this Charter.
Durixg t h e e x i s t e n c e of any such emergency t h e r e s p o n s i b l e c i t y o f f i c e r
may comply w i t f i any la#-ul f e d e r a l o r state law, o r d e r o r r e g u l a t i o n ,
notwithstanding any c o n f l i c t which may exist between such law, o r d e r o r
r e g u l a r i o n and t h e provisions of this Charter, in safeguarding l i f e ,
h e a l t h o r property i n t h e City. A t t h e f i r s t meeting of t h e C i t y Council
Following t h e connnencement of any such emergency, o r t h e taking OF any
a c t i o n under this s e c t i o n , t h e C i t y Council shall review t h e s i t u a t i o n and
i t s f i n d i n g s as t o t h e e x i s t e n c e of such anergency o r t h e need f o r any
f u r t h e r a c t i o n of an emergency n a t u r e and c o n t r a r y t o any j r o v i s i o n of
t h i s Charter, s h a l l b e f i n a l and conclusive. L
Section 1702. Violations. The v i o l a t i o n of any provision of t h i s
C h a r t e r shall be deemed a misdemeanor and be punishable upon c o n v i c t i o n
by a f i n e of n o t exceeding One Thousand ($1,000) D o l l a r s o r by imprison-
ment f o r a term of not exceeding one year o r by both such f i n e and in-
prisomnent .
Section 1703. V a l i d i t y . If any p r o v i s i o n of t h i s Charter, o r t h e
a p p l i c a t i o n thereof t o any person o r circumstance is held i n v a l i d , t h e
remainder of t h e Charter, and t h e a p p l i c a t i o n of such provision t o o t h e r
persons o r circumstances, s h a l l n o t be a f f e c t e d thereby.
