11   TO AMEND ACT 340 OF 1967, AS AMENDED, ACT 924 OF
12   1970, AS AMENDED, ACT 245 OF 1979, AS AMENDED, ACT
13   523 OF 1982, AND ACT 580 OF 1984, ALL RELATING TO
14   THE CONSTITUENT SCHOOL DISTRICT BOARDS OF
15   TRUSTEES IN CHARLESTON COUNTY, SO AS TO
16   PROVIDE THAT MEMBERS OF THE CONSTITUENT
17   SCHOOL DISTRICT BOARDS OF TRUSTEES MUST BE
18   APPOINTED BY THE CHARLESTON COUNTY SCHOOL
19   DISTRICT BOARD OF TRUSTEES; TO PROVIDE THAT
20   MEMBERS SERVING ON THE CONSTITUENT SCHOOL
21   DISTRICT BOARDS OF TRUSTEES AS OF THE EFFECTIVE
22   DATE OF THIS ACT SHALL CONTINUE TO SERVE UNTIL
23   THEIR TERMS END AND UNTIL THEIR SUCCESSORS ARE
24   APPOINTED BY THE CHARLESTON COUNTY SCHOOL
25   DISTRICT BOARD OF TRUSTEES; AND TO REPEAL ACT
26   397 OF 1973 AND SECTION 2 OF ACT 231 OF 1983, BOTH
27   RELATING TO ELECTION OF MEMBERS OF THE
28   CONSTITUENT SCHOOL DISTRICT BOARDS OF TRUSTEES
29   IN CHARLESTON COUNTY.

31   Be it enacted by the General Assembly of the State of South
32   Carolina:
33
34   SECTION 1. Section 1A of Act 340 of 1967, as last amended by
35   Act 373 of 2008, is further amended to read:
36
37      “Section 1A. Candidates forMembers of the constituent school
38   district board of trustees shall file with the county election
39   commission not later than twelve o’clock noon on August fifteenth
40   or, if August fifteenth falls on Saturday or Sunday, not later than
41   twelve o’clock noon of the following Monday of each election
42   year. Candidates who filed must be placed upon the ballot in the

 1   general election without any party designation and in alphabetical
 2   ordermust be appointed by the Charleston County School District
 3   Board of Trustees.”

 5   SECTION 2. Section 1 of Act 924 of 1970, as last amended by
 6   Act 585 of 1980, is further amended to read:
 7
 8      “Section 1. St. Paul’s Constituent School District No. 23 in
 9   Charleston County (which was created by the consolidation of
10   Edisto Island School District No. 13, Adams Run School District
11   No. 19, Yonge’s Island School District No. 15, Rantowles School
12   District No. 22, Ravenel School District No. 17, and Collins
13   School District No. 18, in the county, by action of the county board
14   of education of Charleston County) shall must be composed of
15   seven constituent school trustees. The trustees shall be elected in
16   the general elections must be appointed by the Charleston County
17   School District Board of Trustees for terms of four years and until
18   their successors are elected and qualified; provided, that of those
19   six trustees who shall be elected in the 1980 general election, the
20   three receiving the lower number of votes shall serve for terms of
21   three years, after which all trustees shall serve for terms of four
22   years.”

24   SECTION 3. Section 1 of Act 245 of 1979, as last amended by
25   Act 231 of 1983, is further amended to read:
26
27      “Section 1. In addition to the three members of the Board of
28   Trustees of Cooper River School District 4 in Charleston County
29   provided for in Section 9 of Act 12 of 1939, four members shall
30   must be elected appointed by the Charleston County School
31   District Board of Trustees as trustees of the constituent school
32   district, one from each of the three areas referred to in the act and
33   one from the district at large. The additional member of the board
34   of trustees of the school district who represents the North
35   Charleston area shall serve on the Cooper River Parks and
36   Playground Commission and the other three may not serve on the
37   commission. Members of the board of trustees of the school
38   district shall serve for terms of four years and until their successors
39   are elected and qualify appointed. The additional member of the
40   Board of Trustees of Cooper River School District 4 in Charleston
41   County, who represents the district at large, also must be appointed
42   by the Charleston County School District Board of Trustees.”

 1   SECTION 4. Section 1 of Act 523 of 1982 is amended to read:

 3      “Section 1. Notwithstanding the provisions of Act 397 of 1973,
 4   of Those school trustees in School District No. 20 in Charleston
 5   County elected in the general election of 1982, the four receiving
 6   the greatest number of votes shall serve for a term of four years
 7   and the three receiving the next greatest number of votes shall
 8   serve for a term of two years must be appointed by the Charleston
 9   County School District Board of Trustees. Notwithstanding the
10   provisions of Act 397 of 1973, The school trustees in School
11   District No. 23 of Charleston County elected in the general
12   election of 1984, the three in the district receiving the greatest
13   number of votes shall serve for a term of four years and the three
14   in the district receiving the next greatest number of votes shall
15   serve for a term of two years must be appointed by the Charleston
16   County School District Board of Trustees.”

18   SECTION 5. Section 1 of Act 580 of 1984 is amended to read:
19
20      “Section 1. In addition to the three members of the Board of
21   Trustees of St. Andrews (Constituent) School District Number 10
22   in Charleston County, two members must be appointed as trustees
23   of the school district by a majority of the Charleston County
24   Legislative Delegation School District Board of Trustees, both at
25   large from the territorial area comprising the school district. One of
26   the two additional members shall serve until his successor is
27   elected in the general election of 1986 and qualifies for office, and
28   the other shall serve until his successor is elected in the general
29   election of 1988 and qualifies for office. Beginning in 2008,
30   members of the Board of Trustees of the St. Andrews (constituent)
31   School District Number 10 must be appointed by the Charleston
32   County School District Board of Trustees. All successors to the
33   two additional members of the board of trustees of the school
34   district shall serve for terms of four years, with terms commencing
35   on the first day of January following election appointment and
36   ending on the thirty-first day of December, and until their
37   successors are elected and qualify appointed. All successors to the
38   two additional members of the board of trustees of the school
39   district must be elected in the same manner and under the same
40   terms, and shall also meet the same qualifications and
41   requirements for election and for holding office, as provided by
42   law for the other trustees of the school district and must be elected
43   at large from the territorial area comprising the district.”

 2   SECTION 6. Members serving on the constituent school district
 3   boards of trustees as of the effective date of this act shall continue
 4   to serve until their terms end and their successors are appointed by
 5   the Charleston County School District Board of Trustees.

 7   SECTION 7. Act 397 of 1973 and Section 2 of Act 231 of 1983
 8   are repealed.

10   SECTION 8. This act takes effect upon approval by the Governor.
