Completed applications are to be mailed to the Winter Recreation Program and postmarked no later than
June 1, 2012. Late applications will not be considered. State Parks will not be responsible for ensuring
your application is received by the due date. Applications missing required signatures and/or attachments
may be deemed incomplete, and may not be considered for funding.
Applications meeting all requirements will receive confirmation by July 2, 2012

The Advisory Committees will meet to review the applications and evaluate the availability of funds for
each project. They may wish to ask specific questions of an applicant during this meeting; however, no
verbal presentations will be scheduled. Applicants will be notified of funding results at a later time.

Washington State Parks and Recreation Commission is hereby requested to consider this application for motorized or non-motorized
winter recreation project funding assistance as described herein and to approve funding from such state sources as may be available.
The Applicant:
1. Agrees to cooperate with the Washington State Parks and Recreation Commission (Commission) by thoroughly completing this
application including submitting the required signatures/documents as requested in the application.
2. Understands that allocation and disbursement of funds from the non-motorized program accounts of the state general fund is
governed by 79A.05 RCW.
3. Is aware that project funding assistance will be paid on a reimbursement basis except as otherwise approved by the Commission.
4. Private entities that intend to provide the services described in this application -- understand that if funding is approved, it will be
necessary for the Commission to execute a project contract, and we are prepared to help carryout/undertake all of the obligations
outlined in the project contract. However, also understands that if funding is approved, it may be necessary for the Commission to
contract with a contractor.
5. Agrees to return or replace in-kind losses if, by our actions, the project is cancelled or not completed in a timely manner.
6. Agrees that the project will be open to the public at no charge.
7. Private entities that intend to provide the services described in this application – agree to maintain accurate accounting records and
agrees that all such records will be available upon request.
8. Understands that all projects will be subject to on-site inspections to maintain a high standard of maintenance including trail signing
and grooming and that failure to maintain such standards will be cause for termination of the project.

and Recreation Commission to provide winter recreational services on land which
this project will occur. The landowners must include approval of each groomed trail
route and verification of the number of miles of groomed trails. Each landowner must
complete the Winter Recreation Use Permit (see pages 8 and 9). This must be
submitted with the funding application by the due date.

WINTER RECREATION USE PERMIT
WA State Parks and Recreation Commission is required by statute to have landowner permission for winter
recreation activities funded by the Commission on public and private lands.
RCW 79A.05.225(1) Plan, construct, and maintain suitable facilities for winter recreational activities on lands
administered or acquired by the commission or as authorized on lands administered by other public agencies or
private landowners by agreement.
RCW 4.24.200 and RCW 4.24.210 limit landowner liability.
RCW 4.24.200:
The purpose of RCW 4.24.200 and 4.24.210 is to encourage owners or others in lawful possession and control
of land and water areas or channels to make them available to the public for recreational purposes by limiting
their liability toward persons entering thereon and toward persons who may be injured or otherwise damaged
by the acts or omissions of persons entering thereon.

Liability of owners or others in possession of land and water areas for injuries to recreation users — Limitation.
(1) Except as otherwise provided in subsection (3) or (4) of this section, any public or private landowners or others in
lawful possession and control of any lands whether designated resource, rural, or urban, or water areas or channels and
lands adjacent to such areas or channels, who allow members of the public to use them for the purposes of outdoor
recreation, which term includes, but is not limited to, the cutting, gathering, and removing of firewood by private persons
for their personal use without purchasing the firewood from the landowner, hunting, fishing, camping, picnicking,
swimming, hiking, bicycling, skateboarding or other non-motorized wheel-based activities, hang gliding, paragliding,
rock climbing, the riding of horses or other animals, clam digging, pleasure driving of off-road vehicles, snowmobiles,
and other vehicles, boating, nature study, winter or water sports, viewing or enjoying historical, archaeological, scenic, or
scientific sites, without charging a fee of any kind there for, shall not be liable for unintentional injuries to such users.
(2) Except as otherwise provided in subsection (3) or (4) of this section, any public or private landowner or others in
lawful possession and control of any lands whether rural or urban, or water areas or channels and lands adjacent to such
areas or channels, who offer or allow such land to be used for purposes of a fish or wildlife cooperative project, or allow
access to such land for cleanup of litter or other solid waste, shall not be liable for unintentional injuries to any volunteer
group or to any other users.
(3) Any public or private landowner, or others in lawful possession and control of the land, may charge an administrative
fee of up to twenty-five dollars for the cutting, gathering, and removing of firewood from the land.
(4) Nothing in this section shall prevent the liability of a landowner or others in lawful possession and control for injuries
sustained to users by reason of a known dangerous artificial latent condition for which warning signs have not been
conspicuously posted. A fixed anchor used in rock climbing and put in place by someone other than a landowner is not a
known dangerous artificial latent condition and a landowner under subsection (1) of this section shall not be liable for
unintentional injuries resulting from the condition or use of such an anchor. Nothing in RCW 4.24.200 and 4.24.210
limits or expands in any way the doctrine of attractive nuisance. Usage by members of the public, volunteer groups, or
other users is permissive and does not support any claim of adverse possession.
(5) For purposes of this section, a license or permit issued for statewide use under authority of chapter 79A.05 RCW or
Title 77 RCW is not a fee.
