                     BOARD OF EDUCATION REGULAR MEETING

                                         MINUTES



        The Board of Education of the Fontana Unified School District held a     Minutes
Regular Meeting on July 10, 2002, at the John D. Piazza Education Center,        Approved
9680 Citrus Avenue, Fontana, California. Present at the meeting were: Ms.        7/10/02
Laura Abernathy Mancha, President; Dr. D. Wayne Ruble, Clerk; Mrs. Kathy
Binks, Member; Mr. Gus Hawthorn, Member (arrived after the work session);
Mr. Rick McClure, Member; Dr. Karen Harshman, Superintendent; Mr.
Emmanuel J. D’Souza, Associate Superintendent, Business; and Dr. Patricia
Peoples, Associate Superintendent, Human Resources. Ms. Fran Mazzolini,
Associate Superintendent, Educational Services, was absent. The President
called the meeting to order at 3:00 p.m.



       The President called to order a work session with presentations made by   Interest
Mr. Bill Haney regarding Interest-Based Bargaining. This work session was        Based
conducted in the Building #1 Conference Room at 9680 Citrus Avenue.              Bargaining

       Representatives of the bargaining teams of the Fontana Teachers           Session
Association, United Steelworkers of America, Local 8599 and district
administration were present.

       The work session adjourned at 4:00 p.m.



        The President called a Closed Session at 4:01 p.m. (Mr. Hawthorn was     Closed
arrived during the Closed Session.) The meeting reconvened at 6:00 p.m.          Session

        The President called a Public Hearing to order and opened the meeting     Pledge of
 with the Pledge of Allegiance to the Flag. Ms. Mancha asked the audience to      Allegiance
 remain standing for a moment of silence in memory of the following persons
 who recently passed away: Marcia Brown, former employee and wife of Dr.
 Marlin Brown, Principal; Father of Christine Ramirez, Teacher; Father of Paul
 Plaxton, employee and Husband of Loretta Operini, retired employee.



        The President called for comments from the audience regarding the         Public
 public hearing item, 2002-2003 Collective Bargaining Proposal from United        Hearing
 Steelworkers of America, Local 8599.

         There were none.


        The President adjourned the public hearing and called the regular
 meeting to order.



        Visitors present at the meeting were: Mr. Tony Micciche, President,       Visitors
 United Steelworkers of America, Local 8599; Mr. Sam Poindexter, President,       Present
 Fontana Teachers Association; and interested employees and members of the
 community.



         Dr. Ruble corrected Page 61, last paragraph, of the Minutes of the      Minutes
 Board of Education Meeting of June 19, 2002: changed effective date of          Approved
 transfer of Joy Martin to March 1, 2003.

        On motion made by Dr. Wayne Ruble, seconded by Mr. Gus Hawthorn,
 and carried, the Board approved the minutes, as corrected, of the Board of
 Education Regular Meeting of June 19, 2002.

         Dr. Harshman noted that there were many cards from persons in the           Fees for Use
 audience who wished to address the issue of fees. She informed everyone that        of Facilities
 the item for fees for use of facilities is an Administrative Regulation but not
 Board Policy. In fact, the fees must be increased pursuant to the administrative
 regulation, however, the policy will not be changed. She quoted Board Policy
 1330, which is also available on internet which listed organizations who are not
 required to pay fees. She particularly noted that if an organization has not paid
 in the past they will not be paying in the future. She further clarified that the
 administrative regulation would not be presented to the Board at a meeting as
 they are recommended to the board in a different way. She emphasized that
 fees will be increased, however, no one will be charged who has not been in the
 past.




        The presentation by the “Den Mothers” was postponed to a future              Presentation

         Mr. Dave Ackley, Director, Administrative Support & Student Events,         National
 introduced three students from Fontana A.B. Miller High School who                  History Day
 participated in the National History Day competition in Baltimore, Maryland.        Students
 A display as well as a video documentary was shown for the Board.                   Introduced

         Mr. Hawthorn suggested that the documentary be presented on Channel
 17.

        The President opened the Hearing Session and called for comments           Visitors

        Mr. Carl Wuebben, Girl Scouts, stated that Dr. Harshman did cover
 most of his concerns but asked what the Board is voting on. He stated that they
 would be very willing to with the Principals to reduce energy costs where
 possible.

        Dr. Harshman stated that the issued does not require a vote of the
 Board. She also indicated she would get a message out to principals to talk
 with each unit.



         Ms. Darlene Caringella, Girl Scouts, thanked the Board for the
 clarification regarding the use of facility fees.



         Mr. Steve Gibson, Boy Scouts, also expressed appreciation for the
 clarification. He commented he thought they had heard more of the
 misinformation than the correct information.



      Mr. Cisco Lopez, Boy Scouts, also thanked Dr. Harshman for her initial
 comments.



        Ms. Michelle Green also expressed appreciation for clarifying the
 information and commented that it relieves everyone.



         Mr. Tony Orlich spoke about charges against current politicians.

         Mr. Tony Micciche expressed concern regarding campus security                Visitors

 that the substitute application is a long process and summer would be over
 before these employees could complete that process and work.

         He referred to a recommendation to spend $10,000 on a reclassification
 study. He reminded the Board that there is currently contract language
 regarding reclassification. He stated he did not see a need to spend additional
 money in this area during these fiscally hard times. He also stated that the last
 time such a study was conducted the district worked with the union to choose
 someone to do this. He stated that the union doesn’t want a study at this time
 but if it happened, in the future they would like to be a part of the selection
 process.

          Dr. Peoples explained that this study would be limited to comparative
 wage which is analogous to a prevailing wage study not a reclassification study
 which looks at job duties. This study will compare wages with surrounding
 districts to determine whether they are similar for the same jobs.

        Mr. Micciche referred to air conditioning problems at Fontana A.B.
 Miller High School. He noted that the union understands the cost factors and
 problems involved but feels some kind of solution needs to occur at that school.
 People are working there with no system in place at that site to cool an
 individual area.



         On motion made by Dr. Wayne Ruble, seconded by Mr. Rick McClure,            Grant
 and carried, the Board accepted a Renovation and Repair Grant, #GRPM-1111,          Accepted
 in the amount of $62,941.00 for the 2002-2003 school year, and adopted a
 resolution certifying same.



        On motion made by Mrs. Kathy Binks, seconded by Mr. Rick McClure,            Resolution
 and carried, the Board adopted a resolution accepting the continued funding of      Adopted
 the Federal Block Child Care Grant, contract #FCTR-2100, in the amount of
 $398,075.00 for the 2002-2003 school year.

        On motion made by Dr. Wayne Ruble, seconded by Mr. Rick McClure,           Agreement
 and carried, the Board approved renewal of the subscription agreement with        Approved
 bigchalk.com for bigchalk Library Services in the amount of $56,524.50 for the
 term July 1, 2002 through June 30, 2003.



        On motion made by Mrs. Kathy Binks, seconded by Mr. Gus Hawthorn,          Contract
 and carried, the Board approved a contract with Chaffey Community College to      Approved
 implement tutoring opportunities at all Fontana schools through the Federal
 Work Study, CalWorks, and Student Work Study programs in an amount not to
 exceed $100,000.00 for the term July 2002 through June 30, 2003.



        On motion made by Dr. Wayne Ruble, seconded by Mrs. Kathy Binks,           Bid Awarded
 and carried, the Board awarded Bid No. 02/03-1044 - Tires and Rims, to
 Parkhouse Tire, the lowest responsible bidder, for an estimated total of
 $75,000.00 for the 2002/2003 school year, and authorized Betty Fraser,
 Director of Purchasing, to sign the necessary documents.



        On motion made by Mrs. Kathy Binks, seconded by Dr. Wayne Ruble,           Agreement
 and carried, the Board approved renewal of the cosmetology training agreement     Approved
 with Richard’s Beauty College for the period of July 1, 2002 through June 30,
 2003, in an amount not to exceed $70,000.00, and authorized Betty Fraser,
 Director of Purchasing, to sign the necessary documents.



        On motion made by Dr. Wayne Ruble, seconded by Mr. Rick McClure,           Contract
 and carried, the Board approved a contract with the Coca-Cola Bottling            Approved
 Company in the amount of $270,000.00 for the 2002/2003 school year, and
 authorized JoAnn Lancaster, Director of Child Nutrition, to sign said contract.

         On motion made by Mr. Rick McClure, seconded by Mr. Gus                   Purchase
 Hawthorn, and carried, the Board approved the purchase of furniture and           Approved
 equipment from Virco Manufacturing Company utilizing Riverside Unified
 School District Bid No. 2000/02-28 for purchases district-wide through June
 30, 2003 at an estimated annual cost of $50,000.00, and authorized Betty
 Fraser, Director of Purchasing, to sign the necessary documents.




         On motion made by Dr. Wayne Ruble, seconded by Mrs. Kathy Binks,          Extension of
 and carried, the Board approved the extension of Bid No. 00/01-1003 -             Bid
 Purchase of Paper Goods and Products for Child Nutrition from P & R Paper, in     Approved
 an estimated total of $450,000.00 for the 2002/2003 school year, and authorized
 Betty Fraser, Director of Purchasing, to sign the necessary documents.

 and carried, the Board approved renewal of a contract with the Law Offices of   Approved
 Jones & Mayer to provide legal services for the 2002-2003 fiscal year in an
 amount not to exceed $25,000.00.



        On motion made by Mrs. Kathy Binks, seconded by Dr. Wayne Ruble,         Contract
 and carried, the Board approved renewal of the contract with Carns Consulting   Approved
 Services to provide various services to Human Resources and School Police for
 the 2002-2003 fiscal year in an amount not to exceed $30,000.00.

 and carried, the Board approved a Consultant Services Agreement and purchase       Approved
 of software with Davis Demographics & Planning, Inc., in the amount of
 $47,300.00 for the 2002/2003 fiscal year.

        Dr. Harshman read a letter from the American School Food Service           Correspondence
 Association President notifying the district that JoAnn Lancaster, Director of    Noted
 Child Nutrition, has successfully earned the School Foodservice & Nutrition
 Specialist credential from the American School Service Association.



       The Board discussed the calendar for Board Meetings scheduled in           Board

        On motion made by Dr. Wayne Ruble, seconded by Mrs. Kathy Binks,
 and carried, the Board approved that one meeting be held in August on August
 7, 2002 and that the meeting scheduled for August 21, 2002 be cancelled.

         Dr. Peoples reported that the elementary schools began the year fully       Administrator
 staffed and thanked Darin Brawley, Director, Certificated Personnel.                Comments


        Mr. D’Souza reported on recent funding for construction projects
 awarded by the State Allocation Board. These funds will be made available if a
 bond is passed on the November ballot.



         Mr. McClure referred to his role in CTA regarding budget development        Board
 and reported good news for schools in regard to the budget. He suggested that       Member
 interested persons call Assemblypersons to urge them to act as quickly as           Comments
 possible in the passage of this document.


        Dr. Ruble stated he had spoken with the district piano tuner who was
 concerned because he was told there was no money to tune pianos this year.
 Dr. Ruble commented that he hoped musical instruments wouldn’t be forgotten
 when planning the budget.


         Mrs. Binks referred to a letter from Dana Applebee, Teacher at
 Southridge Middle School thanking the PAR support teacher Peggy Chute and
 her principal Sandie Watkins for helping her through her first year as a teacher.
 Mrs. Binks thanked her for taking the time to write a positive letter.
