INSTRUCTIONS FOR COMPLETION
This questionnaire is designed to provide Wakefield Council with the information
required to assess your company’s suitability to become a contractor to the
Authority.

It is important to fully answer all the questions in this document. Where insufficient
space has been provided in this document, you may append additional pages. All
additional pages must clearly state the company name and the tender reference
quoted on the front of this document.

This questionnaire does not require you to submit supporting documents as
evidence such as accounts, certificates, policies, etc. However, you are asked to
confirm that should such evidence be required during any part of the tender or
contract process it will be made available to the Council on request. Please note
that any documentation submitted cannot be returned and will be securely disposed
of in accordance with the Council’s retention and destruction policy.

Any information submitted in response to this questionnaire must relate to the
applicant only. The applicant is the organisation that will enter into a formal contract
with the Authority if awarded a contract. If you intend to form a partnership or
consortia in order to deliver this contract, a lead organisation must be identified to
take responsibility for the other partner organisations and enter into a contractual
arrangement with the Council if awarded the contract. This lead organisation will
become the applicant for the tender process and all information provided should
relate to their organisation unless stated otherwise.

Failure to complete the questionnaire in full or to provide the information requested
may result in failure to be invited to the tender stage.

You are advised to read all guidance notes within this document.

All responses and submissions provided may form part of the contract should your
application subsequently be successful.

It is your responsibility to ensure the appropriate person is selected as the main point
of contact on the Supplier and Contract Management System (SCMS) and that their
email address is accurate. All correspondence in relation to this tender will be sent
electronically via the SCMS to this person.

The Council reserves the right to change with immediate effect (subject to
appropriate notice) the basis of, or the procedures for, the tendering process. The
Council also reserves the right to reject any or all tenders for the contract, to
terminate discussions with tenderers at any time and not to proceed (cancel the
notice) with the proposed procurement. Under no circumstances shall the Council or
any of its staff, agents, members or advisors incur any liability whatsoever in respect
of such matters.

Any queries you may have regarding this procedure or the information required
should be raised using the ‘Raise a Clarification Question’ function on the Supplier &
Contract Management System (SCMS) in sufficient time to allow the Council to
formulate and distribute a response at least 5 working days before the due date for
return of Tenders. If relevant, answers to queries will be anonymised and circulated
to all potential bidders. These queries can be viewed via the SCMS using the ‘View
Messages’ function.

Return of Questionnaires
Completed questionnaires and any accompanying information should be uploaded to
the Supplier and Contract Management System (https://scms.alito.co.uk) tender
reference <<insert scms ref>> no later than 12 noon on <<insert date for
return>>. It is important to allow enough time to send the Council your electronic
document(s). Please check your username and password the day before returning
your documents so any problems can be resolved before you lodge your response.
For each document you return you will be provided with an online receipt number.
SCMS will also record the receipt number for each document in the ‘Review and
Resubmit Tender Documentation’.

Selection Process
Submitted questionnaires will be assessed following the closing date and the Council
will produce a short-list of applicants comprising the highest 5 scoring bidders (where
5 suitable applicants can be identified). The Council reserves the right to short list
more than 5 applicants where scores are sufficiently close. All applicants will
subsequently be advised of their status and those short-listed will be advised of the
timescales and requirements of further stages.

This questionnaire will be assessed using a combination of pass/fail criteria and a
scoring system. Each section to be scored is allocated a maximum number of marks
which are available. The scoring methodology provided below explains how the
marks are awarded.

Your response to the sections which will be scored will be assessed based on the
following scoring methodology:

If a score of 0 is applied, the PQQ will be eliminated.
If a score of 1 is applied, 1/3 available marks for that question will be awarded.
If a score of 2 is applied, 2/3 available marks for that question will be awarded.
If a score of 3 is applied, all available marks for that question will be awarded.

Example:
Where there are 6 marks available for a question and a score of 2 is applied to a
bidders response, the bidder will be awarded 4 marks for that response.

Important Note: Tenderers should not assume members of the evaluation panel
have any prior knowledge of their organisation. The assessment will be made on the
written response provided.

 1.12 The public sector and utilities procurement Directives, as implemented by the
      Public Contracts Regulations 2006 and the Public Procurement
      (Miscellaneous Amendments) Regulations 2011, include a mandatory

SECTION 2 – FINANCIAL INFORMATION
The Council will use a combination of your Trading Name, Company Registration
Number and Registered Address that you provided within ‘Section 1 - Company
Information’ above to request an external credit report in order to assess the financial
position of your organisation. The information provided in Section 1 MUST relate solely
to the organisation proposing to deliver this contract and not to a group, parent or
holding company.

If the external credit report highlights areas for concern or the Council is unable to run a
full report (i.e. because you are a newly formed business) you may be asked to supply
additional information (i.e. company accounts, cash flow statements etc.) to enable the
Council to undertake a more thorough in depth analysis. Failure to make financial
information available will result in your submission being eliminated. If the Council
deems that an organisation’s financial position presents a high risk to the Council for
this particular project and appropriate mitigating actions cannot be identified, the
Council reserves the right to eliminate the organisation from the tendering process.

APPENDIX (see question 1.12)

The public sector and utilities procurement Directives, as implemented by the Public
Contracts Regulations 2006 and the Public Procurement (Miscellaneous
Amendments) Regulations 2011, include mandatory requirement for contracting
authorities to exclude economic operators (suppliers, contractors and services
providers) from public contracts where they have been convicted of the following
offences:

(a)      conspiracy within the meaning of section 1 or 1A of the Criminal Law Act 1977
         or article 9 or 9A of the Criminal Attempts and Conspiracy (Northern Ireland)
         Order 1983 where that conspiracy relates to participation in a criminal
         organisation as defined in Article 2 of Council Framework Decision
         2008/841/JHA(19);
(b)      corruption within the meaning of section 1 of the Public Bodies Corrupt
         Practices Act 1889 or section 1 of the Prevention of Corruption Act 1906,
         where the offence relates to active corruption;
(c)      the offence of bribery, where the offence relates to active corruption;
(d)      bribery within the meaning of section 1 or 6 of the Bribery Act 2010;
(e)      fraud, where the offence relates to fraud affecting the European Communities’
         financial interests as defined by Article 1 of the Convention on the protection

         Excise Management Act 1979 or section 72 of the Value Added Tax Act 1994;
(vi)     an offence in connection with taxation in the European Union within the
         meaning of section 71 of the Criminal Justice Act 1993; or
(vii)    destroying, defacing or concealing of documents or procuring the execution of
         a valuable security within the meaning of section 20 of the Theft Act 1968 or
         section 19 of the Theft Act (Northern Ireland) 1969;
(viii)   fraud within the meaning of section 2, 3 or 4 of the Fraud Act 2006; or
(ix)     making, adapting, supplying or offering to supply articles for use in frauds
         within the meaning of section 7 of the Fraud Act 2006;
(f)      money laundering within the meaning of section 340 of the Proceeds of Crime
         Act 2002;
(g)      an offence in connection with the proceeds of criminal conduct within the
         meaning of section 93A, 93B or 93C of the Criminal Justice Act 1988 or article
         45, 46 or 47 of the Proceeds of Crime (Northern Ireland) Order 1996;
(h)      an offence in connection with the proceeds of drug trafficking within the
         meaning of section 49, 50 or 51 of the Drug Trafficking Act 1994; or
