I.     STATEMENT
       1.       On July 6, 2005, a Motion for Withdraw and Written Notification Certificate

(Motion to Withdraw) was filed in the captioned matter by Richard J. Bara, Esq., legal counsel of

record for Rocky Mountain Access Transportation, Inc. (RMAT). The Motion to Withdraw

contained a Certificate of Service indicating that it was served on all parties and RMAT on

July 5, 2005.

       2.       The Motion to Withdraw was filed pursuant to Rule 21(c) of the Rules of Practice

and Procedure, 4 Code of Colorado Regulations 723-1, and requests that Richard J. Bara, Esq.

be allowed to withdraw as legal counsel for RMAT in this matter.

       3.       The ten-day objection period provided by Rule 21(c) has now expired and no

response to the Motion to Withdraw, or objection to the relief requested therein, has been filed by

RMAT or any other party.             The Motion to Withdraw complies with Rule 21(c) and will,

therefore, be granted.1


II.     ORDER

        A.       It Is Ordered That:
        1.       The Motion to Withdraw filed in the captioned matter by Richard J. Bara, Esq., is

granted.

        2.       This Order shall be effective immediately.

          Paragraph VI of the Motion to Withdraw and Written Notification Certificate incorrectly states applicable
prehearing deadlines established in this docket by Decision R05-0744-I (Mailed Date of June 15, 2005). Rule 21(c)
does not require a withdrawing attorney to notify the party represented by the attorney of such matters, but in order
to avoid confusion, RMAT should review Decision No. R05-0744-I and the Commission’s rules of practice and
procedure.
