     Mr. McHugh:

     A Class I Sanitary Survey was conducted by the undersigned in company of Wendy Mistretta of
     this office and Kelly P. McHugh (employee of NEES). Also present were Terry Trahan, Al
     Hynes and Jerry Nelson residents being served by above referenced water system.

     As all information requested of the water system has yet to be forwarded to this office and the
     operator present at the time of inspection was unfamiliar with the system several items will be
     addressed at a future date.

                                               NOTICE OF VIOLATIONS

     1.             § 343. Cross Connections [formerly paragraph 12:016-1]
               A.    There shall be no physical connection between a public water supply and any other
                     water supply which is not of equal sanitary quality and under an equal degree of official
                     supervision; and there shall be no connection or arrangement by which unsafe water
                     may enter a public water system.

     2.             §345. Connection with Unsafe Water Sources Forbidden [formerly paragraph
                    12:017]
               A. There shall be no cross-connection, auxiliary intake, bypass, inter-connection or other
               arrangement, including overhead leakage, whereby water from a source that does not
               comply with these regulations may be discharged or drawn into any potable water supply
               which does comply with these requirements. The use of valves, including check or
               backpressure valves is not considered protection against return flow, or back-siphonage, or
               for the prevention of flow of water from an unapproved source into an approved system.

3.        §357. Minimum Disinfection Residuals [formerly paragraph 12:021-2]
          A. A minimum disinfectant residual of detectable amount of total chlorine shall be
             maintained at all points throughout the distribution system at all times for chlorination
             methods other than chloramines.

4.        §367. Records [formerly paragraph 12:021-7]
          A. Daily records of chlorine residual measurements shall be kept. These records shall be
          maintained on forms approved by the state health officer and shall be retained for a
          period of three years.

5.        §335. Distribution [formerly paragraph 12:012-1]
          A. All potable water distribution systems shall be designed, constructed, and maintained
          so as to prevent leakage of water due to defective materials, improper jointing, corrosion,
          settling, impacts, freezing, or other causes. Valves and blow-offs shall be provided so that
          necessary repairs can be made with a minimum interruption of service

6.        §315. Security [formerly paragraph 12:003-5]
        A. All public water supply wells, treatment units, tanks, etc., shall be located inside a
        fenced area that is capable of being locked; said areas shall be locked when unattended.
        The fence shall be resistant to climbing and at least 6 feet high.

7. §105. Permit Requirements for a Potable Water Supply [formerly paragraph 12:002-2]
        D. The review and approval of plans and specifications submitted for issuance of a permit,
        will be made in accordance with the "Ten-State Standards" and the Louisiana Water Well
        Rules, Regulations, and Standards, plus any additional requirements of the state health
        officer as set forth in this Part.
        3.2.1.3 Standby Power
        a. To ensure continuous service when the primary power has been interrupted, a standby
           power supply should be provided through
        1. connection to at least two independent power sources, or
        2. portable or in place auxiliary power.

8. §105. Permit Requirements for a Potable Water Supply [formerly paragraph 12:002-2]
       D. The review and approval of plans and specifications submitted for issuance of a
       permit, will be made in accordance with the "Ten-State Standards" and the Louisiana
       Water Well Rules, Regulations, and Standards, plus any additional requirements of the
       state health officer as set forth in this Part.
       5.4.1 Chlorine gas
       b. Full and empty cylinders of chlorine gas should be

       5.3.2 Respiratory protection equipment
       Respiratory protection equipment, meeting requirements of the National Institute for
       Occupational Safety and Health (NIOSH) shall be available for chlorine gas is handled,
       and shall be stored at a convenient heated location, but not inside where any chlorine is
       used or stored. The units shall use compressed air, have at least a 30-minute capacity and
       be compatible with or exactly the same as units used by the fire department responsible
       for the plant

            RECOMMENDATTIONS FOR CORRECTION OF VIOLATIONS

Violation #1 & #2 All private supplies are to be physically disconnected and a cross connection
control plan is to be submitted to this office within 30 days of receipt of this letter. Enclosed is a
model ordinance.

Violation #3 & #4 At the time of inspection only a trace amount of free chlorine was detected in
the distribution system. Chlorine residuals are to be measured and recorded on a daily basis.
Enclosed is a form for your use. This form is to be completed on a daily basis and mailed to
Region IX Office by the 10th of the following month until further notice.

Violation # 5 System should be maintained to prevent interruption of service and leaks.


Violation #6 Repair hurricane damage to fence and maintain well site as to prevent trees from
overtaking the fence.

Violation # 7 Plans and specification shall be submitted for the installation of an emergency
generator(s) capable of providing adequate power to operate all aspects of the water plant
including, but not limited to, chemical feeders, disinfection equipment, back-wash pumps, intake
pumps, transfer pumps, service pumps, booster pumps, etc., so that water may be treated and
pumped to the distribution system during power outages. Such plans and specifications are to be
submitted to the Office of Public Health’s (OPH) Region IX Office within 45 days of receipt of
this letter

Violation #8 Chlorine tanks are to be secured in position. Proper safety equipment is to be
available to operators responsible for daily operation of the disinfection system. Upon review of
our files, plans or specifications for gas chlorine was never approved. In addition to submitting
these plans and specifications, information regarding the pump and sequestrate agent should be
included in the review materials.

                               ADDITIONAL RECOMMENDATIONS


      1. Electrical panel of system, although operational, does not conform to state and/or local
         codes. Also, the wooden structure to which the electrical panel is attached is rotting.

      2. All pumps should be properly secured. Sitting on the ground is not acceptable.

      3. Several assistance options are available to all water systems. These agencies include, but
         are not limited to, Louisiana Rural Water Association, The State Revolving Loan Fund
         and Community Resource Group. Should NEES be interested in any of these agencies
         this office will provide further information to contact such.

      4. The certified operator in charge of the system should attend any future inspections by this
         office.

      5. No Administrative Order was ever issued to this water system prior to NEES ownership.

      6. Included in this packet is additional historical documentation for your records. These
         documents include a
         1.) “Letter of no objection” regarding the approval of the water system prior to your
         ownership.
         2.) Correspondence between the Department of Health & Hospitals Chief Engineer and
         Region IX Staff requesting information on NEES behalf prior to NEES retaining
         ownership of the system. This correspondence lists specific items addressed by this
         office in August of 1999.

All violations are to be corrected within 30 days of receipt of this letter. Should you need
additional time a written response with time specifications requested is to be submitted for
review.
