Dear Mayor Bloomberg: I am a sixty two year old Black male. On March 2006, I was targeted confronted, threatened, manhandled, terrorized, and deprived of one hundred and fifty dollars, ($150.00) by a group of White and Asian males while sitting alone in my parked vehicle. The attack was racially motivated, the perpetrators were Police officers, my prosecution and conviction absolves them, and I arrested. The Asian member of the group, officer Park, badge number 27463, was the designated "arresting officer," as a diversion, and he prepared and filed Police and Court documents including a sworn affidavit supporting the criminal complaint 2006QN011207, containing statements they knew to be false about the events leading up to the attack. Specifically that he personally observed me operating my vehicle without a seat belt. Contrary to the fabricated documents, I was sitting in my parked vehicle when confronted and detained without legal justification. I was parked in the same spot when officer Park and his White partner, arrived on the scene, several minutes after the confrontation. And I was still parked in the same spot when officer Park's partner approached me threatening and shouting "GET OUT, GET OUT. YOU KNOW WHAT IT'S ALL ABOUT. IT'S BLACK OR WHITE." The false statements were intentionally included in the documents, in order to cover up the illegal actions against me, justify my unlawful arrest and criminal prosecution, increase the weight of the evidence against me and have caused false information to be entered into the Court record. My prosecution and conviction absolves the perpetrators and I was charged with; AGGRAVATED UNLICENSED OPERATION OF A MOTOR VEHICLE; 1
OPERATING MOTOR VEHICLE WITHOUT INSURANCE, AND DRIVING BY UNLICENSED OPERATOR, based on false, inaccurate, and misleading information generated by the Police department computer. Adequate research by the Queens County District attorney and the Criminal court, confirm that contrary to the suspension orders #CO-510270000, ("NO INSURANCE") and #J255433, (FLD TO ANSWER) generated by the Police Department's computer, my vehicle was insured, and the summons #4230255433 was answered. I brought the discrepancies to the attention of the District Attorney, Criminal Court, and the Police Department by motion to dismiss, and complainr filed in March 2006. I was repeatedly prosecuted despite the lack of evidence to support the charges. The Criminal Court used the adjournment process as a tool to create financial hardship, and unwarranted bench warrants by adjourning every Court appearance. On February 16 2007, (Martin Luther King Jr. Day) while in the company of two Black Nassau County Police officers, in the parking lot at the "Home Depot" in Elmont, officer Magnuson a former New York City Police officer arrived on the scene shouting, "Get off the phone, get off the phone, you are under arrest. There is a warrant for your arrest in New York City," and I was arrested, even though I had been appearing in Court at least twice each month since March 2006. On March 01 2006, I was like the next gainfully employed, law abiding person you see sitting in their legally parked vehicle. I did not commit any crime. I was not committing any crime. I did not even have an unpaid parking ticket. Sometime after my arrest by officer Magnuson, all charges were dismissed in absentia. Over two years ago I contacted your office seeking help. Today I am unemployed and homeless. I have a history of arrest and a criminal record. The Court record is sealed, and the perpetrators have been absolved. Thanks Mayor Bloomberg.
