RESOLUTION NO. 1935
A RESOLUTION ESTABLISHING POLICY ON EARTHEN STORM WATER DITCHES AND
RESCINDING RESOLUTION NO. 1074.
WHEREAS, the Public Works Committee of the City Council at their meeting on the 28th day
of August, 1985, recommended to the City Council certain operating policies and procedures; and
WHEREAS, the Governing Body of the City of Overland Park, Kansas, did on the 9th day of
September, 1985, find such policies and procedures to be acceptable;
NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF
OVERLAND PARK, KANSAS:
EARTHEN STORM WATER DITCHES: Maintenance of earthen storm water ditches shall be
the property owner's responsibility, except those areas dedicated as street right-of-way. The City will
assist in the removal of debris from these earthen ditches, located on private property, by hauling away
this material when removed by the property owner and carried or transported to the street right-of-way
area. This policy shall apply regardless of whether the earthen ditch is located on a platted or dedicated
utility or drainage easement.
RESOLUTION NO. 1074 is hereby rescinded.
