Wetland Mitigation Plan

Chapter 1—Introduction
1.1       Purpose and Organization of Wetland Mitigation Plan
The purpose of the wetland mitigation plan is to present additional information on wetlands
identified in the wetland delineation report that are located within the construction and
permanent easements (also referred to as temporary workspace and permanent easement)
for the proposed Pipeline, Lateral, Terminal, and related aboveground facilities. The
wetland information provided in this mitigation plan includes a summary of the wetland
functional assessment by subbasin (4th order hydrologic unit code [HUC] unit) and wetland
hydrogeomorphic (HGM) and Cowardin class, a summary of wetland impacts by HGM and
Cowardin class by subbasin, and the approach to mitigating wetland impacts associated
with the proposed Project.


Chapter 2—Functional Assessment
2.1       Methodology
The U.S. Army Corps of Engineers (USACE), Oregon Department of State Lands (DSL), and
U.S. Environmental Protection Agency (EPA) recommended that Oregon LNG use the
Hydrogeomorphic (HGM) Assessment Guidebook for Tidal Wetlands of the Oregon Coast (Adamus,
2006), to evaluate the functions affected by construction and operation of the Terminal. For
the proposed Pipeline, USACE, EPA, and DSL recommended use of the Guidebook for
Hydrogeomorphic (HGM)-based Assessment of Oregon Wetland and Riparian Sites (for the
Willamette Valley) (Adamus et al., 2001) and best professional judgment to assess the
functions of the wetlands affected.

2.1.1     Terminal
The Hydrogeomorphic (HGM) Assessment Guidebook for Tidal Wetlands of the Oregon Coast rapid
assessment method (Adamus, 2006) was used for assessing the functions and values of tidal
wetlands at the Terminal. Adamus, 2001, was used for interior wetlands at the Terminal.
Although these guidebooks were developed for Oregon wetlands, neither included
reference sites along the Lower Columbia River Estuary (LCRE). Similarly, reference sites
for the Willamette Valley HGM were restricted to the Willamette Valley. Despite the
limitations, Federal and state representatives encouraged Oregon LNG to use the HGM
functional assessment methodologies for evaluating wetlands at the Terminal. Best
professional judgment was used in applying the HGM functional assessments to wetlands
at the Terminal given the limitations of the methodologies to LCRE wetlands. Table 2J- 1
summarizes the functions and the criteria used to evaluate functions for tidal wetlands
according to Adamus (2006).

2.1.2     Pipeline and Lateral
The Guidebook for Hydrogeomorphic (HGM)-based Assessment of Oregon Wetland and Riparian
Sites, Volume IA: Assessment Methods (Adamus, 2001) was used as the basis for identifying
and evaluating the functions associated with the Project wetlands. This assessment method
identifies 13 functions performed by wetlands and outlines the criteria that can be used to
qualitatively assess the level of function provided by each wetland for each criterion.
Table 2J-2 lists the functions and evaluation descriptors for both high and low levels of
performance for each function. This form was used by the field teams who conducted the
wetland delineation to rate the level of each function as high, medium, or low based on their
observations and collected field data. The results of the functional assessment for each
wetland affected by the Project are provided in Attachment 1. Once this evaluation was
performed for each wetland, the high, medium, and low ratings were converted to a
numeric score: high= 3, medium = 2, low = 1, and not applicable = 0. This allowed for
addition of the rating for each function and averaging for all wetlands in a given subbasin,
HGM class, or Cowardin class to be used in mitigation planning.

2.2       Results
Table 2J-3 shows the normalized functional rating of wetlands affected by the Project for all
functional categories displayed by subbasin, HGM class, and Cowardin class.


Chapter 3—Impact Assessment
3.1       Methodology
3.1.1     Terminal
Impacts to wetlands associated with the Terminal and related facilities were quantified as
temporary if they were within the area disturbed by construction but outside the permanent
facility and removal/fill footprint. The impacts were quantified as permanent if they were
in the permanent facility or removal/fill footprint. Figure 2.3-1 of Resource Report 2 shows
the Terminal footprint and affected wetlands.

3.1.2     Pipeline
Impacts to wetlands associated with the proposed Pipeline and Lateral construction and
operation were quantified based on the proposed activity in temporary construction and
permanent operation zones. Planned construction and operation activities in wetlands are
described in Section 2.3.3, Table 2.3-3, and Figure 2.3-2 of Resource Report 2; Appendix 1K
of Resource Report 1; and in Appendix 2C of Resource Report 2. Figure 2J-1 illustrates the
construction and operation effects to wetlands by Cowardin class.
When constructing the proposed Pipeline through the wetlands, the only soil excavation
will occur at the Pipeline trench area, which will be about 10 feet wide, depending on depth
of pipe. Temporary fill will occur next to the trench where soil and plant materials from the
trench will be stockpiled. Indirect soil disturbance, resulting in removal/fill, is expected to
occur throughout the 75-foot-wide construction corridor from aboveground vegetation
removal and mechanized land clearing, which could result in soil displacement. Following
construction, all wetlands will be rehabilitated to preconstruction soil and hydrology

conditions, and revegetated. Operational vegetation maintenance activities will preclude
forested wetlands in the 30-foot-wide corridor, and shrub-scrub wetlands from the 10-foot-
wide corridor centered over the pipe.
As a result, the following assessment of Project construction impacts can be made for the
75-foot-wide construction corridor:

•     All impacts to wetlands will be short-term and temporary through out the construction
      easement (e.g., reestablishment of vegetation beginning within days or weeks of
      cessation of site work), with the exception of the trench excavation area. In the estimated
      10-foot wide trench area, impacts will be longer-term and temporary and herbaceous
      wetlands will recover more slowly as a result of clearing, grubbing, and soil excavation.
As a result of the operation activities, the following assessment of Project operational impacts
can be made for the 50-foot-wide permanent easement:

•     All impacts to emergent wetlands within the 50-foot permanent easement will be
      temporary.

•     All impacts to scrub-shrub wetlands within the 50-foot permanent easement will be
      temporary, with the exception of the 10-foot-wide mow strip over the Pipeline. Scrub-
      shrub wetlands within the 10-foot-wide mow strip will retain their wetland hydrology
      and hydric soil, but the dominant vegetation will shift to mostly herbaceous and trailing
      woody groundcover.

•     All impacts to forested wetlands within the 50-foot permanent easement will be
      temporary with the exception of a 30-foot-wide maintenance corridor over the Pipeline.
      Preconstruction forested wetlands will retain their wetland hydrology and hydric soil,
      but the dominant vegetation will shift to mostly herbaceous and trailing woody
      groundcover within the 10-foot-wide mow strip and to scrub-shrub wetlands elsewhere
      in the 30-foot-wide maintenance corridor where trees exceeding 15 feet in height may be
      cut for Pipeline safety.

3.2       Results
For the Terminal and associated facilities, wetland impacts are categorized as temporary as
a result of construction related activities, or permanent as a result of removal/fill associated
with construction of the Terminal and associated facilities. Table 2J-4 shows the wetland
impacts associated with the Terminal and ancillary facilities by HGM and Cowardin class.
For the Pipeline mainline and Lateral and associated aboveground facilities, the Project’s
impacts to wetlands were determined using the method described in the section above.
Impacts were categorized as temporary wetland impacts or permanent Cowardin class
changes. Temporary wetland impacts include all impacts to wetlands within the 75-foot
construction corridor as a result of the construction and operation of the Project. Permanent
Cowardin class changes include all impacts to forested or scrub-shrub wetlands within the
10-foot-wide and 30-foot-wide prescribed maintenance zones shown on Figure 2J-1.
Table 2J-5 presents a summary of temporary impacts for the mainline and Lateral, by
watershed subbasin (4th order HUC) and by HGM and Cowardin wetland class; and

Table 2J-6 presents the summary of permanent Cowardin class changes for the mainline and
Lateral, by watershed subbasin and by HGM and Cowardin wetland class.


Chapter 4—Mitigation
4.1       Introduction
This chapter lays out the approach to wetland mitigation based on the determination of
impacts in Chapter 3 and the evaluation of wetland functions in Chapter 2. The approach to
mitigation follows the USACE and DSL rules and guidance with the goal of no net loss of
wetland functions and values. The approach follows the USACE and DSL mitigation
sequencing and, where compensation is required, uses a watershed approach to select
available resource replacement sites that offer the greatest functional benefits.

4.2       Avoidance
The Delineation Report, Appendix 2G, shows the wetlands identified for the proposed
Project study area. Most of these wetlands in the study area will be avoided by the Project,
with temporary and permanent impacts for the Terminal and Pipeline totaling
approximately 184 acres of the over 1,000 acres of wetlands identified in the Project study
area. During several design iterations, the Pipeline alignment and temporary work spaces
were shifted away from wetlands and other waters, where possible reducing the acreage of
impact. In addition, during construction, wetlands outside of the construction corridor will
be demarcated in the field and identified on work plans as “no work zones” to avoid
additional wetland impacts.

4.3       Minimization
Efforts will be made before, during, and after Pipeline and Lateral construction to minimize
the extent and duration of Project-related disturbances to wetland resources. For example,
Oregon LNG will segregate and salvage the top 1 foot of topsoil from nonsaturated wetland
areas to be disturbed by trenching (generally coincident with the 10-foot mow strip
maintained during operation) and replace the topsoil at the finish grade after trench
reconstruction. The duration of temporary wetland disturbance during Pipeline
construction will be minimized. The backfilled trench will contain anti-seep plugs at
appropriate intervals to prevent a French drain effect. A detailed description of other
measures to minimize construction and post-construction maintenance effects on wetlands
is provided in the Procedures (Appendix 2A, Section VI).

4.4       Compensation
For the Project, the approach to compensatory mitigation follows the EPA and USACE
Wetland Compensatory Mitigation Rule (March 2008) and DSL guidance emphasizing a
watershed-level approach to compensation. Previous EPA and USACE guidance favored
mitigation in proximity of impacts, but the Wetland Compensatory Mitigation Rule lists this
hierarchy of mitigation preferences: (1) mitigation banks, (2) in-lieu fee programs, and (3)
permittee-responsible mitigation (in the event neither of the previous two options is
practicable).

Oregon LNG proposes a three-pronged approach to compensatory mitigation for Pipeline
impacts consisting of: (1) rehabilitation of wetlands temporarily impacted by construction
in-situ, (2) purchase of mitigation credits from wetland mitigation banks or in-lieu fee
programs, and (3) replacement of lost wetland functions through wetland restoration,
creation, or enhancement. These three compensatory mitigation approaches are described in
more detail below. Under each of the approaches described below, in-kind replacement of
affected wetlands (i.e., PEM, PSS, PFO) will be proposed where feasible. Depending on the
functions being replaced, out-of-kind mitigation may be a viable compensatory mitigation
strategy, especially when, for a given watershed, there are important goals for recovery of
other aquatic functions or habitat for important species.
The final mitigation plan and detailed wetland rehabilitation and resource replacement plan
will be completed during removal/fill permit application reviews with the USACE and
DSL. Final plans will be provided to FERC following final filing.

4.4.1     Terminal
For the Terminal, where approximately 23 acres of temporary and 1 acre of permanent
estuarine impacts will occur, Oregon LNG is assessing the potential for participation in the
proposed Johnson Farm Mitigation Bank. This 100-acre bank is a 7-mile-long estuarine
wetland located in the Lower Columbia subbasin. Figure 2J-2 shows that the proposed
Terminal site is within the service area for the proposed Johnson Farm Mitigation Bank. If
the bank is operational at the time the Project moves forward, compensatory mitigation
credits could be purchased for the Project from the bank. Oregon LNG may pursue its own
estuarine enhancement project through coordination with the Lower Columbia River
Estuary Program (LCREP) and private land owners. LCREP’s Board of Directors has
directed their staff not to coordinate with any of the LNG projects until after a decision is
made on approval of the LNG projects. LCREP has valuable information on opportunities
for estuarine wetland rehabilitation, creation, and enhancement projects that could be useful
in focusing mitigation dollars on priority restoration opportunities. Discussions with private
landowners have been initiated and Oregon LNG is pursuing opportunities for wetland
creation, enhancement, or rehabilitation on these lands.
For non-tidal wetlands, there will be approximately 8.7 acres of permanent and 1.7 acres of
temporary impacts due to Terminal and ancillary facilities construction. Temporary impact
areas will be rehabilitated onsite after construction. Rehabilitation initially involves seedbed
preparation and control of noxious weeds. Some vegetation will regenerate naturally from
the seedbank and vegetative propagules. Supplemental hydroseeding of a mixture of red
fescue (Festuca rubra) and pine lupine (Lupinus albicaulis) at 60 pounds per acre will occur
between September 1 through October 31, or March 1 through April 30. After hydroseeding,
tackified mulch will be applied to promote germination. Supplemental planting of coast
willow (Salix hookeriana) and Scouler's willow (Salix scouleriana) will accelerate woody plant
establishment. Temporary irrigation will be applied, as needed, during dry periods to
assure sufficient moisture for plant establishment. If shoreline monitoring determines that
potentially damaging erosion is occurring, and that stabilization measures would reduce
erosion potential, appropriate measures pursuant to Federal and state permits will be
implemented. Soft armoring techniques will be emphasized, such as vegetation and brush
layering. For permanent non-tidal wetland impacts associated with the Terminal and
ancillary facilities, there may be adequate non-tidal or tidal wetland restoration to purchase

credits from the Johnson Farm Mitigation Bank. Oregon LNG is also coordinating with
North Coast Land Conservatory, Columbia Land Trust, Columbia River Estuary Study
Taskforce (CREST), and private landowners about mitigation opportunities and priorities in
the Lower Columbia subbasin. If credits are not available at Johnson Farm Mitigation Bank
or within state average per acre costs, these permanent wetland impacts will be
compensated through offsite wetland restoration or creation as described below in Section
4.2.2, Onsite or Offsite Wetland Creation, Restoration, or Enhancement for Permanent
Cowardin Class Changes. The final details will be coordinated with the USACE, DSL, and
EPA as part of the Federal and state permitting processes.

4.4.2     Pipeline and Lateral
Compensation for temporary impacts to wetlands as a result of Pipeline construction will be
mitigated through onsite wetland rehabilitation. Compensation for permanent Cowardin
class changes will be through purchase of mitigation bank credits, payment to an approved
in-lieu fee program, onsite or offsite compensatory mitigation, or through a combination of
these measures. These measures are discussed below.

Rehabilitation of Wetlands Temporarily Impacted by the Project. To the extent feasible,
rehabilitation of the Pipeline and Lateral construction corridors to preconstruction wetland
conditions will be undertaken. This will involve topsoil segregation and replacement,
topsoil management to maintain viability of seedbank and vegetative propagules,
reconstruction of grades, permanent erosion control seeding with native wetland species,
and seedbed preparation where soils are displaced or compacted by equipment. This
mitigation measure is appropriate for all 144 acres of temporary Pipeline and 1 acre of
temporary Lateral wetland impacts shown in Table 2J-5.
For the trench excavation area, natural revegetation with native species will be encouraged
by providing suitable soil conditions and applying salvaged topsoil from cleared trench
area, except that weed-infested topsoil will not be reapplied. Proper topsoil stockpile
procedures (aeration, moisture, shading) will ensure that viable plant propagation sources
(e.g., viable seeds, rhizomes, roots, spores, fungi) are replaced following construction in the
trench area. Temporary erosion control seeding with sterile wheat grass will be used to
stabilize soil until natural revegetation occurs.
The wetland areas temporarily impacted by vegetation clearing, equipment traffic, and
material storage outside the trench area will be rehabilitated by re-establishing wetland
vegetation from seedbank germination and vegetative propagation via resprouting of live
roots and propagules left intact and protected during construction. Sterile wheat grass cover
will be used to temporarily stabilize soil until natural germination occurs. In some instances,
a permanent native wetland seed mix will be applied to ensure adequate cover of the site by
desirable species. The seeding and planting mixtures recommended by the U.S. Department
of Agriculture (USDA) Natural Resources Conservation Service (NRCS) for Oregon will be
used as a basis for developing a Project-specific seed mixture. If annual monitoring during
the 3 years after construction indicates that disturbed areas are not successfully revegetating
with wetland herbaceous or woody plants similar to preconstruction conditions,
supplemental seeding or planting will be undertaken. Woody species would resemble local
reference conditions. Measures will be taken to control the spread of noxious weeds.

For natural regeneration of temporarily cleared forested wetlands outside the 30-foot-wide
maintenance corridor, the following actions will be taken:

•    Where feasible, vegetation will be cut during winter months when the plants are in
     senescence.

•    Work crews will minimize damage to stumps (especially stumps less than 10 inches in
     diameter that are most capable of vegetatively reproducing) and to root stock left after
     vegetation clearing.

•    To reduce injury to viable roots and shoots, construction traffic will be managed to
     reduce areas affected by soil compaction and rutting; supported by mats, pallets, or
     other ground pressure dissipaters in moist or wet soils; and characterized by low-
     ground pressure equipment where terrain allows.

•    Woody debris, chipped woody vegetation, and unmerchantable logs greater than
     12 inches will be salvaged for surface application outside the 30-foot-wide maintenance
     corridor where existing downed wood is insufficient.

•    Sterile wheatgrass will be used for temporary erosion control seeding to avoid conflicts
     with the permanent cover.

•    Where compatible with preconstruction woody species, seeds of native woody wetland
     species will be incorporated into permanent erosion control seed mixes.

•    If annual monitoring during 3 years after construction indicates that disturbed wetland
     areas are not successfully revegetating with desirable woody plants, supplemental
     planting will be undertaken.

Mitigation Banks or In-Lieu Fee Programs for Permanent Cowardin Class Changes. Permanent
Cowardin class changes of 5.07 acres of wetlands (1.06 acres from shrub wetland to
herbaceous wetland and 4.01 acres of forested wetland to herbaceous or shrub wetland) will
occur as a result of Pipeline and Lateral maintenance activities and are shown in Table 2J-6.
These permanent Cowardin class changes will first be mitigated through purchase of
mitigation credits from mitigation banks. Existing and proposed banks in the vicinity of the
Pipeline will be used and are shown on Figure 2J-2. Information on the bank and credits
available or predicted to be available are provided in Table 2J-7. Table 2J-8 shows the
permanent Cowardin class change acreages associated with the service area of each of the
existing and proposed mitigation banks. Based on this information it is expected that the
approximately 2 acres of permanent Cowardin class changes to shrub and forested wetlands
along the proposed Pipeline routes from milepost 55 to the end at milepost 121 can be
mitigated through purchase of mitigation bank credits. However, there are no known banks
with forested wetland components located in the Lower Columbia or Nehalem subbasins
(Pipeline from milepost 0 to 55 and Lateral). Compensatory mitigation for these
approximately 3 acres of impacts would occur through in-lieu fee programs or wetland
creation, enhancement, or restoration.
The in-lieu program referred to as “payment to provide mitigation” is administered by DSL
and applicable to projects where no bank credits are available, and impacts are relatively
small. Legislation passed in 2003 requires the fee to be based upon the average cost of

credits available from all active mitigation banks in the state, calculated annually. The latest
fee structure can be found at the DSL web site under Wetland Resources
(http://www.oregon.gov/DSL/). Administrative rules outline DSL’s responsibilities for the
program (Oregon Administration Rules [OAR] 141-085-0156 & 0161). The new EPA and
USACE Wetland Compensatory Mitigation Rule (March 2008) identifies payment in-lieu as
the next option, after mitigation banks, in their three-level compensatory mitigation
hierarchy. Whether or not in-lieu fee payment will be made for the approximately 4 acres of
permanent Cowardin class change between Pipeline mileposts 0 and 55 and along the
Lateral will be determined through discussions with DSL and USACE during the permit
review process.

Onsite or Offsite Wetland Creation, Restoration, or Enhancement for Permanent Cowardin Class
Changes. If no credits, or incomplete credits, for the shrub and forested wetlands permanent
Cowardin class change, can be secured from the available mitigation banks or in-lieu fee
programs, Oregon LNG will further investigate opportunities for onsite or offsite wetland
creation, restoration, or enhancement. Creation is constructing a wetland in an area that
never historically supported wetlands. Restoration is re-establishing wetland hydrology and
vegetation to a site that was historically wetland but has been dried by diking, draining, or
filling. Enhancement is improving an existing but badly degraded wetland by correcting the
conditions that are causing the degradation.
The DSL rules set minimum ratios for required mitigation acreage per acre of project
wetland impact. These ratios vary based on the type of compensatory mitigation, as follows:

•      Creation ratio—1.5:1
•      Restoration ratio—1:1
•      Enhancement ratio—3:1
•      Enhancement of cropped wetland—2:1
Oregon LNG will investigate opportunities for creation, restoration, or enhancement located
within the same watershed as the impacts, and located where lost functions can be most
successfully replaced. The total acreage of onsite or offsite wetland mitigation will depend
on the final mixture of creation, restoration, or enhancement that occurs. Discussions to
determine the availability of land within and outside the 50-foot permanent and 75-foot
construction easements for compensatory wetland mitigation sites are underway.
Discussions have been held with landowners in the Lower Columbia and Nehalem
watershed subbasins expressing interest in use of their land for wetland mitigation.
Areas shown on Figure 2J-1 as columns C and D will be used for construction only and will
not be maintained during Pipeline operation. Where these areas are adjacent to existing
wetlands and consist of low functioning agricultural, herbaceous, or scrub-shrub wetlands,
they will be considered for restoration or enhancement to higher functioning scrub-shrub or
forested wetlands. This approach will focus restoration and enhancement efforts on lands
affected by the Project and where wetlands have historically occurred.
Oregon LNG has initiated discussions with owners of large industrial forest property in the
northern portion of the Coast Range to discuss mitigation opportunities on their properties.
Landowners have expressed a willingness to negotiate with Oregon LNG. Thus, although

specific sites have yet to be identified, it appears that landowners may be willing to provide
sites for mitigation.
Once potential appropriate sites are identified, negotiations with the respective landowners
will commence, followed by: site data collection; draft mitigation site design; DSL, USACE,
and EPA coordination and review; and final mitigation site design. This will be completed
in keeping with the permit processing schedule outlined in Resource Report 1.
