5.1   SUPERVISED CROSSINGS AT WALLAN PRIMARY SCHOOL
      Cr Marstaeller tabled a petition signed by approximately 104 signatories which
      reads:                          R
      “We as parents have a responsibility tour children and their safety. The
      council needs to acknowledge that supervised crossings are need at the
                              FI
      school. There is currently ONE supervised crossing but many have to cross
      Queen St to use it. The school is on a hill, making it very hard to see over
                       N

      the rise from Dudley Street, down Queen Street. Parking is terrible, traffic
      is busy, 2 roundabouts....
      How can we expect our children not to get distracted when crossing!!!

      There have been a few near misses at the school. We must protect our
      children. Must a child lose their life before something is done? I certainly

      hope not and hope the council agrees.

      I will be taking these signatures to council. I request that a supervised

      crossing be place on both Dudley and Queen Street Wallan. We have to
      be the voice for our children, no one else will be!!!”

Summary
Council officers are currently completing an assessment of all Council owned
disabled parking bays within the municipality. In close consultation with Mitchell Shire
Council’s Access and Inclusion Committee, officers are completing a final
assessment report for Council to consider.

of the assessment and an update on progress to date.

At the Council meeting on 10 April 2012 a notice of motion was moved that:

“Council Officers prepare a report on all Council owned disabled parking bays in the
Shire. The report should also include an assessment as to how improvements can be
                        N

made to provide safe access to footpaths from disabled parking bays”.

The disabled parking access assessment is in accordance with the Mitchell Shire
Council Disability Action Plan 2009-2012: “To improve physical access for people

with a disability through capital works” and “to increase access to public facilities”

Issues

The objectives of this disabled parking assessment are as follows:

•     Identify all existing Council managed disabled parking bays in each township.
•     Conduct a Disability Discrimination Act (DDA) audit assessment on all of
      Council’s disabled parking bays in each township.
•     Prepare a rectification plan for all non-standard Council managed disabled
      parking bays identified in the assessment. This plan is to be referred to future
      capital works programs for consideration. The Access and Inclusion Committee
      will be consulted when prioritising the works under this program.

All Council managed disabled parking bays have been identified with details for each
township listed below:

Council Officers are currently compiling maps which illustrate these locations. These

maps will be included into Council’s geographic information system and will be
available as part of the completed assessment.

Disability Discrimination Act (DDA) audit assessments are currently being undertaken

by Council officers. All sites in Seymour have been completed and officers are
currently working through the remaining list of identified disabled parking bays within
                                  FI
the municipality. It is anticipated that this work will be completed by the end of
November 2012.

As part of the assessment, Council officers are also developing a set of standard

drawings for Council managed disabled parking bays.

A draft set of drawings has been completed and these are currently being considered
by the Access and Inclusion Committee. These drawings have been based on the
Australian Standards for Disabled Parking and further developed in liaison with the

Access and Inclusion Committee members, to ensure best practice principles are
achieved. It is expected that these drawings will be finalised by October 2012.

These drawings are to be implemented in all future works to ensure best practice
outcomes are achieved within Mitchell Shire Council.

Financial, Resource and Asset Management Implications
The implementation of the rectification plan for all non-standard Council managed
disabled parking bays, identified in the assessment, will be considered in future
capital works budgets.

Environment and Sustainability Implications
The work done to date has had no environmental or sustainability implications.

The implementation of any proposed works will be undertaken in accordance with
regulations which minimise impacts to the environment.

Consultative Procedures
The Access and Inclusion Committee has been consulted during the preparation of
the disabled parking access assessment.

The Access and Inclusion Committee has also had input into the development of the
standard drawings for Council owned disabled car park bays.

The Committee will continue to have input into the prioritisation of the rectification
plan for all non-standard Council managed disabled parking bays, identified in the
assessment.

Conclusion
Progress on the preparation of this assessment includes location of all Council
owned disabled parking bays within the Shire. Each of these locations is currently
being mapped while Officers continue to conduct a DDA audit assessment of each
bay.

Following completion of the mapping and the DDA audits, design drawings to ensure
that current and future disabled parking bays comply with the Australian Standards

for disabled parking will be finalised and presented to Council.

Finally, as a result of this assessment, a prioritised list of proposed rectification works

to ensure compliance with the Australian Standards will presented to Council for
consideration in future budgets.

Mitchell Shire Council and the owner/s, of the land known as:

Background
                               FI
1.   Planning Permit P305067/07 was issued for a 69 lot subdivision in accordance
     with the endorsed plans. Condition 3 of the permit requires the owner to enter
     into a Section 173 Agreement to provide for as follows:
                        N

     a)    Buildings must not be constructed within the 15m buffer zone as shown on
           the endorsed plans;
                O


     b)    Each lot must be developed with a 3m wide landscape buffer where the lot
           abuts a road and must accord with condition 4 e) prior to the occupation of
           any buildings on site. This requirement does not apply to lots 6-9 on the
           C



           surveyors plan 5266/12 Version 17 where the lots are developed in
           accordance with planning permit P304981/07.01;
 N




     c)    All fencing abutting a road must be dark coloured with a transparent mesh
           material (i.e. no solid fencing);
     d)    All waste storage areas must not be located within areas visible from the
U




           street (e.g. located within buildings);
     e)    Each owner is required to maintain the 15m buffer in accordance with the
           endorsed landscape plans;
     f)    Signage must not be erected above the roof line of buildings; and
     g)    All buildings setback at least 10m from the front boundary with car parking
           provided to the front or side of the building. This requirement may be
           varied if agreed to in writing by the Responsible Authority.
     h)    The owner must pay the reasonable costs for the preparation, execution
           and registration of the Section 173 Agreement.

SECTION 173 AGREEMENTS (CONT’D)

     i)    A copy of the Titles Office registration number (dealing number) for the
           Section 173 Agreement must be provided to Council as proof of
           registration prior to the issue of the statement of compliance.

2.   Planning permit P305748/09 was issued for a 4 lot subdivision in accordance
     with the endorsed plans. Condition 4 of the permit requires the owner to enter
     into a Section 173 Agreement which requires that:

     a)    The land cannot be further subdivided.
     b)    Prior to the sale of any lot created by the amendment to Planning Permit
           P305748/09 or construction of a dwelling on a lot, legal vehicle access

           must be constructed to that lot including the access road to the property to
           the satisfaction of the Responsible Authority.
     c)    Until such time as legal vehicle access is constructed as outlined in (b)
           above, access must not occur over Public or Crown land without the
           written permission and/or approval of the relevant authority.

Summary

This report provides an overview of the Goulburn River High Country Rail Trail
(GRHCRT) Advisory Committee and a summary of the discussions held at its
meetings that occurred on 16 May, 20 June and 15 August 2012. Cr Graeme Coppel
and Jeff Saker, Director Engineering & Infrastructure attended the meetings on
behalf of Council.

Background
The Goulburn River High Country Rail Trail Management Plan September 2011 and

the Memorandum of Understanding between Mitchell Shire Council, Murrindindi
Shire Council and Mansfield Shire Council both make reference to the Advisory
Committee as follows:

 “a new committee known as the Goulburn River High Country Rail Trail Advisory
Committee was to be established to guide and inform decision making by the three

Councils with respect to the management and maintenance of the Rail Trail. The
role of the committee will be to assist the three Councils to oversee the ongoing
development and promotion of the trail.”

The Committee is not delegated to make decisions on behalf of Councils but will
provide advice as necessary. More specifically the role of the GRHCRT Advisory

     Advise Councils on matters of trail management as they relate to the terms of the
     GRHCRT Management Plan and MOU.
•    Promote a co-operative and coordinated approach to trail management and

     further community and business complementing initiatives across the three
     Municipalities.

Whilst the GRHCRT Advisory Committee may provide input into the development of
maintenance standards for the Rail Trail, responsibility for the negotiation and
agreement of maintenance standards will remain with the respective Councils.
