Notice is hereby given that Westminster City Council proposes to make a Dog
Control Order pursuant to its powers under Section 55 of the Clean Neighbourhoods
and Environment Act 2005.

Representations are hereby invited on the proposals to make the following Dog
Control Order:

PROPOSED ORDER:

Fouling of Land by Dogs

This order will apply to any land which is open to the air and to which the public are
entitled or permitted to have access ( with or without payment) within the area of the
City of Westminster.

It will be an offence for any person in charge of a dog, which defecates at any time
on any land within the City of Westminster, not to remove the faeces from the land
forthwith.

The order will not apply to a person who is registered as a blind person in a register
compiled under section 29 of the National Assistance Act 1948, or to a person who
has a disability which affects their mobility, manual dexterity, physical co-ordination
or ability to lift , carry or otherwise move everyday objects, in respect of a dog trained
by Dogs for the Disabled ( registered charity number 700454), Support Dogs (
registered charity number 1088281) or Canine Partners for Independence (
registered charity number 803680) and upon which they rely for assistance.


Penalty

Anyone who commits an offence under any of the provisions of the Dog Control
Order may be liable on conviction in the Magistrates Court to a fine not exceeding
level 3 on the standard scale ( currently £1000 ).

Westminster City Council intends to issue £80.00 fixed penalty notices for the above
mentioned Dog Control offence. Failure to pay a fixed penalty notice may result in
prosecution.
Consultation

Any representations on the proposed Dog Control Order should be made to
Westminster City Council before the end of the consultation period on 2nd May 2008.
