36.     MINUTES

        The Minutes of the Meeting of the Planning Applications Sub-Committee held on 13th
        August 2012 were received.

                                             record and signed by the Chairman.

37.   INTERESTS

      (a)      Members of this Council who are also Members of Braintree District Council
               confirmed that, whilst considering planning applications at the Town Council
               any opinion that may be given will be based on the information that is known
               to date. Each Councillor confirmed that he/she will not be held by opinions
               given or comments made at Meetings of Witham Town Council, but will
               approach further meetings with an open mind and furthermore, he/she will
               consider any additional information and/or representations that may be
               received prior to the meeting of the District Council and form a judgement on
               that occasion.


                                              RESOLVED That the interest of Councillor P.
                                              Horner be noted.



      (b)      Councillor J.C. Goodman declared a non-pecuniary interest in item 4(a)
               application no 12/00202/TPO as the agent is known to him.


38.   QUESTIONS AND STATEMENTS FROM THE PUBLIC

      There were no members of the public present.

39.   PLANS

                                      Notice of intent to carry out works to trees in a
                                      Conservation Area – Shorten 2 Cypress trees by half
                                      and shorten 1 Cypress tree by 1/3rd.

      12/01071/OUT                    PONDHOLTON FARM, MALTINGS LANE,
                                      WITHAM
                                      Revised master plan for a missed use development
                                      comprising a commercial area for employment,
                                      neighbourhood centres, community facilities including
                                      food retail, non-food retail, a pub/restaurant, Class B1
                                      office, retail warehousing, other uses within Classes A1
                                      to A5, children’s day nursery, health centre, sports

                                      facilities, residential dwellings, open space, landscaping
                                      and ancillary infrastructure at land to the south of
                                      Hatfield Road forming part of the Maltings.

                                      Members agreed that unless a realistic approach is
                                      taken to some changes in the masterplan the site will
                                      remain in its current unfinished state. Concern was
                                      expressed at the potential impact on the Town Centre
                                      from out of town retail provision despite the Retail
                                      Assessment. Councillor S.J. Goodfellow objected to
                                      the plans on this specific issue.


                                              RESOLVED recommend approval subject to:

                                                     the concerns raised by the Police being
                                                      satisfactorily addressed
                                                     Witham Town Council being fully
                                                      consulted on any changes to the current
                                                      S.106 Agreement.

                                              Councillors believe that the clause in the S.106
                                              Agreement requiring the community buildings,
                                              business park and infrastructure to be in place
                                              before any further residential dwellings are built
                                              is non-negotiable and must be retained in any
                                              future S.106 Agreement.



     LIST NO 33

     12/01093/FUL                     CEDAR HOUSE, 21A COLLINGWOOD ROAD,
                                      WITHAM
                                      Erection of 3no new build houses with associated
                                      amenity spaces and a new access drive.



                                              RECOMMEND REFUSAL on the grounds of
                                              over-development of site. Although Councillors
                                              welcome the proposal to retain and refurbish
                                              Cedar House.

      12/01097/PDE                    SOUTH EAST GALVANIZERS LTD, CRITTALL
                                      ROAD, WITHAM
                                      Application for Prior Notification of Proposed
                                      Demolition - Demolition of existing steel framed, metal
                                      clad galvanizing plant.


                                              NO OBJECTION although as this proposal
                                              was approved as part of Application no
                                              10/01722/FUL, Councillors do not feel consent
                                              is required



      12/01053/FUL                    TEMPLARS ESTATE LAND ADJOINING
                                      CONRAD ROAD, WITHAM
                                      Replace existing Greenfields Housing owned 57 no
                                      lighting columns and 41no wall lights.


                                              RECOMMEND APPROVAL



      12/01108/FUL                    17 HOWBRIDGE ROAD, WITHAM
                                      Erection of front porch.


                                              NO OBJECTION



39.   TRAFFIC REGULATION ORDERS

      a.    TRO/02/121 Disabled Parking Bay/Residents Parking Permit – Newland Street –
            SUPPORTED.

      b.    Double Yellow Lines – junction Laurence Avenue and Sauls Avenue -
            SUPPORTED – although felt unlikely to be necessary.

      c.    Extension parking restriction Station Road to Janmead in Avenue Road – NO
            COMMENT – although felt unlikely to be necessary.

      (b)      It was agreed that no personal representations should be made.

40.   DECISIONS

      Decisions relating to planning application from 31st July to 10th August 2012 were
      received.

                                              and noted.
