Annotated provisional agenda
Item 1: Opening of the meeting
1. The Conference of the Parties to the Basel Convention will hold its ninth meeting from 23 to
27 June 2008 at the Bali International Convention Centre, Nusa Dua, Bali, Indonesia. The meeting will
be opened at 10 a.m. on Monday, 23 June 2008.
2. Opening statements will be delivered by the President of the eighth meeting of the Conference
of the Parties and by representatives of the host country, the Secretariat of the Basel Convention and the
United Nations Environment Programme (UNEP).
Item 2: Election of the President and other officers
3. At the commencement of the first session of the meeting, a president, three vice-presidents and a
rapporteur are to be elected from among the representatives of the Parties present at the meeting. They
will serve as the Bureau of the meeting. The election of the President will be presided over by the
President of the eighth meeting of the Conference of the Parties.
Item 3: Adoption of the agenda
4. The Conference of the Parties will adopt its agenda and may wish to take into account the
present annotated provisional agenda when so doing.

Item 4: Organization of the meeting
5. The Conference of the Parties will have before it a scenario note prepared by the Secretariat that
is intended to assist delegates in preparing for the ninth meeting of the Conference of the Parties and, in
particular, to highlight those agenda items that may raise the key issues for the meeting. The scenario
note also contains proposals for the organization of the meeting for consideration by the Conference of
the Parties.
6. It is proposed that, following the opening of the meeting on Monday, 23 June 2008, the
Conference of the Parties should establish a Committee of the Whole to facilitate deliberations at the
technical level. The Committee of the Whole could convene for three days and establish such contact
groups as may be necessary to assist consultations. It is proposed that the high-level segment should be
convened on Thursday, 26 June 2008 and Friday, 27 June 2008. The first day of the high-level segment
would comprise a one-day world forum on waste management for human health and livelihood,
focusing on the theme of the Conference. The second day would focus on the adoption of decisions and
any declarations that the Conference of the Parties may wish to issue.
7. For reasons of economy, information documents for the meeting will be made available to
delegates on CD-ROM only and text in annexes to all pre-session documents will be presented in
English only.

Item 5: Theme of the ninth meeting: Waste management for human health and
livelihood
8. The Conference of the Parties will have before it a note prepared by the Secretariat, at the
request of the Expanded Bureau, with a view to facilitating consideration of the Conference’s theme. A
world forum on waste management for human health and livelihood will be convened during the
high-level segment. In the context of this forum, the Conference of the Parties may wish to reaffirm its
commitment to the original objectives of the Convention, that is, to protect human health and the
environment from the adverse effects that may result from the generation and management of hazardous
and other wastes. The Conference of the Parties may also wish to discuss how continued and sustained
efforts towards meeting these objectives may contribute to attaining the Millennium Development Goals
related to human health and livelihood and, thus, to sustainable development. These deliberations will
be assisted by statements delivered by eminent speakers drawn from various backgrounds. The
Conference of the Parties may wish to consider adopting a declaration associated with the theme of the
meeting.

Item 6: Compliance Committee
9. By decision VI/12, the Conference of the Parties established a mechanism for promoting
implementation of and compliance with the obligations under the Basel Convention and a committee
charged with administering the mechanism, which is known as the Committee for Administering the
Mechanism for Promoting Implementation and Compliance (“the Compliance Committee”).
10. By decisions VIII/31 and VIII/32, the Conference of the Parties, among other things:
(a) Approved the Committee’s work programme for 2007–2008;
(b) Requested the Committee to report to the Conference of the Parties at its ninth meeting
on the work it had carried out to fulfil its functions in accordance with paragraphs 23 and 24 of its terms
of reference.

11. The Conference of the Parties will receive a report on the work of the Compliance Committee
over the biennium 2007–2008 and a proposed programme of work for the biennium 2009–2010
(UNEP/CHW.9/3). Included among the proposals for the work that the Compliance Committee could
undertake in 2009–2010 to facilitate Parties’ implementation of the Convention is a request to the
Conference to consider establishing a special source of funding, within the Technical Cooperation Trust
Fund, that the Committee could make available to support the implementation efforts of Parties in need
of such assistance.
12. The terms of office for five members of the Committee, one from each of the five regional
groups of the United Nations, will expire at the end of the ninth meeting of the Conference of the Parties
and it will, therefore, be necessary to hold elections during the present meeting. Accordingly, the
Secretariat has issued a communication to all Parties requesting them to submit nominations for the five
candidates. The Conference of the Parties will be invited to consider the nominations for these five
positions and to elect five new members to the Committee to serve a tenure of two terms. 1
13. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/2.

Item 7: Implementation of the decisions adopted by the Conference of the Parties at its
eighth meeting
(a) Strategic Plan for the Implementation of the Basel Convention (to 2010)
(i) Report on the work programme
14. By decision VIII/33, the Conference of the Parties approved the programme and budget for the
biennium 2007–2008. The programme comprises a global programme and a programme to support the
implementation of the Strategic Plan focus areas.
15. The Conference of the Parties will receive a succinct report on the Secretariat’s implementation
of the programme for the biennium 2007–2008 (UNEP/CHW.9/4). A detailed report will also be
presented (UNEP/CHW.9/INF/3).
16. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/4.
(ii) Programme framework until 2010
17. By decision VI/1, the Conference of the Parties adopted the Strategic Plan for the
Implementation of the Basel Convention (to 2010) to give further effect to the Basel Declaration on
Environmentally Sound Management.2 By decision VIII/10, the Conference of the Parties included
consideration of the developments and obstacles in the implementation of the Strategic Plan in the work
programme of the Open-ended Working Group. By decision OEWG-VI/28, the Open-ended Working
Group recommended that the Conference of the Parties should initiate a review of the Strategic Plan to
take place between its ninth and tenth meetings.

18. The Conference will receive a progress report on the implementation of the Strategic Plan since
2006 (UNEP/CHW.9/4). A further report, taking into account the review of the operation of the Basel
Convention regional and coordinating centres and the role of the Basel Convention Partnership
Programme, will be presented (UNEP/CHW.9/INF/4). Comments submitted by five Parties will also be
presented (UNEP/CHW.9/INF/5).
19. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/5.
(iii) Follow-up to the Strategic Plan beyond 2010
20. As the end of the period for which the Strategic Plan was adopted is approaching, there is a need
for the Conference of the Parties, at its tenth meeting to be held in 2010, to consider establishing a new
tool to guide policy and implementation, along the lines of the Strategic Plan, for the period beyond
2010. The Conference of the Parties may, therefore, wish to consider initiating, at its ninth meeting, a
process that may lead to a new strategic plan being developed for its consideration at its tenth meeting.
21. The Conference of the Parties may wish to adopt a decision on initiating a process for the
elaboration of a new strategic plan, as set out in document UNEP/CHW.9/6.

(b) Basel Convention regional and coordinating centres
1. Review of the operation of the Basel Convention regional and coordinating centres
22. By decision VIII/4, the Conference of the Parties requested the Open-ended Working Group to
initiate, at its sixth session, a review of the operation of the Basel Convention regional and coordinating
centres, including their relationship with Convention bodies, the Secretariat and other stakeholders, to
enhance the combined effectiveness and capacity of the centres and the Secretariat. Parties were also
invited to submit their views on the objectives and scope of the review for consideration and action.
23. The Conference of the Parties also requested the Secretariat to prepare a report for the
Open-ended Working Group at its sixth session on its review of the centres and, in the light of the
discussion at that meeting, to prepare a report on the same topic for the Conference of the Parties at its
ninth meeting.
24. The Open-ended Working Group initiated the review at its sixth session and, by decision
OEWG-VI/2, requested the Secretariat to prepare a report on the operation of the Basel Convention
regional and coordinating centres in accordance with the terms of reference and detailed requirements
set out in that decision and to publish the report on the Basel Convention website by 15 December 2007
for consideration by Parties, signatories and the regional and coordinating centres. In addition, Parties,
signatories and the regional and coordinating centres were invited to submit comments on the report by
31 January 2008.

25. The draft report was published on the Basel Convention website3 and the final report will be
presented to the Conference of the Parties (UNEP/CHW.9/INF/6). A compilation of the comments
made by the Parties, signatories and regional and coordinating centres on the draft report will also be
presented (UNEP/CHW.9/INF/7).
26. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/7.
2. Review of the proposal for the establishment of a regional centre for South Asia in the South Asia
Co-operative Environment Programme
27. By decision VIII/3, the Conference of the Parties mandated the Open-ended Working Group at
its sixth session to consider in detail a proposal submitted by the South Asia Co-operative Environment
Programme (SACEP) for the establishment of a regional centre for South Asia, based on the feasibility
study for the establishment of the centre prepared by SACEP. The decision requested the Secretariat to
submit the recommendations of the Open-ended Working Group to the Conference of the Parties at its
ninth meeting for its consideration and action.
28. The Open-ended Working Group at its sixth session requested the Secretariat to review the
proposal from SACEP (UNEP/CHW.9/INF/8) for submission to the Conference of the Parties at its
ninth meeting. That review will be presented to the Conference of the Parties (UNEP/CHW.9/INF/9).
29. The Conference of the Parties may wish to proceed along the lines proposed in document
UNEP/CHW.9/8.

30. The Nairobi Declaration on the Environmentally Sound Management of Electrical and
Electronic Waste and decision VIII/2 were adopted by the Conference of the Parties at its eighth
meeting. By decision OEWG-VI/23 on a workplan on electrical and electronic waste (e-waste) for

2009–2010, the Open-ended Working Group, among other things, invited Parties and others to submit
proposals on additional elements of the workplan on e-waste to the Secretariat by 30 November 2007.
31. The Conference of the Parties will receive information on past, present and future activities on
e-waste under the Basel Convention and a proposed e-waste workplan as requested in decision VIII/2
for its consideration. The Conference of the Parties may wish to establish a contact group to consider
the proposed workplan on e-waste for 2009–2010.
32. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/9.

33. By decision VIII/5, the Conference of the Parties requested the Secretariat to report on progress
on the workplan of the Partnership Programme for 2007–2008 and to prepare a workplan for 2009–2010
to be presented to the Conference of the Parties at its ninth meeting.
34. A report on progress on the 2007–2008 workplan, highlighting key points concerning the
development of the Partnership Programme and the sustainability of partnerships, will be presented to
the Conference of the Parties (UNEP/CHW.9/10). A proposed workplan for 2009–2010 will also be
presented (UNEP/CHW.9/10).
35. In the context of partnerships to be initiated through the Basel Convention regional and
coordinating centres, the Conference will be invited to consider how to stimulate action by, for example,
investing in additional financial support, or through further assistance from the Secretariat to develop
partnerships. With regard to the partnerships listed in the existing Partnership Programme workplan, the
Secretariat will seek guidance on how this work might be reported on in the future, as defined in
documents UNEP/CHW.8/2/Add.2 and UNEP/CHW/OEWG/6/18. The Secretariat will also present
information on the partnerships under the Basel Convention, based on experience, discussions and the
outcome of Conference of the Parties and other relevant meetings (UNEP/CHW.9/INF/14 on future
directions for partnerships).
36. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/10.
1. Mobile Phone Partnership Initiative
37. By decision VIII/6, the Conference of the Parties provisionally adopted a guidance document on
environmentally sound management of used and end-of-life mobile phones. That document summarized
the five guidelines developed by the Mobile Phone Partnership Initiative. The Conference of the Parties
encouraged Parties and stakeholders to initiate pilot projects to test the guidelines and the guidance
document. Parties were also requested to review the guidance document and subsequently submit any
revisions to the Conference of the Parties at its ninth meeting for consideration and final adoption.
38. By decision OEWG-VI/21, the Open-ended Working Group requested Parties to submit
comments on the guidance document. The guidance document, as revised and agreed upon by the
Mobile Phone Working Group, will be presented to the Conference of the Parties (UNEP/CHW.9/11).
A report on progress of the Mobile Phone Partnership Initiative will also be presented
(UNEP/CHW.9/INF/16).

39. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/12.
2. Partnership for Action on Computing Equipment
40. In accordance with decision VI/22 and in support of the Nairobi Declaration, the Partnership for
Action on Computing Equipment, an interim group, was established to develop the elements for a
multi-stakeholder partnership. Document UNEP/CHW.9/INF/12 will provide the Conference of the
Parties with information on activities, the membership of the group and the creation of the Partnership.
41. The Conference of the Parties may wish to adopt the interim group’s recommendations on the
establishment of a multi-stakeholder partnership, along the lines of the draft decision set out in
document UNEP/CHW.9/10.

(e) Cooperation and coordination between the Basel, Rotterdam and Stockholm Conventions
42. By decision VIII/8, the Conference of the Parties agreed, among other things, to participate in
the process specified in decision SC-2/15 of the Conference of the Parties to the Stockholm Convention
on Persistent Organic Pollutants, including the establishment of an ad hoc joint working group on
enhancing cooperation and coordination among the Basel, Rotterdam and Stockholm Conventions,
which would make joint recommendations to the conferences of the parties of all three conventions,
including the Conference of the Parties to the Basel Convention at its ninth meeting.
43. The Ad hoc Joint Working Group on Enhancing Cooperation and Coordination among the
Basel, Rotterdam and Stockholm Conventions met three times and developed a recommendation for
transmittal to the conferences of the Parties to the three conventions. The Conference of the Parties will
be invited to consider that recommendation (UNEP/CHW.9/14) and may wish to consider adopting it.
44. To assist its consideration of this issue, the Conference of the Parties will receive a summary,
prepared by the co-chairs of the Working Group, of the Group’s work (UNEP/CHW.9/INF/19) and a
note providing further information on the costs and organizational implications of establishing certain
joint services of the Basel, Rotterdam and Stockholm Conventions as proposed by the Working Group
(UNEP/CHW.9/INF/20).

45. The Conference of the Parties may wish to establish a contact group to consider the Working
Group’s recommendation.

(f) International cooperation and coordination
46. By decision VIII/7, the Conference of the Parties requested the Secretariat to strengthen further
cooperation and coordination with international and regional organizations and multilateral
environmental agreements in areas of relevance to the Basel Convention. The Secretariat was also
requested to seek observer status on the Committee on Trade and Environment of the World Trade
Organization and to report on the implementation of the said decision to the Conference of the Parties at
its ninth meeting.
47. The Conference of the Parties will receive a report on cooperation with international and
regional organizations, multilateral environmental agreements and non-governmental organizations
during the biennium 2007–2008 (UNEP/CHW.9/15). The Secretariat will also provide an oral report on
the status of its application for observer status on the Committee on Trade and Environment of the
World Trade Organization.
48. By decision VIII/9, the Conference of the Parties requested work to be undertaken on
cooperation between the Basel Convention and the International Maritime Organization and on the
respective competencies of the Basel Convention and the International Convention for the Prevention of
Pollution from Ships, 1973, as modified by the Protocol of 1978 related thereto, any gaps between those
instruments and any options for addressing those gaps.
49. A report will be presented to the Conference of the Parties on steps taken to implement that
decision (UNEP/CHW.9/16). A compilation of information and views received in response to the
request made in decision VIII/9 will also be presented to the Conference of the Parties
(UNEP/CHW.9/INF/22).
50. The Conference of the Parties may wish to adopt decisions along the lines of the draft decisions
set out in documents UNEP/CHW.9/15 and UNEP/CHW.9/16.

(h) Technical matters
1. Revised technical guidelines on environmentally sound management of used tyres
54. By decision VIII/17 on technical guidelines on environmentally sound management, the
Conference of the Parties, among other things, invited Brazil to prepare draft revised technical
guidelines on used tyres. By decision OEWG-VI/3, the Open-ended Working Group agreed to establish
a small intersessional working group on the revision of the technical guidelines on used tyres and
invited Brazil to prepare, in consultation with the small intersessional working group, a revised version
of those guidelines by 31 March 2008, based on comments to be received by 31 January 2008.
Accordingly, Brazil prepared two revised draft technical guidelines on 10 March 2008 and 31 March
2008, respectively. The latest versions of these guidelines will be presented for consideration by the
Conference of the Parties.
55. The Conference of the Parties may wish to establish a contact group on technical matters to
consider the draft revised technical guidelines on used tyres.
56. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/18.
2. Technical guidelines on environmentally sound management of mercury waste
57. By decision VIII/33 on the programme and budget for the Basel Convention for 2007–2008, the
Conference of the Parties agreed to include a new Strategic Plan focus area on mercury and asbestos
wastes. By decision OEWG-VI/20, the Open-ended Working Group took note of the draft technical
guidelines on the environmentally sound management of mercury wastes and encouraged Parties to
contribute to their further development. The Working Group also recommended that the Conference of

the Parties at its ninth meeting should consider whether the work on the development of the technical
guidelines should be included in the work programme of the Open-ended Working Group for the next
budget cycle. The Conference of the Parties will receive a report on the status of the development of the
technical guidelines on environmentally sound management of mercury waste (UNEP/CHW.9/19 and
UNEP/CHW.9/INF/24).
58. The Conference of the Parties may wish to establish a contact group on technical matters to
consider:
(a) The inclusion of this task in the work programme of the Open-ended Working Group for
2009–2010;
(b) Comments received from Parties and other stakeholders on the draft technical guidelines
on environmentally sound management of mercury waste (UNEP/CHW.9/INF/25, Add.1 and Add.2).
59. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/19.
3. Persistent organic pollutants
(i) Technical guidelines on environmentally sound management of persistent organic pollutants
60. By decision VIII/16, the Conference of the Parties adopted technical guidelines on persistent
organic pollutants and requested the Secretariat to disseminate them. Parties and others were also
invited to use the technical guidelines and to submit, not later than two months before the ninth meeting
of the Conference of the Parties, reports to the Conference of the Parties, through the Secretariat, on
their experience in the application of the guidelines, including on the definition of low persistent organic
pollutant content and on levels of destruction and irreversible transformation and any difficulties or
obstacles encountered, with a view to improving them as necessary. By paragraph 8 of decision VIII/16,
the Conference of the Parties invited Parties and others to submit comments to the Secretariat on issues
referred to in subparagraphs 7 (b) and 7 (c) of that decision.
61. By decision OEWG-VI/5, the Open-ended Working Group invited Parties and others to submit
to the Secretariat by 31 January 2008 comments on the issues referred to in subparagraphs 7 (a) and
7 (b) of decision VIII/16.
62. A report will be presented to the Conference of the Parties on the responses received from
Parties and other stakeholders to the requests made in decisions VIII/16 and OEWG-VI/5
(UNEP/CHW.9/20).
(ii) Amendment of entries relating to persistent organic pollutants
63. By decision VIII/16, the Conference of the Parties invited Parties and others to submit
comments to the Secretariat on issues referred to in subparagraph 7 (c) of that decision concerning the
consideration of the amendment of entry A4110 in Annex VIII of the Basel Convention, relating to
produced polychlorinated dibenzo-p-dioxins and polychlorinated dibenzofurans, and other relevant
entries relating to pesticide persistent organic pollutants and DDT, in order to include a concentration
level for those persistent organic pollutants. By decision OEWG-VI/9, the Open-ended Working Group
invited further comments from Parties and others on that issue by 29 February 2008.
64. A report will be presented to the Conference of the Parties on the responses received from
Parties and other stakeholders to the requests made in decision VIII/16 (UNEP/CHW.9/20).
(iii) Stockholm Convention revised draft guidelines on best available techniques and provisional
guidance on best environmental practices
65. By paragraph 11 of decision VIII/16, the Conference of the Parties welcomed the fact that the
bodies of the Stockholm Convention were considering best available techniques and best environmental
practices with respect to unintentionally produced persistent organic pollutants, including the more
recent technologies for destruction and irreversible transformation listed in the general technical
guidelines developed under the Basel Convention, and invited experts of the Basel Convention to
contribute to that work.
66. By decision OEWG-VI/6, the Open-ended Working Group requested the small intersessional
working group established by decision OEWG-I/4 to consider, taking into account the discussions at the

sixth session of the Open-ended Working Group and the comments received from Parties on Stockholm
Convention decision SC-3/5, the waste-related aspects of the revised guidelines on best available
techniques and provisional guidance on best environmental practices, in particular the section entitled
“waste management considerations”. It was further requested to report the results of that work, through
the Secretariat, to the Conference of the Parties for consideration at its ninth meeting. Parties and others
were invited to submit to the Secretariat by 29 February 2008 comments on the need to invite the
appropriate bodies of the Stockholm Convention to develop, where not yet available, guidelines on best
available techniques and guidance on best environmental practices with respect to the processes for the
destruction and irreversible transformation of the persistent organic pollutant content in wastes
contained in the updated general technical guidelines on the environmentally sound management of
wastes consisting of, containing or contaminated with persistent organic pollutants.
67. A report will be presented to the Conference of the Parties on the responses received from
Parties and other stakeholders to the requests made in decisions VIII/16 and OEWG-VI/6
(UNEP/CHW.9/20). The Conference of the Parties may wish to establish a contact group on technical
matters to consider the items on persistent organic pollutants.
68. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/20.
4. Review of other selected technical guidelines pursuant to decision VIII/17, e.g., on incineration on
land (D10), specially engineered landfill (D5) and wastes collected from households (Y46)
69. By decision VIII/17 on technical guidelines on environmentally sound management, the
Conference of the Parties requested the Open-ended Working Group to undertake a review of selected
technical guidelines as appropriate and initiate updating as necessary, e.g., incineration on land (D10),
specially engineered landfill (D5) and wastes collected from households (Y46).
70. By decision OEWG-VI/4, the Open-ended Working Group reiterated the invitation to countries
and other stakeholders to provide comments regarding the review and updating of those guidelines and
on their experiences of implementing them, by 30 March 2008.
71. A report will be presented to the Conference of the Parties on the responses received from
Parties and other stakeholders to the requests made in decisions VIII/17 and OEWG-VI/4
(UNEP/CHW.9/21).
72. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/21.
5. Review of work on the guidance papers on H10 and H11 pursuant to decision VIII/21
73. By decision VIII/21 on classification and hazard characterization of wastes, the Conference of
the Parties invited Parties to contribute to the finalization of the guidance paper on hazard characteristic
H10 and the revision of the guidance paper on hazard characteristic H11. At its sixth session, held in
September 2007, the Open-ended Working Group adopted decision OEWG-VI/7 on the review of work
on guidance papers on H10 and H11 pursuant to decision VIII/21.
74. A report will be presented to the Conference of the Parties on the status of work on the guidance
papers and responses received from Parties and other stakeholders to the requests made in decisions
VIII/21 and OEWG-VI/7 (UNEP/CHW.9/22).
75. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/22.
6. Review of cooperation with the World Customs Organization and its Harmonized System
Committee pursuant to decision VIII/20
76. At its eighth meeting, the Conference of the Parties adopted decision VIII/10 on the work
programme of the Open-ended Working Group for 2007–2008 and decision VIII/20 on separate
identification in the World Customs Organization (WCO) Harmonized Commodity Description and
Coding System of certain wastes in Annexes VIII and IX to the Basel Convention. By the latter
decision, the Conference of the Parties requested the Secretariat to cooperate with various WCO bodies,
to continue to make progress in identifying the wastes covered by the Basel Convention in the WCO
Harmonized Commodity Description and Coding System and to report regularly to the Open-ended
Working Group and the Conference of the Parties on progress.

77. The Conference of the Parties will receive a report on the status of the implementation of
decision VIII/20 (UNEP/CHW.9/23).
78. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision

7. Review or adjustment of the lists of wastes contained in Annexes VIII and IX of the Basel
Convention
79. By decision VII/21, the Conference of the Parties adopted corrections to the French language
versions of Annexes VIII and IX of the Basel Convention. By decision VIII/10, the Conference of the
Parties adopted the work programme of the Open-ended Working Group for 2007–2008, which, among
other things, provided for a technical review to be carried out of the wording of entries in the various
language versions of Annexes VIII and IX. By decisions VIII/15 and OEWG-VI/10, the procedure for
the review or adjustment of the lists of wastes contained in Annexes VIII and IX was revised.
80. A report will be presented to the Conference of the Parties on the status of the lists of wastes and
responses received from Parties and other stakeholders, in particular the results of consultations between
Canada and France on the French version of the lists, as requested in decisions VIII/15 and
OEWG-VI/10 (UNEP/CHW.9/24).
81. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/24.
8. Harmonization and coordination
82. Pursuant to paragraph 5 of decision VII/17, the Open-ended Working Group agreed by decision
OEWG-IV/13 to establish a working relationship with the United Nations Subcommittee of Experts on
the Globally Harmonized System of Classification and Labelling of Chemicals. The Open-ended
Working Group also agreed to establish a correspondence group and adopted terms of reference for that
group. The Subcommittee of Experts subsequently adopted a similar decision on the establishment and
terms of reference of the correspondence group, which was thereafter established and commenced its
work. By decision VIII/19, the Conference of the Parties agreed to extend the mandate of the Joint
Correspondence Group and requested the Secretariat to report regularly on the Group’s work to the
Open-ended Working Group and the Conference of the Parties.
83. The Conference of the Parties will receive a report on the status of implementation of decision
VIII/19 (UNEP/CHW.9/25).
84. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/25.
9. National classification and control procedures for the import of wastes contained in Annex IX
85. Reference is made to decisions VI/19, VII/20 and VIII/22 on national classification and control
procedures for the import of wastes contained in Annex IX to the Basel Convention. By decision
OEWG-VI/12, the Open-ended Working Group encouraged those Parties experiencing difficulties with
national classification or control procedures relating to the import of wastes contained in Annex IX that
had not provided the Secretariat with any information on those difficulties to complete the questionnaire
developed for that purpose and return it to the Secretariat, if possible by 30 March 2008.
86. A report will be presented to the Conference of the Parties on the status of national classification
and control procedures for the import of wastes contained in Annex IX to the Basel Convention and
responses received from Parties and other stakeholders to the requests made in decisions VIII/22 and
OEWG-VI/12 (UNEP/CHW.9/26).
87. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/26.
10. Hazardous waste minimization
88. By decision VIII/23 on hazardous waste minimization, Parties and others were invited to
provide comments to the Secretariat by 30 June 2008 on their experiences of hazardous waste
minimization. The Conference of the Parties also requested the Secretariat to prepare a compilation of

the comments received for consideration at the present meeting. The Conference of the Parties will
receive an oral report on the implementation of that decision.

(i) Legal matters
1. Implementation of decision V/32
89. By decision VIII/10, the Conference of the Parties mandated the Open-ended Working Group to
review the implementation of decision V/32 and provide guidance to the Secretariat on steps to be
taken, which could include the development of a strategic plan to strengthen countries’ capacity to
respond to emergencies and the transmittal of a questionnaire regarding incidents as defined under
paragraph 2 (h) of article 2 of the Basel Protocol on Liability and Compensation from Damage
Resulting from Transboundary Movements of Hazardous Wastes and their Disposal.
90. By decision OEWG-VI/14, the Open-ended Working Group invited Parties to provide
comments and suggestions on a draft standard form for requests for assistance under decision V/32, as
set out in annex II to that decision. The revised draft form will be presented to the Conference of the
Parties for its consideration (UNEP/CHW.9/27).
91. By the same decision, the Secretariat was requested to provide information on its lessons
learned from any experience in providing emergency assistance, such as in Côte d’Ivoire, including on
the adequacy of technical and financial assistance that may be provided under decision V/32, so as to

facilitate the review by the Conference of the Parties of the implementation of decision V/32. A note
containing this information will be presented to the Conference of the Parties (UNEP/CHW.9/27).
92. By decision OEWG-VI/14, Parties were invited to complete the questionnaire regarding
incidents as defined under paragraph 2 (h) of article 2 of the Basel Protocol on Liability and
Compensation. Completed questionnaires received from Parties in response to that decision will be
presented to the Conference of the Parties (UNEP/CHW.9/INF/26).
93. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/27.
2. Enforcement: national legislation and other measures adopted by Parties to implement the Basel
Convention and to combat illegal traffic
94. By decisions VIII/24 and VIII/26, the Conference of the Parties requested the Secretariat to
undertake activities related to the prevention and prosecution of illegal traffic and to legal,
administrative and other measures to implement and enforce the provisions of the Convention.
95. A report will be presented to the Conference of the Parties on the steps taken by the Secretariat
to implement such enforcement activities (UNEP/CHW.9/28).
96. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/28.
3. Basel Protocol on Liability and Compensation
97. By decision VIII/25, the Conference of the Parties requested the Secretariat to undertake tasks in
respect of the Basel Protocol on Liability and Compensation.
98. A report will be presented to the Conference of the Parties on the extent to which the Secretariat
has been able to execute those activities, noting that no additional voluntary contributions have been
received for such purposes during the current biennium (UNEP/CHW.9/29).5
99. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/29.
4. Addressing the interpretation of paragraph 5 of Article 17 of the Basel Convention
100. By decision VIII/30, Parties were urged to make every effort to facilitate the early resolution of
how to interpret the expression “who accepted them” in paragraph 5 of article 17 of the Basel
Convention. The Conference of the Parties requested the Open-ended Working Group to address the
issue, taking account of the perception of ambiguity held by many Parties, with a view to resolving it at
the earliest opportunity, and to develop a draft decision to reach an agreed interpretation by the Parties
in accordance with international law for consideration by the Conference of the Parties at its next
meeting.
101. The outcome of the Open-ended Working Group’s work on this issue will be presented to the
Conference of the Parties, including a non-exhaustive list of possible elements for a draft decision, for
its consideration (UNEP/CHW.9/30).
102. A compilation of comments and views provided by Parties in response to the requests made in
decisions VIII/30 and OEWG-VI/16 will be presented to the Conference of the Parties
(UNEP/CHW.9/INF/27).
103. The Conference of the Parties may wish to convene a legal drafting group to consider the form
that a decision to reach an agreed interpretation could take. The Conference of the Parties may also wish
to consider initiating a further consultation process.

to elaborate further on three options that could be available with respect to the requirement of insurance, bonds or
other financial guarantees, ensuring that at least one option explored provided guidance on steps that could be taken

5. National definitions
104. By decision VIII/27, the Conference of the Parties requested Parties that had not yet provided
the Secretariat with any of the information required under article 3 of the Convention to provide such
information as soon as possible and to report any subsequent significant change in that information
using the standardized reporting format for reporting under article 3 of the Convention. The Secretariat
was requested to place such information on the Convention website.
105. A report on the implementation of that decision will be presented to the Conference of the
Parties (UNEP/CHW.9/31).
106. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision

6. Article 11 agreements and arrangements
107. By decision VIII/28, the Conference of the Parties requested Parties to supply the Secretariat
with any texts of bilateral, multilateral or regional agreements or arrangements that they had concluded,
and requested the Secretariat to place such texts on the Convention website. 6

7. Article 5 on designation of competent authorities and focal points
110. By decision VIII/29, the Conference of the Parties called upon Parties to designate competent
authorities and focal points and to inform the Secretariat of any modifications or additions to such
designations as they occurred.
111. The Conference of the Parties also invited non-Parties and interested organizations to identify
contact persons for the Convention, if they had not done so, and to submit the relevant information to
the Secretariat, including any modifications or additions as they occurred.

to the Conference of the Parties (UNEP/CHW.9/33).

(j) Dismantling of ships
114. By decision VIII/11 on environmentally sound management of ship dismantling, the Conference
of the Parties, among other things, welcomed the steps taken by the International Maritime Organization
(IMO) in developing the draft International Convention on the Safe and Environmentally Sound
Recycling of Ships and invited IMO to ensure that the draft Convention to be adopted by it established
an equivalent level of control as that established under the Basel Convention, noting that the duplication
of regulatory instruments that had the same objective should be avoided.
115. Parties were invited to provide comments to the Secretariat on issues such as roles and
responsibilities under the draft Convention and those relevant to the Basel Convention, including:
assessment of the level of control and enforcement established by the Basel Convention in its entirety;
assessment of the expected level of control and enforcement to be provided by the draft Convention in
its entirety and its comparison with the level of control and enforcement under the Basel Convention;
and exploration and discussion of the possibilities for effective short- and medium-term measures. A
compilation of compilation of comments submitted by Parties in respect of the aforementioned
measures will be presented to the Conference of the Parties (UNEP/CHW.9/INF/29).
116. The Conference of the Parties also requested the Secretariat to follow the development of the
draft Convention and report thereon to the Open-ended Working Group and to the Conference of the
Parties at its ninth meeting. The report of the Working Group on Ship Recycling established by the
57th session of the IMO Marine Environment Protection Committee will be presented to the Conference
of the Parties (UNEP/CHW.9/INF/28), as will the submission made by the Secretariat to the Marine
Environment Protection Committee at its 57th session on the equivalent level of control and possible
future action by the Basel Convention on this issue (UNEP/CHW.9/INF/30).
117. The Conference of the Parties also requested the Secretariat, subject to the availability of the
necessary resources, to continue to implement activities to promote the application of the Technical
Guidelines for the Environmentally Sound Management of the Full and Partial Dismantling of Ships. A
report on the steps taken by the Secretariat to develop the “Global Programme for Sustainable Ship
Recycling: Improving Working Practices for the Betterment of Occupational Health and Safety and
Environmental Standards in Ship Recycling Yards in Asia” will be presented to the Conference of the
Parties (UNEP/CHW.9/34).

scenarios take into account the core functions of the Secretariat (meetings, coordination, information
management), support services (e.g., legal and technical support, resource mobilization, outreach and
public relations) and the programme of support for the implementation of the Strategic Plan focus areas.
In the light of the desirability of determining a realistic and focused programme of work under the
Convention for the biennium 2009–2010 and the various options available for achieving cost savings,
the three alternative scenarios are intended to facilitate agreement by Parties on the activities to be
included in the programme of work and on the allocation of the necessary financial resources to ensure
implementation of the agreed activities. It is expected that this manner of presentation will enhance
transparency and assist Parties in deciding on the inclusion in the programme of work of proposed
activities in conjunction with the allocation of resources in the budget for those activities. The proposals
set forth under all other agenda items are presented on the basis of the Executive Secretary’s assessment
of the required rate of growth of the programme budget.
122. Additional financial information on expenditures and income for both Basel Convention trust
funds will be presented to the Conference of the Parties (UNEP/CHW.9/INF/31).
123. The Conference of the Parties may wish to establish a contact group to consider the work
programme and budget for the biennium 2009–2010.

124. By decision VIII/34, the Conference of the Parties requested the Secretariat to report on
progress in mobilizing resources. By decision OEWG-VI/24, the Open-ended Working Group took note
of the workplan elements proposed for 2007–2008.

125. A report will be presented to the Conference of the Parties on actions and activities undertaken
through the resource mobilization programme and in the promotion of sustainable financing
(UNEP/CHW.9/36). The Conference of the Parties will be invited to consider the way forward for this
programme, including its sustainability in the light of staffing resources. Information on fund-raising
results will be presented to the Conference of the Parties (UNEP/CHW.9/35 and
UNEP/CHW.9/INF/31).
126. Information on the potential linkages between the United Nations Framework Convention for
Climate Change and the Basel Convention will be presented to the Conference of the Parties
(UNEP/CHW.9/INF/32). Parties may wish to consider how these could be explored further following
the outcome of the Conference of the Parties to the United Nations Framework Convention on Climate
Change convened in November 2007, particularly with regard to the Clean Development Mechanism
and joint implementation.
127. An annotated table of contents of a cost-benefit framework guide, with a section on the costs of
inaction (or costs avoided through the implementation of the Convention) will be presented to the
Conference of the Parties (UNEP/CHW.9/INF/33). A draft fund-raising strategy will be presented to the
Parties (UNEP/CHW.9/INF34). Representatives are invited to consider these two information
documents, having, to the extent possible, consulted other relevant national governmental agencies on
the table of contents and strategy. Comments will be sought from Parties.
128. The Conference of the Parties may wish to adopt a decision along the lines of the draft decision
set out in document UNEP/CHW.9/36.

Item 8: Work programme of the Open-ended Working Group for 2009–2010
129. By decision OEWG-VI/27, the Open-ended Working Group requested the Secretariat to prepare
a draft work programme for the Group for the biennium 2009–2010.
130. That draft work programme will be presented to the Conference of the Parties
(UNEP/CHW.9/37). A compilation of the comments submitted by Parties and others on that draft work
programme will also be presented (UNEP/CHW.9/INF/36).
131. The Parties may wish to consider the proposed activities contained in the seven sections and
adopt the work programme as revised by the Parties, taking into account decisions on other agenda
items that the Conference of the Parties may adopt.
132. The Conference of the Parties will also elect officers constituting the bureau of the Open-ended
Working Group.

Item 9: Twentieth anniversary of the adoption of the Basel Convention (2009)
133. The Secretariat will make an oral presentation on a proposal for an event to commemorate the
twentieth anniversary of the adoption of the Basel Convention, intended to celebrate the Convention’s

achievements, as well as to consider future challenges. The presentation will encompass the purpose,
resources and desired outcomes of such an event and will take into account the comments and guidance
received from the Expanded Bureau of the eighth meeting of the Conference of the Parties at its second
meeting, convened in February 2008.7 The Parties will be invited to provide guidance to the Secretariat
on the possible organization of such an event.
Item 10: Credentials of representatives
134. Rule 18 of the rules of procedures for meetings of the Conference of the Parties provides that
the credentials of representatives and the names of alternate representatives and advisors should be
submitted to the Executive Secretary of the meeting, if possible not later than 24 hours after the opening
of the meeting. The credentials shall be issued either by the Head of State or Government or by the
minister of foreign affairs or, in the case of a regional political or economic integration organization, by
the competent authority of the organization. The credentials presented by the Parties will be examined
by the Bureau of the meeting, which shall submit its report to the meeting.
Item 11: Other matters
(a) UNEP Governing Council decision 24/5
135. At its sixth session, the Open-ended Working Group considered a conference room paper
presented by the representative of a group of Parties, containing UNEP Governing Council decision
24/5 on waste management. This decision, among other things, contained a request for the Executive
Director of UNEP to prepare, in consultation with the Secretariat of the Basel Convention and others, a
report on aspects of waste management for consideration at the tenth special session of the Governing
Council. The Secretariat will report orally on the outcome of that process, including the outcome of the
tenth special session of the UNEP Governing Council/Global Ministerial Environmental Forum, held in
Monaco in February 2008, to the Conference of the Parties at its ninth meeting.
(b) Date and venue of the tenth meeting of the Conference of the Parties
136. Rule 3 of the rules of procedure for meetings of the Conference of the Parties to the Basel
Convention provides that “[t]he meetings of the Conference of the Parties shall take place at the seat of
the Secretariat, unless other appropriate arrangements are made by the Secretariat in consultation with
the Parties”. Rule 4, paragraph 2, provides that “[a]t each ordinary meeting, the Conference shall decide
on the date and duration of the next ordinary meeting”. If a Party has indicated an interest in hosting the
tenth meeting, or a future meeting of the Conference of the Parties, that invitation will be presented to
the Conference of the Parties for its consideration.
(c) Strategic issues for consideration by the Conference of the Parties at its tenth and eleventh
meetings
137. At the second meeting of the Expanded Bureau of the eighth meeting of the Conference of the
Parties, the Expanded Bureau was invited to provide guidance as to whether to recommend that the
Conference of the Parties at its tenth meeting, to be held in 2010, focus on a successor arrangement to
the Strategic Plan for the Implementation of the Basel Convention (see agenda item 7 (a)) and that the
Conference of the Parties at its eleventh meeting, to be held in 2012, conduct an evaluation of the
effectiveness of the Convention in accordance with paragraph 7 of article 15 of the Convention. With
regard to the second proposal, it was noted that 2012 would have symbolic significance as it would
mark the twentieth anniversary of the entry into force of the Basel Convention.
138. The Secretariat invited members of the Expanded Bureau to share these proposals with the
regional groups and to provide feedback to the Secretariat. The Conference of the Parties will receive a
note concerning the feedback received, if any, and setting out issues relevant to the organization of an
evaluation under paragraph 7 of article 15 of the Convention. The Conference of the Parties will be
invited to consider whether it should, at its eleventh meeting, undertake an evaluation and, if so,
whether the preparatory steps for such a review should be initiated at its ninth meeting.

139. The Conference of the Parties may wish to consider other matters raised during the course of the
meeting or that Parties or others may bring to the attention of the Secretariat after submission of the
annotated provisional agenda and before the ninth meeting begins.

Item 12: Adoption of the decisions and the report
140. It is anticipated that, at its final session, on 27 June 2008, the Conference of the Parties will
adopt any decisions that it has not yet adopted and will adopt the draft report of the meeting as
presented by the Rapporteur. The Conference may also wish to adopt a declaration relating to the theme
of the meeting.
Item 13: Closure of the meeting
141. It is anticipated that the President will close the Conference of the Parties during the afternoon
of Friday, 27 June 2008.
