CALL TO ORDER:
John Wieczorek called the meeting to order at 6:00 p.m. at the Mahoning Township Building, 2685 Mahoning Drive
East, Lehighton, PA 18235

ROLL CALL:
PRESENT:
John Wieczorek, Chairman; Franklin Ruch, Vice-Chairman; Bruce Steigerwalt, Supervisor; Linda Benner, Supervisor;
Travis Steigerwalt, Supervisor; Thomas Nanovic, Solicitor and Natalie D. Haggerty, Secretary-Treasurer

PUBLIC COMMENT:
None

Larry Stawiarski, Director Carbon County Mapping Department
Larry Stawiarski was present to discuss the capabilities of GIS. The Board would look to have our zoning map overlaid
with parcel numbers. The county would digitize our zoning map and then place the overlay of parcel numbers. The
county would be able to provide updates on a monthly basis. The township first must purchase the software. There is a
60-90 day free trial period and the software would cost $1,500.00-$1,700.00. Idea shared of possibility purchasing a
laptop in order to provide better accessibility for our planners and zoning officer. We will keep this in mind and discuss
further during talks of 2013 budget.

APPROVAL OF MINUTES:
MOTION
Linda Benner made a motion to approve the minutes of the January 9, 2012 Board of Supervisors Meeting. Seconded
by Travis Steigerwalt. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Travis Steigerwalt, yes and
Franklin Ruch, yes 5-0 vote. Motion carried.

Recommendation from the Fire Committee to Award the Bid for Custom Pumper
MOTION
Franklin Ruch made a motion to award the bid to KME, Kovatch for a Custom Rescue Pumper motion amended to
include purchase price of $467,217.00. Seconded by John Wieczorek. Payment plan is threefold with $50,000.00 from
Mahoning Valley Fire Co Relief; 2% loan from the state in the amount of $150,000 and $268,000.00 from the Fire
Millage Fund. In addition the yearly payment for the 2% 15 year loan would be paid out the fire millage fund. Monthly
payments of $11,583.00. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda Benner, yes; Travis Steigerwalt, yes and
Franklin Ruch, yes 5-0 vote. Motion carried.

OLD BUSINESS:
Walmart Request for Reduction in Letter of Credit
Question of whether or not the concrete monuments that were called out for in the deeds are in place. Share with Tim
Edinger. Place on next agenda

Resolution 2012-2 Fee Schedule Pertaining to the Zoning Hearing Board Activities
MOTION
Travis Steigerwalt made the motion to adopt Resolution 2012-2 Fee Schedule pertaining to the Zoning Hearing Board
Activities with corrections of removing “refundable”, removal of the sentence “refundable portion of the fee schedule
will be used to pay reasonable fees with respect to the administration of the zoning ordinance” and add Article V
amendment provided by Attorney Nanovic. Seconded by Franklin Ruch. John Wieczorek, yes; Bruce Steigerwalt, yes;

Recommendation of the Road Committee to Hire Robert Kern Sr. as a Full Time Road Department Worker
MOTION
Franklin Ruch made a motion to hire Robert Kern Sr. as a full time road department worker with a six month probation
pending clearance of CDL Drug and Alcohol testing and background clearance, (rate of pay per contract 80% of rate
first six months $ 15.11/hr and 90% remaining six months $17.00). Seconded by Linda Benner. John Wieczorek, yes;
Bruce Steigerwalt, yes; Linda Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

Approval of the 2011 Exoneration List and Delinquent Real Estate Tax List (available for public inspection)
MOTION
Travis Steigerwalt made a motion to approve the 2011 Exoneration List and Delinquent Real Estate Tax List and made
available for public inspection. Seconded by John Wieczorek. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda
Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

Packerton Business Park Major Subdivision Request Extension until July 31, 2012
MOTION
Travis Steigerwalt made a motion to approve the request for an extension of time until July 31, 2012 for the Packerton
Business Park Major Subdivision. Seconded by Franklin Ruch. John Wieczorek, yes; Bruce Steigerwalt, yes; Linda
Benner, yes; Travis Steigerwalt, yes and Franklin Ruch, yes 5-0 vote. Motion carried.

John Wieczorek made a motion to adopt the Addendum to the Intermunicipal Agreement Joint Board of Appeals

Road Committee
      Fuel Tank Replacements. Telephone bids have been received for replacement of fuel tanks. Hafer Petroleum
        provided the least expensive proposal at a cost of $10,487.00.

Franklin Ruch made a motion to approve the road committee recommendation and purchase tanks from Hafer
Petroleum at a cost of $10,487.00. Seconded by Travis Steigerwalt. John Wieczorek, yes; Travis Steigerwalt, yes;

      Recommendation of the Road Committee to Amend CBA, Article XII (vacation time can be used in ½ hour
         increments)

Franklin Ruch made a motion to approve recommendation of the road committee and adopt amendment to the CBA,
Article XIII. Franklin Ruch amended motion to include the correction of vacation days from twenty five to twenty.

     Compile a list of ordinances and forward to township office.
Bruce Steigerwalt
     Commented on an article in the Times News with regards to Commissioner Nothstein attending a Zoning
        Hearing Board Meeting and the zoners did not grant the waivers. Correcting what was said, Commissioner
        Nothstein was before the Planning Commission and some of the waivers were indeed granted.
Franklin Ruch
     Keep in mind GIS and hope to purchase in the future
     Recreation grants
MOTION
Franklin Ruch made a motion to have bid package of specs for pole barn (shell of building only with doors) be prepared
by Tim Edinger. Franklin Ruch withdrew his motion.
Ask Tim to prepare specs for the entire building and forward to the township office.
     Progress of Ashtown Drive with the posting of no truck traffic. Bruce Steigerwalt has some information that
        might be helpful.
Thomas Nanovic
     Does the Board request As Built Plans for Lowes (yes, share with Tim Edinger)

     Dead End Lane Property, no worse than any other property owners in that vacinity
John Wieczorek
     An executive session was held on January 11, 2012 at Attorney Nanovic’s office for matters of legal and
        personnel.
     There will be an executive session at the conclusion of the meeting for personnel and legal.
