The Plaintiff having filed an Affidavit pursuant to Civil Rule 4.4 (A) (2) which satisfied the Court that the residence of the Defendant is unknown, and the Court being satisfied that due diligence has been exercised by Plaintiff, and that Plaintiff is proceeding in forma pauperis, now ORDERS the Clerk of Courts to post service of notice on the bulletin boards at the following locations in Athens County: 1) The Domestic Relations Courtroom; 2) The Municipal Courtroom; 3) The Bureau of Motor Vehicles. ____________________________________ Melinda K. Bradford, Magistrate Copies: Plaintiff: ___________________________ Address: ___________________________ ___________________________ INSTRUCTIONS WHERE RESIDENCE OF SPOUSE IS UNKNOWN First, contact the Child Support Enforcement Agency (CSEA) at 740-797-2523 and request that they check in the nationwide child support database for an address for your spouse. CSEA cannot release this address to you, but they can give you a letter indicating whether or not they have an address for your spouse. If CSEA does have the address, take the letter indicating that they have it to the Clerk of Courts, along with the rest of your divorce papers. Request that the Clerk of Courts obtain the address from CSEA and that your spouse be served by Certified Mail to that address. Also note this request in the "Instructions for Service" section of your Complaint for Divorce. If CSEA does not have the address, proceed with the forms in this packet to request an Order directing the Clerk of Courts to post service of notice. There are three papers that you will need to file. The first is a Motion. Please fill in your name as Plaintiff and the name of your spouse as Defendant on the top of the page. Also, fill in the case number on the upper right hand corner. You will need to sign your name and fill in your address and phone number at the bottom. Second, is the Affidavit. Please fill in the date when you last had contact with your spouse. Also, in detail, state whom you have contacted immediately before filing this paper so as to locate the residence of your spouse. This should include the Child Support Enforcement Agency, plus you should attach a letter from them indicating that they do not have an address for your spouse in their database. The listing could include your spouse's relatives, friends, past employers, post office, etc. You then need to sign these papers in front of a Notary Public. The last paper is the Journal Entry. Again, fill in your name as Plaintiff, name of your spouse as Defendant and the case number. You should make two copies of each of these pleadings. You are now ready to file these papers. Please go to the Domestic Relations Division Offices located on the fourth floor of the Athens County Courthouse beside the elevator. They will direct you as to what happens after that.
