STUDENT SHORT-TERM SUSPENSION LETTER BY PRINCIPAL
FOR STUDENT WITH RIGHTS
UNDER SECTION 504
This is to notify you that your child, ______________, is being suspended from
school for ___school days beginning on __________________. However, your child
has a disability or may have the rights of a child with a disability under the Section 504
of the Rehabilitation Act of 1973. Because of this, we are requesting that you attend a
meeting at _____________________ School in the _______________ room/office on
________________________ at _________________, to determine if your child’s
behavior in question is a manifestation of your child’s disability or suspected disability.
A copy of the New Hanover County Schools Notice of Rights under Section 504 is
The incident that led to this suspension and recommendation occurred on
___________________. On that date, your child [describe what the child did and
where it occurred] in violation of New Hanover County Schools Student Discipline
Policy 8410 [list applicable subsections].
During the period of suspension your child is not to be on any New Hanover
County Schools property or grounds or any official public school activity, athletic contest
or function of the New Hanover County Schools. However, during the first 10 days of
your child’s suspension, he or she may take textbooks home, upon request receive all
missed assignments and to the extent practicable, the materials distributed to students
in connection with the assignment, and the opportunity to take any quarterly, semester
or grading period examinations missed during the first 10 day suspension period, at a
time and place designated by me.
If it is determined that your child’s behavior in question is a manifestation of
his/her disability or suspected disability, he/she will not serve any remaining portion of
the suspension if doing so would result in him/her serving in excess of ten (10)
cumulative days of suspensions in the school year, but a Section 504 team will be
assembled to conduct a functional behavioral assessment of your child, or if one has
already been conducted, to modify your child’s behavior intervention plan. The team
will also consider other modifications to your child’s Section 504 Plan to address his/her
behaviors including a possible change in the location where educational and related
services are provided.
If it is determined that your child’s behavior in question was not a manifestation
of his/her disability, your child will serve any remaining portion of his/her suspension.
Information on all prior discipline incidents involving your child for the current
school year is enclosed.
