In this Resolution, the Commission considers the appeal by 3 Phases Renewables LLC (Respondent) of CPUC Resource

the Respondent’s Month-Ahead Resource Adequacy filing for May 2008, which was due on April 1, 2008, was not received
at the Commission until April 4, 2008, and that on account of this tardiness, Respondent should be fined $2,500 in accordance
with the schedule of penalties set forth in Appendix A to Resolution E-4017.
