Enhancing cooperation and coordination among

             Enhancing cooperation and coordination among the Basel,
             Rotterdam and Stockholm conventions
             Note by the Secretariat
             1.      Decision IX/10 of the Conference of the Parties to the Basel Convention on the Control of
             Transboundary Movements of Hazardous Wastes and Their Disposal, decision RC-4/11 of the
             Conference of the Parties to the Rotterdam Convention on the Prior Informed Consent Procedure for
             Certain Hazardous Chemicals and Pesticides in International Trade and decision SC-4/34 of the
             Conference of the Parties to the Stockholm Convention on Persistent Organic Pollutants (the
             “synergies decisions”) are substantially identical decisions by which the conferences of the parties to
             the three conventions called for greater cooperation and coordination among the three conventions. In
             those decisions, the conferences of the parties agreed, among other things, to convene simultaneous
             extraordinary meetings of the three conferences, at which the parties would discuss the matters listed
             in paragraph 3 of part V of the synergies decisions, relating to cooperation and coordination among the
             conventions.
             2.     Accordingly, simultaneous extraordinary meetings of the conferences of the parties to the
             conventions were held from 22 to 24 February 2010 in Bali, Indonesia. At those meetings, the
             conferences of the parties each adopted an omnibus decision that was in substance identical to the
             decisions adopted by the other conferences of the parties: decision BC.Ex-1/1 of the Conference of
             Parties to the Basel Convention, decision RC.Ex-1/1 of the Conference of the Parties to the Rotterdam
             Convention and decision SC.Ex-1/1 of the Conference of the Parties to the Stockholm Convention.
             3.       The omnibus decisions are divided into the following sections:
(a)          Section I, on joint activities;
(b)          Section II, on joint managerial functions;
(c)          Section III, on joint services;
(d)          Section IV, on synchronization of budget cycles;

(e)         Section V, on joint audits;
(f)         Section VI, on review arrangements.
            4.     In response to the request set out in paragraph 9 of section I of the omnibus decisions,
            information on joint activities, including a proposal for cross-cutting and joint activities for possible
            inclusion in the programmes of work of the three secretariats for 2012–2013, is set out in document
            UNEP/FAO/RC/COP.5/25/Add.1. The proposal includes a revised workplan for the clearing-house
            mechanism of the three conventions, as requested in paragraph 12 of section I of the omnibus
            decisions.
            5.     In response to the request set out in paragraph 6 of section II of the omnibus decisions,
            information on joint managerial functions, including a proposal to modify the organization of the
            Basel Convention Secretariat, the Stockholm Convention Secretariat and the United Nations
            Environment Programme part of the Rotterdam Convention Secretariat, including the possible
            continuation of the joint head function in a manner that is cost-neutral in respect of the operating
            budgets of the three conventions, is set out in UNEP/FAO/RC/COP.5/25/Add.2. That document also
            puts forth a proposal, as requested in paragraph 5 of section III of the omnibus decisions, for the
            modification of the organization of the secretariats for the biennium 2012–2013 that is consistent with
            the proposal referred to in paragraph 6 of section II.
            6.     Information on joint services is set out in document UNEP/FAO/RC/COP.5/25/Add.3,
            information on the synchronization of budget cycles in document UNEP/FAO/RC/COP.5/25/Add.4
            and information on joint audits in document UNEP/FAO/RC/COP.5/25/Add.5.
            7.      Information on review mechanisms for evaluating how far the arrangements adopted pursuant
            to the synergies decisions have contributed to meeting the objectives listed in paragraph 1 of
            section VI of the omnibus decisions is set out in document UNEP/FAO/RC/COP.5/25/Add.6. It
            includes detailed draft terms of reference prepared by the secretariats for a report by the secretariats
            that will facilitate the review by the conferences of the parties requested in paragraphs 2 and 3 of
            section VI of the decisions and draft terms of reference prepared by the Executive Director of the
            United Nations Environment Programme and the Director-General of the Food and Agriculture
            Organization of the United Nations for the review called for in paragraphs 4 and 5 of section VI of the
            decisions.
            8.     The information provided in the present note and the addenda thereto was made available to the
            Conference of the Parties to the Stockholm Convention at its fifth meeting, held from 25 to 29 April
            2011 in Geneva, and will also be made available to the Conference of the Parties to the Basel
            Convention at its tenth meeting, to be held from 17 to 21 October 2011 in Cartagena, Colombia.
            9.    The decision taken by the Conference of the Parties to the Stockholm Convention at its fifth
            meeting on enhancing cooperation and coordination among the Basel, Rotterdam and Stockholm
            conventions is provided in document UNEP/FAO/RC/COP.5/INF/17. The Conference of the Parties
            may wish to consider that decision.
            Possible action by the Conference of the Parties
            10.    The Conference of the Parties may wish to adopt a decision along the following lines:
                            The Conference of the Parties,
                            Mindful of the legal autonomy of each of the Basel Convention on the Control of
                    Transboundary Movements of Hazardous Wastes and Their Disposal, the Rotterdam
                    Convention on the Prior Informed Consent Procedure for Certain Hazardous Chemicals and
                    Pesticides in International Trade and the Stockholm Convention on Persistent Organic
                    Pollutants,
                            Recognizing the broad scope of the three conventions,
                             Welcoming the continued commitment of all parties to ensuring the implementation of
                    the full breadth of the three conventions,
                            Recalling decision IX/10 of the Conference of the Parties to the Basel Convention,
                    decision RC-4/11 of the Conference of the Parties to the Rotterdam Convention and
                    decision SC-4/34 of the Conference of the Parties to the Stockholm Convention, hereinafter
                    referred to as the “synergies decisions”,
                          Recalling also the decision BC.Ex-1/1 of the Conference of Parties to the Basel
                    Convention, decision RC.Ex-1/1 of the Conference of the Parties to the Rotterdam Convention

        and decision SC.Ex-1/1 of the Conference of the Parties to the Stockholm Convention,
        hereinafter referred to as the “omnibus decisions”,
                Reaffirming that actions taken to enhance coordination and cooperation should be
        aimed at strengthening the implementation of the three conventions at the national, regional
        and global levels, promoting coherent policy guidance and enhancing efficiency in the
        provision of support to parties, with a view to reducing their administrative burden and
        maximizing the effective and efficient use of resources at all levels,
                Mindful of the various principles recognized within the three conventions, including
        pertinent provisions of the Rio Declaration on Environment and Development such as
        principle 7,1
                Bearing in mind the potential further to enhance coordination and cooperation with
        other existing and newly developed instruments and frameworks in the chemicals and wastes
        management cluster such as the Strategic Approach to International Chemicals Management
        and the global legally binding instrument on mercury currently under negotiation,
                 Adopts the present decision, in substance identical to the decision adopted by the
        conference of the parties to the Stockholm Convention and subject to the adoption of a
        decision that is also in substance identical to the present decision by the conference of the
        parties to the Basel convention and invites this conference of the parties also to adopt this
        decision,
