COOPERATION AGREEMENT BETWEEN UNIVERSITY OF THE BASQUE COUNTRY AND
............................................. TO JOINTLY CARRY OUT THE ORGANISATION AND
IMPLEMENTATION OF STUDIES LEADING TO THE OFFICIAL DEGREE OF MASTER’S
DEGREE IN “……………………………………..”



                                          THE PARTIES

Of the one part, Mr. Iñaki Goirizelaia Ordorika, Honourable Rector of the University of the
Basque Country, hereinafter UPV/EHU, for and on behalf of the said University, in
accordance with the powers laid down in article 20.1 of Organic Act 6/2001 of 21 December
on Universities (LOU), amended by Organic Act 4/2007 of 12 April, and article 178 of the
Statutes of the University of the Basque Country approved by Decree 17/2011 of 15 February
(Official Gazette of the Basque Country of 24 February 2011)


Of the other, Mr./ Ms. (name) , (position) of the University of ------------------, hereinafter
(University’s acronym or abbreviation), for and on behalf of the said University, in accordance
with the powers laid down in ---------------- (insert here the current regulations concerning the
relevant university structure)

And of the other, Mr. / Ms. (name) , (position) of the University of ------------------, hereinafter
(University’s acronym or abbreviation), for and on behalf of the said University, in accordance
with the powers laid down in ---------------- (insert here the current regulations concerning the
relevant university structure)




                                         HEREBY STATE

FIRST.-            Whereas, on (date) ……….………. ……, .....….., the Parties entered into a
                   Framework Cooperation Agreement, which laid down the general guidelines
                   of collaboration for developing programs of mutual interest in teaching,
                   research and dissemination of culture. [TO BE SUPPRESSED WHERE NOT
                   APPLICABLE]

SECOND.-           Whereas, in accordance with article 3, section 4 of Royal Decree 1393/2007
                   of 29 October, amended by Royal Decree 861/2010 of 2 July regulating
                   official university education, Universities may jointly organise studies
                   leading to a single official degree of Master’s by signing an agreement with
                   other national or foreign universities. For this purpose, the curriculum
                   must be accompanied by the relevant agreement.

THIRD.-            Whereas, in accordance with the regulations and procedures concerning the
                   approval of master’s degree programmes applicable at each university
                   participating in this agreement, and, in the exercise of their autonomy, the
                   said universities consider it suited to their institutional purpose the
                   establishment of inter-university relationships for jointly organising,
                   developing and implementing the said studies.

Taking into consideration the aforementioned declarations, the parties involved mutually
acknowledge that they have sufficient legal capacity to enter into this agreement in accordance
with the following



                                           CLAUSES


First.-           Purpose
                  To jointly organise the Master’s Degree in “……………………….” between the
                  participating institutions with equal rights and obligations.

Second.-          Responsible bodies
                  The body responsible for the organisation and implementation of the
                  Master’s Degree programme at each institution, shall be as follows:

                         At the UPV/EHU, it shall be the Department/Institute of
                          ……………………, and the School of Master’s and Doctoral
                          Programmes shall be responsible for planning, coordinating and
                          managing the Programme.

                         At the University of --------------------, it shall be the (responsible
                          body)……….

                         At the University of --------------------, it shall be the (responsible
                          body)……….

Third.-           Coordination and Inter-University Academic Committee
                  The studies leading to the official degree of Master’s which is the subject of
                  this agreement shall be coordinated by the responsible body/person at each
                  participating institution, as indicated in the Explanatory Report.


                  The person/body responsible for the Master’s Degree programme at each
                  University shall set up an Inter-University Academic Committee with equal
                  representation in order to supervise and update the programmes and to
                  submit improvement proposals for the future to the proposing bodies
                  responsible for the Master’s Degree programme at each participating
                  institution.

                  Responsibility for the coordination of the Master’s Degree programme lies
                  with the University of ………………………….

Fourth.-          Quality Assurance System
                  The Master’s Degree will have a Quality Assurance System available for the
                  teaching imparted. To this end, the coordinating University shall provide
                  the other participating Universities with the required documents to
                  complete the corresponding quality assessment protocols. Each of the other
                  signatory Universities undertake to collate the required information and
                  send it to the coordinating University via their respective Quality units.

Fifth.-      Adhesion of other Universities
             Other Universities may adhere to this agreement subject to the unanimity of
             all signatories. Such adhesion shall entail the acceptance of everything
             agreed upon under this agreement and any other agreements which may be
             approved by the Inter-University Academic Committee. Any institutions
             adhering to this agreement after the implementation of the studies shall
             have the same rights and obligations as other participating institutions.

Sixth.-      Teaching Programme and Offer of the Master’s Degree
             The teaching programme shall be prepared and updated jointly by the
             Universities participating in the Master’s Degree through the Inter-
             University Academic Committee, and shall be offered at each of the
             Universities signatory to this agreement

Seventh.-    Mobility of faculty and students
             The bodies responsible for the Master’s Degree programme at each
             participating University shall establish the necessary mechanisms for the
             mobility of the faculty members involved, and, where appropriate, of
             students, in addition to the supervision and implementation of any required
             practical training.

Eighth.-     Resources and services allocated to teaching
             The Universities shall provide access for students enrolled on the Master’s
             Degree to the general services provided by the University (study rooms,
             computer rooms, libraries, laboratories, etc.) to ensure the programme is
             properly implemented

Ninth.-      Admission and selection of students
             The Inter-University Academic Committee shall agree the access
             requirements and admission criteria, which will be unique in the
             participating universities.

Tenth.-      Processing of student files
             Each of the institutions signatories to this agreement is responsible for the
             administration and safekeeping of the files of students who are enrolled
             with them.

             Students shall be linked for academic and administrative purposes to the
             University at which they are enrolled, and in their capacity as postgraduate
             students, they shall be bound by all regulations in force at said University,
             which also implies compliance with the existing rules for remaining at the
             University.

Eleventh.-   Issuance of degree certificates
             Each University participating in the Master’s Degree shall process the
             issuance and registration of official titles for the students enrolled in it, in
             accordance with the provisions of Royal Decree 1002/2010 of 5 August.

             Students shall receive, in addition to the degree of the University where they
             are enrolled, the relevant certificates of the University where they have
             studied and successfully passed the subjects of the Master’s Degree.

Twelfth.-       Exchange of Information and Data Protection
                The Universities party to this agreement undertake to adopt the measures
                required in each case, in order to comply with Organic Act 15/1999 of
                December 13, on the Protection of Personal Data, and must ensure that
                this protection is real and effective.

Thirteenth.-    Modification, termination and new proposal for the curriculum of the
                Master’s Degree programme
                Each participating University may request from the other participating
                universities, through the Inter-University Academic Committee, the
                modification, termination, or new proposal for the curriculum. In any case,
                such request must be notified to the other party prior to 30 June of the year
                preceding the commencement of the relevant academic year.

                All of the above shall be carried out by mutual agreement by the
                aforementioned Committee in accordance with the regulations established
                at each participating University and with the procedures provided for by the
                competent bodies for the modification of studies and authorisation of the
                relevant degree qualification.

Fourteenth.-    Completion of studies in the event of termination of agreement
                Upon termination of this agreement, the Universities shall ensure that
                students studying the Master’s under this agreement are allowed to
                complete such study programme.

Fifteenth.-     Insurance
                The participating Universities shall ensure the necessary insurance cover
                for their faculty members and students, according to the mobility
                programme that shall be established.

Sixteenth.-     Fees
                The public tuition fees that students must pay for the subjects of the
                Master’s Degree shall be those established by (the Autonomous
                Communities/authority responsible for third-level education) at the
                Universities participating in these lessons, where the students are enrolled.

Seventeenth.-   Income and Expenditure
                The management of income and expenditure arising from the teaching of
                the Master’s Degree which are the subject of this agreement shall be carried
                out in accordance with the regulations in force for such purpose at each
                participating University.

                In particular, each University shall pay the displacement costs for their
                lecturers whenever they impart lessons for the Master's Degree at any of the
                Universities party to this agreement, in accordance with the procedures
                established in their respective rules, unless the Master's Degree has some
                form of external financing intended to cover such expenditure.

Eighteenth.-    Access to the Doctoral Degree Programme
                Any students who pass a Master's Degree under this agreement, and who
                meet the requirements to access a Doctoral Programme, shall be the
                preferred candidates for these studies at any of the Universities.

Nineteenth.-     System of Interpretation of the Agreement
                 This agreement is of an administrative nature, and its interpretation and
                 application is governed by the legal administrative system in force.

                 Any disputes arising under this agreement or from its execution shall be
                 resolved by the Inter-University Academic Committee, in accordance with
                 the provisions of Clause Third herein above.

Twentieth.-      Validity of the Agreement
                 This agreement shall be effective from the date following the date of signing
                 by the last signatory and shall be understood to remain in force provided
                 that:

                 - The lessons have been authorised by the Governments of the respective
                 (Autonomous Communities/authority responsible for third-level education).

                 - No claims exist from any of the signatory parties. In any case, any such
                 claims must be notified to the other Universities prior to 30 June of the year
                 preceding the commencement of the relevant academic year.

Twenty-first.-   Grounds for termination
                 This agreement shall be terminated for any of the following reasons:
                 - Failure to deliver the Master's Degree object of this agreement.

                 - By mutual agreement between the signatories.

                 - An official complaint by one of the parties to this agreement.


Twenty-second.- Termination of previous agreements (only where these exist)
                The signing of this agreement renders ineffective the cooperation agreement
                signed on (day) (month,) (year) between the University of the Basque
                Country and the University of (name of University) to jointly carry out the
                organisation and implementation of studies leading to the official Degree in
                (name of Master’s Degree)

And as proof of compliance and acceptance, the parties hereto have signed this agreement on
