be calculated using each hospital's direct medical education costs reported on the 2001 Institutional Cost Report and an estimate of the total indirect medical education costs for 2001, which shall equal the product of 2001 hospital specific inpatient operating costs, including exempt unit costs, and the indirect teaching cost percentage determined by the following formula: 1-(1/(1+1.89(((1+r)^. 405)-1))), where r equals the ratio of residents and fellows to beds for 2001 adjusted to reflect the projected 2003 resident counts. Each hospital's rate adjustment will be limited to seventy-five percent of the GME component included in its 2003 Medicaid inpatient rates of payment. Hospitals will not receive a rate adjustment if the GME component in its 2003 Medicaid inpatient rate is greater than its 2001 GME costs stated at 2003 levels. The aggregate amount of the rate adjustment for GME will be subject to the federal upper payment limit regulations and will be reduced proportionately by the amount in excess of the federal upper payment limit. Such reduction, if applicable, will be calculated on an annual basis. Rate adjustments shall be included as an add-on to Medicaid inpatient rates excluding exempt unit rates but including GME rates for Medicaid HMOs. The rate add-ons will be based on the Medicaid data, including Medicaid HMO data, reported in each hospital's annual cost report submitted for the period two years prior to the rate year and filed with the Department of Health by November first of the year prior to the rate year. There will be no reconciliation to reflect changes in Medicaid data between the year two years prior to the rate year and the rate year. Long Term Care Services: Effective April 1, 2004 and thereafter, for residential health care facilities, the assessment and subsequent reimbursement of same, on each facility's gross receipts, excluding gross receipts attributable to payments received from Medicare, shall be reinstated to six percent. Each residential health care facility (RHCF) established under the nursing home companies law and designated as an acquired immune deficiency syndrome (AIDS) facility or having a discrete AIDS unit approved by the Commissioner of Health, shall refinance its capital mortgage on or before August 1, 2004 or 120 days immediately after the effective date of the authorizing legislation, whichever is later, and shall forward the results of such refinancing to the Commissioner of Health, provided however, no such RHCF shall be required to refinance its capital mortgage if the Department of Health, in consultation with the Dormitory Authority of the State of New York determines that such refinancing could not be accomplished on an economic basis or is otherwise not feasible. In the event that any such RHCF does not refinance its capital mortgage and the Department of Health has not made a determination that a refinancing was not economic or feasible, then the capital cost component of rates of payment for such facilities beginning August 1, 2004 or 120 days immediately after the effective date of authorizing legislation, whichever is later, shall reflect the capital interest cost equivalent to the lower of: (i) the prevailing market borrowing rates available for refinancing capital mortgages for their remaining term on or about August 1, 2004 or 120 days immediately after the effective date of the authorizing legislation, whichever is later; or (ii) the existing rate being paid by the facility on its capital mortgage or mortgages as of such date. The Commissioner of Health shall determine, in consultation with the Dormitory Authority of the State of New York, the prevailing market borrowing rates available to RHCFs to refinance capital mortgages for the purposes of this provision. For residential health care facilities possessing a valid operating certificate for 300 or more beds, the Department of Health, in establishing the allowable indirect component of residential health care facility (RHCF) rates of payment for services provided for the period April 1, 2004 through March 31, 2005, shall utilize 25 percent of the indirect peer group prices for RHCFs with less than 300 beds and 75 percent of the indirect peer group prices for RHCFs with 300 or more beds; for the period April 1, 2005 through March 31, 2006, 50 percent of the indirect peer group prices for RHCFs with less than 300 beds

Pursuant to 42 CFR §447.205, the Department of Health hereby gives public notice of the following: The Department of Health proposes to amend the Title XIX (Medicaid) State Plan for inpatient, long-term care, and non-institutional services to comply with proposed State legislation under consideration. The following significant changes are being considered: Inpatient Hospital Services: For periods on and after April 1, 2004, the Commissioner of Health shall adjust Medicaid inpatient rates of payment for non-public general hospitals, including graduate medical education (GME) payment rates for Medicaid HMO's, for the purposes of reimbursing GME costs. Rate adjustments for each non-public general hospital shall be based on the difference between the GME component, direct and indirect, of the 2003 inpatient rates of payment, including exempt unit per diem rates, and the sum of direct and indirect medical education costs stated at 2003 levels. The 2003 direct and indirect medical education costs shall

and 50 percent of the indirect peer group prices for RHCFs with 300 or more beds; for the period April 1, 2006 through March 31, 2007, 75 percent of the indirect peer group prices for RHCFs with less than 300 beds and 25 percent of the indirect peer group prices for RHCFs with 300 or more beds; and for the period beginning April 1, 2007 and thereafter, the indirect peer group prices for RHCFs with less than 300 beds in lieu of the indirect peer group prices for RHCFs with 300 or more beds. For services provided beginning April 1, 2004 and thereafter, for hospital-based residential health care facilities, the Department of Health shall utilize the free-standing residential health care facility indirect peer group prices in lieu of the hospital-based RHCF indirect peer group prices in establishing the allowable indirect component of RHCF rates of payment, provided however, that for such services provided beginning April 1, 2004 and thereafter, a separate statewide average of total reimbursable base year administrative and fiscal services costs shall be determined for hospital-based RHCFs and the reimbursable base year administrative and fiscal services costs of such facilities shall not exceed such separate statewide average. In no event shall the calculation of such separate statewide average result in a change in the statewide average determined pursuant to Public Health Law for all RHCFs. For purposes of establishing rates of payment for residential health care facilities for services provided on and after April 1, 2004, the regional direct and indirect input price adjustment factors to be applied to any such facility's rate calculation shall be based upon the utilization of either 1983, 1987, 1993 or 2001 calendar year financial and statistical data provided, however, the state share amount for the utilization of 2001 calendar year data shall be no more than $19 million on a pro rata basis per calendar year. The determination of which calendar year's data to utilize shall be based upon a methodology that ensures that the particular year chosen by each facility results in a factor that yields no less reimbursement to the facility than would result from the use of the other 3 years data. Such methodology shall utilize the 1983 and 1987 regional direct and indirect input price adjustment factor corridor percentages in existence on January 1, 1997 as well as the 1993 regional direct and indirect input price adjustment factor corridor percentage in existence on January 1, 2004 as well as a 2001 regional direct and indirect input price adjustment factor corridor percentage calculated in the same manner as the 1993 direct and indirect input price adjustment factor corridor percentage in existence on January 1, 2004. Non-Institutional Services: For Early Intervention program services rendered on and after July 1, 2004, home and community-based individual/collateral visit shall mean "the provision by appropriate qualified personnel of early intervention services to an eligible child and/or parent or parents or other designated caregiver at the child's home or other natural setting in which children under three years of age are typically found". The definitions of basic and extended visits as established in regulation are hereby eliminated and the rate for home and community-based individual/collateral visits shall be determined annually by the Commissioner in accordance with §69-4.30 of Title 10 of the NYCRR. The billing limits set forth in regulation, as applicable to basic and extended visits or as may be amended, shall continue to apply to home and community-based individual/collateral visits. Effective for Early Intervention service coordination services provided on and after July 1, 2004, payment will be made using a capitation methodology. Two separate capitation rate categories will be established for service coordination services: a single capitation rate for initial service coordination services rendered through the establishment of the initial Individualized Family Services Plan (IFSP) and, a monthly rate for ongoing service coordination services. These provisions are contingent upon securing all necessary federal approvals. The estimated annual net aggregate increase in Medicaid

expenditures attributable to these proposed initiatives for the period April 1, 2004 – March 31, 2005 is approximately $311 million. In addition, pursuant to, but not required by 42 CFR §447.205, the Department of Health gives this informational notice regarding a proposed Title XIX (Medicaid) State Plan amendment for non-institutional services. For ambulatory care visits on and after April 1, 2004, visits solely for the provision of podiatric services shall no longer constitute a billable Medicaid visit. The estimated annual net decrease in Medicaid expenditures attributable to this proposed initiative is approximately $2.4M. federal Office of Ocean and Coastal Resource Management (OCRM). The DOS considers this action to be routine and requests OCRM's concurrence on this determination. The change to the New York State Coastal Management Program (CMP) covered by this request is the incorporation of an amendment to the Town of Tonawanda Local Waterfront Revitalization Program (LWRP) into the State's CMP. A major component of the State's CMP is the provision that local governments be allowed to prepare Local Waterfront Revitalization Programs, which further detail and make geographically specific the State's coastal policies. Each LWRP will be reviewed for consistency with the State's CMP and approved if it meets the guidelines established in the State CMP and Article 42 of the New York State Executive Law. The Town of Tonawanda's Local Waterfront Revitalization Program was originally approved by the New York State Secretary of State in June 1996 and incorporated into the NYS CMP as a routine program change in August 1997. After several years, the Town determined that the LWRP needed to be updated to reflect changing conditions along the Town's Niagara River shoreline. The proposed amendment to the Town's LWRP modifies the NYS CMP through: • Revision of the coastal boundary from 1,000 feet inland of River Road to 500 feet inland of River Road. The choice of 1,000 feet was originally related to the expected relocation of River Road. It is now clear that River Road will not be relocated. As a result, the coastal area boundary is unnecessarily deep, requiring a high level of landscaping and other requirements on properties not visible from River Road. This proposed boundary change, while maintaining protection for development fronting on River Road, will enable greater flexibility inland of the shoreline. Protection of the River Road corridor will be accomplished through changes to the Town's zoning ordinance, including creation of a River Road Zoning Overlay district. These changes to the zoning ordinance will advance the policies and objectives of the Town of Tonawanda LWRP and the State CMP. • Refining land uses along the Town's shoreline to recognize the importance of industrial and commercial uses, while encouraging recreational use and public access to the waterfront.
