CONDITIONS RELEVANT TO MAKING AN APPLICATION AND OFFER

     12.   The amounts referred to in Items 8 to 10 are payable upon the applicant signing the
           Lease and/or prior to taking possession of the Premises.
     13.   The Applicant will not be entitled to occupation of the Premises until;
           i) vacant possession is provided by the current occupant of the premises
           ii) the Lease is signed by the applicant; and
           iii) the payment of all monies due to be paid by the applicant being paid by the
                applicant prior to occupation of the premises

     14.   The persons comprising the applicant are over the age of 18 years, none are bankrupt
           and they each declare that all of the information supplied in the applicant’s particulars
           are true and correct and are not misleading in any way.

     15.   The applicant acknowledges having inspected the premises and if the option is
           exercise will accept possession of the premises in the condition as at the date of
           inspection

     16.    Upon the exercise of the option by the applicant, the Applicant will execute the Lease.
           The Lease shall be the “Standard Residential Property Lease” including any special
           conditions attached to this Application and the payment of all monies referred to in
           items 8 to 12

     17.   The applicant agrees to pay the rent one period in advance except for the first two
           weeks rent.

     18.   The applicant acknowledges that they are responsible for their own contents. The
           applicant should arrange their own insurance to cover their own contents and
           determine if the insurer covers damage to the premises caused by a waterbed or the
           escape of water from a waterbed.

     19.   The Applicant acknowledges and agrees that the Owner will carry out all inspections of
           the premises between normal business hours

     20.   All acts and things that the owner is empowered to do maybe done by the lessor or
           their appointed managing agent. Notices to the owner must be served on the Managing
           Agent unless otherwise directed by the owner.

     21.   The Applicant makes this application and offer jointly and severally. Service of any
           notice to any one applicant shall be deemed to be service on them all.

     22.   The Applicant agrees that for the purpose of this application, the Owner/Managing
           Agent may make enquiries of the persons given as references by the applicant, and
           also make enquiries of such persons or agencies as the owner sees fit.

     23.   The Applicant acknowledges having been advised that items of personal information
           contained in this application may be recorded in a tenancy data base, if the tenant
           defaults on their lease agreement, on behalf of the owner and may be disclosed in
           connection with other residential tenancy applications by the applicant

     24.   The Applicant acknowledges that in the event of lost keys or lockouts, Star Property
           Management is not obligated to deliver keys to site.

OFFER OF OPTION TO OWNER

     27.   The option is exercised by the applicant either;
           i) executing the Lease; or
           ii) taking possession of the property with the owner’s consent; or
           iii) giving a notice in writing to the owner exercising the option
                which ever comes first

     28.   If the applicant exercises the option, then the option Fee is credited to the rental
           payment pursuant to the lease. If not exercised, then the option fee is the property of
           the owner pursuant to section 27(2)(a) of the residential Tenancies act 1987.

     29.   The applicant encloses with this application an option fee for the sum referred to in
           item 7. It is agreed that the acceptance of this application is subject to the approval of
           the owner in the owner’s absolute discretion. The applicant UNDERSTANDS THAT
           WITHDRAWEL AFTER ACCEPTANCE OF THE APPLICATION AND OFFER WILL
           RESULT IN FORFEITURE OF THE OPTION FEE.

33.        Special Conditions

       GENERAL

       1. The tenant acknowledges they will not have indoor plants on floor areas unless
          they have containers that will not damage the floors. Floors damaged will be
          required to be completely replaced at the tenant’s expense.

       2. The tenant and owner acknowledge that the provisions of Section 49 of the
          Residential Tenancy Act 1987 are modified as follows:

                  Section 49 – The tenants shall not assign their interest under this
                   agreement or sub-let any part of the premises

      3.     The tenant acknowledges and understands that inspections will be carried out
           on the premises, the tenant acknowledges and understands that the property
           manager will use the office key to gain access if the tenant is not home during
           the inspection.

      4. The tenant acknowledges and understands they are responsible for the payment
         of 100% of water consumed at the premises. If the tenancy is for a period less
         than 12 months the water consumption will be calculated on a pro-rata basis.

      5. The tenant acknowledges and understands that the rent on the property will be
         reviewed at the end of each six month period of this and any subsequent lease.

      6. The tenants acknowledge and understand rent payments are to be made as one
         payment and not individual amounts if there is more than one tenant in the
         property.

      7. The tenant acknowledges and understands that rent payments will be accept by
         cheque, money order (mailed to PO Box 910 Nedlands 6909), direct credit,
         electronic transfer (National Australia Bank BSB 086:164 Account Number
         5455:13906 with reference number first three letters of street name plus street
         number of property being rented).

      8. The Applicant acknowledges that in the event they lose their keys or lock
         themselves out, Star Property Management is not obligated to deliver keys to
         site.

      9. The tenant is aware there is no smoking allowed in the premises by either
         tenants or visitors. Should there be any evidence of smoking inside the home,
         the tenant agrees to pay for internal painting and the general cleaning of the
         curtains, blinds and carpets

 10. The tenant acknowledges that having inspected the subject premises prior to
     making an application for tenancy, that the application for tenancy is thereby
     made on the premises on an as is and as found basis and as recorded in the
     Property Condition Report, or as negotiated at time of Lease Application.

 11. The tenant agrees and understands the owner takes no responsibility in relation
     to a telephone line to the property it is wholly the tenant's responsibility.

 12. The tenant acknowledges that they have read clause 2.11 of the lease agreement
     and they understand insects and vermin include ants and cockroaches. Star
     Property Management advises that baiting is very effect in eliminating ants and
     such products are easily obtained from common hardware stores. To avoid
     cockroaches you must keep the property clean and free from rubbish.

 13. The tenants are aware that no posters, nails, stickers, screws, poster putty, blue
     tac, adhesive tapes or fittings are to be fixed onto any surfaces within the
     property without the prior consent of the owner. If approval is granted, the tenant
     may be required to return the property to the original condition; as it was at
     commencement tenancy and or as per the property condition report.

 14. The tenant agrees not to store any boxes or timber directly on the ground within
     the property, including in sheds or garages due to the possibility of white ant
     infestation.

 15. The tenant agrees to ensure that oil, grease and grim stains do not appear on
     hard standing areas such as driveways, garage floors and paths. Such grease
     and grim, as and when appears during the tenancy is required to be removed.
     Failure to remove such staining can result in professional cleaners being
     employed to remove the same with cost being charged back to the tenant.

 16. Where there is an electronic means of access to the property and the tenant
     receives a remote control, the tenant acknowledges they are responsible to
     maintain that remote control. Should the remote control be lost, damaged or
     stolen, the tenant understands that it is their responsibility to ensure it is
     replaced and handed back to the agent in good working order (as stated on the
     property condition report) when vacating.
      

LAWNS AND GARDEN MAINTENANCE
 17 Where the owner is paying for lawn and or edges and or a garden service, the
    following conditions apply:
       The owner will be providing a lawn, edges and garden service on monthly
         or six-weekly basis (depending on the time of year) during the term of the
         lease.
       Adequate watering of lawns and gardens is the tenants responsibility
       Normal day to day maintenance (other than the work covered by the
         contracted service) is the tenants responsibility
       Such day to day maintenance includes (but is not limited to) watering,
         purchasing of soil wetting agents, fertilizers and mulch. It would also
         include pruning of shrubs and bushes if only a lawn mowing service is
         provided.

    VACATING
    18 On termination of the lease the tenant acknowledges that the following items
       must be attended to at their expense and if they are not attended to or are not
       to the owner’s satisfaction they will be attended to by the owner and the cost
       will be deducted from the tenant’s bond. Receipts must be provided to the
       owner where required:
            The carpets and floors throughout the premises are to be professionally
               cleaned.
            The windows throughout the premises internally and externally are to
               be cleaned.
            The window treatments (curtains & blinds) throughout the premises are
               to be cleaned.
            The flyscreens throughout the premises are to be cleaned.
            Filters in air conditioning units are to all be cleaned

  19 The tenant acknowledges and understands the owner will have the water meter
     read at the conclusion of their tenancy agreement by The Water Authority of
     Western Australia, the cost of this special reading will be borne by the tenant.

  20 The tenant acknowledges that this lease is for a fixed term. Under the
     Residential Tenancies Act this contract may only be terminated during the fixed
     term should both parties agree in writing on the proscribed form. Should this
     early termination occur, penalties can be applied and they are:
           Tenant to pay rent until a new tenant is secured
           Tenant to pay for all advertising associated with the re-letting of the
              property
           Tenant to reimburse the landlord for unexpired letting fees as per the
              agents advise
           Tenant to reimburse the landlord for updating the Property Condition
              Report
