A meeting of the Colorado Board of Licensure for Architects, Professional Engineers, and Professional Land Surveyors
was held Friday, January 14, 2011 at 1560 Broadway, Suite 1250C, Denver, Colorado. This meeting of the Board was
publicly noticed in accordance with Division Policy.

I.     MEETING – CALL TO ORDER:
       The meeting was called to order by William J. Starker, Chair, at 9:10 a.m.

III.   APPROVAL OF PREVIOUS MEETING MINUTES:
       A motion was made, seconded and carried to approve the November 12, 2010 minutes as amended. The Board
       requested the three Board Opinions from that meeting be posted as reference information on the AES website.

  V.     STAFF COMMENTS:

         Christy Thomas, Enforcement Supervisor, introduced and welcomed Karry Lenon as the Administrative Assistant
         who began with the AES Board on January 3, 2011.

         The Board was informed by Ms. Kinnaird Linn that Governor John W. Hickenlooper has reappointed Barbara J.
         Kelley as Executive Director of the Colorado Department of Regulatory Agencies.

         Program Director Angeline Kinnaird Linn reminded the Board that she and Bud Starker will be attending the NCEES
         Board Presidents’ Assembly in Atlanta, GA, February 10-12, 2011. The February 11, 2011 Board Meeting will be
         run by Vice Chair Axel Johnson and Enforcement Supervisor Christy Thomas.

         Ms. Kinnaird Linn informed the Board that Mr. Starker would also be attending the NCARB Regional Meeting in
         Cleveland, OH in March 2011 on behalf of the Board.

         Program Director Kinnaird Linn requested one Board member be nominated to attend the NCEES Western Zone
         Regional meeting in Spokane, WA on May 26-28, 2011. Dan Donegon was nominated to represent the Board.

         The Board was also asked to nominate one Architect Board member to attend the NCARB Annual Meeting that will
         be held June 22-25, 2011 in Washington, D.C. The Board nominated Ron Abo to represent the Board.

         Ms. Kinnaird Linn updated the Board on some recent, successful changes to the application review process with its
         contractors.

  VI.    GENERAL BUSINESS:

         Agenda Item Change
         The Board was informed that the agenda item for Suzanne L. Chason would be moved to the Executive Session –
         Exam Items section of the meeting.
         Surveyor Quorum Report
         Bryan Clark presented the Survey Quorum report to the Board from the morning’s meeting. Items discussed were
         updates to the Monument Record form and instructions for completion of the form, a presentation by Don Lambert
         of the Monument Record web mapping project he is working on for his master’s degree program, two opinion items,
         and Quorum elections. After discussion, a motion was made, seconded and carried to accept the Survey Quorum
         report.
         Annual Designation of Board Meeting Notices
         It was the consensus of the Board to designate the reception area of the Division of Registrations, at 1560
         Broadway, Suite 1350, Denver, Colorado, 80202 as the location of the Board’s public notices.

       Request for Delegation of Authority – Approval of Applications and Stipulation Compliance
       The Board reviewed three proposed policies that would allow delegation of authority to staff. A motion was made,
       seconded and carried to approve policy 70.4.6 – Architect Endorsement Applications. A motion was made,
       seconded and carried to approve policy 70.4.7 – Engineer and Land Surveyor Intern Applications. A motion was
       made, seconded and carried to approve policy 70.4.5 – Stipulation Compliance as amended.

      Reconsideration for the NCEES Engineering Education Standard
      After discussion, no further action was taken. The Board requested that this information be included with their
      meeting resources.

       Request for Board Direction – Use of Term Engineer, Colorado Association of Healthcare Engineers and
       Directors
       After discussion, the Board took no action.

       Tabled Request for Board Approval of School Program – Metro State College
       The Board requested additional information after review of this request at the November 12, 2010 meeting. After
       discussion, a motion was made, seconded and carried to approve the Metro State College Land Surveying program
       for its current students through December, 2012 based on the curriculum remaining substantially the same and the
       faculty remaining substantially the same.

       Request Regarding Entry of Stipulation in National Database – Michael Ehrlich, PE
       The Board considered a request from Mr. Ehrlich to delete the entry of the Board Stipulation that he signed from a
       national database. Mr. Ehrlich’s attorney requested to address the Board. The request was denied by consensus
       of the Board. After discussion, a motion was made, seconded, and carried to take no action on the request.

       Request for Reconsideration of LOA – Richard A. Bender, ARC
       The Board considered a request from Mr. Bender to reconsider the Letter of Admonition issued to him on November
       29, 2010, for holding out while his license was expired from August 1, 2007 until October 28, 2010. After
       discussion, a motion was made, seconded and carried to table action and request Mr. Bender to clarify how he did
       or did not hold out or practice while his license was expired.

      Tabled Complaint 2010-004986 – Kevin Kenney, Unlicensed
      At the October 8, 2010 meeting, the Board considered a complaint based on the allegation that Mr. Kenney is
      holding himself out to the public as a professional engineer. Mr. Kenney did not respond to the 30-day letter
      requesting a response to the allegation. The Board tabled action and asked staff to request additional information
      from the Complainant verifying the allegations. The Complainant responded. After discussion, a motion was made,
      seconded and carried to dismiss the case for lack of an apparent license law violation.

      Tabled Complaint 2011-000683 – Matthew J. Koch, PLS
      At the November 12, 2010 meeting, the Board considered a complaint based on the allegation that Mr. Koch failed
      to meet the generally accepted standards of the practice of professional land surveying on a survey in Fremont
      County. The Board tabled action and requested corrections to the land survey plat. Mr. Koch responded. After
      discussion, a motion was made, seconded and carried to dismiss the case and request Mr. Koch to properly deposit
      the revised plat.

      Complaint 2011-001336 – Kenneth R. Alles, PLS
      The Board reviewed a complaint based on the allegation that Mr. Alles failed to meet the generally accepted
      standards of the practice of professional land surveying on a land survey plat in Greeley. Mr. Alles responded.
      After discussion, a motion was made, seconded and carried to refer the case to the Office of Investigations for an
      expert review and opinion.

      Complaint – Angela Bellantoni, Unlicensed
      The Board reviewed an anonymous complaint that alleged Ms. Bellantoni and Environmental Alternatives, Inc., are
      holding out to the public as licensed professional engineers and offering engineering services without a licensed
      engineer on staff. After discussion, a motion was made, seconded and carried to issue a 30-day letter requesting a
      response to the allegations.

      Complaint 2011-001734 – Michael T. Caistor, ARC
      At the November 12, 2010 meeting, the Board reviewed a settlement judgment report and initiated a complaint
      based on the allegation Mr. Caistor failed to meet the generally accepted standards of the practice of architecture
      on a home in Dillon. Mr. Caistor responded. After discussion, a motion was made, seconded and carried to table
      action and request Mr. Caistor to submit a copy of the contract, drawings, specifications, and an explanation of his
      involvement in the project.

      Complaint 2011-000969 – Robert E. Campbell, Unlicensed
      The Board reviewed an anonymous complaint that alleges Mr. Campbell is holding himself out to the public as a
      licensed professional engineer. Mr. Campbell responded. After discussion, a motion was made, seconded and
      carried to dismiss the case for lack of an apparent license law violation.

      Complaint 2011-001704 – Ryan J. Hardesty, PE
      The Board reviewed a complaint that Mr. Hardesty failed to meet the generally accepted standards of the practice of
      engineering on a site investigation report for a home in Centennial. Mr. Hardesty responded. After discussion, a
      motion was made, seconded and carried to dismiss the case for lack of an apparent license law violation.

      Complaint 2011-001729 – Michael B. Kopplin, PE
      The Board reviewed information at the November 12, 2010 meeting about disciplinary action taken by West Virginia
      that alleges Mr. Kopplin violated a law or regulation governing the practice of engineering in another jurisdiction.
      Mr. Kopplin responded. After discussion, a motion was made, seconded and carried to issue a Letter of
      Admonition.

      Complaint 2011-001145 – Rick F. McKittrick, Unlicensed
      The Board reviewed a complaint that alleges Mr. McKittrick is holding himself out to the public as a licensed
      professional engineer. Mr. McKittrick responded. After discussion, a motion was made, seconded and carried to
      dismiss the case for lack of an apparent license law violation.

      Complaint 2011-001723 – Frank D. Moore, PE
      The Board reviewed information at the November 12, 2010 meeting and initiated a complaint that alleges Mr. Moore
      practiced professional land surveying without a license. Mr. Moore responded. After discussion, a motion was
      made, seconded and carried to issue a Letter of Admonition.

      Complaint 2011-001320 – Martin L. Reynolds, PLS
      The Board reviewed a complaint based on the allegation that Mr. Reynolds failed to meet the generally accepted
      standards of the practice of professional land surveying on a land survey in Conejos County. Mr. Reynolds
      responded. After discussion, a motion was made, seconded and carried to table action and request additional
      information and correction of the plat. The Board directed that the Complainant be advised that he may want to
      have a supplemental land survey performed because of the apparent encroachment on his property.

      Complaint 2011-001732 – William A. Scott, PE
      The Board reviewed information at the November 12, 2010 meeting and initiated a complaint based on a claim
      against Mr. Scott alleging substandard practice on the foundation footer and stem wall design for a home in Dillon.
      Mr. Scott responded. After discussion, a motion was made, seconded and carried to refer the case to Executive
      Session for possible disciplinary action.

      Complaint 2011-001736 – John W. Weldy, PE
      The Board reviewed information at the November 12, 2010 meeting and initiated a complaint based on a claim
      against Mr. Weldy alleging he failed to meet the generally accepted standards of the practice of engineering while
      preparing the wood foundation wall design for a home in Dillon. Mr. Weldy responded. After discussion, a motion
      was made, seconded and carried to dismiss the case for lack of an apparent license law violation.

      Disciplinary Action by Another State – Terri L. Johnson, PE
      The Board considered information reported by Ms. Johnson against her licenses in Arkansas and Hawaii for
      working on a project located in Arkansas without first applying for licensure in Arkansas. The Arkansas Board of
      Registration for Professional Engineers and Land Surveyors provided disciplinary documentation. After discussion,
      a motion was made, seconded and carried to issue a Letter of Admonition against Ms. Johnson based on
      disciplinary action in another state.

      Disciplinary Action by Another State – James M. McNeely, PLS
      The Board considered information reported by Mr. McNeely against his license in Florida for violating minimum
      technical standards on a land survey in Florida. The Florida State Board of Professional Surveyors and Mappers
      provided disciplinary documentation. After discussion, a motion was made, seconded and carried to issue a Letter
      of Admonition against Mr. McNeely based on disciplinary action in another state.

      Disciplinary Action by Another State – Francis J. Stanton, PE
      The Board considered information reported by Mr. Stanton for an arrest and guilty plea to a first offense of DUI in
      the State of Tennessee. After discussion, a motion was made, seconded and carried to take no action.

      Tabled Report of Settlement or Judgment – David R. Addor, PE
      At the November 12, 2010 meeting, the Board considered a settlement/judgment report for Mr. Addor alleging
      substandard practice on the drainage and design improvements for a private school in Denver. The matter was
      tabled and additional information was requested. Mr. Addor responded. After discussion, a motion was made,
      seconded and carried to initiate a complaint and refer the case to Executive Session for possible disciplinary action.

      Tabled Report of Settlement or Judgment – Craig S. Blett, PE
      At the November 12, 2010 meeting, the Board considered a settlement/judgment report for Mr. Blett alleging
      substandard practice on the site grading design for the Bear Valley Park Condominium project in Denver. The
      matter was tabled and additional information was requested. After discussion, a motion was made, seconded and
      carried to refer the case to the Office of Investigations for an expert review and opinion.

      Report of Settlement or Judgment – Robert J. Buckley, PLS
      The Board considered a claim filed against Mr. Buckley alleging substandard practice on the construction staking
      for an office project in Centennial. After discussion, a motion was made, seconded and carried to take no action.
      The Board also provided direction to Staff to send a letter of inquiry to two other licensees named in the report.

      Report of Settlement or Judgment – William R. Edgel, PE
      At the November 12, 2010 meeting, the Board requested that staff notify Mr. Edgel of his requirement to submit his
      report of malpractice settlement or judgment in a construction defect lawsuit by December 1, 2010. Mr. Edgel did
      not respond to the request. After discussion, a motion was made, seconded and carried to initiate a complaint and
      issue a 30-day letter.

      Report of Settlement or Judgment – John B. Guyton, PLS
      At the September 10, 2010 meeting, the Board requested staff to correspond with Mr. Guyton regarding a
      settlement/judgment claim filed against Mr. Guyton alleging substandard practice on the construction staking for the
      Bear Valley Park condominium development project in Denver. Mr. Guyton responded. Larry Connolly recused
      himself and left the room during the discussion and vote. After discussion, a motion was made, seconded and
      carried to table action and request Mr. Guyton to submit a copy of the contract, drawings, and scope of work on the
      project.

      Report of Settlement or Judgment – John C. Hurtig, ARC
      The Board considered a claim filed against Mr. Hurtig alleging substandard practice on the architectural design and
      construction services for the remodeling of a metal roof building in La Junta. After discussion, a motion was made,
      seconded and carried to table action and request Mr. Hurtig to submit a copy of the contract, drawings,
      specifications, and a list of names of sub-consultants involved.

      Report of Settlement or Judgment – Ned C. Kirschbaum, ARC
      The Board considered a claim filed against Mr. Kirschbaum alleging substandard practice on the architectural
      design and construction administration services for the Cape Girardeau Federal Courthouse in Missouri. Jeff Olson
      recused himself and left the room during the discussion and vote. After discussion, a motion was made, seconded
      and carried to take no action.

      Report of Settlement or Judgment – Craig D. Moritz, PE
      The Board considered a claim filed against Mr. Moritz alleging substandard practice on the retaining wall design for
      the Bear Valley Park condominium development project in Denver. After discussion, a motion was made, seconded
      and carried to take no action.

       Report of Settlement or Judgment – Steven D. Sparn, ARC
       The Board considered a claim filed against Mr. Sparn alleging substandard practice on the architectural design for a
       three-story condominium and commercial office building and parking garage in Boulder. After discussion, a motion
       was made, seconded and carried to table action and request Mr. Sparn to submit a copy of the contract, drawings,
       specifications, and a list of the names of all other professionals involved.

       Report of Settlement or Judgment – Thaddeus V. Trzos, ARC
       The Board considered a claim filed against Mr. Trzos alleging substandard practice on the exterior wall design of a
       public school in Falcon. Dan Donegon recused himself and left the room during the discussion and vote. After
       discussion, a motion was made, seconded and carried to table action and request Mr. Trzos to submit a copy of the
       contract, drawings, specifications, and a list of names of all other professionals involved.

       Compliance with Board Order 2008-000627 – David E. Archer, PLS
       The Board considered the first quarterly report for the quarter ending December 31, 2010 submitted by practice
       monitor, Dean F. Glorso, PLS, pursuant to the July 9, 2010 Stipulation and Final Agency Order Mr. Archer signed
       with the Board. After discussion, the report provided by the practice monitor was not accepted in accordance with
       the terms of the Order and must be corrected and resubmitted. The practice monitor will be directed to visit Mr.
       Archer at no cost to Mr. Archer.

       Compliance with Board Order 2009-002132 – Carlton A. Miller, EI
       The Board considered quarterly reports for the quarters ending September 30, 2010 and December 31, 2010
       pursuant to the April 11, 2008 Agreement and Final Agency Order Mr. Miller signed with the Board. Mr. Miller also
       submitted a request to have his Agreement modified to reflect completion of his court probation on October 24,
       2010. After discussion, a motion was made, seconded and carried to accept the report in accordance with the
       terms of the Agreement. A motion was made, seconded and carried to amend the Agreement to not require a
       probation officer signature but to require that he continue to voluntarily disclose any felony or sex offense
       convictions by way of his own quarterly reports with the last report due December 2013.

       Compliance with Board Order 2010-005036 – Guenther Polok, PE
       The Board considered a request by Mr. Polok to approve an alternate seminar to be used to meet the terms of the
       November 12, 2010 Stipulation and Final Agency Order he signed with the Board in lieu of the required 3 semester
       hour course. After discussion, a motion was made, seconded and carried to accept the alternate course offered by
       Global Innovative entitled “Flexible and Rigid Retaining Wall Systems Design Workshop” held in March, 2011 as
       being compliant with the Continuing Education requirement.

       Compliance with Board Order 2008-002816 – Mark F. Shifter, ARC
       The Board considered a quarterly report for the quarter ending December 31, 2010 pursuant to the April 11, 2008
       Agreement and Final Agency Order Mr. Shifter signed with the Board. After discussion, a motion was made,
       seconded and carried to accept the report in accordance with the terms of the Order.

       Compliance with Board Order 2009-002133 – Douglas E. Vandenbark, PE
       The Board considered a quarterly report for the quarter ending September 30, 2010 pursuant to the July 10, 2009
       Agreement and Final Agency Order Mr. Vandenbark signed with the Board. After discussion, a motion was made,
       seconded and carried to accept the report in accordance with the terms of the Order.

       INTERVIEWS REGARDING PRIOR DECISIONS OF THE BOARD:
       Individuals may have requested a personal interview with the Board regarding a prior Board decision on their
       application, or in some cases, the Board may have initiated the personal interview. After full consideration of each
       applicant's entire file and the additional information presented, the Board made its decision. Due to privacy issues,
       the names of applicants and the Board’s decisions are no longer a part of the minutes made available to the public.

X.     EXECUTIVE SESSION – DISCIPLINARY MATTERS:
       At 3:14 p.m., a motion was made, seconded and carried unanimously to enter into executive session for the
       purpose of discussing with counsel disputes that are the subject of pending or imminent court action, discussing
       specific claims or grievances, and receiving legal advice on specific legal questions, pursuant to § 24-6-402(3)(a)(II)
       and (III), C.R.S. At 4:31 p.m. the Board’s discussion in executive session concluded and the Board returned to open
       session.

XI.    ACTIONS SUBSEQUENT TO EXECUTIVE SESSION:

       Complaint 2010-002613 – Ronald Barta, Unlicensed
       The Board reviewed a report presented by the Office of Investigations. After discussion, a motion was made,
       seconded and carried to refer the case to the Office of the Attorney General for possible disciplinary action.

       Complaint 2011-001732 – William A. Scott, PE
       The Board reviewed information at the November 12, 2010 meeting and initiated a complaint based on a claim
       against Mr. Scott alleging substandard practice on the basic foundation footer and stem wall design for a home in
       Dillon. Mr. Scott responded. After discussion, a motion was made, seconded and carried to dismiss the case. The
       Board found that there was no reasonable cause to warrant further action at this time.

       Tabled Report of Settlement or Judgment – David R. Addor, PE
       At the November 12, 2010 meeting, the Board considered a settlement/judgment report for Mr. Addor alleging
       substandard practice on the drainage and design improvements for a private school in Denver and tabled to request
       additional information. Mr. Addor responded. After discussion, a motion was made, seconded and carried to
       dismiss the case. The Board found that there was no reasonable cause to warrant further action at this time.
