                            Minutes of the Meeting of 17 April 2012


The following Commissioners were present:

        Richard Hobbie, President
        James Mercante
        Carmine Ragucci
        Lucienne Bulow
        Russell Johnson
        Richard Hendrick

UPON MOTION DULY MADE, SECONDED AND UNANIMOUSLY VOTED UPON, (EXCEPT AS
OTHERWISE MINUTED) IN A PUBLIC MEETING, WHICH CONVENED AT 10:30 A.M., THE BOARD
CONDUCTED THE FOLLOWING BUSINESS:

1.      The President called the meeting to order.

2.      The Minutes of the 10 April 2012 Regular Meeting were reviewed and approved.

3.      Renewed, for a period of one year, (unless otherwise noted), the following New York State pilot
license(s) following a personal interview and review of work performance data, training, and
medical/health records:

        Vincent Kirby – FBLIS-BISP.

3a.     Other Pilot/Personnel Matters:

        HR Pilot-in-Training Brian Moore: The Hudson River Pilots Association’s (HRPA) Appeal of the
Board’s 25 January 2012 Opinion and Order scheduled for today was postponed on Monday, 16 April
upon request of counsel to the HRPA and rescheduled for Tuesday, 1 May 2012 at 10:30 AM in the
Board’s office. Continued on the docket.

4.      The Board adjourned to executive session to discuss and/or act on personnel,
investigation, negotiation, and/or legal matters.

5.      The Board returned to Public Session from Executive Session.

6.      The Board continued a review of apprentice and pilot training including subject matter, questions
for possible inclusion on future State pilot license examinations and the apprentice selection process in
other state pilot associations. The Board reviewed the SHPA Monthly Apprentice Report. Continued on
the docket.

7.       The Board noted a letter from the HRPA relative to the Board’s authorization of a technology
grant to the HRPA for the lease/purchase of a DGPS unit.

8.       The Board received requested documentation from Block Island Pilots with respect to a proposed
rate increase for the waters of Long Island Sound and Block Island Sound. Continued on the docket.

9.       M/V BAVARIA EXPRESS: Loss of propulsion. 8 April 2012. FBSHP Winfield Winter. While
outbound in the Ambrose Channel the vessel experienced a loss of propulsion. FBSHP Winter was able
to continue to steer the vessel to a point just past the 7 buoy where the vessel was safely anchored at the
edge of the channel. USCG VTS notified. Tugboats were dispatched and the vessel was moved as a
dead ship to Gravesend Bay where it was safely re-anchored. No violation of the New York State
Navigation Law or the New York Codes, Rules and Regulations. No personal injury, pollution or damage.
The Board voted to close the case.
10.     The Board was provided updated information from the New York State Joint Commission on
Public Ethics with respect to filing the annual Financial Disclosure Statement.

11.    The Board has commenced review of the 2011 Annual Report.

12.    There being no further business to conduct, or public comment, the Board meeting adjourned at
11:50 AM.
