Hon’ble MP, New Delhi.
Sub: Blatant breach of 3G Policy by private operators, Airtel, Idea and Vodafone and
their calibrated and cartelization at the cost of state owned Company, BSNL - NTP 11
seeks to legitimize both.
Airtel, Vodafone and Idea entered into a cartel at the time of 3G auctions by not bidding on Pan
India basis to get 3G spectrum. Through carefully worked out premeditated sinister
arrangement, these operators bid selectively, thereby paying more than 50% less 3G spectrum
charges compared to BSNL which was forced to pay for Pan India 3G License by denying it
opportunity to bid.
After having entered into a cartel at the time of 3G auction, these operators took recourse to
premeditated blatant breach of policy by entering into roaming agreements strictly forbidden by
policy to provide 3G services in areas where they did not bid for 3G spectrum and do not have
license. In fact, ongoing naked policy contravention in 3G segment which is being
grossly overlooked and is direct corollary of cartelization at the time of 3G auctions are
frantically being sought to be legitimized by MOC&IT and telecom policy makers
through diabolical provisions in draft NTP 11 in the dubious garb of optimum utilization
of 3G spectrum.
Our communications to MOC&IT dated 16th Aug and 28th Sept 11,(enclosed) apprising him in
detail about these violations and urging him to act expeditiously in accordance with licensing
policy provisions have failed to evoke any response. Also our communication to Hon’ble PM
dated 12th Sept and 31st Oct.,11(enclosed) have not met with any response so far. TRAI
has also informed DOT that providing of 3G services without 3G spectrum is strictly
forbidden by policy and illegitimate.
BSNL strictly adhering to policy provisions has been victim of a very hostile telecom
environment because of rampant and persistent policy violations by private operators
and their legitimization by fresh policy interventions. You are requested to kindly
impress upon MOC&IT to sternly act against such blatant policy violations in the greater
interests of viability of BSNL which has been meeting social obligations of the
government in an exemplary manner at incredibly huge costs.
