August 14, 2006 Regular Session of the County Commissioners
The Board of Commissioners, in and for Beaverhead County, Montana, met in
session on August 14, 2006, at 9:15 a.m. Present: Chairman Garth Haugland,
Commissioner Mike McGinley, and Commissioner Tom Rice.
Road Manager Richard Miller joined the meeting and submitted the Road Report
for August 6-12, 2006:
Sweetwater Road, Carter Creek road, Nissen Lane, and Old Armstead Road
were watered and bladed.
Antelope Drive, Argenta and Railroad Streets at the Fairgrounds, and
Sweetwater Road from Rand Marshall’s house to Ten Peaks Drive were
watered, bladed, and magchlorided.
Medicine Lodge Road (Cabin Creek) was bladed.
A utility locate was done on Smith Road.
The roads in the Glen and Melrose areas were checked.
Gravel was hauled to South Valley Road.
Sawdust and chips were hauled to the Fairgrounds.
Equipment was serviced and repaired.
Stibal Lane and South Valley Road were bladed.
Two bad spots on the North Valley Road were repaired.
Barrow pits on the Wise River side of the Scenic Byway were cleaned.
Equipment was moved to Little Lake Creek Road.
Installation of a cattleguard on Little Lake Creek Road was started.
Bad spots on Miner Lake Road were repaired.
Brush was removed on the Scenic Byway.
Equipment was serviced and repaired.
Richard discussed with the Commissioners the County’s dust abatement
program on County and subdivision roads.
Richard requested new equipment, and preliminary road budget issues were
discussed. Richard left the meeting.
County Attorney Marv McCann and Deputy County Attorney Kurt Steadman
joined the meeting. The County’s ownership of roads in particular the North Lane issue,
was discussed. Ira Walker wants to donate North Lane to the County, but state statute
says that counties can only have purchased rights-of-way or dedicated rights-of-ways;
counties cannot own roads.
Commissioner McGinley asked Kurt to write an easement that would allow
Beaverhead County High School’s busses to turn-around on a piece of County property
located by the Search and Rescue building. This easement would allow BCHS busses

to access the School’s bus barn. Kurt will write this easement. Marv and Kurt left the

Representatives Dan Reilly and Steve Brueske, Dillon Tribune Reporter Barbara
Bauerle. Introductions were given and Chairman Haugland turned the meeting over to
Larry. Copies of the agenda and attachments were distributed. Everyone gave his or
her verbal report. Dick, Dan, Steve, and Larry gave power point presentations on the
drought conditions and the effect of the drought in Beaverhead County. The next
County Drought Task Force meeting will be September 11, 2006. The Drought Task
Force left the meeting.
Chairman Haugland recessed the meeting at 12:00 p.m. for the lunch break and
reconvened the meeting at 1:30 p.m. with all Commissioners in attendance.
Dillon City Council President Frank Mastandrea, Members of the Humane
Society Board of Directors Dorothy Stout, Sandra McKee, and Cynthia Ayers joined the
meeting. Frank requested that the Commissioners place a mill levy on the 2006
General Election Ballot for the Humane Society.
MOTION: Commissioner McGinley moved and Commissioner Rice
seconded that a one-mill levy be placed on the 2006 General
Election ballot. The motion carried unanimously.
Frank agreed to write the ballot initiative and to have a legal review completed before
the August 21, 2006 Commission meeting. Frank, Dorothy, Sandra, and Cynthia left the
Planner Rick Hartz, Rich and Sandy Nyquist, Ike Walker, Marilyn and Howard
Begin, Jim Watkins, W.D. Eddie, Bill Mancoronal, Arley and Caral McLaren, Danny
Devers, County Attorney Marv McCann, and County Road Manager Richard Miller
joined the meeting. There was lengthy discussion about the status of North Lane and
the procedure on how to make this road a County road. Richard will write a petition that
will include a statement that the adjoining property owners would consent to expanding
their property to the centerline of North Lane; a cost estimate for surveying the property
will be placed on the petition. Marv will do the legal work on this matter. Rick, Rich,
