December 14, 2009, Regular Session of the County Commissioners
The Board of Commissioners, in and for Beaverhead County, Montana, met in session
on Monday, December 14, 2009 at 9:30 a.m. Present: Chairman Tom Rice,
Commissioner Garth Haugland, Commissioner Mike McGinley, and Secretary Patti
Odasz.
Minutes:
The December 7, 2009 minutes were not read.

Report on County Projects:
Road Supervisor Mike Shafer and Road Secretary Jamie Flynn joined the meeting.
The following Road Department Report for December 6 –12, 2009 was submitted:
DILLON AREA
Plowed snow at Wise River with a truck.
Plowed snow with a grader on the following roads and lanes: Flynn, Eliason,
Downing, Old Stage, Bolick, Rebich, and Hwy 324 at Bannack Pass.
Welded and fabricated buckets for backhoes.
Installed a school bus stop sign on Sweetwater Road.
Attended a loss control liability class from MACo.
Replaced a 16-ton weight limit sign on the bridge on Sweetwater Road.
Shop cleanup and maintenance.
Road checked Melrose, Glen, Dillon, Elkhorn and Horse Prairie area roads.
Equipment service and repair.
LIMA AREA
Flood control on Big Sheep Creek Road.
Attended a loss control liability class from MACo.
Mounted snow equipment.
Shop cleanup and maintenance.
Road checked Lima, Dell and Centennial Valley area roads.
Equipment service and repair.
WISDOM AREA
Culvert survey on Lower North Fork and Skinner Meadows Roads.
Mounted snow equipment.
Attended a loss control liability class from MACo.
Road checked Wisdom and Jackson area roads.
Equipment service and repair.
The County has purchased 4,545 yards of gravel from the Martinell gravel pit.
Chairman Rice will find out if the cost to the County includes royalties.
The detour for the Nissen Lane bridge project will be started this week.
Mike Shafer informed the Commissioners that quite a few cattleguards would need to
be purchased for 2010 projects. Commissioner McGinley will check to see how much is
in the budget for cattleguards.
Mike Shafer will be ordering three sets of snowplow blades from MHL Systems. This
Company honored the warranty on the blade that failed.
The Commissioners will make a 2010 project list for the Road Department.
The Department Environmental Quality is in the process of finalizing the Apex Gravel Pit
permit.
The Nature Conservancy used 380 yards of the County’s gravel in the Centennial Valley
for an approach. This is more gravel than the Commissioners were told that were
needed. This matter will be further investigated.
A Roscoe Steel Representative is going to design a pipe to replace the cement bridge
on Anderson Lane.
Sheriff’s Office Update:
Sheriff Jay Hansen joined the meeting. There were no bids for the trailer that Jay just
tried to sell at a Sheriff’s sale. The landowner where this trailer is located does not own
the trailer. The taxes on this trailer are uncollectable and the trailer is worthless.
Research will be done as to the landowner’s options for the removal of the trailer.
In the near future, a trailer owned by Lydia and Jacob Major that will go to a Sheriff’s
sale. Jay has been unable to locate the Majors.

Action on the Final Plat of the White Minor Subdivision:
Planner Rick Hartz joined the meeting and submitted the Final Report and plat for the
White Minor Subdivision. The Beaverhead County Planning Department recommends
final plat approval of the White Minor Subdivision. All of the conditions that were placed
on this proposal at the time of preliminary plat approval (November 23, 2009) have been
met or otherwise satisfied. The final plat review fee has been paid to Beaverhead
County.
MOTION: Commissioner Haugland moved and Commissioner McGinley
seconded that the Final Plat of the White Minor Subdivision be
approved. A verbal vote was taken and the motion carried
unanimously.
Conference Call Re: CDBG Grant Application:
Dillon City Operations Manager J.S. Turner joined the meeting. At this time the
Commissioners initiated a conference call with Grant Writer Judie Tilman regarding a
CDBG application.
Judie informed the Commissioners that CDBG money for economic development has
already been spent, but there will be other funding available in April. The economic
development portion of CDBG is an open cycle. Originally it was estimated that the new
hospital project would create approximately 16 jobs and the off-site improvements
would total approximately $600,000 to $650,000. The City had one public hearing for
the CDBG Economic Development Grant and was going to submit an application of
$400,000 for the offsite improvements. After further evaluation, the project should
create approximately 26 to 30 jobs, thus allowing a joint application to be submitted
requesting up to $800,000. Also, after further study it was determined that the offsite
improvement costs would be approximately $945,000 not including $18,000, for
administration. The Commissioners were asked if the County would consider
submitting a joint application with the City of Dillon for the new hospital project. The
Commissioners answered in the affirmative. On January 4, 2009 at 7:00 p.m. in the
Commissioners’ Room, the County will hold a public hearing on the County’s needs and
priorities. After this hearing a joint hearing will be held with the City of Dillon. The City
of Dillon will be taking the lead on this project. After the joint hearing, the County will
need to pass a resolution to submit an application. Further discussion ensued. The
conference call was completed.
Lunch Recess:
Chairman Rice recessed the meeting at 12:00 p.m. for the lunch break and at 1:30 p.m.
he reconvened the meeting with Commissioner Haugland, Commissioner McGinley,
and Secretary Patti Odasz present.
County Attorney’s Office Update:
County Attorney Jed Fitch and Clinical Director of the Western Montana Mental Health
Center (WMMHC) Natalie McGillen joined the meeting. Jed explained that at the
present time emergency detentions are sent to the State Hospital at Warm Springs.

Discussion ensued and the following motion was made:
MOTION: Commissioner Haugland moved and Commissioner McGinley
seconded that the Beaverhead County accept WMMHC’s
proposal for security detention. A verbal vote was taken and
the motion carried unanimously.
Chairman Rice signed the agreement.
News Media:
Chairman Rice went over the day’s business with the news media.
Payment of Invoices:
The Commissioners reviewed and approved the November 29 – December 12, 2009
invoices for a total of $851,297.12. The Invoice Payment Schedule is located in the
Financial Administrator’s Office.
Public Comment on Subjects Under County Jurisdiction
No public comments were expressed.
Adjourn
There being no further business to come before the Board, the meeting was adjourned
at 5:00 p.m.
