                                 Importation of Toxic Ships
                               High Court seeks Explanations

Five of the six officials, directed to appear before the High Court, made a personal appearance
today, the 13th of October, 2010 before the High Court bench comprising Mr. Justice Md.
Imman Ali and Mr. Justice Md. Obaidul Hasan. The Chairman, Chittagong Port Authority
could not be present due to the unrest in the Port but has been directed to appear on the 28th of
October when the matter shall again be taken up for hearing.

While the Collector of Customs (Import) apologized before the Court and the officials of
Department of Environment shall do the same, the Department of Shipping officials who
granted the NOC for the importation of the ships named. MV BADRI and MT BO have opted
to contest the rule of the Court.

On submission of the lawyers appearing for the respondent/contemnors, the Court, however,
has exempted the present 5 officials from personal appearances.

The Court has directed the government officials to explain in writing why the two ships have
been allowed to enter Bangladesh in violation of its judgment and order passed in a case filed
by Bangladesh Environmental Lawyers Association (BELA) and what measures each of them
took to prevent their entry when they were intimidated of the fact that they ships were
attempting to enter.

The Hon’ble Court has further directed not to break the ships without environmental clearance
that should be given after ensuring all necessary safety and precautionary measures. If
anything contrary to that happens, the COurt has warned not to spare any of the responsible
government officials.

Senior lawyers Rafiqul Haque, Rokon Uddin Mahmood and Anisul Haque appeared for the
respondent/contemnors. Advocate S.Rizwana Hasan and Iqbal Kabir appeared for BELA.
