                               SEPTEMBER 27, 2011

                                  CALL TO ORDER
The Newberry Township Board of Supervisors held their regular meeting at the
Township Municipal Building, 1915 Old Trail Road, Etters, PA. The meeting was called
to order by Chairman Carl Hughes at 6:56 P.M. Chairman Hughes proceeded with the
pledge to the flag and the Lord’s Prayer. Present at the meeting were Vice-Chairman
Ernest Helmick, Supervisor Stephen Pancoe, Supervisor Robert Conley and Supervisor
Brandt Cook. Also present, Manager Don Keener, Chief John Snyder, Codes & Zoning
Officer Rod Borda, Engineer Ryan Rhoades and Solicitor Margaret Driscoll. Absent was
Road Foreman Randy Eichelberger

                                 PUBLIC COMMENT

Sherilyn Kanyuck, 925 Pleasant Drive Mrs. Kanyuck said the Board should feel
honored to serve the Township.

                                       MINUTES

Motion made by Supervisor Pancoe, seconded by Vice-Chairman Helmick, to approve
the Minutes from the September 13, 2011 Board of Supervisors Meeting. Vote on the
Motion. 5 Ayes. Motion carried.

                                      REPORTS

Engineer’s Report: Ryan provided a written report. Motion made by Supervisor
Pancoe, seconded by Supervisor Cook, to authorize Ryan to do a study on the light at the
I83 and Pines Road intersection for a price not to exceed $6,800.00. Vote on Motion. 5
Ayes. Motion carried. Chairman Hughes asked if Ryan had an opportunity to look at the
stormwater runoff problem behind Penske than runs unto Culhane Road. Ryan stated that
he, Randy and Don were reviewing the issue.

Chief of Police’s Report: The Chief provided a written report. Motion made by
Supervisor Pancoe, seconded by Supervisor Conley, for the Police Department to
purchase two new Crown Victoria vehicles. Vote on Motion. 4 Ayes. 1 Naye from Vice-
Chairman Helmick. Motion carried.

Fire Commissioner’s Report: Discussion ensued with regards to Fairview Township
taking over the Lewisberry Fire Department. The Board agreed, by consensus, to have
the call boxes remain as assigned until they have obtained more information on the fate
of the Department.

Supervisors’ Report: Supervisor Conley commended Chairman Hughes for the
fundraiser held at the Flea Market to help purchase Christmas presents for
underprivileged children in the Township. Chairman Hughes stated that Community Day
was to be held at Newberry Commons on Saturday, October 1st. Vice-Chairman Helmick
asked Don where the Teamster Contract Negotiations stood. Don stated that he needed to
set up a meeting with Chairman Hughes, Supervisor Conley and the union representative.

                                   OLD BUSINESS

None.

                                   NEW BUSINESS

PPL Presentation Jim Nulton, PPL, stated that they had donated $4,000.00 to the
Police Department in appreciation for their monitoring the truck traffic coming from
Bruner Island.

Discussion of the Refuse Contract Bids Two bids were received: One from Penn
Waste for $2,614,131.00 for three years and another for $2,670,213.00 from York Waste.
Motion made by Supervisor Pancoe, seconded by Vice-Chairman Helmick, to award the
contract to, Penn Waste, the low bidder. Vote on Motion. 5 Ayes. Motion carried.

Authorize Execution of the 2012 SPCA Contract Motion made by Supervisor Conley,
seconded by Supervisor Pancoe, to authorize the SPCA Contract in the amount of
$7,643.00 for 2012. Vote on Motion. 5 Ayes. Motion carried.

Approval of the West Shore Recreation Commission 2012 Contribution Motion
made by Supervisor Conley, seconded by Supervisor Pancoe to table the approval of the
2012 contribution for $33,382.00 until a WSRC representative can come speak before the
Board. Vote on Motion. 5 Ayes. Motion carried.

Approval of Attendance for York County Convention Motion made by Supervisor
Pancoe, seconded by Vice-Chairman Helmick, to approve Don Keener’s attendance at
the Convention. Vote on Motion. 5 Ayes. Motion carried.

Authorize Advertisement of the Stormwater Ordinance Motion made by Supervisor
Pancoe, seconded by Supervisor Cook, to table the advertisement of the Ordinance per
Solicitor Driscoll’s recommendation. Vote on Motion. 5 Ayes. Motion carried.

Discussion of The Woods Zoning Text Amendment Fran McNaughton, Developer,
looked to the Board for approval of the Text Amendment to Section 512 of the Zoning
Ordinance with regards to Parking Requirements. Motion made by Supervisor Cook,
seconded by Supervisor Conley, to table the approval until staff could further review the
text amendment and the possibility of taking out a portion of the Parking Requirements in
the Ordinance. Vote on Motion, 5 Ayes. Motion carried.
                   SUBDIVISION AND LAND DEVELOPMENT

Ryan & Mary Gross - Minor Final Subdivision Plan Motion made by Supervisor
Pancoe, seconded by Supervisor Cook, to approve the Minor Final Subdivision Plan, with
waivers and subject to Engineer’s comments of September 27, 2011. Vote on Motion. 5
Ayes. Motion carried.

                                 PAYMENT OF BILLS

Motion made by Supervisor Pancoe, seconded by Supervisor Conley, to approve check
numbers 51571 - 51622, 15689, 14218, 11971 & 11972, 2472 – 2474. Vote on Motion.
5 Ayes. Motion carried.

                               EXECUTIVE SESSION

The Board recessed to Executive Session at 9:10 P.M. to discuss personnel and legal
matters.
The Board reconvened from Executive Session at 9:45 P.M.

                                  ADJOURNMENT

Motion made by Supervisor Cook seconded by Supervisor Pancoe, to adjourn the
September 27, 2011 Board of Supervisors Meeting. Vote on Motion. 5 Ayes. Motion
carried.

The Meeting was adjourned at 9:47 P.M.
