Forester Licensing Board Minutes – April 12, 2006 Berkshire-Pioneer RC&D Office 433 West St. Suite 8, Amherst, MA Board Members in attendance: S. Sylvester, J. Kelly, M. Kelty, K. Ross, G. Boyce. Others in attendance: Legal Counsel: Nick Vontzalides Guests: The chair referred members to the minutes of the March 8, 2006 meeting and requested comments or corrections prior to their approval. A motion was made and seconded to accept the minutes as written. Motion carried with a unanimous vote. Scheduled 9 AM Appeal by Mr. Mike Leonard of the director’s decision in his complaint against Mr. James DiMaio. Mr. Leonard has not appeared for the hearing. We will postpone until later in the meeting in hopes that he will appear. Public Inquiry-None Reviewed and approved renewal application packages submitted by: David Beers Julie Renaud Evans Kevin S. Evans Brian Holt Hawthorne Gary Moulton Kevin M. Scherer Discussed the need to notify SAF CF’s of the potential change to the regulations which will require them to provide documentation with their renewal applications consistent with non-CF’s. The board decided that we would include this information in the annual renewal letter which will be going out within the next month. The language will be: Change in the license renewal requirement for SAF Certified Foresters within the DCR “Forester Licensing Policies” We have deleted the last paragraph under Policy 2: Continuing Forestry Education which states “Successful completion of an SAF CFE or SAF Certified Forester (CF) certificate will constitute sufficient proof that the CFE requirement is met for renewal of a license”. Governor Department of Conservation & Recreation This means that if these proposed changes are approved the FLB will require SAF CF’s to comply with the same requirements of non-CF’s by providing documentation for their CFE credits to the MA FLB at the time of their renewal application. After the internal review is complete this proposed change will go through a public review process with hearings allowing outside input. Mr. Michael Leonard Appeal Hearing Appeal Hearing Opened 10:00 AM After review and discussion of the materials submitted by Mr. Leonard, the FLB determined that there was no material submitted currently by Mr. Leonard that was significantly different from the material reviewed by the FLB and investigator Keith Ross when the board made it’s finding on December 19, 2005 to recommend to the Director that the complaint by Mike Leonard against James DiMaio be dismissed. Motion was made (J. Kelly) that the FLB recommend to the Director that she deny the appeal of Mr. Leonard (second M. Kelty). Motion carried unanimously. 10:13 AM Appeal Hearing Closed. The secretary passed out two letters regarding board member K. Ross. The first was a letter from Dr. Rick Van de Poll President, Northeast Wilderness Trust (NWT) to Director Geigis stating that Keith Ross had resigned as a member of the Board of the Trust, but has been retained as a “special projects advisor” and the NWT would like to consider Keith a Trust representative for the continuance of his term with the FLB. The second letter was from Director Priscilla Geigis to Dr. Van de Poll stating that “Mr. Ross will be able to continue his volunteer service on the MA FLB representing non-profits. Discussed the idea of reciprocity with license holders in other states and MA. It was determined that this is not feasible at this point due to the differences in Licensing requirements from state to state. Chairman S. Sylvester voiced his concern about if proposed changes to Forester Licensing Regulations and Policies that the FLB had spent many hours working on were getting the attention they deserved from DCR and questioned the progress they were making toward being adopted. N. Vontzalides reported that the proposed changes were actually going through internal review and no other action on the part of the FLB was necessary at this time. Board Member Openings-The FLB discussed the need to get the word out on the two board openings and how nominations would be accepted. It was decided that the openings would be mentioned in the soon to go out renewal letters and that the secretary should encourage other outreach such as posting on the DCR website and other mailings and announcements. The announcement will state: Request for Nominations or Letters of Interest: The FLB has two members whose terms are expiring this summer. We are looking for two interested parties to serve on the board each of which would be for a three year term. The two openings are: “Landowner of classified forest land” (starting 7/1/06).
