A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF HAWAIIAN
GARDENS, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA RECOMMENDING
APPROVAL OF AMENDMENTS TO THE CITY’S ZONING CODE AND AMENDMENTS TO
THE ZONING MAP TO REFLECT THE GENERAL PLAN LAND USE MAP

        WHEREAS, the Hawaiian Gardens City Council has requested that the City’s Zoning
Code be revised to further enhance the quality of life in Hawaiian Gardens; to promote public
health, safety and the general welfare; and to stabilize and conserve property values; and

        WHEREAS, the City’s Zoning Code needs to be amended to be consistent with the
City’s recently adopted General Plan, including the need for consistency of the Zoning Map to
the Land Use Map in the General Plan; and

      WHEREAS, the City’s Zoning Code needs to be amended to be consistent with State
and Federal laws; and

        WHEREAS, the City’s Zoning Code needs to be amended to additional clarification as to
the intent of certain regulations; and

       WHEREAS, the proposed amendments to the Zoning Code include development
standards that clearly articulate the City’s desire for quality development and the promotion of
owner occupancy or pride in tenancy; and

       WHEREAS, the City desires to streamline the permit process; and

        WHEREAS, the proposed amendments to the Zoning Code would clarify and facilitate
the City’s ease of use and code enforcement process; and

       WHEREAS, the proposed amendments to the Zoning Code and Zoning Map where
considered by the Planning Commission at publically noticed study sessions on September 21,
2010, October 21, 2010 and November 18, 2010 and comments from the public were heard;
and

        WHEREAS, the proposed amendments to the Zoning Code and Zoning Map where
considered by the City Council at a publically noticed study session on January 24, 2011 and at
a publically noticed community workshop on February 23, 2011 and comments from the public
were heard; and

        WHEREAS, the proposed Zoning Code and Zoning Map amendments would not conflict
with the goals, objectives and policies of the General Plan; and

      WHEREAS, the Initial Study prepared for the proposed Zoning Code and Zoning Map
amendments indicates that the amendments do not have the potential for creating significant
adverse environmental impacts; and

       WHEREAS, on June 3, 2011 a Notice of Intent to Adopt a Negative Declaration was

distributed surrounding communities and local agencies notifying them of the City’s intent; and

        WHEREAS, on June 3, 2011, an public notice was published in the Los Cerritos News;
and on June 3, 2011, notices were mailed to tenants, occupants and all property owners in the
entire city specifying the date, time and location of the public hearing; and notices were placed
at the City Hall, Lee Ware Park, and Lakewood Mobilehome Park; and

       WHEREAS, the draft Initial Study and draft Negative Declaration were circulated for a
20-day public review period starting on June 3, 2011 and ending on June 22, 2011; and

       WHEREAS, no significant public comments were received on the Initial Study or
Negative Declaration for the proposed Zoning Code and Map amendments; and

        WHEREAS, on June 22, 2011, the Hawaiian Gardens Planning Commission held a
public hearing to receive oral and written testimony relative to the proposed Zoning Code and
Map amendments; and

       WHEREAS, the Hawaiian Gardens Planning Commission sufficiently considered all
evidence and testimony presented to them to make the following recommendation.

       NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of
Hawaiian Gardens as follows:

       Section 1. The Planning Commission of the City of Hawaiian Gardens HEREBY FINDS
AND DETERMINES that the amendments of the Zoning Code and Zoning Map will not create
potentially significant environmental impacts, and therefore will adopt a Negative Declaration
pursuant to the California Environmental Quality Act and Hawaiian Gardens Environmental
Guidelines.

        Section 2. The Planning Commission of the City of Hawaiian Gardens makes the
following findings necessary to approve Zoning Code and Zoning Map amendments:

       That the proposed amendments to the Zoning Code would make the Code consistent
       with General Plan;

       That the proposed amendments to the Zoning Map would eliminate inconsistencies
       between the Zoning Map and the General Plan Land Use Map;

       That the proposed amendments to the Zoning Code would make the Code consistent
       with current State and Federal laws;

       That the proposed amendments to the Zoning Code would make the Code consistent
       with the rest of the City’s Municipal Code;

       That the proposed amendments to the Zoning Code would streamline the permit
       process;

       That the proposed amendments to the Zoning Code would facilitate the City’s code
        enforcement process;

       That the proposed amendments to the Zoning Code would encourage quality
       development;

       That the proposed amendments to the Zoning Code would be beneficial for the long-
       term development of the City; and

       That the proposed amendments to the Zoning Code would not be detrimental to the
       public health, safety or welfare of the City or its inhabitants.

         Section 3. The Planning Commission HEREBY RECOMMENDS APPROVAL of
Resolution No. 011-012 approving amendments to the City’s Zoning Code and Zoning Map to
reflect the General Plan Land Use Map.

       Section 4. The Planning Commission Chairman of the City of Hawaiian Gardens is
hereby authorized to affix his signature to this resolution signifying its adoption by the Planning
Commission. The Planning Secretary is directed to attest thereto.


     PASSED, APPROVED, AND ADOPTED by the Hawaiian Gardens Planning
Commission on this 22nd day of June 2011.
