                           MINUTES OF PROCEEDINGS

At a meeting of the Planning Applications Sub-Committee No. 2 on Thursday 18 July
2002 at 6pm, at City Hall, Victoria Street, SW1.

1.    MEMBERSHIP

There were no changes of Membership.

RESOLVED: That Councillor Robert Davis be appointed Chairman.

2.    DECLARATIONS OF INTEREST

There were no declarations of interest.

3.    MINUTES

The Chairman, with the assent of the members present, signed the Minutes of the
meeting held on 25 April 2002.

5.    TREE PRESERVATION ORDER 495 (2002) – 20A CAVENDISH AVENUE,
      NW8

      The Council made a provisional Tree Preservation Order No. 495 to give
      protection to a False Acacia tree in the rear garden of 20A Cavendish
      Avenue, NW8. The Order was for six months from 1 February 2002. An
      objection to the Order was received stating that;

      (i)     That they were led to believe by the Council’s Tree Officers that obtaining
              consent to remove the tree in conjunction with the planning application
              would be a formality.
      (ii)    That when the planning application was submitted, it included not only the
              removal of the tree but the planting of two replacement trees, and on this
              basis the application was supported by one adjoining owner but objected to
              by the other.
      (iii)   That the Tree Officers have been unduly influenced by one vociferous
              neighbour and their client feels that he is entitled to make the best use of
              his garden especially in view of his intention to replace the tree with two
              others.


      (iv)    That the removal of much larger trees which had a greater impact on the
              streetscene has been allowed in the area.

      (v)    That the applicant is prepared to replace the tree with two semi-mature
             trees and would consider providing a Holly or something similar which could
             provide better screening of the hospital.
      (vi)   That the applicant considers that he has acted properly throughout and
             would like to be treated fairly by the Council.

      RESOLVED:

      (a)    That Tree Preservation Order 495 (2002) – 20A Cavendish Avenue,
             NW8 be confirmed with immediate permanent effect.

      (b)    That a letter be sent to the owner advising that the Council would be
             prepared to consider an appropriate future application made under the
             Order and in accordance with requirements of the Council's
             Arboriculturalists for consent to remove the tree in question, in
             conjunction with replanting of suitable replacement tree(s) in suitable
             location(s).

4.    PLANNING APPLICATIONS

The Director of Planning and Transportation submitted reports in relation to the
following applications for determination by the Sub-Committee, copies of which are
included in the Register in the custody of the Chief Executive.

      (1)    23 TREVOR SQUARE, SW7 (TP23723) Demolition of existing half
             width wing extension and erection of new rear wing extension at
             basement to second floor level; conservatory within lightwell area at
             basement and ground floor level.

             RESOLVED: That conditional planning permission and listed building
             consent be granted in accordance with the recommendation of the
             Director of Planning and Transportation, subject to an informative that
             the building must be a self-contained single dwelling.

      (2)    35 SOUTH EATON PLACE, SW1 (TP14074) Erection of timber trellis
             to existing brick wall forming boundary to site.

             RESOLVED: That conditional planning permission and listed building
             consent be granted in accordance with the recommendation of the
             Director of Planning and Transportation, subject to a condition that the
             trellis remain as a natural wood finish.

      (3)    57-59 GOODGE STREET, W1 (TP12934) Use of part ground floor and
             part basement as residential storage area and alterations to the
             shopfront.

             Additional representations were received from Charlotte Street
             Association (8/7/02), Dish Dash (8/7/02).

             RESOLVED: That conditional planning permission be granted in
             accordance with the recommendation of the Director of Planning and
             Transportation.

(4)   112 HARLEY STREET, W1 (TP6862) (1) Use of premises as a day
      surgery and ancillary consulting rooms (Class D1); (2) Alterations
      including installation of air conditioning plant at roof level and infilling of
      lightwell to provide additional floorspace.

      RESOLVED:

      (i)     That conditional planning permission be granted in accordance
              with the recommendation of the Director of Planning and
              Transportation, subject to a legal agreement (or variation to
              existing agreement) to secure the provision of replacement
              residential accommodation at No. 6 Devonshire Place.
      (ii)    That conditional planning permission be granted in accordance
              with the recommendation of the Director of Planning and
              Transportation.
      (iii)   That, if within six months date of the resolution to grant
              conditional permission the agreement has not been completed
              or there is no immediate prospect of the agreement being
              completed the application may be reported back to Committee.

(5)   72 DUKE STREET, W1 (TP23526) Continued use of basement and
      ground floors as a café and “shisha parlour” (for smoking a shisha
      pipe.

      RESOLVED: That the application be granted, subject to appropriate
      conditions to protect the surrounding residents.

(6)   527-533 HARROW ROAD, W10 (TP11990) Demolition of existing four
      storey building and erection of a four storey metal and glass single
      family dwelling and provision of a new pedestrian and vehicular access
      on Harrow Road frontage.

      Additional representations were received from British Waterways
      (3/7/02).

      RESOLVED: That the application be deferred and the applicant be
      advised that the principle of a modern building is not objected to,
      however further consideration should be given to the submitted design
      to incorporate the following:

      (i)     incorporation of additional glazing
      (ii)    the building should not be so out of context with the street scene
      (iii)   a reduction in the extent of overlooking from the roof terrace be
              considered.

(7)   2-5 WESTBOURNE TERRACE, W2 (TP9196) Modifications to
      permission dated 31 July 2001 (RN/00/09688) namely installation of a
      goods lift, raising of parapet walls and internal alterations.

      Additional representations were received from SEBRA (13/7/02).

                 RESOLVED: That conditional planning permission and listed building
                 consent be granted in accordance with the recommendation of the
                 Director of Planning and Transportation.

        (8)      ASTOR HOUSE, 26-30 CRAVEN HILL GARDENS, NW2 (TP1028)
                 Installation of nine air conditioning units within the roof void of the main
                 roof at No. 29-30 and modification to roof cut-away.

                 Additional representations were received from Councillor Susie
                 Burbridge (18/7/02), SEBRA (15/7/02) and flats within 41/40 Queen’s
                 Gardens (15/11/02).

                 RESOLVED: That planning permission be refused on the grounds of
                 impact on residential amenity.
