I.     CALL TO ORDER AND ESTABLISHMENT OF QUORUM

       The meeting was called to order at 11:19 a.m. in Conference Center Room 2 of the Indiana Government Center
       South, 402 W. Washington Street, Indianapolis, IN 46204. A quorum was established.

       Members Present:

II.    ADOPTION OF THE AGENDA

       A motion was made and seconded to adopt the agenda, as amended.

       A motion was made and seconded to adopt the minutes from the August 3, 2009 meeting.

                Re: Appeal of Denial

                Case Summary: On June 24, 2009 the Board received an application for certification as a massage
                therapist by grandfathering from Ms. Quigley. On August 4, 2009 the Board sent notification that she had
                not met the requirements therefore her application was denied. On August 20, 2009 the Board received
                an appeal of denial letter.

                A motion was made and seconded to dismiss Ms. Quigley’s petition for appeal of the denial of her
                Massage therapy certification by grandfathering due to her failure to appear.

V.   PERSONAL APPEARANCES

          A.    Anthony Bell did personally appear before the Board to answer questions regarding his positive
                response application. A motion was made and seconded to approve the application and to place
                Mr. Bell on indefinite probation and to require quarterly reports from his parole officer and
                quarterly personal or employer reports the first one being due February 1,2010.

          B.    Scott Crebb did personally appear before the Board to answer questions regarding his positive
                response application for certification as a massage therapist by grandfathering. A motion was
                made and seconded to approve the application.

          C.    Brent Darwent did personally appear before the Board to answer questions regarding his positive
                response application for certification as a massage therapist by grandfathering. A motion was
                made and seconded to approve the application.

          D.    Yili Guo did personally appear before the Board to answer questions regarding his positive
                response application for certification as a massage therapist by endorsement. A motion was
                made and seconded to approve the application and to place Mr. Guo’s certification on indefinite
                probation. He may not request to withdraw probation until after he has successfully completed
                his criminal probation in the State of California.

          E.    Cassandra Heavrin did not appear as requested by the Board to answer questions regarding her
                positive response application. The Board requested that another notice be sent for the October
                meeting and that said request be sent certified.

          F.    Xiuli Hinderliter did personally appear before the Board to answer questions regarding her
                positive response application for certification as a massage therapist by examination. A motion
                was made and seconded to issue the certification on indefinite probation and to require that she
                follow the conditions of the diversion program. She may not request withdrawal of probation until
                she has satisfied he conditions of the diversion program.

                response application for certification as a massage therapist by – motion to table until criminal
                probation is complete

                positive response application for certification as a massage therapist. A motion was made and
                seconded to approve the application.

          I.    Shawn Kelley did personally appear before the Board to answer questions regarding his positive
                response application for certification as a massage therapist. A motion was made and seconded
                to approve the application and to issue the certification on indefinite probation and to require
                quarterly reports from his criminal probation officer, the first report being due February 1, 2010.

     positive response application for certification as a massage therapist. A motion was made and
     seconded to approve the application.

     response application for certification as a massage therapist. A motion was made and seconded
     to table the application until November.

     response application fro certification as a massage therapist. A motion was made and seconded
     to issue the certification on indefinite probation. Once she has successfully satisfied the terms of
     her criminal probation she will be eligible to petition to Board to withdraw probation.

M.   Tausha Lutrell did not appear. The Board requested that the staff send another notice to appear
     for the October meeting and that said notice be sent certified.

N.   Niki Parker did personally appear before the Board to answer questions regarding her positive
     response application for certification as a massage therapist. A motion was made and seconded
     to approve the application and to issue the certification on indefinite probation and to require
     quarterly probation reports from probation officer first one due in February. She may petition to
     withdraw probation when she has satisfied the conditions of her criminal probation.

        A.      FSMTB Update

                Debra Persinger with FSMTB stated that the federation would cover the cost of one delegate from the
                State of Indiana. Tasha Coleman will attend as the voting delegate along with Barb Lis.

VIII.   ADJOURNMENT

        There being no further business, and having completed its duties, the meeting of the State Board of Massage
        Therapy adjourned at 4:50 pm.
