GUIDANCE NOTES FOR THE APPLICATION FOR A STREET WORKS
LICENCE UNDER SECTION 50 OF THE NEW ROADS AND STREET
WORKS ACT 1991 (FORM SWL1)
1. The person granted a Street Works Licence becomes an Undertaker for the
purposes of the New Roads and Street Works Act 1991 and therefore attracts the
relevant duties and responsibilities imposed by the Act and associated Secondary
Legislation and Codes of Practice.
(The attached ‘N’ notice must be completed with your start and end dates, which
must be adhered too: see page 5 of these guidance notes regarding charging
under section 74)
YOU MUST SUBMIT A 3-MONTH NOTICE FOR A MAJOR WORKS PROJECT
WITH A FOLLOW UP 10 DAY NOTICE USING FORM SWL4 PRIOR TO
COMMENCING WORK ON SITE. - PLEASE NOTE THAT THE ACTUAL START
NOTICE IS REQUIRED THE DAY YOU BEGIN YOUR WORKS.
YOU MUST SUBMIT A 1-MONTH NOTICE FOR BOTH MINOR WORKS AND
STANDARD WORKS PROJECTS WITH A FOLLOW UP 10 DAY NOTICE USING
FORM SWL4 PRIOR TO COMMENCING WORKS ON SITE.
WORKS CANNOT COMMENCE UNTIL CONFIRMATION IS RECEIVED FROM
DONCASTER MBC HIGHWAY NETWORK MANAGEMENT SECTION GIVING
APPROVAL
2. Financial penalties will be imposed by the Doncaster Metropolitan Borough Council
being the Street Authority against the licence holder for non-compliance with the
relevant statutory duties or licence conditions. Applicants should note that this
liability cannot be delegated to any other person or organisation.
3. The requirement to obtain a Street Works Licence applies to any person or
organisation (other than a Statutory Body) who wishes to place, retain and
thereafter inspect, maintain, adjust, repair, alter or renew apparatus, or
change its position or remove it from the Highway.
4. The term apparatus included drains, cables, ducts, sewer pipes, water and gas
pipes etc.
5. Form SWL2 must be completed by the applicant for authorisation to place and
retain apparatus in the highway and this must be submitted to the Street Authority
with: -
a) 10 copies of a scale plan 1:500 of the proposed location of the relevant
apparatus marked by a red broken line. The plans should also provide a
detailed cross section of the work, which indicates the depth of excavation
and the type and size of apparatus.
b) Proof of Public Liability Insurance. This must provide a minimum £5m cover
and be maintained from commencement of the works on the highway, up to
completion and acceptance by the Street Authority of the permanent
reinstatement.
c). Payment of: -
(i) £160.00 Capitalised fee in lieu of annual charge
(ii) £150.00 Inspection Fee.
d) Completed Declaration Form (Statutory Undertakers
Declaration/Requirements).
e) Method Statement, Safety Proposals/Policy Compliance with CDM
Regulations.
6. Form SWL3 must be completed by the applicant for consent to work on existing
apparatus in the highway and this must be submitted to the Street Authority with: -
a) Proof of Public Liability Insurance. This must provide a minimum £5m cover
and be maintained from commencement of the work on highway up to
completion and acceptance by the Street Authority of the permanent
reinstatement.
b) £150.00 Inspection Fee
c) Completed Declaration Form (Statutory Undertakers
Declaration/Requirements).
7. A Street Works Licence or consent to work on existing apparatus in the highway
will only be granted to the owners of apparatus or his Successors in Title. Owners
should note their statutory duty to secure that the apparatus is properly maintained
at all times.
8. In order for Doncaster Metropolitan Borough Council (Street Authority) to comply
with its statutory duty, all applications must be received three months in advance
for major works projects and one month in advance for standard /minor works.
9. The Licensee must give the Street Authority (Doncaster Metropolitan Borough
Council) the required notice as set out in the Code Of Practice For The
Coordination of Street Works And Works For Road Purposes and Related Matters.

10. Applicants should note that: -
The Street Authority may impose special conditions: -
a) To minimise the inconvenience to persons using the street, having regard to
people with a disability in particular.
b) For Traffic Sensitive Streets, Streets with Special Engineering Difficulties
and Protected Street.
11. The Licensee must permit the Street Authority to monitor his performance
throughout all stages of street works. These are signing, guarding, excavation and
reinstatement, within 6 months following interim or permanent reinstatement and
within 3 months preceding the end of the guarantee period. (This period will begin
from the date the Street Authority is notified of the permanent reinstatement using
form R1 enclosed).
12. The Licensee must inform the Street Authority of the completion of the
reinstatement by the end of the following working day, stating whether it is interim
or permanent. If an interim reinstatement is carried out this must be made
permanent within 6 months. An interim reinstatement must only be made by
agreement with the Street Authority and only in exceptional circumstances for
example difficulty in obtaining specialist-surfacing materials.
13. The Licensee must complete and submit Form SWL5 to the Street Authority within
7 days of completion of the works and clearing the site.
14. Where the apparatus in respect of which an application for a Street Works Licence
is made to the Street Authority is to be placed or retained on a line crossing the
street, and not along the line of the street, a person aggrieved by: -
a) the refusal of the Authority to grant him a license,
b) their refusal to grant a licence except on terms prohibiting its assignment or
c) any terms or conditions of the licence granted to him, may appeal to the
Secretary of State.
15. Out of hours and/or emergency telephone numbers must be provided to enable the
authority to make contact with you in the event of their being some problems or
difficulties with you’re on site works.
16. All the works carried out adjacent to or on the public highway must be protected
and carried out in accordance with Chapter 8 of the Traffic Signs Manual. You will
be responsible for seeking the agreement of all interested parties including the
Council’s Traffic Management Section and you MUST provide detailed designs of
proposed temporary traffic management.

17. Should a temporary traffic regulation order be required a minimum of 8 weeks
notice must be provided in addition to the application for a Section 50 licence. The
cost of such an order is £792.00 plus advertising costs. There is also an
additional charge for the suspension of any parking bays of £22.50 per space per
day. Please note that you will need special permission for the use of
temporary traffic control.
18. You MUST complete the APPLICATION FOR THE USE OF PORTABLE TRAFFIC
CONTROL FORM. The proposal will be considered by the Highway Network
Management section if approval is not given you will be informed of the further
actions you will have to carry out prior to undertaking the work. All aspects of the
work are liable to inspection at any reasonable time during and at the end of the
works.
NB: The applicant must strictly adhere to these conditions and the owner of the
apparatus must sign the application form.
IMPORTANT NOTES FOR THOSE APPLYING FOR
STREETWORKS LICENCE
DURING EXCAVATION/REINSTATEMENT
1. If you (the Licensee) or your contractors are unsure about any aspects of your job
(signing/guarding, reinstatement specification or makeup of the street etc.) please
contact The Highway Network Management Section to obtain further guidance.
2. The licence you receive gives permission to excavate in the highway it also makes
you subject to the requirements contained in the New Roads and Street Works Act
1991 and the Traffic Management Act 2004.
3. The Works will be subject to inspections by the Street Authority at any time. Should
the site safety or method of excavation/reinstatement be found defective under the
legislation, you shall be liable for defect inspection fees as detailed in the Codes of
Practice for NRSWA together with any further investigatory costs incurred by the
Council.
4. The completed reinstatement carries the licensee guarantee for either two or three
years. If the reinstatement is found to be defective during this time you will be fully
liable for remedial repairs and the costs involved.
5. Full information on all aspects of working in the highway under NRSWA can be found
in the NRSWA Codes of Practice (‘Blue, Yellow and Pink’ books for general issues
regarding co-ordination and noticing, reinstatement specifications and inspection
regimes, new ‘purple’ book for issues relating to section 79 (see below). The website

COMPLETION OF WORK
After completion of work, Doncaster MBC will then require, under Section 79 of the
NRSWA:
1. The attached NRSWA ‘R’ Notice completed.
2. An ‘as built’ drawing on OS map scale 1:500 or better showing precise location of all
apparatus and limits of excavations having taken place will be provided within 28
days of work completion.
3. Accuracy of recording apparatus on site should be no worse than +/- 300mm. This
accuracy must be represented on the map, together with a statement of co-ordinates
as derived from either map or GPS.
4. The Licensee must also inform Doncaster MBC of any known future alterations to
the underground apparatus, or any change of ownership, so that the record may be
suitably amended
5. The works undertaken shall be subject to inspection by Doncaster MBC under
NRSWA. Should the apparatus or reinstatement be found defective, the owner shall
be liable for defect inspection costs as detailed in the Codes of Practice for NRSWA
and any further investigatory costs incurred by the Council
OTHER ISSUES TO CONSIDER
1. It is your responsibility to sign, guard, light and maintain your work safely.
Your qualified operative is required to be on site at all times during the works,
which should be overseen by a qualified Supervisor.
2. You are required to give pedestrians and disabled people safe and clearly
indicated routes around the site at all times. You may not close footways and
require pedestrians to cross the road. Plant, equipment and vehicles must not
be left on the footway outside the signed and guarded working area.
3. Doncaster MBC may direct times of working, especially where a street is
subject to special controls.
4. Under Section 74, charges may be levied for work overruns according to the
Category of the street. Please contact us if you require advice prior to works
commencement, or 24 hours before your stated end date if you find delays
unavoidable during the works. The table below details the daily overrun
charges.

5. All apparatus should be laid wherever possible in conformity with NJUG publication 7
(obtainable from National Joint Utilities Group, 30 Millbank, London, SW1P 4RD)

SECTION 6 - CONDITIONS
1. The Street Authority for the Highway mentioned in Section Two of Form SWL2
(hereinafter called “the Highway”) hereby grant to the party named in Section One
of Form SWL2 (hereinafter called “the Licensee”) with the intent that the same shall
benefit and run with the property described in Section Two of Form SWL2 hereto
Licence under Section 50 of the New Roads and Street Works Act 1991 to place
and leave in the Highway in the position shown by a red broken line on the plan
attached hereto the apparatus (hereinafter referred to as “the Apparatus”) short
particulars of which are set out in the Section Two of Form SWL2 hereto and to
maintain repair and reinstate the Apparatus and break open and have access to
the Highway for those purposes upon the terms and subject to the conditions
hereinafter specified and subject also to the relevant conditions and provisions
contained in Schedule 3 of the said Act and the Licensee hereby accepts the
Licence upon and subject to the said terms conditions and provisions.
2. This licence is granted to the owner of the apparatus and his Successors in title
and where he proposes to part with his interest in the apparatus; he shall before
doing so give 6 weeks notice to the Street Authority stating to whom the benefit of
the licence is to be transferred.
3. The Licensee shall: -
a) Conduct all the relevant works in accordance with the requirements of the
New Roads and Street Works Act 1991, and its associated Secondary
Legislation and Codes of Practice.
b) Indemnify the Street Authority against any claim in respect of injury, damage
or loss arising out of: -
a) the placing or presence in the street of apparatus to which the licence
relates, or
b) the execution by any person of any works authorised by the licence;
c) Provide the authority with a copy of the written consent from the
owning authority for which the service connection will be made.
and the former Licensee shall indemnify the Street Authority against any claim in
respect of injury, damage or loss arising out of the execution by the Authority or the
licensee of any works under Paragraph 7 or Schedule 3 or the said Act.
4. The Licensee shall pay the Street Authority in connection with the grant of the
licence: -
a) The sum of £160.00 which the Street Authority will accept as a capitalised
payment in lieu of the annual fee for administering the licence recoverable
under Schedule 3 Section 2b of the New Roads and Street Works Act 1991.
b) The sum of £150.00 for the chargeable inspection fees, per unit of
inspection.

c) Works in excess of 200 metres length will be subject to additional
Inspection Fees.
5. The licence hereby granted shall remain in force until withdrawn by the Street
Authority under Schedule 3 of the New Roads and Street Works Act 1991 or
surrendered to the Street Authority by the Licensee.
6. The Street Authority may determine this licence at any time: -
a) on the expiration of such period as may be specified in the Notice being a
period of not less than seven working days beginning with the date of
service of the Notice on the Licensee if any condition of this licence is
contravened by the Licensee or if the Street Authority becomes aware of the
fact that the Licensee intends to cease using or has abandoned the
apparatus or intends to do so, or
b) the Licensee has parted with or intends to part with his interest in the
apparatus in a case where assignment of the licence is prohibited, or
c) the Street Authority considers the withdrawal of the licence is necessary for
the purpose of the exercise of their function as Street Authority.
NB Under sub paragraph (c) not less than 3 months notice will be given by
the Street Authority.
7. Where a licence expires or is withdrawn or surrendered the Street Authority: -
a) may remove the apparatus to which the licence relates or alter it in such
manner as they think fit and reinstate, the street and may recover from the
former Licensee the expenses incurred by them in doing so
b) if satisfied that the former Licensee can, within such reasonable time as they
may specify, remove the apparatus or alter it in such a manner as they may
require and reinstate the street, they may authorise him to do so at his own
expense. A further licence will be required for such works.
8. Any licence issued under this procedure by the Street Authority must not be
construed as conferring any right for the applicant to make any connection to a
sewer, drain, pipe, cable or other apparatus.
9. The Licence does not confer any right on the Licensee, as against the owners of
land, which the highway is situated, to use the land. The Licensee must make his
own arrangements with such owners in cases where their consent is needed.
10. In this Licence the terms: -
“Licensee” shall include the Successor in Title - Personal Representative -
Receiver - Liquidator or Trustee of the Licensee.
“Highway” shall include and apply to each and every Highway, when more than one
Highway is specified in the Section 2 of Form SWL1 hereto.

To comply with Section 69 of the Act where street works are likely to affect another person’s
apparatus in the street, applicants must take all reasonably practicable steps: -
a) to give the person to whom the apparatus belongs reasonable facilities for monitoring the
execution of the works, and
b) to comply with any requirement made by him, which is reasonably necessary for the
protection of the apparatus or for securing access to it.
All Statutory Undertakers must therefore be contacted before the commencement of any work.
Space is provided below for them to indicate their requirements (if any) and these conditions,
complete with the endorsements, should be presented with your application form.

SECTION 5 Declaration by owner of apparatus:
I confirm that the foregoing details are correct and acknowledge that the works referred to above must
be conducted in accordance with the requirements of the New Road and Street Works Act 1991 and
associated legislation and codes of practice, together with any other conditions imposed by the Street

It is a requirement of the N.R.A.S.W.A. 1991 Section 67. (1) that the execution of the works is
supervised by a person having a prescribed qualification as a supervisor and there is on site at all
times when such works are in progress at least one person having a prescribed qualification as a
trained operative.

soon as practicable after the implementation date.
The Authority must be notified if:
a) Any change is made to the date or time on the application.
b) The work is in the vicinity of any permanent traffic signals including
Pelican crossings.
c) The work is in the vicinity of a level crossing (Railtrack must also be consulted)
d) A ‘Relaxation’ is sought for signing of a lane closure under Chapter 8, (i.e.
merge to the right without a guide island). Please refer to Paragraph D1.6.1 -
D16.6, and also Paragraph D6.7.2 within the design section of Chapter 8 for
further advice.
1:1250 scale plan showing the proposed traffic management layout must accompany the
request. To include carriageway widths available for traffic / details of safety zones to
be provided / length of lead in taper / size and type of signs to be used.
4. Upon receipt of the completed application form, DMBC will contact the applicant only if
approval is refused.
Failure to comply with the above requirements may affect this
and future applications.

before the proposed start date of the road closure. No application will be granted without
an official order number.

A charge of £792 is made for a Road Closure/ other legal restriction, to cover administrative
and legal costs. The client will also be liable for the total cost of any advertisements required
by law to publicise the closure.
I confirm that I have already consulted with local residents, businesses, schools, Statutory
Undertakers and Bus Operators where necessary. (Please forward any correspondence)
I agree that my nominated contractor or I will be responsible for: -
The provision and installation of advanced notification signage as agreed by Council, 1
(i) week (or by agreement) prior to the start date of the road closure / other restriction,
stating commencement date, duration of the road closure/ restriction, the contractor for
the works and a 24hour contact telephone number.
(ii) The provision, installation and maintenance of any temporary signage for businesses
etc and agreed with the Highway Authority prior to installation. Pedestrian access during
any closure/ restriction period will be maintained.
(iii) Submission for approval of a Road Diversion plan 4 weeks prior to the commencement
date of the road closure, indicating the nature and position of all diversionary signs,
traffic cones and barriers associated with the closure and the route.
(iv) The provision, installation and maintenance of road signs, traffic cones and barriers as
specified in the approved plan, including road signs at each end of the road closure /
restriction stating the contractor for the works, and a 24 hour contact telephone number.
(v) Consultation with the Statutory Undertakers, affected businesses and residents during
the road closure period, where necessary.
(vi) Re-opening the road with immediate effect should work be completed ahead of
schedule, notifying DMBC as soon as the road has re-opened and removing all
temporary road signs, traffic cones and barriers.
(vii) A 1:1250 scale MUST be supplied with the application showing TM Layout to be
installed.
N.B.
1. Signs, cones and barriers must comply with the ‘Traffic Signs Regulations and
General Directions 2002 and be maintained for the duration of the road closure.
2. Without an Official Order Number/ Expenditure Code or Invoice no Road Closure /
other legal restriction will be processed. As such any unauthorised closure will
constitute an unlawful obstruction of the highway which could result in Police
intervention.

NOTES:-
1. Site approval for portable traffic signals is required under the Traffic Signs
Regulations and General Directions 2002
Note: traffic signals which are being used at works within the highway and which are not
authorised will result in the suspension of the works.
2. Portable traffic lights will be used under full manual control at times specified by the
Authority.
3. All schemes involving the use of portable traffic signals will have on site, a set of stop
and go boards to be used in the event of signal failure.
4. Upon receipt of the completed application form, DMBC will contact the applicant only
if approval is refused.
5. It is imperative that the minimum advance notice outlined above is given where design
of portable traffic signals at junctions is required e.g. where there is a junction
between a set of shuttle working traffic signals or if more than two approaches need
traffic signal control.
6. Emergency works will still require this form to be completed either immediately before,
or as soon as practicable after the implementation date.
7. The Authority must be notified if:
a) Any change is made to the date or time on the application.
b) The work is in the vicinity of any permanent traffic signals including

Pelican crossings.
c) The work is in the vicinity of a level crossing (Railtrack must also be consulted)
8. It is important that the Emergency Contact Number is one that is permanently
monitored. In the event of equipment failure if the ECN does not respond DMBC will
carry out remedial action to make the site safe and the costs will be re-charged to the
contractor carrying out the work.
All parts of the application highlighted with an asterix * are
mandatory fields and must be completed. Failure to comply
with the above requirements may affect this and future
applications.
