BUSINESS CONSIDERATIONS: Why would a business prefer to submit claims to arbitration
rather than submitting the case to the court for review? Should a business have a policy of
arbitrating every controversy? Why?

ETHICAL CONSIDERATIONS:               Is it ethical for a state government to attempt to “repeal”
federal statutes through the enactment of state statutes that specifically negate the applicability of
a federal law? Would it be ethical for a business to attempt to “repeal” a state statute by using
