CONDITIONS OF THE CONTRACT AGREEMENT
1. All puppies are sold on a 72 hour trial basis. In this time the purchaser agrees to have the puppy
examined by a veterinarian. If the puppy is deemed unhealthy, it can be returned at the purchaser’s
expense for a full refund or replacement. This provision is only valid if the dog is in the same
condition as when the dog left the Seller.
2. This agreement specifically excludes any guarantee against internal parasites although every effort
has been made to assure their removal.
3. Seller is in no way responsible for any acquired diseases.
4. Purchaser agrees to follow recommended feeding and proper diet, keep the dog at a sensible weight
for dog’s size and age, regular exercise, and proper care INCLUDING: grooming, annual vaccinations,
heartworm preventative, and confining dog in fenced yard/area where fence is at least standard
height of 6 foot. A FAT or OVERWEIGHT Newfoundland is more susceptible to injury due to stress
on their joints.
5. Purchaser is responsible for ANY transportation costs. If the dog is returned to the Seller the
Purchaser is responsible for ALL costs including all transportation costs to the Seller. Seller is not
responsible for ANY costs to return the dog. We will not ship our puppies but we will meet you half
way providing purchaser pays for fuel costs. If a puppy must be flown the Purchaser must come to
pick up the puppy and fly back with him/her. If the puppy is being flown back to the Seller, the
Purchaser is responsible for ALL COSTS.
6. Purchaser agrees that if the puppy is to be kept outdoors at any time, purchaser will provide a fenced
area with a shelter (must meet or exceed state humane society regulations) for protection from the
severe cold and sun. All guarantees are null and void if the puppy/dog is kept chained.
Fenced area for exercise is REQUIRED. The use of a tie out or chaining the dog is NOT an approved
method of confining a Newfoundland. By signing this agreement and initialing this section the
Purchaser agrees this will NOT be a means of confinement. ___________________ Purchaser

7. Purchaser agrees to contact the seller immediately in the event purchaser can no longer keep the
dog. The dog MUST be returned to the SELLER without refund of purchase price. The SELLER will
evaluate the dog, have the dog vetted, and determine the future placement of the dog, if any. The
expenses of returning the dog to SELLER are the responsibility of the PURCHASER. A $5000
PENALTY WILL BE PAID TO THE SELLER BY THE PURCHASER IF PURCHASER FAILS TO
RETURN THE DOG TO THE SELLER. By initialing below you understand the above

8. Purchaser agrees that this dog or ANY offspring the dog may produce will NOT be given, sold to,
leased or consigned to any pet shop, chain store, catalog sales house, commercial or retail animal
establishment, any broker of animals, animal shelter or humane society. Only dogs sold under a full
registration may be bred. All companion, pet and performance only dogs are sold under a
non-breeding limited registration.
9. All PET Newfoundlands are sold on a limited registration. It is mandatory that you spay/neuter
your pet between 18 and 24 months of age but not before 18 months. If the spay/neuter
agreement is NOT complied with the seller will automatically regain possession of this dog. There
will be an automatic fee for expenses incurred in regaining the dog charged to the purchaser of this
dog of $1000.00 payable to the seller/breeder.
If this dog is sold on a FULL registration, as a show/breeding prospect, the dog is allowed to remain
unaltered after 2 years of age. If you believe you have a dog that may be show/breeding quality
and you would like it evaluated before having the dog altered contact the Seller for evaluation. The
SELLER has the ONLY and FINAL say in whether the dog remains unaltered. By signing
this Purchase Agreement you agree that the decision of the SELLER at this point is the
direction you will take. The decision of the SELLER will be given in writing. Proof of
spay/neuter must be provided to SELLER.
If this dog is sold on a FULL registration, before this dog is bred you agree to have this puppy’s hips
and elbows x-rayed at 2 years of age and his heart recertified after one year of age for OFA
evaluation. We also recommend thyroid, patella, cystinuria and CERF clearances.
If this dog is sold on a FULL registration, before this dog is bred you will get approval in writing for
ALL litters from Dawn Blaine.

10. Grading of the litter for future potential must be considered an educated guess at best. Therefore
we CANNOT guarantee that puppies selected for show or breeding will mature to these
11. The sellers kennel name is to be used when naming the dog on the AKC registration form. The
kennel name is BELLE HARBOUR and will prefix the name. In order to insure that all Belle Harbour
puppies are AKC registered, seller will submit registration papers to AKC on the behalf of the buyer
and AKC certificate will be mailed directly to the buyer. The buyer has 30 days to provide seller with their
choice of a registered name for the dog. That name must have the Belle Harbour prefix. If buyer has not
provided a name for the dog to the seller by that time, seller will register the dog with their choice of
name. Dog may only be registered in AKC registry and with the name originally designated at time of
purchase. No name changes will be permitted on registration documents.
12. Failure to comply with any of the agreements in this contract during the duration of ownership
guarantees it null and void AND will result in seller having the option to take back the dog at sellers
13. Seller is NOT responsible for any veterinarian expenses incurred on this dog.
GUARANTEES OF THE PURCHASE OF THIS PUPPY/DOG
1. Seller will guarantee against crippling hip dysplasia up to two years of age. This is defined as
the inability to function as a pet. This diagnosis must be agreed upon by the purchasers
licensed veterinarian and the sellers veterinarian. The seller may request the opinion of an
orthopedic specialist. Radiographs must confirm the diagnosis. If surgical correction or
euthanasia is recommended, the seller will replace the dog with a puppy of equal quality as soon
as one becomes available. If the original dog is kept it must be spayed/neutered before any
replacement is made. This guarantee becomes null and void if the dog has been used
for breeding, is overweight or if the problem is the result of injury.
2. The seller guarantees the puppy free of crippling hereditary heart defects up to 24 months of
age. Diagnosis must be confirmed by a board certified veterinary cardiologist. In
such case a replacement will be made as soon as one becomes available. If the dog is
kept it MUST be spayed/neutered before any replacement is made. This guarantee is null and
void if the dog has been used for breeding.
3. Purchaser agrees to contact the seller before implementing any treatment to said dog for any
suspected diseases that may be covered by this agreement. Failure to contact the seller will
void the guarantees.
4. Seller is in no way responsible for any acquired diseases.
5. In any situation where a puppy meets the requirements for the guarantee it is the SELLERS
choice to either refund the purchase price of the puppy OR replace the puppy when one of the
same becomes available (pet / show depending on what you purchased). IN ALL CASES THE
DEPOSIT IS NOT REFUNDABLE.
We the purchaser(s) and the seller agree to all that has been previously stated in this contract agreement
