Smuggling)
Project name: PAKU83 – UNODC Country Programme for Pakistan 2010-2014; Sub-Programme 1:
Illicit Trafficking and Boarder Management; Outcome 2: Human trafficking and migrant smuggling
operations identified and acted upon

Period of assignment/services (if applicable): 1st October 2012 to 31st Jan, 2013. (10 Days per month)

explanation of the query without identifying the source of inquiry, to all consultants.



1. BACKGROUND

The United Nations Office on Drugs and Crime (UNODC) Country Office for Pakistan (COPAK) is tasked
with assisting Pakistan through its Country Programme (CP) 2010-14 with a focus on needs related to
illicit trafficking and border management, criminal justice and drug demand reduction and HIV/AIDS.

COPAK requires the services of International Legal Consultant (Human Trafficking and Migrant
Smuggling), to develop a comparative study of current Pakistan's law, and to develop separate draft
laws relating to trafficking in persons and smuggling of migrants based on the UN Protocol and UNODC
Model Laws and feedback and guidance received by the Government of Pakistan on the comparative
study, under Outcome 2 “Human trafficking and migrant smuggling operations identified and acted
upon”. The consultant will be reporting to the UNODC senior Law Enforcement Advisor who manages
UNODC Country Programme Sub-Programme 1 to deliver outputs that advance the related work plans
according to the schedule agreed with the Government of Pakistan under the overall supervision of the
Country Representative.
2. MAIN OBJECTIVES, RESPONSIBILITIES AND DESCRIPTION OF THE PROPOSED ANALYTICAL WORK.

The purpose of the assignment is to develop a comparative study of current Pakistan's law, and to
develop separate draft laws relating to trafficking in persons and smuggling of migrants based on the UN
Protocol

       Develop a comparative study of current Pakistan's law relating to trafficking in persons and
        smuggling of migrant smuggling, requirements of the UN Protocol to Prevent, Suppress, and
        Punish Trafficking in Persons, the Protocol against the Smuggling of Migrants, and the UNODC
        Model Laws relating to trafficking in persons and migrant smuggling.
        Completed October, 2012

       Develop separate draft laws relating to trafficking in persons and smuggling of migrants based
        on the UN Protocol and UNODC Model Laws and feedback and guidance received by the
        Government of Pakistan on the comparative study (1).
        Completed November, 2012

       Develop final drafts of the laws, incorporating feedback on first drafts, by mid January, 2013.


3. REQUIREMENTS FOR EXPERIENCE AND QUALIFICATIONS

I. Academic Qualifications:

       University degree (Master’s degree or equivalent) in Law, International Relations, Law or other
        relevant degree.


II. Years of experience:

     10 years of relevant experience, as an academic / practitioner of Law including in an
      international setting in areas related to human trafficking and migrant smuggling.



III. Competencies:

       Capacity to review documents and conduct interviews as part of background research.
       Demonstrated administrative, planning, organisational and advisory skills.

       Ability to draft legislation.

       Excellent verbal and written communication skills in English.

       Ability to work under pressure and to tight deadlines.

       Possess strong negotiation skills.


4. DOCUMENTS TO BE INCLUDED WHEN SUBMITTING THE PROPOSALS.
Interested individual consultants must submit the following documents/information to demonstrate
their qualifications:

1. Proposal:

(i) Explaining why they are the most suitable for the position

(ii) Provide a brief methodology on how they will approach and conduct the work (if applicable)



2. Financial proposal

3. Personal CV including past experience in similar projects and at least 3 references

4. P-11 Form duly completed.


5. FINANCIAL PROPOSAL


         Lump sum contracts

The financial proposal shall specify a total lump sum amount, and payment terms around specific and
measurable (qualitative and quantitative) deliverables (i.e. whether payments fall in installments or
upon completion of the entire contract). Payments are based upon output, i.e. upon delivery of the
services specified in the TOR. In order to assist the requesting unit in the comparison of financial
proposals, the financial proposal will include a breakdown of this lump sum amount (including travel,
per diems, and number of anticipated working days).



Travel;

All envisaged travel costs must be included in the financial proposal. This includes all travel to join duty
station/repatriation travel. In general, UNDP should not accept travel costs exceeding those of an
economy class ticket. Should the IC wish to travel on a higher class he/she should do so using their own
resources. In the case of unforeseeable travel, payment of travel costs including tickets, lodging and
terminal expenses should be agreed upon, between the respective business unit and Individual
Consultant, prior to travel and will be reimbursed.


EVALUATION

Individual consultants will be evaluated based on the following methodologies:

1. Cumulative analysis
When using this weighted scoring method, the award of the contract should be made to the individual
consultant whose offer has been evaluated and determined as:

a) responsive/compliant/acceptable, and

b) Having received the highest score out of a pre-determined set of weighted technical and financial
criteria specific to the solicitation.
