Introduction

This Annual Plan for the Environmental Health Service of Fermanagh District
Council outlines the level of activity and associated resources which it is intended
to deploy in pursuit of our primary objective, viz.namely, “to protect public health            Formatted: Font color: Auto

by a proactive advisory and educational service to the public and business sector
of County Fermanagh..

In compiling the plan, due cognizance has been taken of Codes of Practice,
Guidance and advice from the external agencies, namely, viz. Food Standards                     Formatted: Font color: Auto
Agency, Health and Safety Executive Northern Ireland, Department of Health,
Social Services and Public Safety, and most importantly the Corporate Strategy
of Fermanagh District Council, and the identified needs and wishes of the people
of County Fermanagh.

continue to take a holistic approach to problem-solving and will work with key
partners to improve the health and well-being of, not only the inhabitants of, but
also those who visit, work and stay in County Fermanagh. With regard to our
statutory enforcement duties “we are committed to consistent proportionate
enforcement recognising that prevention is better than cure and that our roles as
enforcers is one which involves actively working with business to advise and
assist with compliance”.

The plan seeks to explain how we will maximise the available resources at our
disposal to achieve our objectives and enable us to account for our actions to
customers, Councillors and other Statutory Agencies.

The plan is set out by core function and has regard to requirements and
guidance issued by external agencies with our staffing structure as set out in the
Appendix. It should however be noted that Environmental Health work can be
reactive in nature, and staff do, on occasions, have to operate across core
function boundaries to respond to urgent matters.

  The overlying aim of the Environmental Health Service of Fermanagh District
  Council and, therefore, of the food service is to protect public health, to make a
  major contribution to the creation of a clean, safe and healthy environment and to
  act locally to enhance the global environment.

2. Background

  2.1 Profile of Fermanagh District Council

  Fermanagh District Council is unique as a local government authority in Northern
  Ireland as it covers the County of Fermanagh as well as the district which creates
  a strong sense of place and makes it the largest local government district
  covering one-eighth of the province’s land mass. This also encourages and
  enables a strategic approach to the planning and delivery of its services, in

particular, enhancing co-operation with other Government agencies and statutory
authorities. The Council’s key strength, however, is the central role it plays for
and within its community. It is situated in the south-west of the province with a
catchment population of approximately 250,000 which includes Tyrone and the
border Counties of Sligo, Leitrim, Monaghan, Cavan and Donegal. It has a

2.3 Scope of the Food Service

The service is responsible for securing compliance with all food safety and
food standards legislation that is implemented by the District Council and
takes due regard to the Food Law Code of Practice and Practice Guidance
issued by the Food Standards Agency.

It aims to ensure that food is fit for human consumption, free from
extraneous matter and attempts to secure the protection of consumers

The Food Service strives to increase the knowledge of food handlers and
the general public about the principles and practice of food safety and to
improve community health through diet and nutrition. . It also acts to
prevent the spread of notifiable communicable disease.

initiatives throughout the year and there is a joint approach to inspections
in premises that are deemed to be low risk for health and safety..

Service. The Principal Officer (Food Control) for this Group is responsible
for ensuring uniformity of enforcement of food legislation throughout the
five constituent Councils within the Western Group and also throughout
Northern Ireland using the mechanics of the Northern Ireland Food Liaison
Group.

The extensive land border with the Republic of Ireland requires Officers to be              Formatted: Justified
extra vigilant regarding fresh meat, meat products and meat preparations
coming from unapproved sources.

The large number of visitors the County attracts, particularly during the                   Formatted: Justified
summer months, accounts for the high percentage of hotels and catering

food premises in the area.

The Council offices are based in the Townhall in the centre of Enniskillen.                 Formatted: Justified
Officers can be contacted during the day in person or by telephone either
through the general switchboard or by a direct dial telephone. Normal hours
of working are a 7½ hour day between 8.00 am and 6.00 pm, Monday to
Friday. When necessary Officers work outside these hours, e.g. to carry out
routine inspections of food premises not open during the normal working day
and to respond to emergency communicable disease incidents. The Council

   operates a 24 hour message service where members of the public/trade can
   log enquiries.

   The Director of Environmental Health’s home telephone number is listed as
   an out-of-hours contact number. An emergency on-call telephone number is
   available on a ‘need to know’ basis with a rota of suitably qualified Officers
   drawn up by the Western Group Environmental Health Service for out-of-
   hours cover for communicable disease outbreaks, E.Coli O0157 cases and
   hazard warning notifications. This ensures 24-hour cover for the above
   situations.

   2.5 Enforcement Policy

   Fermanagh District Council has adopted the enforcement concordat drawn up
   by the Cabinet Office, which sets out what business and others being
   regulated can expect from enforcement officers. The concordat commits
   Fermanagh District Council to good enforcement policies and procedures and
   is supplemented by separate documented enforcement policies for the food
   service covering food safety and food standards which are available on the
   Council’s website and from the Council offices. As required by the Code of
   Practice the Code for prosecutors issued by the Public Prosecution Service
   will also be taken into account.

   3.1 Food and Feeding stuffs – Premises Inspections

   Fermanagh District Council aims to comply with the minimum frequencies of
   interventions as laid down in the Food Safety (Northern Ireland) Order Draft
   Code of Practice with priority given to inspecting the higher risk premises.
   The draft Code of Practice advises that premises should be inspected no later
   than 28 days after the due date.

   The Code has recently been updated to comply with the proposed Regulatory                   Formatted: Justified
   Reform Act’s aim of reducing the regulatory burden on businesses. The main
   change is that Category C and D premises need not necessarily receive a full
   inspection each time they are due, rather, Officers should select from a suite
   of ‘interventions’ the most appropriate intervention for the business which will
   improve levels of compliance. Interventions include audit, inspection,
   surveillance and verification.

   Food premises are subject to interventions at intervals determined on their
   risk rating in accordance with the inspection rating system within the Food

according to the type of food sold, the nature of the trading and the overall
food safety standards of the business. The frequency of interventions is
dependent on the riskating score obtained for each premises.                                Formatted: Font color: Auto

The Department continues to implement the Food Hygiene Rating Scheme                        Formatted: Font color: Auto
(FHRS). Businesses that fall within the scope of the scheme are given a
rating indicating their standard of food hygiene at the time of their routine
intervention. Each premises receives a certificate and window sticker which
they are encouraged to display. Although the display of certificates is not
mandatory the ratings of all premises are available on the Food Standards
Agency’s website which can also be accessed through Fermanagh District
Council’s website.

All premises that are included in the Food Hygiene Rating Scheme are                        Formatted: Font color: Auto
subject to inspection to enable them to achieve a hygiene rating. Premises                  Formatted: Font color: Auto
can request a re-scoring visit after necessary works are completed.

Priority will be given to ensuring consistency of inspections so that businesses
can have confidence in the Scheme.

In addition, hotels will be subject to an intervention at least every 12 months.

Interventions are also triggered by other events such as complaints, food
alerts or observed change of use.

There has been a significant change to the way that the Council’s
performance will be measured by tThe Food Standards Agency measures
Council’s performance by . Historically the relevant Performance Indicator
measured the percentage of due inspections carried out during the fiscal year.
The new approach measures the percentage of premises in the district which
are ‘broadly compliant’ i.e. a score of not more than 10 in each of the scoring
no more than 10 points in the aspects of the risk rating relating to hygiene,

Under the “Building Compliance with Food Hygiene requirements in Northern                   Formatted: Font color: Auto
Ireland” strategy all non-broadly compliant premises will remain highest
priority and be inspected within 28 days of their programmed date.

Having cognizance of this Strategy and the Food Law Code of Practice                        Formatted: Justified
revisits to premises will be carried out when food businesses fail to comply
with significant statutory requirements and consideration, where appropriate,
given to the service of Hygiene Improvement Notices and Remedial Action
Notices.

In accordance with earlier changes in the Code of Practice an inspection                    Formatted: Font color: Red
regime for low risk food premises for both food hygiene and food standards
will be introduced.

Alternative Enforcement Strategies

These are premises which would have been inspected every 3-5 years and
typically include businesses such as newsagents, chemists, off licences, etc.
that sell shelf stable low risk foods, together with low risk catering operations
such as church and community halls.

These premises will now be sent questionnaires every three years and only
inspected if the questionnaires are either not returned or show significant
changes in the business.

Inspections are also triggered by other events such as complaints, food alerts
or observed change of use.

The Department may, however, continue to inspect some premises in the low
risk category when this is the preferred surveillance option – such as Bed &

3.2 Food and Feeding stuffs – Complaints

Fermanagh District Council investigates all food complaints both in relation to
contaminated food and composition and labelling having regard to the Lacors

Guidance on Food Complaints, second edition, published in November 1998,
and to guidance issued by the Northern Ireland Food Liaison Group and
within the framework of the Council’s enforcement policies. Complaints
relating to poor standards of premises are also investigated. It is anticipated

3.3 Home Authority Principle

Fermanagh District Council has adopted the Home Authority Principle as
espoused by the Local Authority Co-ordinators of Regulatory Services
(Lacors). This seeks to prevent duplication of enforcement effort and
contraventions of food law by offering advice to companies through a
single local authority.Fermanagh District Council will have regard to the
Primary Authority Scheme when enforcement actions are being
considered and may offer non-statutory Primary Authority type
partnership agreements for businesses for regulatory functions in our
remit. This scheme to some extent replaces the Home Authority principle
which seeks to prevent duplication of enforcement effort and
contraventions of food law by offering advice to companies through a
single local authority.

3.4 Advice to Businesses

Fermanagh District Council is proactive in encouraging businesses to seek
advice at the design and planning stage as well as when the business is fully
operational. The Food Section comments on approximately 50 750 Planning
Applications and Building Control Plans each year which have a direct food
implication. Fermanagh District Council is in partnership with the Fermanagh

Fermanagh District Council is committed to monitoring food quality and safety
by carrying out food sampling programmes as laid down in the Microbiological
and Chemical Food Sampling Policy and with regard to the Code of Practice
and the guidance issued by the Northern Ireland Food Liaison Group. The
level of microbiological sampling carried out is 210 2150 food samples and 98
938 potable water samples per annum. This is based on the 8the 8 per
1,000 population guidance recommended by the Northern Ireland Food
Liaison Group; however, restrictions continue to be imposed by the Northern
Ireland Public Health Laboratory which has led to a reduction in sample

provided by the Food Standards Agency, provide nutrition talks to various
groups and promote nutrition messages at the County Agricultural Show. At
the Show there will also be an exhibition on the Food Hygiene Rating
Scheme, a Food Safety Quiz and a hand-washing demonstration.

The theme for Food Safety Week is “Food Safety on a Budget”. This event
which promotes the importance of food hygiene in the home, will focus on
how people can ensure that they keep their food safe when trying to save
money. Working in partnership with Fermanagh District Council,
safefood, the FSA and the Department of the Environment’s ‘Love Food Hate                  Formatted: Font: Not Bold
Waste’ initiative will be running a cookery demonstration to coincide with Food
Safety Week to show consumers how to get the best from their leftovers while
also keeping up good food hygiene habits at home. Free recipe cards will be
available at the cookery demonstration.

Safety Certificates remain in place for two designated sports grounds in
Fermanagh, Brewster Park, Enniskillen and St. Molaise Park, Irvinestown.
Inspections will be carried out to ensure the terms and conditions of the Safety
Certificate are being complied with. A Safety Advisory Group (SAG) meeting will
be organised so emergency services and other interested bodies can provide
advice to the Council on the safe capacity of the sports grounds and any other
matters relating to the safety of spectators.

identify grounds in County Fermanagh that will be designated as Sports Grounds
requiring a Certificate as per Article 4(1) of the Safety of Sports Gounds

information on the effects of over-exposure to UV radiation, identification of skin
types and risk groups, maintenance of equipment and legal matters.

Regular monitoring is carried out in swimming pools and spa pools as part of a
monitoring programme. It is proposed to issue advice to employees relating to
exposure to loud music in entertainment premises and to continue to encourage
the owners to carry out noise at work risk assessments to limit exposure of
employees to noise in excess of the action levels. With regard to skin cancer
advice will be issued to salons which operate sunbeds advising of the new
guidance in relation to their use, particularly by under 18’s. Awareness will be
raised among members of the public about their skin type and the premature
aging of over exposure to UV radiation.

          remediation.

7.        Clean Neighbourhoods

          The Clean Neighbourhoods and Environment Act (Northern Ireland) 2011
          contains a range of legislative measures to improve the quality of the local
          environment by giving District Councils additional powers to deal with issues
          such as litter, fly-posting and graffiti, dogs, noise, statutory nuisance,
          nuisance alleyways, abandoned and nuisance vehicles and abandoned
          shopping trolleys. The issues which fall under the remit of Environmental

8.      High Hedges

        The High Hedges Act (Northern Ireland) 2011 coming into force in April 2012
        provides a means of dealing with certain high hedges that are having an
        adverse impact on the reasonable enjoyment of a neighbouring domestic
        property due to loss of light. Potential complainants, however, are required to
        attempt to resolve the problem with their neighbour before they can ask the
        Council to investigate a high hedge complaint. In addition, there is a fee to be
        paid to the Council for the service provided.

9.      Private Tenancies

        The Private Tenancies (NI) Order 2006 provides District Councils with the
        power to assess the fitness levels of all pre-1945 private rented properties. It
        also allows Councils to investigate all complaints of alleged harassment and
        illegal eviction.

The Environmental Protection and Public Health Service has the following key

Background to main Environmental Protection Functions


1. Industrial Pollution Control

   Under the Industrial Pollution Control (Northern Ireland) Order 1997 the
   Council has been required to authorise certain Industrial Processes which
   were prescribed for control of emissions to air.

   Under the more recent Pollution Prevention and Control Regulations
   (Northern Ireland) 2003, (the new Integrated Pollution Prevention and Control
   regime), the Council is required to issue permits to operators of these
   installations.

   Surveys are undertaken in order to establish which premises/installations
   require permits. Once a permit has been issued, ongoing inspections are
   carried out to ensure compliance with conditions and to secure any necessary
   improvements. It is anticipated that the discharge of Industrial Pollution
   Control duties will involve approximately 50 days this year.

2. Complaints

   Under the Pollution Control and Local Government (Northern Ireland) Order
   1978 the Council has a duty to investigate and deal with complaints of noise
   nuisance. Many of these complaints involve on-going monitoring and some
   complaints can involve complex investigations and liaison with consultants
   and other agencies.

3. Local Air Quality Management

   The Environment (Northern Ireland) Order 2002 provides the framework for
   the system of Local Air Quality Management (LAQM) in Northern Ireland. This

  is an integral part of delivering the air quality objectives Quality Strategy for
  England, Scotland, Wales and Northern Ireland, published in 2000. The
  Order places a legal duty on Local Authorities in Northern Ireland to carry out
  air quality reviews to assess whether the Government’s Air Quality objectives
  for certain pollutants are likely to be achieved by 2010.

   A Review and Assessment of air quality is the first step in the LAQM process.
   New Air Quality regulations prescribe air quality objectives for Northern
   Ireland and the dates for meeting them. For each objective the Council has
   to consider present and likely future air quality and assess whether the
   objectives are likely to be achieved in time.

   In line with guidance issued by the former Department of Environment,
   Transport and the Regions, that reviews and assessments followed a three
   stage phased approach, all District Councils were required to undertake the
   first stage and to proceed to subsequent stages if necessary.

  The Council has completed the first three stages of its Review and
  Assessment process. The third stage involved an accurate detailed review of
  pollutants using computer-modelling and monitoring techniques to predict the
  likelihood of exceeding the air quality objectives and the subsequent report
  indicated that the relevant air quality objectives would be achieved.

  In order to ensure the continuity of the Local Air Quality Management
  process, the Council has also undertaken, as required, an ‘Updating and
  Screening Assessment’ of air quality. The objective of this round of
  assessment was to consider any matters that had changed since the first
  three-stage round and which could lead to a risk of an air quality objective
  being exceeded e.g. the consideration of new objectives, new monitoring
  data, new sources or significant changes to existing sources within the
  Council area and surrounding authorities. This assessment considered each
  of these matters on a pollutant-by-pollutant basis and a report was submitted
  to the Department of the Environment for consideration.

  This Updating and Screening report did not identify any likely exceedences
  and indicated that the relevant air quality objectives would still be met by the
  due dates. A further Updating and Screening assessment is currently being
  undertaken.

4. Planning

  The District Council is a Statutory Consultee under Planning legislation and
  consequently the Planning Service forwards copies of planning applications to
  the Environmental Health Department for assessment of any likely
  environmental impact and for comments and professional opinions.
